HomeMy WebLinkAbout06/29/1981 - Adjourned City Council MeetingRoll Call Public Hearing Costa Mesa General Plan Goal VI - Land Use ADJOURNED REGULAR MEETING OF THE CITY COUNCIL CITY OF COSTA MESA June 29, 1981 The'City Council of the City of Costa Mesa, California, met in adjourned regular session on June 29, 1981, at 6:40 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, said meeting having been duly and regularly ordered adjourned from the adjourned regular meeting of June -25, 1981, and a copy of the Notice of Adjournment having been posted as required by law. The meeting was called to order by the Mayor, followed by the Pledge of Allegiance to the Flag. Council Members Present: Council Members Absent: Officials Present: Schafer, Hall, Hertzog, McFarland, Johnson None Assistant City Manager, City Attorney, Development Services Director, Senior Planners, and Deputy City Clerk The Mayor announced the public hearing for Goal VI, Land Use, Costa Mesa General Plan. The Development Services Director read the contents of Goal VI from the document entitled, "Final EIR and Recommendations - Costa Mesa General Plan". The Planning Commission recommended adoption. Jack Polans, 2864 Royal Palm Drive, Costa Mesa, requested to speak on Policies 241B, 241C, 242, 243B, and 246 for Objective VI -A, and the Mayor asked that he address these items when the public discussion is announced for same. There being no other speakers, the Mayor closed the public hearing. On motion by Councilman McFarland, seconded by Mayor Schafer, and carried, Goal VI was adopted as written. Objective VI -A The Mayor opened the public -hearing for Objective VI -A of Goal VI, which is: To establish and maintain a balance of land uses throughout the community. The Planning Commission recommended adoption. There being no speakers, the Mayor closed the public hearing. On motion by'Vice Mayor Hall, seconded by Councilman John- son, and carried; Objective VI -A was adopted as written. Policies for The Mayor announced the public hearing for Policies 240 Objective VI -A through 243B of Objective VI -A. The Planning Commission recommended adoption of Policies 240, 241A, 242, and 243C. The Housing and Community Development (HCD) Com- mittee supported Policies 240, 2418, and 242. Jack Polans referred to a letter submitted by C. J. Seger- strom and Sons, Costa Mesa, dated November 14, 1980, and spoke in opposition to high density residential and the Urban Center Residential designation. Diane Patter- son,'Director of Governmental Relations for the Newport Harbor -Costa Mesa Board of Realtors, supported Policies 240, 241A; 241B; and 242 amended by deleting the phrase, "affordable to the incomes of the newly -created job opportunities". Ms. Patterson opposed Policy 241C. Malcolm Ross, C. J. Segerstrom and Sons, 3315 Fairview Road, Costa Mesa, spoke in support of Policies 241A, 242, and 243C. He opposed Policies 243A and 2438. There being no other speakers, the Mayor closed the public hearing. A motion was made by Vice Mayor Hall, seconded by Mayor Schafer, and carried, to adopt Poli- cies 240; 241A modified by deleting "and encourage" and substituting "for" in the first line, and in the last line, adding "building," between the words "single" and "project"; 242; and 243C. On motion by Vice Mayor Hall, seconded by Councilman McFarland, and carried, Policy 243D was adopted. General Plan The Development Services Director reported that the Public Hearing public hearing for the General Plan would be continued to be Held Over to the regular Council meeting of July 20, 1981, at which time a detailed report -would be available on the adopted goals, objectives, and policies. He stated that after public and Council discussion, a resolution will be adopted. The Development Services Director also announced that hearings will be held later in the year for Council to select General Plan priorities. Board of Realtors Mayor Schafer reported that the Newport Harbor -Costa Submittals Mesa Board of Realtors had submitted their recommenda- tions for those items being considered this evening, and that their comments would be entered into the record. Objective VI -B The Mayor opened the public hearing to consider Objective VI -B of Goal VI, which is: Provide adequate, suitable sites for residential use and development and offer sufficient regulatory discretion to meet the housing needs of the