HomeMy WebLinkAbout67-11 Entertainment PermitsH 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 467-11 AN AMENDMENT TO ORDINANCE NO. 67-4 OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DEFINING ENTER- TAINMENT; PROVIDING FOR ENTERTAINMENT PERMITS; PROVIDING STANDARDS AND PROCEDURES TO BE FOLLOWED IN GRANTING PERMITS; GENERALLY PROVIDING FOR THE REGULATION OF LIVE ENTERTAINMENT. THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS: Chapter VI, Article 13 of the Municipal Code of the City of Costa Mesa is hereby amended to read as follows: "CHAPTER VI Business, Professions and Trades Article 13 Live Entertainment Sections: 61300. Section 61300 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby amended to read as follows: "SECTION 61300. ENTERTAINMENT DEFINED. The term "entertainment" means every form of live entertainment, music, solo band or orchestra, act, play, burlesque show, fashion show, review, pantomine, scene, song or dance, act, or song and dance act, or any other act or performance participated in by one or more persons for the purpose of holding the attention of, gain- ing the attention and interest of, diverting or amusing guests or patrons, and shall include any of such forms or live enter- tainment when used in connection with, or as a means to attract or hold the attention of such guests or patrons for the purpose of advertisement, demonstration or display of goods, wares, merchandise, or service, in any public place. The definition of entertainment shall further include, but not be limited to, the presence of any waitress, hostess, entertainer or other female attendant in such public place, or permitting or allowing any other female present on the premises to participate in any performance in such public place, unclothe( or in such attire, costume or clothing as to expose to public view any portion of either breast at or below the areola thereof, or any part of the pubic region or anal region, buttocks or crease of the buttocks of any such person." Section 2. Section 61300.1 of the Municipal Code of the City of Costa Mesa is hereby added to read as follows: "SECTION 61300.1. CLOTHING DEFINED. The definition of clothing, costume or attire shall include, but not be limited to, completely enclosing and covering with a. solid, non-trans- parant material, the entire areola area and all of the lower portion of the female breast; the complete buttocks and pubic area including the anal region and crease of the buttocks." -2- 1, 2 31 41 5I 6lii 7 8 91 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Section 3. Section 61301 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby amended to read as follows: "SECTION 61301. PERMIT REQUIRED FOR ENTERTAINMENT IN PLACE SERVING FOOD OR REFRESHMENTS. No person shall provide or permit any entertainment nor shall any person entertain in a coffee shop, restaurant or other place where food or other refreshments or beverages are served, and which is open to the public, unless each establishment and each entertainer shall first obtain a permit to do so from the City Council as herein- after provided. Any person providing or permitting entertainment, anti /or entertaining without a required permit shall/deemed in violation of this section and any violation shall be deemed a misdemeanor and subject to the penalty as provided in Section 1115 of the Costa Mesa Municipal Code." Section 4. Section 61302 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby amended to read as follows: "SECTION 61302. EXCLUSIONS. The provisions of Section 61301 shall not be deemed to require a permit for the following: (a) For the use of a radio or music recording machine, or juke box in any establishment; (b) For entertainment conducted in connection with a regularly established recreation park, circus, or fair- ground; (c) Where entertainment conducted by or sponsored by any non-profit society or association, organized or incorporat- ed for benevolent, charitable, dramatic or literary purpose having an established membership and which holds meetings other than such entertainment at regular intervals, when proceeds, if any, arising from such entertainment -2- 1 2 3 4 5 6 7 8 911 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 are used for the purposes of such club, society or association." Section 5. Section 61303 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby deleted. Section 6. Section 61305 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby amended to read as follows: "SECTION 61305. APPLICATION FOR ESTABLISHMENT ENTERTAIN- MENT PERMIT. Applicants for establishment entertainment permits shall: (a) File a written, signed and acknowledged application with the City Clerk showing: (1) The name and permanent address of applicant. (2) A detailed description of the entertainment, including type of entertainment, number of persons engaged in the entertainment, and