CITY OF COSTA MESA
December 18, 1985
The City Council of the City of Costa Mesa, California,
met in adjourned regular session on December 18, 1985,
at 7:35 p.m., in the Council Chambers of City Hall, 77
Fair Drive, Costa Mesa, said meeting having been duly
and regularly ordered adjourned from the regular meeting
of December 16, 1985.
ROLL CALL COUNCIL MEMBERS PRESENT: Hertzog, Hornbuckle, Schafer,
Hall, Wheeler
COUNCIL MEMBERS ABSENT: None

ORDINANCES A motion was made by Council Member Hall, seconded by
Council Member Wheeler, and carried 5-0, to read all
ordinances by title only.
PUBLIC HEARING The Mayor announced the public hearing to consider Final
Final EIR No. 1026 Environmental Impact Report (EIR) No. 1026, Costa Mesa
for 19.5 acres in City Council, for 19.5 acres located in the Downtown
the Redevelopment Redevelopment Area. The Affidavit of Publication is

There being no speakers, the Mayor closed the public
hearing.
MOTION A motion was made by Council Member Schafer, seconded
EIR Certified by Vice Mayor Hornbuckle, certifying the Final Environ-
mental Impact Report as adequate and accurate. The
motion carried 4-1, Council Member Wheeler voting no.
PUBLIC HEARINGS The City Clerk announced that public hearings will be

Apartment Project Park Avenue, Plumer Street, and -Anaheim Avenue, includ-
ing that portion of Plumer Street extending approxi-
mately 384 feet east of Anaheim Avenue.
PUBLIC HEARING The Senior Planner announced the public hearing for the
EIR Certification; following items: Certification that the City Council
Findings of Fact; has reviewed and considered the information contained
and Statement of in the Final Environmental Impact Report prior to final
Overriding Consid- action on General Plan Amendment GP -85-4A, Rezone Peti-
erations tion R-85-13, Planning Action PA -85-214, and author-
ization to issue Multi -family Housing Revenue Bonds;
findings regarding the environmental impact of the
proposed development; and Statement of Overriding
Considerations. The Affidavit of Publication is on
file in the Clerk's office.
Council Member Wheeler disagreed with the Statement of
Overriding Considerations.
There beim no speakers, the Mayor closed the public
hearing.
MOTION On motion by Council Member Schafer, seconded by Vice
Resolution 85-109 Mayor Hornbuckle, Resolution 85-109, being A RESOLUTION
Adopted OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALI-
FORNIA, CERTIFYING THAT THE FINAL ENVIRONMENTAL IMPACT
REPORT (EIR) WITH RESPECT TO THREE PROPOSED DEVELOPMENT
SITES WITHIN A 19.5 -ACRE AREA OF THE COSTA MESA DOWNTOWN
REDEVELOPMENT PROJECT WHICH INCLUDES A MULTI -FAMILY
RENTAL HOUSING DEVELOPMENT HAS BEEN PREPARED IN COMPLI-
ANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
(CEQA) AND STATE AND LOCAL GUIDELINES; CERTIFYING THAT
INFORMATION FROM THE FINAL EIR HAS BEEN REVIEWED AND
CONSIDERED PRIOR TO FINAL ACTION ON GENERAL PLAN AMEND-
MENT GP -85-4A, REZONE PETITION R-85-13, PLANNING ACTION
PA -85-214, AND THE AUTHORIZATION TO ISSUE MULTI -FAMILY
HOUSING REVENUE BONDS; MAKING CERTAIN FINDINGS REGARDING

PUBLIC HEARING The Senior Planner announced the public hearing for
GP -85-4A General Plan Anendment GP -85-4A, Costa Mesa City
Council, to change the land use designation of the
ccm mercial portions within the project area to residen-
tial. The Affidavit of Publication is on file in the
Clerk's office. Staff reccmmended approval of Option I,
amend the General Plan designation and zoning to resi-
dential.
Council Member Wheeler cco mented that Option III would
be more appropriate. Option III would retain the pres-
ent land use designation and zoning.
There being no speakers, the public hearing was closed.
MOTION On motion by Vice Mayor Hornbuckle, seconded by Council
Resolution 85-110 Member Schafer, Resolution 85-110, being A RESOLUTION OF
Adopted THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA,
ADOPTING GENERAL PLAN AMENDMENT GP -85-4A, AMENDING THE
GENERAL PLAN OF THE CITY OF COSTA MESA, approving
Option I, was adopted by the following roll call vote:

Schafer
NOES: COUNCIL MEMBERS: Hall, Wheeler

PUBLIC HEARING The Senior Planner announced the public hearing for
R-85-13 Rezone Petition R-85-13, Costa Mesa City Council, to
change the zoning within the project area frcm Cl, C2,
and R2 to R4. The Affidavit of Publication is on file
in the Clerk's office.
There being no speakers, the public hearing was closed.
Council Member Wheeler stated that the current zoning
would be more appropriate.
MOTION On motion by Council Member Schafer, seconded by Vice
Ordinance 85-37 Mayor Hornbuckle, Ordinance 85-37, being AN ORDINANCE

passed to second reading by the following roll call
vote:

