'ADJOURNED REGULAR MEETING
OF THE'CITY COUNCIL
CITY.OF COSTA MESA
June 4, 1981
The City Council of.the City of Costa Mesa, California,
met in adjourned regular-session,on June 4, 1981, at
6:30 p:m., in the:Council.Chambers of City Hall, 77 Fair
Drive, Costa Mesa; said meeting having been duly and
r.egularly.ordered adjourned from the regular meeting of
June 1, 1981, and a copy of.the Notice of Adjournment
having'been posted as required by law. The meeting was
called to -order by the:Mayor; followed by the Pledge of
Allegiance -to the Flag.

Public Hearings
The Mayor announced the public.hearing to consider the
final Environmental: Impact Report (EIR) for the General
Final EIR for
Plan of the City of Costa Mesa. The Affidavit of Publi-
General Plan
cat ion concerning the final EIR, the Local Coastal
Program,:and proposed -General Plan, are on file in the
Clerk's office. Mayor Sdhafer reported that the Newport
Harbor -Costa Mesa Board of Realtors, 401 North Newport
Boulevard, Newport Beach; submitted their critique of
policies to be includedin the proposed General Plan.
There being no speakers, the.Mayor closed the public
hearing. -On motion by.Vice Mayor Hall, seconded by
Councilman Johnson, and carried, the Environmental
Impact Report was accepted as accurate and adequate.
Goals, Policies,
The Development Services Director reported that the
and Objectives
Council -is considering goals, policies, and objectives
in relation to the City's proposed General Plan. The
decisions to be made are to select policies which the
Council wishes to,,attai.n,.and selection of priorities
and an.implementati'on plan. Cost is not a factor to
be considered at this time.
Goal I
The Mayor.announced the public hearing for Goal I,
Environmental
Environmental Quality and Resource Conservation. The

tions - Costa Mesa General Plan". Clarence Donovan,
1864 Samar Drive, Costa Mesa; asked for information
relative to Objective I-A,.Section 1A, concerning
density, and the Mayor responded that this would be
addressed when that.item was introduced. Carl Spitzer,
582 Knowell Place;,.Costa Mesa, member of the Newport
Harbor -Costa Mesa Board of Realtors, stated that a
pleasant environment, simplicity, and local control was
the desire of the Board of Realtors. Douglas Toohey,
1149 E1 Camino Drive, Costa Mesa, voiced his objections
to any goal which would not do away with deteriorating
environment, and also objected to high density policies.
Mr.' Toohey submitted a letter from his wife, Barbara
Toohey,'opposing development of the Santa Ana River
mouth as a marina. There being no other speakers, the
Mayor closed the public hearing.- On motion by Council-
man McFarland, seconded by Vice Mayor Hall, and carried,

Objective I -A The Mayor opened the public hearing for Objective I -A,
which, -is: Preserve the City's open space lands to
provide adequate recreational -.opportunities and relief
from the,pressures'of urban development. There being
no speakers, the Mayor closed the public hearing. On
motion by Vice Mayor Hall, seconded by Councilman
.McFarland, and 'carried, Objective I -A was adopted.
Objective I -A The.Mayor announced the public hearing for Policies
Policies IN through -12, for.Objective I -A', Goal I. The Planning
Commission--recommended,adoption of Policies IA, 2B, 3,
4, 5; 6---7,-9-, 10; and"11B. The Housing and Community
Development Committee (HCDC) recommended the following:
Policies 1B; IC'with modifications, 4, 5, and 8. HCDC
took no,pos:ition on,Policy`3,.and opposed the remaining
policies. In'response to.inquiries from Clarence Dono-
van, the Development:Services Director explained the
difference between Policies IN and 1B. Mr. Donovan
stated that-he'supported Policy 1A. Sam Berry, -666
-Darrell -=Street; --Costa Mesa, President of the Mesa West
Homeowners Association,'spoke in opposition to Policy
1A. Elizabeth -Powell, 1943 Republic Avenue, Costa
Mesa; spoke.irr.support of Policy 2A. There being no
other :speakers,.the Mayor.closed.the public hearing.
A motion was made, -by Vice.Mayor Hall, to adopt Policies
1A, 1B, 1C:with modifications, and combining the three
policies— The motion was seconded by Councilman McFar-
land; -however; further -discussion ensued regarding
the•inc.lusion-of 1B. Vice:Mayor,.Hall then amended his
motion;to.delete'Policy•1B;-,adopt Policy lA modified to
read: Provide a minimum of 4:O acres of public perma-
nent open space (2.5 acres in neighborhood and community
parks and 1:5 acres -in school yards) for every -1;000i
residents. -His motion also included adoption'of Policy
1C modified to read: -Encourage,through development
rights transfers,7or'other-incentives, the development
of-private;permanent:space,,and.recreational facilities
to meet the -needs of the City's residents. The amended
motion -was seconded,by Councilman McFarland, and car-
ried:, A motion was made''by;Vice,Mayor Hall, seconded
by Councilman -Johnson'; to'adopt Policies 3, 4, 5, 7,
8 --and 9.-. After further discussion, Vice Mayor Hall
amended..his-motion;-seconded:by Councilman Johnson, and
carried, to include adoption:of-Policies 2B, 6, and 10,
with the latter• modified•:to read: Encourage other
local,-r.egional;:state, or:federal agencies to maintain
an adequate inventory of:open space lands within Costa
Mesa.
Objective I -B The:.Mayor:announced the -public hearing for Objective
I -B of -Goal I;'which.is:, Preserve the City's existing
biotic'resourcesin as -ecologically viable and natural
a condition as possible and;:where feasible, restore
and -integrate these resources into the urban environ-
ment.:: -Conrad Nord0i'st;�974:Modjeska Circle, Costa
Mesa ,`stated-that:human-life was more important than
biotic life: Karla'.-Kramer,1943 Republic Avenue, Costa
Mesa, and Clarence Donovan spoke. -in support of Objective
I=B.Nancy Spitzer,'582`Knowell,Place, Costa Mesa,
stated that the subject Objective applied to only a
small portion of the City:- Mark Robinson, 317 Nassau
Road, Costa -Mesa, spoke in support of Citywide improve-
ments. There being no other speakers, the Mayor closed
the:publ'ic hearing:;' A,motion was made by Vice Mayor
Hall;seconded_,by Councilwoman Hertzog, and carried,
to adopt,Objective I -B modified to delete the word
"Preserve";:and .in:its place add the words "Evaluate
the preservation of
Policies for The.Mayor-opened the public hearing to consider Policies
Objective I -B 13A through 17'of Objective�I-B: Goal I. The Planning