any further information about the entertainment or enter- tainers, as the Chief of Police or the City Council may deem necessary. (3) The date, hours and location where said enter- tainment is proposed, and the admission fee, if any, to be charged. (4) The name or names of the person or persons having the management or supervision of applicant's business. (5) The length of residence of applicant within the city. (6) A statement of the nature and character of applicant's business, if any, to be carried on in conjunction with such entertainment. (7) Whether or not the person or persons having the management or supervision of applicant's business =19 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 have been convicted of a crime, the nature of such offense, and the sentence received therefore. (8) Such other reasonable information as to the ident y or character of the person or persons having the management or supervision of applicant's business, as the City Council may deem necessary. (b) Obtain and complete the Costa Mesa Police Department R. L� , Permit Application Form and psent the form, in person, to the Police Department. If the applicant is a partner- ship, all partners shall obtain and complete the form. If the applicant is a corporation, the managing officer shall obtain and complete the form. (c) Submit to fingerprinting and photographing. (d) Secure the validation by the Costa Mesa Finance Department for fees paid for each Costa Mesa Police Department Permit Application Form before processing by the Costa Mesa Police Department. (e) See that each entertainer employed or to be employed by their establishment completes and Bents the Costa Mesa Police Department Permit Application Form and said entertainer submits to fingerprinting and photographing." Section 7. Section 61305.1 of the Municipal Code of the City of Costa Mesa is hereby added to read as follows: "SECTION 61305.1. APPLICATION FOR ENTERTAINERS PERMIT. Applicants for entertainers permits shall: (a) Obtain and complete the Costa Mesa Police Department V so Permit Application Form and persent the form, in person, to the Costa Mesa Police Department. (b) Submit to fingerprinting and photographing by the Costa Mesa Police Department. (c) Secure the validation by the Costa Mesa Finance Department for fees paid for the Costa Mesa Police 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Department Permit Application Form before processing by the Costa Mesa Folice Department." Section 8. Section 61309 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby amended to read as follows: "SECTION 61309. GRANTING ESTABLISHMENT ENTERTAINMENT PERMIT. After the making and filing of said applications for the original or amended permit and payment of fee, the Chief of Police shall make an investigation. After the investigation is complete, the Chief of Police shall report to the City Council prior to the hearing heretofore provided for. The City Council may issue a permit, or issue an amended permit, and impose reasonable regulations thereon, or refuse to amend a permit)or deny a permit." Section 9. Section 61309.1 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby added to read as follows: "SECTION 61309.1. GRANTING ENTERTAINERPERMIT. After the making and filing of the Costa Mesa Police Department Permit Application Form, payment of the fee, and having been finger- printed and photographed, the Chief of Police shall make an investigation. After the investigation is complete, the Chief of Police shall report to the City Council prior to the hearing heretofore provided for. The City Council may issue a permit, or amended permit, or endorse a permit, and impose reasonable regulations thereon; or refuse to amend a permit, or refuse to endorse a permit, or deny a permit." Section 10. Section 61309.2 of the Municipal Code of the City of Costa Mesa is hereby added to read as follows: "SECTION 61309.2. GRANTING TEMPORARY ENTERTAINER PERMITS. Upon the filing of the Costa Mesa Police Department Permit MV 1 2 3 4 51 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Application Form by entertainer, properly validated for payment of fee, entertainer having been fingerprinted and photographed and interviewed by the Chief of Police or his representative, The Chief of Police, in his sole discretion, may issue a temporary entertainer permit for a period of twenty (20) days." Section 11. Section 61310 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby amended to read as follows: "SECTION 61310. GROUNDS FOR DENIAL OF ESTABLISHMENT ENTERTAINMENT PERMIT. The City Council may deny a permit or refuse to amend a permit on any of the following grounds: Cavale, Cr/< (a) The:Tthe premises proposed to be used in the of the business of live entertainment is not a suitable or proper place therefore. (b) The conduction of the business of live entertainment does not comport