HomeMy WebLinkAbout06/18/1981 - Adjourned City Council Meetingtai ADJOURNED REGULAR MEETING OF THE CITY COUNCIL CITY OF COSTA MESA June 18, 1981 The City Council of the City of Costa Mesa, California, met in adjourned regular session on June 18, 1981, at 6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, said meeting having been duly and regularly ordered adjourned from the regular meeting of June 15, 1981, and a copy of the Notice of Adjournment having been posted as required by law. The meeting was called to order by the Mayor, followed by the Pledge of Allegiance to the Flag. Roll Call Council Members Present: Schafer, Hall, McFarland, Johnson Council Members Absent: Hertzog Officials Present: City Manager, City Attorney, Development Services Director, City Clerk, Senior Planners Public Hearings The Mayor announced the public hearing for Goal IV, Costa Mesa Socio -Economic Considerations, Costa Mesa General Plan. General Plan The Development Services Director read the contents of Goal IV from the document entitled, "Final EIR and Rec- Goal IV ommendations - Costa Mesa General Plan". Carl Spitzer, 582 Knowell Place, Costa Mesa, expressed his opinion that housing is not something provided by government but by the citizens through taxes, and government can best serve housing problems by not interfering. Mayor Schafer stated that the Newport Harbor -Costa Mesa Board of Realtors, 401 North Newport Boulevard, Newport Beach, submitted their recommendations pertaining to Goal IV, which will be entered into the record, but that because the recommendations were not received until a few hours before the meeting, it was difficult for the Council to review, and that any pertinent comments the realtors wished to make should be presented under the appropriate policies. Joan Margol, Chairman of the Housing and Com- munity Development Committee, 1796 Kinglet Court, Costa Mesa, spoke in support of Goal IV, and emphasized the importance of providing the opportunity for housing to those in need. There being no other speakers, the Mayor closed the public hearing. On motion by Councilman McFarland, seconded by Vice Mayor Hall, and carried, Goal IV was adopted as written. Objective IV -A The Mayor opened the public hearing for Objective IV -A of Goal IV which is: Provide for the housing needs of all social and economic segments of the community. The Planning Commission recommended adoption. Jean Forbath, 2880 Clubhouse Road, Costa Mesa, stated that housing should be provided as a service to the community, and urged the Council to adopt the subject objective. Nancy Spitzer, 582 Knowell Place, Costa Mesa, suggested that the City provide a climate where housing can be de- veloped effectively and efficiently so that housing might be obtained by all socio-economic segments. A motion was made by Vice Mayor Hall,` seconded by Council- man McFarland, and carried, to adopt Objective IV -A, modified as follows: Investigate methods and policies to make provisions for all social and economic segments of the community in meeting their housing needs. Policies for Mayor Schafer announced the public hearing to -consider Objective IV -A Policies 147 through 178C, Goal IV. The Planning fel Commission recommended adoption of the following poli- cies: 147, 148, 150, 151, 152, 153, 154, 155, 156, 157, 158, 159, 162, 163 amended, 164, 165, 166, 168B, 170, 171, 172, 173B, with the addition of 173C if practical, 174, 175, 176, 177, 1788, and 178C. The Housing and Community Development Committee supported the following policies: 147, 148, 149B amended, 150, 151, 152, 153, 154, 155, 156, 157, 158, 159,.160 amended, 162, 163, 164, 165, 166, 168A, amended, 168B amended, 169, 170, 171, 172, 173A, 174, 175, 176, 177, and 178A. The HCD Committee took no position on Policy 167, and opposed the remaining policies. The Senior Planner reported that at the request of the Council, the Chamber of Com- merce established a Housing Task Force to review the policies of the General Plan and those comments were presented by the Chamber at a Study Session held some months ago. Loren Baumgardner, 1670 Santa Ana Avenue, Suite G, Costa Mesa, spoke in support of policy 1.53, in connection with regulations, costs, and restrictions he encountered in the building of his development, and spoke against the proposed requirement of installing smoke detectors in residential units. Paul Franklin, President of the Newport Harbor -Costa Mesa Board of Realtors, spoke against the restricting and limiting of condominium conversions with regard to policies 150 and 151. Diane Patterson, Director of Governmental Rela- tions for the Board of Realtors, spoke in opposition to policies 168A and 168B. Carl Spitzer related that costs imposed on builders, laborers, and other development - related businesses are passed on to the consumers in rent costs. Jean Forbath expressed her ideas on how to keep market rate unit costs steady while allowing affordable units in connection with the Inclusionary Program. There being no other speakers, the Mayor closed the public hearing. On motion by Vice Mayor Hall, seconded by Councilman Johnson, and carried, Policies 150 and 151 were adopted with the deletion of the words "and maintain". A motion was made by Council- man McFarland, seconded by Vice Mayor Hall, to adopt Policy 147 with the deletion of the following phrase: with an emphasis on low- and moderate -income, minority, elderly, handicapped, female -headed, and large -family households. Following discussion the motion failed to carry, Mayor Schafer and -Vice Mayor Hall voting no. On motion by Councilman McFarland, seconded by Vice Mayor Hall, the above motion was again stated but amended by substituting the word "implement" with "investigate". The motion carried unanimously. A motion was made by Vice Mayor Hall, seconded by Councilman Johnson, to adopt the following Policies: 153, 154, 155, 156, 157, 