Commission recommended adoption of Policies 13B, 13C,
14B, 16, and 17 amended as;shown in the document.
Clarence:Donovan spoke in opposition to Policy 14C.
Karla Kramer stated:her preference for Policies 13A and
13C. Elizabeth Powell -.stated that consideration should
be given to the comments of the California Department of
Fish,and Game;as detailed under_�Policy 13A. There being
no other speakers, the Mayor closed the public hearing.
Vice. -Mayor Hall made.a-motion, seconded by Councilman
Johnson, to adopt Policy 13B modified by adding the
following phrase: however, these measures shall not be
at the expense of economic; environmental, recreational,
living, or employment standards for the residents of the,
City;:and to adopt Policy -14B.- After discussion, Vice
Mayor Hall amended-h.is-moti.on, seconded by Councilman
Johnson, and carried,.to..include adoption of Policy 17
amended -as recommended,by-the._Planning Commission.
Objective I -C
The Mayor announced the public hearing for Objective
I -C of,.Goal I, -,which reads as follows: Ensure that the
City's natural and man-made historic resources are pre-
served and protected.. Elizabeth Powell supported the
adoption of subjectObjective as written. There being
no other speakers, the Mayor -closed the public hearing.
A motion was made by Councilman McFarland, seconded by
Councilwoman Hertzog, to.adopt.Objective I -C. Further
discussion ensued, and thereafter Councilman McFarland
amended his motion by deleting the word "Ensure", and
replacing it with the.word "Encourage". The amended
motion was seconded by Councilwoman Hertzog, and
carried.
Policies for
The Mayor opened the public hearing to consider Policies
Objective I -C
18 through 27;for Objective I=C; Goal I. The Planning
Commission recommended adoption of the following
Policies: 18; a combination:of 19B and 19C and reworded
as shown in the�General Plan document; 20B; 21 amended
as stated in subject document; 22; 23C; 24B; 25; and 27.
Elizabeth Powell recommended adoption of Policy 20A
rather than 20B— There being no other speakers, the
Mayor closed the public hearing. A motion was made by
Vice Mayor Hall,•seconded.'by Councilman McFarland, and
carried', adopting -Policies 18; 19B and 19C as combined
and reworded by -the Planning Commission; 20B amended to
read: Require developments on land containing known
archaeological resources to. -use reasonable care to
locate structures;,paving, landscaping, and fill dirt
in such a way as to preserve these resources undamaged
for future generations when it is the recommendation of
a qualified archaeologist that said resources be pre-
served in situ..°The motion also included adoption of
the following Policies: 21as amended by the Planning
Commission; 22; 23C; 25 amended to delete the words
"or with the.potential.of-having"; and 27 amended to
read:. Review the feasibility, on an individual basis,
of providing assistance to those owners desirous of
restoration of historic sites, -.buildings, and struc-
tures in return -for -agreements -or deed restrictions
prohibiting their destruction or regulating their use.
Recess
The Mayor declared a recess at.8:25 p.m., and the meet-
ing reconvened at.;8:35.p.m.
Objective I -D
The Mayor announced the public hearing for Objective
I=D of.Goal I. which is: Protect and conserve the
City's existing and future water resources. Elizabeth
Powell _spoke in .support"of the :subject Objective. There
being no other -speakers, the.Mayor closed the public
hearing. A motion was made by Vice Mayor Hall to adopt
Objective'I-D but amended to read as follows:-:-- Work
towards the protection and -conservation of the City's