PA -85-214 The Senior Planner presented Planning Action PA -85-214
Redevelopment (Redevelopment Action RA -85-15), Costa Mesa Redevelop,
Agency ment Agency, fora Conditional Use Permit to exceed R4
density with a Density Bonus to allow 160 apartment
units on approximately 3.8 acres of land (42 units per
acre).
Staff reccmmended the addition of Condition No. 45
extending the affordability requirements to 20 years.
Staff also recommended the addition of Finding G, stat-
ing reasons why the Conditional Use Permit to exceed R4
density is consistent with the findings required in
Costa Mesa Municipal Code Section 3-347.
Council Member Wheeler stated that he does not agree
with the findings because he believes that the project
will have an adverse impact on the surrounding proper-
ties; the project is not -consistent with the General
Plan; and 42 units per acre is not appropriate for that
area.
MOTION A motion was made by Vice Mayor Hornbuckle approving
PA -85-214 Planning Action PA -85-214 subject to conditions con -
Approved tained in the Staff Report, adding Condition No. 45,
low and moderate income affordability requirements shall
be effective for 20 years; and based on the findings
contained in the Staff Report as well as the following
additional finding:
G. The Conditional Use Permit to exceed R4 density
is consistent with the findings required in Costa
Mesa Municipal Code Section 13-347 in that:
(1) The proposed development is substantially
canpatible with developments in the general
area and would not be materially detrimental
or otherwise injurious to other properties
or improvements in the area.
(2) Granting of the Conditional Use Permit will
not be materially detrimental to the health,
safety, and general welfare of the public.
(3) Granting of the Conditional Use Permit will
not allow a use, density, or intensity which
is not in accordance with the General Plan
designation for the property.
The motion was seconded by Council Member Schafer, and
carried 4-1, Council Member Wheeler voting no.
PUBLIC HEARING
The Mayor announced the public hearing to consider the

Series A, in an aggregate amount not to exceed
$14,000,000.00, to provide financing for acquisition
and construction of a 160 -unit multi -family residential
project by Lincoln Park Mesa? The Affidavit of Publi-
cation is on file in the Clerk's office.
Audre Schiff, owner of property within the project area,
commented that the proposed site was not appropriate for
residential use. Ms. Schiff asked if tax funds would be
used for the project. The Redevelopment Agency Director
responded that no tax money would be involved.
There being no other speakers, the Mayor closed the
public hearing.

Resolution 85-111 Mayor Hornbuckle, Resolution 85-111, being A RESOLU-

CALIFORNIA, APPROVING ISSUANCE BY THE COSTA MESA
REDEVELOPMENT AGENCY OF MULTI -FAMILY HOUSING REVENUE
BONDS, 1985 SERIES A, NOT TO.EXCEED A PRINCIPAL AMOUNT
OF $14,000,000.00, FOR THE PARK CENTER APARTMENT
PROJECT, was adopted by the following roll call vote:

NEW BUSINESS The Development Services Director presented a Housing
Mitigation Plan required for construction of a shopping
Housing center containing 690,000 square feet, in conjunction
Mitigation with Zone Exception ZE-84-101, South Coast Plaza,
Plan located at 3333 Bear Street.
The Director reviewed staff's memorandum of December 6,
1985, pointing out that the shopping center would gener-
ate a housing demand for approximately 49 dwelling units
and would eliminate the potential to develop 272 new
dwelling units, resulting in an increased demand for
321 units. Since the developer was required to submit
a program to mitigate this impact, he has made a pro-
posal to participate in the 160 -unit Lincoln project.
In the past, consideration has been given to allow extra
credit for projects which meet other City goals such as
providing housing for the Downtown Redevelopment Area,
or providing housing for special groups (families,
seniors, handicapped, low- and moderate -income house-
holds). Since the Lincoln project meets two of these
goals by providing affordable housing in the Downtown
Redevelopment Area, staff has recommended two alterna-
tives for allowing 1.8 credits per unit.
Council Member Wheeler objected to the 1.8 credits per
unit since he does not know what percentage of the
apartment project would be financed by the shopping
center developer. Council Member Wheeler opposed
granting the developer credit for almost twice as many
units as are actually being constructed, and felt that
this action would set a dangerous precedent.
MOTION A motion was made by Council Member Hall, seconded by
Housing Mitigation Council Member Schafer, adopting the Housing Mitigation
Plan (1.8 Ratio) Alternative contained in staff's memorandum of Decem-
Approved ber 6: Allow 1.8 credits per unit for the 160 units
actually being constructed by Lincoln Properties with
the 14 additional units receiving only a 1 to 1 credit,
resulting in 302 housing credits; and stipulating that
the 19 -unit deficit shall be provided in conjunction
with the developer's future housing mitigation programs.
The motion carried 3-2, Council Members Hornbuckle and
Wheeler voting no.
Allocation of The Redevelopment Agency Director recommended allocation
Community of available Cmuunity Development Block Grant funds, in
Development amounts not to exceed $1,000,000.00, to the Costa Mesa
Block Grant Funds Redevelopment Agency for the purpose of financing land
assembly costs for the Lincoln Park Center apartment
project. Details of the request are contained in the
Director's memorandum of December 18, 1985.
Council Member Wheeler suggested that these funds be
used in depressed areas of the City.

Allocation Council Member Schafer, authorizing allocation of the
Authorized Community Development Block Gant funds as reccmnended
by the Agency Director. The motion carried by the
following roll call vote:
