HomeMy WebLinkAbout05-48 - Inconsistencies in State and Federal Law Pertaining to Medical Marijuana DispensariesRESOLUTION NO. 05-48: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, REQUESTING THAT THE LEAGUE OF CALIFORNIA CITIES WORK TO RESOLVE THE INCONSISTENCIES IN STATE AND FEDERAL LAW PERTAINING TO MEDICAL MARIJUANA DISPENSARIES THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES AS FOLLOWS: WHEREAS, in 1996, California voters approved Proposition 215 that ensures that seriously ill Californians have the right to obtain and use marijuana for medical purposes when recommended by a physician; and WHEREAS, Proposition 215 also allows for the use of marijuana for personal medical purposes; and WHEREAS, on June 6, 2005 the United States Supreme Court ruled that the federal government has the right to prohibit cultivation and possession of marijuana for personal medical use, regardless of state laws that may allow it; and WHEREAS, on June 21, 2005, based on the United States Supreme Court decision, the City Council approved an Ordinance to prohibit the establishment of medical marijuana dispensaries in Costa Mesa; and WHEREAS, City Council continues to be concerned about the contradictions in the state and federal laws pertaining to this issue; and WHEREAS, the League of California Cities' mission is to advocate on issues that impact cities throughout the State. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COSTA MESA that City of Costa Mesa requests that the League of California Cities work through the proper legal channels to resolve the inconsistencies in state and federal law, and to develop guidelines for local communities pertaining to medical marijuana dispensaries.