with existing land uses in the neighborhood. (c) That the live entertainment proposed is prohibited by local or state law, ordinance, statute, rule or regulation, or prohibited in the particular location where the entertainment is proposed. (d) That the entertainment proposed threatens a public nuisance. (e) That the conduction of the business of entertainment will not comport with the peace, health, safety and general welfare of the public. (f) That the applicant is unfit to be granted such permit by virtue of bad moral character, intemperate habits, or a bad reputation, or by virtue of past arrests, or crimes or offenses involving moral turpitude. (g) That the applicant has falsified or fails to provide information and evidence of substantial and material import in his or her application for permit or amendment thereto. Section 12. Section 61310.1 of the Municipal Code of the City of Costa Mesa is hereby added to read as follows: "SECTION 61310.1. GROUNDS FOR DENIAL OF ENTERTAINERS PERMIT. The City Council may deny a permit or refuse to amend a permit, or endorse a permit on any of the following grounds: (a) That the entertainment proposed is prohibited by local or state law, ordinance, statute or rule or regulation, or prohibited in the particular location where the entertainment is proposed. (b) That the entertainment proposed threatens a public nuisance. (c) That the entertainment proposed will not comport with the peace, health, safety and general welfare of the public. (d) That the applicant is unfit to be granted such permit by virtue of bad moral character, intemperate habits, or a bad reputation, by virtue of past arrest, or crimes or offence s involving moral turpitude. (e) That the applicant has falsified or fails to provide information and evidence of substantial and material import in his or her application for permit or amendment thereto. (f) That the applicant is employed or proposes to be IYoT employed by an establishment Ahaving a valid establishment entertainment permit." (g) That the applicant is not otherwise a qualified person to entertain for which a permit is sought." Section 13. Section 61311 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby amended to read as follows: "SECTION 61311. DENIAL --NOTICE TO APPLICANT FOR ESTABLISH— 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 MENT ENTERTAINMENT PERMIT AND/OR ENTERTAINERS PERMIT. The City Clerk shall notify the applicant or applicants of the City Council's denial of an application for a permit or his or her application for an amendment thereto. Service of such notice shall be made personally or by certified or regular mail." Section 14. Section 61316 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby amended to read as follows: "SECTION 61316. APPEAL HEARINGS UPON SUSPENSION OF PERMITS. An establishment entertainment permittee or an entertainer permittee whose permit has been suspended by the Chief of Police may petition for an appeal hearing before the City Council subject to the following procedures. The Chief of Police shall notify the applicant of the suspension of the permit. Service of such notice shall be made personally or by certified or regular mail. The notice shall include, or be accompanied by a statement that the applicant may request an appeal hearing before the City Council by filing a written request therefore with the City Clerk within ten days after service upon him of the notice of suspension and any failure to so file, shall constitute a waiver of his rights to such an appeal hearing. The request for an appeal hearing shall be in writing and signed by or on behalf of the applicant and shall state his mailing address. It need not follow any particular form. At its next regular meeting, duly held, immediately following the receipt of a notice requesting an appeal, the City Council shall establish a date and time certain for the conduct of such hearing whereupon no further notice, other than the notice of the date and place of hearing, need be served on the applicant at the place designated by applicant as his address for receiving such notice of the date and place of hearing in his application for an appeal hearing." 