AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA
ADDING SECTION 2711.1 TO THE MUNICIPAL CODE OF THE CITY OF
COSTA MESA REGARDING WORKING TIME AND HOLIDAYS FOR THE
COMMUNICATIONS DEPARTMENT AND CERTAIN OTHER EMPLOYEES.
The City Council of the City of Costa Mesa does hereby ordain as follows:
SECTION 1. There is hereby added to the Municipal Code of the City of Costa
Mesa a certain section designated as Section 2711.1 and entitled: "Same. Communications
and Facilities Employees," to read as follows:
"Section 2711.1 Same. Communications and Facilities Emplyoees.
Officers and members of the Communications Department, excluding clerical
employees in that Department, and the Director of Facilities and the Facilities
Supervisor, shall work the shifts of duties specified by the Director of
Communications and the Director of Facilities, respectively, regardless of legal
holidays. Any of the above officers or members who works on any legal holiday
as part of his regular shift shall not be entitled to time off, overtime, or
additional compensation, except as hereinafter specifically set forth. He shall,
however, accrue credit for holiday pay purposes, not to exceed one year's accrual,
based each calendar year upon the number of days (excluding Saturdays and Sundays)
in that year on which the general City offices are closed in observance of legal
holidays, accrual to be at the rate of one twelfth (112th) of a full year's
credit for each month of service during that year. At least once each calendar
year, at a time designated by the City Manager, each officer or member shall be
paid in a lump sum, at a rate equal to his current regular compensation, for
all such accrued holiday pay."
SECTION 2. This Ordinance is hereby declared to be for the immediate preservation
of the public peace, safety, convenience and general welfare and is hereby enacted as an
urgency ordinance to take effect immediately up*n passage. A declaration of facts
constituting the urgency is as follows:
The recently created Department of Communiciations, together with the Director
of Facilities and the Facilities --Supervisor, have assumed responsibilities which by
their nature require continuous service to the public, and no provision exists in the
Municipal Code for their accrual of holiday pay.
SECTION 3. This Ordinance shall take effect immediately upon its adoption and
shall within fifteen (15) days after its passage be published once in the ORANGE COAST
DAILY PILOT, a newspaper of general circulation, printed and published in the City of
Costa Mesa, together with the names of the members of the City Council voting for and
against the same.
