PROJECT DESCRIPTION •
• The applicant proposes a 710 square-foot, second-story addition in conjunction with
a 404 square-foot, first floor addition to an existing one-story single-family residence.
• The requested administrative adjustment to allow a three-foot, nine-inch separation
between the residence and the detached garage is denied. The property's lot width
and size are consistent with other properties in the immediate vicinity, under the
same zoning district. As a result, there are no special circumstances applicable to
the property, such as unusual lot size, width, or topography that would justify
approval of the administrative adjustment. However, a minor modification can be
approved for a four-foot, ten-inch separation, which should not negatively impact the
usable area of the addition.
▪ A minor design review is required because the second story south (right) side
setback is proposed at six feet, which is less than the recommended 10-foot
average second-story setback and the existing side setback of 10 feet. The project
meets the intent of the Residential Design Guidelines by incorporating various
building material into the design, providing visual interest to the building elevation.
Furthermore, the scale of the second-story addition is consistent with the existing
residence, with both to have similar plate heights between eight and nine feet.
• Privacy of the adjoining neighbors should not be impacted because of the locations
and setbacks of the second-story windows. A clerestory window is proposed on the
south (right side) elevation, minimizing privacy impacts to the south neighbor.
Windows on the north (left side) and east (rear) elevations are at least 20 feet and
45 feet from the north and east property lines, respectively; therefore, privacy
impacts to those neighbors are also minimal.
• Since the proposed addition is isolated from the main living area of the residence, a
land use restriction is required to ensure that future property owners and/or
occupants that the addition area cannot be used as, and/or converted to, a separate
dwelling unit.
• The General Plan and Zoning designations for the property is medium density
residential, which allows a maximum of one dwelling unit per 3,630 square-foot of lot
area. The subject property will contain one dwelling unit on a 7,909 square-foot lot,
consistent with the General Plan and Zoning designations. •
FINDINGS
A, The information presented does not substantially comply with Section 13-29(g)(1) of
the Costa Mesa Municipal Code in that special circumstances applicable to the
property do not exist to justify granting of the administrative,adjustment for a three-
foot, nine-inch separation between the residence and the detached garage. There
are no special circumstances applicable to the property, such as unusual lot size,
width, or topography. Strict application of the zoning ordinance would not deprive the
property owner of privileges enjoyed by owners of other property in the vicinity under
identical zoning classification. Specifically, the lot width and size are consistent with
other properties in the immediate area. Denying the administrative adjustment will
not deprive the property owner from use and enjoyment of his property because a
minor modification can be approved for a four-foot, ten-inch separation without

negatively impacting the usable area of the addition. Granting the deviation would
constitute a grant of special privilege inconsistent with the limitations upon other
properties in the vicinity and zone in which the property is situated.
B. The informationpresented complies with Costa Mesa Municipal Code 'Section
13-29(g)(6) in that allowing a four-foot, ten-inch separation between the residence
and detached garage would not be detrimental to the health, safety, and general
welfare of persons residing or working within the immediate vicinity of the project or
to properties and improvements within the neighborhood. Specifically, the reduced
separation would still provide adequate distance between the buildings for ingress
arid egress purposes. The proposed improvement is compatible with and
enhances the architecture and design of the existing and anticipated development
in the vicinity.
C. The information presented complies with Costa Mesa Municipal Code Section
13-29(g)(14) in that the minor design review meets the purpose and intent of the
Residential Design Guidelines, which are intended to promote design excellence in
new residential construction, with consideration being given to compatibility with the
established residential community. This minor design review includes site
planning, preservation of overall open space, landscaping, appearance, mass and
scale of structures, location of windows, varied roof forms and roof plane breaks,
and any other applicable design features. Specifically, various building material
are incorporated into the design for visual interest. Furthermore, the scale of the
second-story addition is consistent with the existing residence, with both to have
similar plate heights between eight and nine feet. Privacy of the adjoining
neighbors should not be impacted because of the locations and setbacks of the
second-story windows.
D. The proposed project complies with Costa Mesa Municipal Code Section 13-29(e)
because:
1. The proposed development and use is compatible and harmonious with
uses both on-site as well as those on surrounding properties.
2. Safety and compatibility of the design of the buildings, parking areas,
landscaping, and other site features including functional aspects of the
site development have been considered.
3. The proposed development is consistent with both the General Plan and
the Zoning designations because the proposed construction will not
increase the number of dwelling units on the property.
4. The proposed development satisfies the City's Residential Design
Guidelines.
5. The zoning application is for a project-specific case and does not
establish a precedent for future development.
E. The project has been reviewed for compliance with the California Environmental
Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures,
and has been found to be exempt under Section 15301, Existing Facilities, of
CEQA.