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Section 15. Section 61317 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby amended to read as follows: "SECTION 61317. REVOCATION OR SUSPENSION PROCEEDINGS EFFECT ON PERMITTEE. Pending the final determination of a proceeding for revocation or suspension of a permit, a permittee shall not continue to entertain and/or to engage in the business of providing entertainment until the City Council makes such final determination. " Section 16. Section 61318 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby amended to read as follows: "SECTION 61318. LOCATION. The establishment entertainment permittee shall conduct no entertainment activity at a location nor shall the entertainer permittee entertain at other than the location specified on the permit unless such a permit has a change of location or additional locations endorsed thereon as approved by the City Council. A violation of this section shall be deemed a misdemeanor and subject to the penalty as provided in Section 1115 of the Costa Mesa Municipal Code." Section 17. Section 61319 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby amended to read as follows: "SECTION 61319. ADMINISTRATION. The Chief of Police is empowered to adopt reasonable rules and regulations or to imposed reasonable conditions upon any permit issued for the purpose of implementing this article with copies of said rules, regulations or conditions to be provided to those permittees affected thereby and violations of said rules and regulations or conditio shall be deemed a misdemeanor and subject to the penalty as provided in Section 1115 of the Costa Mesa Municipal Code. Sufficient members of the police department shall be is 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 admitted free of charge to all locations where entertainment is permitted pursuant to this article for the purpose of insur- ing conformity with the permit, including any rules, regulations or conditions applicable thereto. Such police officers may require permittees or any entertainers at the location purport- ing to entertain under the authority of permittee's permit to identify themselves by their name, age and address." Section 18. Section 61319.1 of the Municipal Code of the City of Costa Mesa is hereby added to read as follows: "SECTION 61319.1. GENERAL RULES AND REGULATIONS FOR ESTABLISHMENT ENTERTAINMENT PERMITTEES AND ENTERTAINER PERMITTEE: The reasonable rules and regulations as provided in Section 61319 shall include, but not be limited to the following: (a) No establishment permittee, or manager, shall permit female employees or entertainers to dance with male patrons, (b) No establishment permittee, or manager shall permit a minor under age of twenty-one years in the establishment unless accompanied by his parent or guardian, unless permitted under Business and Professions Code Sections 23039, 25663 and 25665 or where no alcoholic beverage is served. (c) No establishment permittee or manager shall permit any person to dance with another person of the same sex. (d) Establishment permittee or manager shall be held responsible for the conduct of employees, entertainers and palttns on the establishment premises. (e) No entertainment shall be permitted in any establish- ment between the hours of 2:00 AM and 10:00 AM. (f) All entertainment shall be performed on a suitable stage or place separate from the general patron area. The place of entertainment must be approved by the Chief of Police or his duly authorized agents. 5M v 1 2 3 4 5 6 7 8', 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 (g) There shall be no entertainment of any find which is visible from the sidewalk,street or parking area. (h) No entertainer shall mingle or associate with any patron or be in the general patron area except when conventionally dressed in street clothes. (i) Patrons shall not be allowed to participate in any entertainment act unless entertainers are conventionally dressed in street clothes. (j) No entertainment shall be conducted in which any performer, entertainer, employee, patron or guest, participating directly or indirectly, sings or speaks any obscene or indecent words, or performs any lewd or indecent gestures or acts. (k) No entertainment shall be conducted in which any performer impersonates, by means of costumes or dress, a person of the opposite sex. (1) Employment of entertainers or employees whose activities or conduct encourages, promotes or condones the congregation of homosexuals, lesbians or persons pretending to be such, shall be prohibited. (m) No entertainer or employee shall do any act or utter any words that would incite a riot or cause any disturbance. (n) Each permit shall be kept separately, in a suitable protective container, so that the entire face of the permit is visible. (o) Each establishment permit shall be posted in a conspicuous place upon the premises. (p) Each entertainer permit shall be kept in their immediate possession; or upon the premises at all times when the entertainer is actually performing." Section 19. Section 61321 of the Municipal Code of the City of Costa Mesa, Chapter VI, Article 13, is hereby amended -11- 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 as follows: 2/ "SECTION 613. SEVERABILITY OF VIOLATIONS. Each act or performance in which a violation of this chapter occurs by act of the establishment entertainment permittee and/or any entertainer permittee shall be deemed a distinct and separate violation." Section 2. (a) , (b) , (c) , (d) and (e) and Section 3. are hereby deleted. Section 20.