existing and future water resources. The motion was
seconded by,Councilman Johnson; and carried.
Policies for
The'Mayor opened the public hearing to consider Policies
Objective I -D
28A -through 33 for:Objective,I=D; Goal I. The Planning
Commission -recommended adoption of the following:
Policies 28B amended,'29A; 29C, 3OB, 315, 32A, and 33.
Walter-Hart,.2202 Miner Street, -Costa Mesa, submitted
recommendations from the Mesa West Homeowners Associa-
tion, sipecifical:ly,:reading..that item pertaining to
dumpsites within the City.- It was determined that
this suggestion should be,inserted when Policy 51 is
discussed. Elizabeth Powell,.recommended adoption of
Policy 28Arathern•than,28B.She also submitted a com-
munication,relating to Policy 30 which recommends that
the-words::"native-Caaifornia•vegetation" be deleted and
replaced with "veget-ati'on_native•to coastal Southern
California,". The City`Manager-referred to Policy 32A
and recommended:.=that "City=owned" be deleted. There
being no -other speakers, the Mayor closed the public
hearing -,-A motion was,made:by Vice Mayor Hall, seconded
by -Councilman McFarl-and.;to-adopt the following: Policy
28B•as amend.ed,by.the Planning .Commission; Policy 29C;
Poli c - 30B-* amended'to `read-: -Encourage, through the
establishment:of.landscape design criteria/guidelines,
the,use,of,natjve:California vegetation, with evaluation
as:to:,their-drought'res-istance; in all proposed develop-
ment projects; Policy 31;:Policy 32A amended by deleting
"City -owned'',; -and -.Policy 33:~:Further discussion ensued
and thereafter: V_ice•Mayor:Hall.amended his motion by
changing Policy -29C: to read.: -Cooperate with the pur-
veyor of local, -.water -supplies for the encouragement of,
through publicity/public relations programs, the inclu-
.sion.of water conservation devices in all proposed
development projects. The amended motion was seconded
by Councilman McFarl-and,- and carried.
Objective I -E
The -.Mayor -,announced the!public.h-earing for Objective
I-E:of:Goal I, which is: -Conserve energy and resources
in:the development„and,operation of public and private
buildings; facil!Ities; and activities. Elizabeth
Powelll-:stated .that conservation was very important.