F. The project is exempt from Chapter XII, Article 3, Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.
CONDITIONS OF APPROVAL
•
Ping. 1. Plans submitted for building plan check shall show a minimum four-foot,
ten-inch separation between the residence and garage.
2. The addition area shall not be converted to a separate dwelling unit
without providing adequate parking to accommodate a second dwelling
unit on the property.
3. No kitchen or kitchenette shall be permitted in the addition area without
prior City approval.
4. Any future sink, toilet, shower, and or bath tub shall not be allowed in
the addition without prior Planning Division approval.
5. The addition shall be served from the same utility meters (electric, gas,
and water) as the existing residence on the property.
6. A land use restriction executed by and between the property owner and
the City of Costa Mesa shall be recorded prior to the issuance of building
permits, to inform future property owners of the restrictions contained in
condition numbers 2, 3, 4, and 5. Applicant shall submit to the Planning
Division a copy of the legal description for the property, and either a lot
book report or current title report identifying the current legal property
owner(s) so that the document may be prepared.
7. No modification(s) of the approved building elevations including, but not
limited to, changes that increase the building height, removal of building
articulation, or a change of the finish material(s), shall be made during
construction without prior Planning Division written approval. Failure to
obtain prior Planning Division approval of the modification could result in
the requirement of the applicant to (re)process the modification through
a discretionary review process such as a minor design review or a
variance, or in the requirement to modify the construction to reflect the
approved plans.
8. Any future second-floor windows shall be reviewed and approved by the
Planning Division prior to installation.
9. All new and existing construction shall be architecturally compatible with
regard to building material, style, colors, etc. with the existing structures.
10. Any mechanical equipment such as air-conditioning equipment and duct
work shall be screened from view in a manner approved by the Planning
Division. All roof-mounted equipment is prohibited.
11. All construction-related activity shall be limited to between the hours of
7 a.m. and 8 p.m., Monday through Friday, and 8 a.m. to 6 p.m.
Saturday. Construction is prohibited on Sundays and federal holidays.
• Exceptions may be made for activities that will not generate noise
audible from off-site, such as painting and other quiet interior work.

face of the site plan as part of the plan check submittal package.
13. The applicant shall contact the Planning Division to arrange for Planning
inspection of the site prior to the release of occupancy. This inspection is
to confirm that the conditions of approval and Code requirements have
been satisfied.
Eng. 14. Maintain the public right-of-way in a "wet-down" condition to prevent
excessive dust and remove any spillage from the public right-of-way by
sweeping or sprinkling.
CODE REQUIREMENTS
The following list of federal, state, and local laws applicable to the project has been
compiled by staff for the applicant's reference. Any reference to "City" pertains to the
City of Costa Mesa.
Ping. 1. Approval of the zoning action is valid for one (1) year and will expire at the
end of that period (January 18, 2008) unless building permits are
obtained and construction commences, or the applicant applies for and is
granted an extension of time. A written request for an extension of time
must be received by Planning staff prior to the expiration of the zoning
action.
2. Street address shall be displayed on the fascia adjacent to the main
entrance or front door in a manner visible from the public street.
Numerals shall be a minimum 6" in height with not less than 'A" stroke
and shall contrast sharply with the background.
3. Development shall comply with all requirements of Chapter 5, of Title 13,
of the Costa Mesa Municipal Code relating to development standards for
residential projects.
4. Existing mature trees shall be retained wherever possible. Should it be
necessary to remove existing trees, the applicant shall submit a written
request and justification to the Planning Division. A report from a
California licensed arborist may be required as part of the justification.
Replacement trees shall be of a size consistent with trees to be removed
and may be required on a 1:1 basis. This requirement shall be completed
under the direction of the Planning Division.
5. All property line walls or fences shall be repaired or replaced as
necessary under the direction of the Planning Division.
Bus. 6. All contractors and subcontractors must have valid business licenses to
Lic. do business in the City of Costa Mesa. Final inspections, final
occupancy, and utility releases will not be granted until all such licenses
have been obtained.
Bldg. 7. Comply with the requirements of the California Code of Regulations, Title
24, also known as the California Building Standards Code, as amended
by the City of Costa Mesa.
8. Submit an erosion control plan as part of the building plan check
package.

will be required by the Engineering Division prior to the start of any on- or
off-site work.
10. Submit required cash deposit or surety bond to guarantee construction of
off-site street improvements at time of permit per Section 15-32,
• C.C.M.M.C. and as approved by City Engineer. Cash deposit or surety
bond amount to be determined by City Engineer.
11. Obtain a permit from the Engineering Division, at the time of development
and then construct P.C.C. residential sidewalk per City of Costa Mesa
standards as shown on the offsite plan, including four (4) feet clear
around obstructions in the sidewalk.
Fire 12. Provide approved smoke detectors to be installed in accordance with the
2001 Edition of the Uniform Fire Code.
SPECIAL DISTRICT REQUIREMENTS
The requirements of the following special districts are hereby forwarded to the
applicant:
AQMD 1. Applicant shall contact the Air Quality Management District
(800) 288-7664 for potential additional conditions of development or
for additional permits required by the district.
CDFA 2. Comply with the requirements of the California Department of Food
and Agriculture (CDFA) to determine if red imported fire ants exist on
the property prior to any soil movement or excavation. Call CDFA at
(714) 708-1910 for information.
