REGULAR MEETING OF THE CITY COUNCIL AND SUCCESSOR AGENCY
TO THE REDEVELOPMENT AGENCY, AND HOUSING AUTHORITY
OCTOBER 3, 2023 - MINUTES
CALL TO ORDER —The Closed Session meeting was called to order by Mayor Stephens at
4:00 p.m.

Ms. Hall Barlow, City Attorney requested to add one additional closed session item be added
to the agenda, regarding litigation that was brought to the attention of the City after the agenda
had been posted and needed to be considered before the next regularly scheduled meeting.

CALL TO ORDER —The Regular City Council and Successor Agency to the Redevelopment
Agency, and Housing Authority meeting was called to order by Mayor Stephens at 6:00 p.m.

A video was played of the National Anthem and Mayor Stephens led the Pledge of Allegiance.

PUBLIC COMMENTS — MATTERS NOT LISTED ON THE AGENDA
Speaker, spoke on walkable Cities and accessibility for everyone and spoke in favor of
reduced road speeds.
Juana Trejo expressed support for policing efforts, spoke on problems with rental assistance,
and to monitor contracts.
Wendy Simoa spoke on noise problems at The 12 gym and the Conditional Use Permit.
Speaker, spoke on Senate Bill 567 being approved and housing rights being violated.

Jay Humphrey, Costa Mesa, spoke on attending the State meeting regarding the Fairview
Developmental Center and requested the City to encourage residents to make comments
during the EIR review period, and appreciates the Council reconsidering the cannabis
ordinance.
Speaker, spoke on being evicted due to the owner making renovations, the high expense to
move, and requested assistance.
Megan Wilson, Costa Mesa, spoke on the feral cats on West 20th Street, and requested the
City review the policies on animal hoarding.
Speaker, Costa Mesa, spoke on being evicted due to the owner making renovations, and
spoke on the barriers to qualify for services.
Speaker spoke on parking minimums.
Speaker, requested assistance as they have received an eviction notice.
Speaker, representing Resilience Orange County, spoke on the barriers to receiving housing
assistance and people being denied assistance.
Speaker, spoke on the proposed State Emergency Operations Center at the Fairview
Developmental Center and spoke on repairs at the dog park.
Speaker, thanked the Council for the street improvements on Placentia Ave., spoke on Strong
Towns and a new Orange County Chapter, and spoke on the Emergency Operations Center
meeting at the Fairview Developmental Center.
Speaker, spoke on parking on Monrovia Street, requested to not reduce parking requirements,
spoke on the West 19th Street improvements, and spoke on notification for the State
Emergency Operations Center meeting at the Fairview Developmental Center.
Kim Hendricks spoke on Fairview Park.
COUNCIL MEMBER COMMITTEE REPORTS, COMMENTS, AND SUGGESTIONS
Council Member Harper spoke on the timeline for addressing the Cannabis Ordinance, on the
number of Cannabis Businesses, requested a moratorium on addressing Cannabis
Businesses until the Ordinance is addressed, requested an update on the Tennis Center
contract, requested police presence due to street takeovers, spoke on the State Emergency
Operations Center meeting at the Fairview Developmental Center, and spoke on parking
minimums.
Council Member Marr requested staff review the Families Forward contract and funding, spoke
in support of a housing clinic, requested staff review the issues associated with evictions,
spoke on the State Emergency Operations Center meeting at the Fairview Developmental
Center, and spoke in support of a cannabis business moratorium.