seconded by:Councilwoman Hertzog, and carried, Objective

Policies for
The-Mayor:opened the,public:hearing to consider Policies
Objective I -E
34A.through 5.1 for:Objective I -E; Goal I. The Planning
Comm.i:ss: on. recommended ad:opti.on; of the following:
Policy; 34B; 35A,, 36- mod-i.fi ed .as :shown in the General
P1 a.n. document, : 37B,- 38 as- amended in subject document,
39B amended; 40B, 41; 42B;.4.4: amended, 45 as modified,
46,,47A -,,,4-,7B, 48A;:49 as modified, 50, and 51 amended.
,Walter -Hart read.a r.ecommendati.on from the Mesa West
Homeowners Association- which i.s :- Prohibit the use of
land..within' the ,City. ;for di-sposal dump sites; discourage
the'County or other neighb:oringicities from selecting
new sites adjacent to•Costa:Mesa�where the runoff of
rainfal-1 could.seep into -underground streams and possi-
bly contaminate the --water in wells serving Costa Mesa.
Elizabeth: Powell; suggested,adoption of Policy 39A rather
than -3.96. -There being no other speakers, the Mayor
cl:osed�the.publ-ic hearing. A.motion was made by Vice
Mayor.,Hall, seconded.,by Cdu.ncilwoman Hertzog, to adopt
the followingPolicies:: 3469 35A9 36 as amended, 37B,
38'as amended, 3.9B -as amended, 40A, 41, 44 as modified,
45 as- mo'di f i ed.,` 46, 47A-.9; 48A, x.49 as amended, 50 modi f i ed
to, read:: • . Institute a, program within City Hall to separ-
'at'el,waste ,paper- for: recycling;- when feasible; and 51, as
amended, and adding the following sentence, "Prohibit
the use of land -for disposal dump sites in Costa Mesa,
and work towards the prohibition of contiguous areas for
dump sites". After further discussion, Vice Mayor Hall
amended his motion in relation to the sentence which was
added under, Policy 51. The modified motion, which was
seconded by Councilwoman Hertzog, and carried, adds the
following phrase!to.the subject sentence, "where there
is possible groundwater contamination".
Objective I -F The -Mayor, --announced the -public hearing for Objective
Including the I -F of,,Goal I which is the Local Coastal Program Land
Coastal Program Use Plan_.and'Development Policies. Objective I -F reads
as follows: Ensure the orderly, balanced utilization
and conservation,of .the City's coastal resources. The
Planning Commission recommended that the following be
added -to subject Objective; "taking into account the
social•and.economic needs of -.the community". The Senior
Planner referred to his memorandum dated June 1, 1981,
Which recommends that the•subject Objective, and Alter-
native'Pol.icies:52 through,62 become the foundation of
the Land Use Plan and Development Policies component
of the City's Local Coastal Program to be forwarded to
the Coastal Commission for certification. In response
to an inquiry from Elizabeth Powell, the Senior Planner
stated that the'General Plan is a long-range plan for
present and.f.uture, and that the Coastal Act provides
for period:ic,revisions.' Barbara Toohey, 1149 El Camino
Drive;' Costa Mesa, and Mark. Robinson, Costa Mesa, spoke
in Iopposition to a proposed marina. There being no
other speakers,•the Mayor~closed the public hearing.
A motion was made by -Vice Mayor Hall, seconded by Coun-
cilman McFarland, and carried; to adopt Objective I -F as
modified, and d'eleti'ng the word -"Ensure", and replacing
it with -the words "Work towards"..
Policies for The'Mayor opened'the public hearing to consider Policies
Objective I -F 52 through 62 of Objective I -F, Goal I. The Planning
Commission recommended adoption of the following:
Policies 5-2, 53A,as._amended in the document, 54A, 54B,
55,'56, 57, 58,'59, 60, 6lA,'and-62 as amended. Costa
Mesa residents'Sam-Berry,. Karla Kramer, and Elizabeth
Powell spoke-i.n•opposition`to the proposed marina. Ms.
Kramer and Ms.' Powell al•so-spoke concerning Policy 55,
restoration of Canyon -Park ais a,natural environment,
stating that•the subject park is being used as a dump
site. Communications -.were submitted by Karla Kramer
and Elizabeth Powell opposing Policy 53A, pursuit and
support of a marina adjacent to the east levee of the
Santa Ana River. Ms. Kramer and Ms. Powell also sub-
mitted communications relating to their aforementioned
statements concerning :Policy 55, concerning Canyon Park.
There being no other speakers, -the Mayor closed the
public hearing. ; After brief discussion, a motion was
made'by Vice Mayor Hall,.seconded by Councilman Johnson,
to adopt Policies 52; 53A excluding the modification
recommended by the Planning Commission; 54A; 55 modi-
fied to read: Develop the. Canyon Park site as a low
intensity, wilderness area combining hiking, picnicking,
and educational uses -in a restored natural environment,
as funds are available. The motion also included adop-
tion of Policies'57', 58, 61A; and 62 excluding the
Planning Commission.'s recommended modification. After
further discussion, Vice.Mayor Hall amended his motion,
which was seconded'by Councilman Johnson, and carried,
to include adoption of Policy 60. The Development
Services Director -stated that the proposed resolution
submitted by staff with the aforementioned memorandum
dated June 1, 1981., re'l ati ng to -the City's Coastal
Program, -should now be considered for adoption. The
Sen.ior:Planner suggested a modification of the draft
resolution by adding the following as the fifth

paragraph: WHEREAS, the Coastal Resources subelement
of the Community Development/Management Element of the
Costa Mesa'General Plan contains materials and data
sufficient for a thorough and complete review of the
document as the Land Use Plan component of the City's
Local Coastal Program. On motion by Councilman McFar-
Resolution 81-48 land, seconded by Vice Mayor Hall, Resolution 81-48,
Coastal Program being A.RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ADOPTING THE COASTAL RESOURCES
SUBELEMENT-OF THE COMMUNITY.DEVELOPMENT/MANAGEMENT
ELEMENT OF THE COSTA MESA'GENERAL PLAN AS THE CITY OF
COSTA MESA LOCAL COASTAL.PROGRAM LAND USE PLAN AND
DEVELOPMENT POLICIES AND TRANSMITTING SAME TO THE
CALIFORNIA COASTAL COMMISSION;.SOUTH COAST REGIONAL
COMMISSION FOR REVIEW AND CERTIFICATION, including the
additional:,paragraph stated above, was adopted by the
following roll call vote:

Goal II Due to the late hour, the'Council' agreed to conclude
Held Over; the meeting, and discussion of Goal II was continued
to the meeting of June 10, 1981.
Adjournment At 10:20 p.m., the Mayor adjourned the meeting to June
10,'1981, at 6:30 p.m., in the.Council Chambers of City