community's existing and future population. The Planning Commission recommended adop- tion. Carl Spitzer, 582 Knowell Place, Costa Mesa, suggested deleting the word "Provide" and substituting the phrase "Encourage the use of". There being no other speakers, the Mayor closed the public hearing. A motion was made by Councilman McFarland, seconded by Councilman Johnson, to adopt Objective VI -B as written. Vice Mayor Hall made a substitute motion to adopt Objective VI -B modified by deleting the word "Provide" and substituting the phrase "Investigate methods to ensure"; however, the substitute motion died for lack of a second. Thereafter, the motion to adopt Objective VI -B as written carried, Council Members Schafer and Hall voting no. Policies 244 Mayor Schafer announced the public hearing for Policies through 253D of 244 through 253D of Objective VI -B. The Planning Com - Objective VI -B mission recommended adoption of the following Policies: 244, 245, 246, 247, 248, 249, 250, 251C, 252B, and 253C. The HCD Committee recommended that Policy 244 be amended to read Establish no regulatory policies and controls which compromise the affordability of newly - constructed residential units. The HCD Committee supported Policies 246, 250, 251C, 252A, and 253D. Carl Spitzer spoke in support of the following: Policy 244 amended by deleting the phrase "without compromising the affordability of newly -constructed residential units" and substituting "without increasing costs"; Policy 246 amended by deleting the first word "Develop" and substituting "Permit"; Policy 247 amended to read: Maximize the supply of residential land by encouraging the conversion of existing marginal commercial and/or industrial land to medium- or high-density residential units or mixed uses, where feasible and consistent with environmental conditions suitable for new residen- tial development. Mr. Spitzer also supported Policies 249, 250, 251C, and 253. Jack Polans supported Policy 246 amended by deleting the phrase "Develop higher density residential areas in close proximity to commun- ity facilities" and substituting "Develop specific number of residences per acre and state distance to community facilities". Referencing Policy 252B, Diane Patterson stated that excessive cost of housing is a problem for all buyers, not just those with special needs, and if the City can reduce the fees for one group, they should be reduced for all, rather than subsidize fees for sum and increase fees for others. Malcolm Ross of C. J. Segerstrom and Sons, spoke in support of the following: Policies 244; 246; 247; 249 modified by inserting "quality" between the words "density" and "residential" in the third line; 251C modified by adding the phrase "such as the land intensity use system" at the end of the policy; 252B; and 253A. There being no other speakers, the Mayor closed the public hearing. On motion by Vice Mayor Hall, seconded by Councilman McFarland, the following ' Policies were adopted: 244; 245, 246 modified by delet- ing "Develop" and substituting "Permit"; 250; 251C; and 253C. Referencing Policy 246, Mayor Schafer suggested that the word "in" be inserted in the first line between "density" and "residential". Vice Mayor Hall amended his motion to include the Mayor's recommendation. The amended motion was seconded by Councilman McFarland, and carried. A motion was made by Councilman McFarland, seconded by Councilwoman Hertzog, to adopt Policy 247 as written. Considerable discussion followed and the motion failed to carry, Council Members Schafer, Hall, and Johnson voting no. A motion was made by Vice Mayor Hall, seconded by Councilman Johnson, and carried, to adopt Policy 247 modified by deleting "through" in the first line and substituting "by permitting". A motion was made by Councilman McFarland, seconded by Council- woman, and carried, to adopt Policy 248. On motion by Councilman McFarland, seconded by Vice Mayor Hall, and carried, Policy 249 was adopted. After discussion relating to Policy 252B, a motion was made by Vice Mayor Hall, seconded by Councilman McFarland, and carried, directing staff to prepare a report on implementation of Assembly Bill 1151. Objective VI -C The Mayor announced the public hearing for Objective VI -C, Goal VI, which is: Ensure the long term produc- tivity and viability of the community's economic base. The Planning Commission recommended