Council Member Reynolds spoke on access gaps to resources on housing, requested data on
the number of people being denied services and the causes of these decisions, spoke on
Walktober, participating in A Week Without Driving, spoke on the new striping on W. 19th St.
and requested delineators between the bike lanes, spoke on the kickoff for Strong Towns
Orange County, spoke on a sidewalk condition index, and spoke on funds for supporting
community -based events.
Council Member Chavez spoke on Walk to School Day on October 4th, spoke on the Fire
Station Open House on October 7th, spoke on Back to SOY Night on October 12th, spoke in
support of a housing clinic and a cannabis moratorium, and requested to adjourn the meeting
in memory of Brandon Accola.
Council Member Gameros recognized first responders.
Mayor Pro Tern Harlan spoke on Walk to School Day on October 4th, spoke on the meeting on
the proposed State Emergency Operations Center at Fairview Developmental Center,
expressed support for housing at the Fairview Developmental Center site and is opposed to an
Emergency Operations Center at the location.
Mayor Stephens spoke on the meeting on the proposed State Emergency Operations Center
at Fairview Developmental Center and supports housing at the location, spoke on Jake Knapp
from Estancia High School receiving a PGA card, spoke on the sustainability Decathlon
October 5t" through October 15t" at the Fairgrounds, spoke on evictions and that legal aid will
be at future Council meetings to provide assistance, spoke on Placentia Ave. street
improvements, and spoke on Adjourning the meeting in honor of Brandon Accola, Dianne
Feinstein, Jordan Brandman, and Ronnie J. Coleman,
REPORT — CITY MANAGER — Ms. Farrell Harrison spoke on the proposed State Emergency
Operations Center at the Fairview Developmental Center and providing comments on the EIR,
spoke on the Nationwide Emergency Alert and Wireless Emergency Alert Test on October 4th,
spoke on the new Costa Mesa App CM311, and spoke on bringing forth an eviction ordinance.

and waived full reading of Ordinances and Resolutions.

3. ADOPTION OF WARRANT RESOLUTION
ACTION:
City Council approved Warrant Resolution No. 2706.

ACTION:
City Council approved the minutes of the regular meeting of September 19, 2023.
5. DESIGNATION OF CITY NEGOTIATORS FOR THE COSTA MESA CITY
FIREFIGHTERS ASSOCIATION (CMFA) MEET AND CONFER AND
AUTHORIZATION TO PROCEED WITH THE FINANCIAL ANALYSIS OF THE
CURRENT MEMORANDUM OF UNDERSTANDING (MOU) PER THE
TRANSPARENCY IN LABOR NEGOTIATIONS COUNCIL POLICY
ACTION:
1. City Council designated City Manager Lori Ann Farrell Harrison as the City's
Principal Negotiator, Deputy City Manager Alma Reyes, Human Resources Manager
Kasama Lee, Human Resources Administrator Fanni Acosta, and Finance Director
Carol Molina as the City's representatives in negotiations with the CMFA.
2. Authorized staff to have the independent fiscal analysis of the current CMFA
2017-2024 Memorandum of Understanding (MOU) completed per the requirements
of the Transparency in Labor Negotiations Council Policy.
6. AUTHORIZE THE USE OF A COOPERATIVE AGREEMENT WITH LONG BEACH
BMW FOR THE PURCHASE OF FOUR NEW 2024 BMW R1250 RT-P POLICE
MOTORCYCLES
ACTION:
1. City Council approved the purchase of four (4) new 2024 BMW R1250RT-P police
motorcycles based on pricing provided through a cooperative agreement with the
Los Angeles County Sheriff's Department, PO-SH-23008318-1.
2. Authorized the City Manager to execute the necessary documents for the purchase
in the amount of $129,033.94 from Long Beach BMW Motorcycles located at 2125
E. Spring Street, Long Beach, CA 90806.

7. ACCEPTANCE OF THE CITYWIDE PARKWAY MAINTENANCE, STREET
REHABILITATION, AND SLURRY SEAL PROJECT, CITY PROJECT NO. 21-03
ACTION:
1. City Council accepted the work performed by All American Asphalt, Inc., 400 East
Sixth Street, Corona, California 92879 for the Citywide Parkway Maintenance, Street
Rehabilitation, and Slurry Seal Project, City Project No. 21-03, and authorize the City
Clerk to file the Notice of Completion.
2. Authorized the City Manager to release the retention monies thirty-five (35) days
after the Notice of Completion filing date; release the Labor and Material Bond seven
(7) months after the filing date; and release the Faithful Performance Bond one (1)
year after the filing date.

Presentation by Fire Chief Stefano, Assistant Fire Chief Pyle, Emergency Medical
Services Manager Horner, Training Safety & Professional Standards Captain Torres,
Battalion Chief Coates, Fire Marshal Neal, and EOC Manager Emrick.
Public Comment:
Speaker, spoke on strategies to add speed humps and slower speeds, size of fire trucks
and negotiating the width of streets, hybrid fire trucks, single staircase buildings, and
lithium ion batteries.