1589 159, and 162. Following discussion, Vice Mayor Hall amended his motion, seconded by Councilman Johnson, and carried, to delete the last sentence of Policy 154. A motion was made by Vice Mayor Hall, seconded by Councilman Johnson, to adopt the following Policies: 164, 165, 168B, 172, 173B and 173C combined, with 173C modified to substitute the word "adjacent" with "sur- rounding". Following discussion, the motion carried unanimously. On motion by Vice Mayor Hall, seconded by Councilman Johnson, and carried, Policies 175 and 177 were adopted. On motion by Councilman McFarland, sec- onded by Vice Mayor Hall, and carried, Policies 178B and 178C were adopted. Objective IV -B The Mayor announced the public hearing for Objective IV -B, which is: Insure availability of adequate com- munity facilities and provision of the highest level of public services possible within budgetary con- straints. The Planning Commission recommended adoption. There being no speakers, the Mayor closed the public hearing. On motion by Vice Mayor Hall, seconded by Councilman Johnson, and carried, Objective IV -B was LJ adopted as written. Policies for The Mayor opened the public hearing to consider Policies Objective IV -B 179 through 200 of Objective IV -B, Goal IV. The Plan- ning Commission recommended adoption of the following policies: 179, 180, 181B, 182A, 183A, 183C modified, 1848, 185, 186, 187, 188, 189, 190, 191, 192, 193, 194, 195, 197, 198, and 200. ,The Housing and Community Development Committee supported the following policies: 181A, 1826, 186, 192, 193, 194, 196, 197 modified, 199 r modified, -and 200. The HCD Committee took no position on -policies 179; 180, 183A, 184, 185, 187, 188, 189, 190, 191, and opposed the remaining policies. Tom Arnold, 278 Rochester Street, Costa Mesa, referring to Policy 186, commented -on the need for cooperation between Costa Mesa and Newport Beach, particularly pertaining to fire protection. In reference to Policy 199, Diane Patterson suggested if it is felt a Social Impact Analysis is needed in conjunction with Environmental Impact Reports, there also should be a Fiscal Impact Analysis, and urged the adoption of Policy 187. Nancy Spitzer spoke in favor of the following policies: 181B, 184B with the deletion of the .phrase "and raise service levels", 186 with the deletion of the phrase "and maintain or in- crease the level of service provided to the public", 188, 190, and 191. She expressed concern with Policy 197 and stated that preparation of a social services directory should be provided by private enterprise. There being no other speakers, the Mayor closed the public hearing. A motion was made by Vice Mayor Hall, seconded by Councilman McFarland, to adopt Policies. 179, 180, 1818, 182A, 182B reworded to read: Continue to explore alternatives for financing the construction - of a new building to house.the Center Street Library, 183C amended,. 1848, 185, 186, 187, 188, 189, 190 with Planning-Commission"s notation, 191, 192, 193, 194, 195, 196, 197, and 200. At the recommendation of the City Manager, Vice Mayor Hall amended his motion, seconded by Councilman McFarland, to modify Policy 184B to read: Conduct productivity studies to increase the efficiency and effectiveness of the various City departments. The Development Services Director explained that Policies 195 and 196 would have been more appropriately numbered as 195A and 1956 as they are two different approaches dealing with the same subject. Vice Mayor Hall amended his motion, seconded by Councilman McFarland, to delete Policy 196. Mayor Schafer suggested the rewording of Policy 182B to read: Explore the financing for con- struction of a new building to house the Center Street Library. Vice Mayor Hall amended his motion, seconded by Councilman McFarland, and carried, to remove Policies 182A and 182B for further discussion. A motion was made by Vice Mayor Hall, seconded by Councilman Johnson, to adopt Policy 182A, and 182B, modified as follows: Continue to explore alternatives for financing the con- struction of a new building to house the Center Street Library. The motion carried unanimously. Objective IV -C The Mayor opened the public hearing for Objective IV -C of Goal IV which is: Minimize the negative impacts of certain problematic uses and distinguish those which are of land use concern and those which are more appropriately considered through vehicles other than the City's General Plan and zoning procedures. The Planning Commission recommended adoption. In response to Carl Spitzer's inquiry, the Development Services Director clarified the meaning of the phrase, "negative impact of certain problematic uses". There being no other speakers, the Mayor closed the public hearing. On motion by Vice Mayor Hall, seconded by Councilman Johnson, and carried, Objective IV -C was adopted as written. 279 Policies for The Mayor opened the public hearing to consider Policies Objective IV -C 201A through 204 for Objective IV -C, Goal IV. The Plan- ning Commission recommended adoption of the following policies: 201B, 202C, 203C, and 204. The Development Services Director commented that 201A, which is stated as reflecting current policy of requiring Conditional Use Permits, is probably incorrect. There being no speakers, the Mayor closed the public hearing. On motion by Vice Mayor Hall,.seconded by Councilman McFarland, and carried, Policies -201B, 202C, 203B, and 204 were adopted. A motion Iwas made by Vice Mayor Hall' to amend previously adopted Policies 150 and 151 to include that during analysis by staff of these policies .a review of the ordinance as to its compatibilty with todays standards will also be given, however, the motion died for lack of second. General Plan Hearing Announced Mayor Schafer announced that the next General Plan Hear- ing is scheduled for June 25, 1981, at 6:30 p.m., and will be concerning Goal V, Transportation.