adoption. Jack Polans read excerpts from a communication from the State of California Department of Housing and Community Devel- opment dated May 21, 1980, and asked if the City intends to subsidize housing for people working within the City. Mayor Schafer responded in the negative. Diane Patter- son suggested rewording Objective VI -C as follows: Provide a legislative inaugurational environment to encourage the long term productivity and the maintenance of the community's economic base. There being no other speakers, the Mayor closed the public hearing. A motion was made by Councilman McFarland, seconded by Mayor Schafer, to adopt Objective VI -C as written. The motion carried, Council Members Schafer and Hall voting no. Policies for Mayor Schafer opened the public hearing for Policies Objective VI -C 254 through 262 of Objective VI -C. The Planning Commis- sion recommended adoption,of Policies 254, 255, 256B, 257A, 258, 260,'261, and 262. The HCD Committee had no recommendations. Carl Spitzer spoke in support of Poli- cies 254, 255, and 257A. There being no other speakers, the Mayor closed the public hearing. A motion was made by Vice Mayor Hall, seconded by Councilman Johnson, and carried, adopting Policies 254, 255, and 260 modified by. deleting the words "viable strip". On motion by Councilman McFarland, seconded by Vice Mayor Hall, and carried, Policy 256B was adopted with the modification to delete the first word "Supply" and substitute "Permit". A motion was made by Councilman McFarland, seconded by Councilwoman Hertzog, to adopt Policy 261 as written, however, the motion failed to carry, Council Members Schafer, Hall, Hertzog, and Johnson voting no. A motion was made by Councilman McFarland, seconded by Councilman Johnson, to adopt Policy 262 as written. The motion carried, Council Members Hall and Hertzog voting no. Recess The Mayor declared a recess at 8:35 p.m., and the meeting reconvened at 8:50 p.m. Objective VI -D The Mayor announced the public hearing for Objective VI -D, Goal VI, which is: Promote land use patterns and development which contribute to community and neighbor- hood identity. The Planning Commission recommended adoption. There being no speakers, the Mayor closed the public hearing. On motion by Vice Mayor Hall, seconded by Councilwoman Hertzog, and carried, Objective VI -D was adopted as written. Policies 263A The -Mayor opened the public hearing to consider Policies through 273 of 263A through 273 of Objective VI -D. The Planning Com - Objective VI -D mission recommended adoption of the following Policies: 263B, 264B, 2658, 266A, 267A, 268A, 270 amended, 271 amended, 272, and 273. The HCD Committee supported Policy 272 and took no position on the others. David Dmohowski of the Irvine Company, 550 Newport Center Drive, Newport Beach, spoke in support of Policy 263B and in opposition to Policy 263A. Diane Patterson opposed Policies 264A and 265A. She supported Policies 264B, 265B, and 268B. There being no other speakers, the Mayor closed the public hearing. A motion was made by Vice Mayor Hall, seconded by Councilman McFarland, and carried, to adopt the following Policies: 266A modified by adding the phrase "when compatible with architectural design of structure" at the end of the policy; 267A; 268A modified by inserting "residential" in the second line between "adjacent" and "structures" and in the third line between "existing" and "struc- tures"; 270 and 271 as modified by the Planning Commis- sion; 272; and 273. A motion was made by Councilman McFarland, seconded by Mayor Schafer, to adopt Policy 263B as written. The motion carried, Council Members Schafer and Hall voting no. A motion was made by Councilman McFarland to adopt Policy 264B as written, however, the motion died for lack of a second. Policies 274 Mayor Schafer opened the public hearing for Policies 274 through 285C of through 285C of Objective VI -D. The Planning Commission Objective VI -D recommended adoption of the following Policies: 274, 275, 276, 277, 278, 279, 280, 281, 282, 283, 284C, and 285B. The HCD Committee supported Policy 284C and took no position on the others. Paul Franklin, Board of Realtors, supported Policies 284C and 285C; he opposed Policies 283, 284A, and 2848. Jack Polans opposed Poli- cies 283, 284B, 284C, 285B, and 285C. He supported Policy 284A amended to read, "Prohibit by legislation the construction