HomeMy WebLinkAbout01/06/1982 - Adjourned City Council Meeting/I ADJOURNED REGULAR MEETING OF THE CITY COUNCIL CITY OF COSTA MESA January 6, 1982 The City Council of the City of Costa Mesa, California, met in adjourned regular session on January 6; 1982, at 7:00 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, said meeting having been duly and regularly adjourned from the regular meeting of January 4, 1982, and a copy of the Notice of Adjournment having been posted as required by law. The meeting was called to order by the Mayor. ROLL CALL Council Members Present: Council Members -Absent: Of.fic1als Present:: Schafer, Hall, Hertzog, McFarland, Johnson None City Manager, City Attorney-, Deputy City Clerk OLD BUSINESS Continued from the meeting of January 4, 1982, regarding Council's previous decision not to appeal the Appellate Arnel Lawsuit Court ruling in connection with the Arnel lawsuit. The Appellate Court ruled the Initiative Ordinance of 1978 was invalid because it was -discriminatory. The City Attorney reported he.received a copy of a letter from Santa Barbara's City Attorney Frederick W. Clough: written to San Jose's City Attorney Robert Logan, setting forth certain points concerning the Court of Appeal's opinion in Arnel which Mr. Logan should include in his letter to the State Supreme Court when asking that Court to take the case on its own motion. Portions of that letter were read aloud.by Mr. Wood. Considerable discussion ensued between the Council and Mr. Wood. Then Mayor Schafer opened discussion to the public. Jon Paradis, 1140 Salinas Avenue, Costa Mesa, Vice President of the North Costa Mesa Homeowner's Associa- tion, spoke in favor of having the State Supreme Court hear the case and render its, own decision. He felt it wouldn't be costly because much of the investigative work has been done and paid for. After stating his ease,,Mr. Paradis answered questions from the Counc.i}. Dan Gott,:953 Dahlia Avenue"- Costa Mesa, stated in 1976, he represented -,a -group; of `homeowners in the Greenbrook Communi=ty and had -:extensive meetings with Arnel Developers, the City of Costa Mesa, the Planning Commission, and the.City Council, and was unable to reach a satisfactory agreement with Arnel. He asked that tonight the Council vote in favor of allowing the State Supreme Court to hear the case and render their own decision. David Leighton, 1074 Redding Avenue, Costa Mesa, President of the North Costa Mesa Homeowner's Associa- tion, wanted to reassure Mr. McFarland that they were not trying to bypass anyone in their attempt to be heard. His group of homeowners wants to work with the developers and the City. He questioned the possiblity of lowering South Coast Road southerly as a buffer F� [i between the different types of residential zoning being discussed in the land use. Henry Segerstrom, 3315 Fairview Road, Costa Mesa, felt that there was a spirit of cooperation and would like to see the final decision of the Court of Appeals stand. He wanted the matter of land use left with the developer, the homeowners, and the City. MOTION After further discussion between Council and Mr. Wood, Decision Not a motion was made by Vice Mayor Hall, seconded by To Petition Councilman McFarland, to reaffirm the decision not to Approved petition the Supreme Court to rehear the decision of the Fourth District Court of Appeals in the Arnel decision. The motion carried by the following roll call vote: AYES: COUNCIL MEMBERS: Hall, Hertzog, McFarland NOES: COUNCIL MEMBERS: Schafer, Johnson ABSENT: COUNCIL MEMBERS: None ADJOURNMENT At 8:50 p.m., the Mayor adjourned the meeting.