of high-rise (over two stories or 30 feet) structures within the City proper and its outer limits". There being no other speakers, the Mayor closed the public hearing. On motion by Councilman McFarland, seconded by Councilwoman Hertzog, and car- ried, Policies 274, 275, 276, and 277 were adopted. A motion was made by Vice Mayor Hall to adopt Policy 278 amended by adding the following phrase at the end of the Policy, "with full consideration to the maintenance, water, and energy requirements". The motion was sec- onded by Councilman McFarland, and carried. A motion was made by Councilman McFarland to adopt Policy 280 amended by adding the following phrase at the end of the policy, "in new developments". The motion died for lack of a second. On motion by Vice Mayor Hall, seconded by Councilman McFarland, and carried, the following Poli- cies were adopted: 281 amended by deleting the phrase "or other design controls"; 282; and 284C. A motion 1 1 was made by Councilman McFarland, seconded by Council- woman Hertzog, to adopt Policy 283 as written. The motion failed to carry, Council Members Schafer, Hall, and Johnson voting no. On motion by Councilman McFar- land, seconded by Councilwoman Hertzog, and carried, Policy,285B was adopted as written. Objective VI -E The Mayor announced the public hearing for Objective VI -E, Goal VI, which is: Ensure integration of utility system considerations into land use planning and devel- opment processes. The Planning Commission recommended adoption. There being no speakers, the Mayor closed the public hearing., On motion by Councilman McFarland, seconded by Councilwoman Hertzog, and carried, Objective VI -E was adopted. Policies for Mayor Schafer opened the public hearing for Policies Objective VI -E 286 and 287 of Objective VI -E. The Planning Commission recommended adoption of both Policies, and the HCD Committee supported same. There being no speakers, the Mayor closed the public hearing. On motion by Council- woman Hertzog, seconded by Councilman Johnson, and carried, Policies 286 and 287 were adopted -as written. Policies for Mayor Schafer announced the public hearing for Policies Annexations 288A through 289C relating to General Plan alternatives regarding annexation of County islands and other unin- corporated areas within the City's sphere of influence. The Development Services Director read Policies 288A, 288B, and 288C concerning County island annexations, and Policies 289A, 2898, and 289C relating to annexation of unincorporated areas within the City's sphere of influ- ence. The above mentioned Policies are detailed in a memorandum dated June 26, 1981, from the Senior Planner. The Planning Commission recommended adoption of Policies 288B and 289B. 'Jack Polans spoke regarding expenditures by the City for services required in future annexation areas. Gerald Odegaard, 1632 Pegasus Street, Santa Ana Heights, asked if a decision tonight would have an effect on the Specific Plan for Santa Ana Heights which is being studied by the County of Orange. The Develop- ment Services Director responded that the study being done by the County does not include City property. There being no other speakers, the Mayor closed the public hearing. On motion by Councilman McFarland, seconded by Vice Mayor Hall, and carried, Policies 288C and 289C were adopted. Oil Extraction The Development Services Director referred to the Policy Options aforementioned memorandum dated June 26, 1981, which states that the draft General Plan does not include any Referred to policy options regarding the termination, continuation, Planning and/or expansion of oil extraction activities within the Commission City. The subject memorandum contains suggested Poli- cies 290A through 292 addressing this issue. Inasmuch as the Planning Commission has not had the opportunity to review the oil extraction policies, a motion was made by Vice Mayor Hall, seconded by Councilwoman Hertzog, and carried, referring this item to the Planning Commis- sion meeting of July 13, 1981, and to be brought back to the Council meeting of July 20, 1981, in conjunction with the final resolution adopting goals, objectives, and policies to be included in the final General Plan. General Plan Mayor Schafer again announced that the public hearing for the Costa Mesa General Plan is being continued to Held Over the regular Council meeting of July 20, 1981.
