The meeting was duly and regularly ordered adjourned from the adjourned regular meeting of January 23, 1990, and copies of the Notice of Adjourn- ment were posted as required by law. The meeting was called to order by the Mayor, followed by the Pledge of Allegiance to the Flag, and Invocation by Vice Mayor Hornbuckle. ROLL CALL COUNCIL MEMBERS PRESENT: Mayor Peter Buffa Vice Mayor Mary Hornbuckle Council Member Ory Amburgey Council Member Sandra Genis arrived at 6:32 p.m. Council Member Ed Glasgow COUNCIL MEMBERS ABSENT: None OFFICIALS PRESENT: City Manager Allan Roeder Assistant City Attorney Eleanor Frey Public Services Director William Morris City Clerk Eileen Phinney Principal Planner R. Michael Robinson MINUTES On motion by Council Member Amburgey, seconded by Vice January 17, 1990 Mayor Hornbuckle, and carried 4-0, Council Member Genis absent, the minutes of the adjourned regular meeting of January 17, 1990, were approved as distributed. Council Member Council Member Genis arrived in the Council Chambers Genis Arrived at 6:32 p.m. ORAL Dick Sherrick, 3146 Country Club Drive, Costa Mesa, COMMUNICATIONS stated that Mesa Consolidated Water District has increased Costa Mesa residents' water rates to subsi- Increased Water dize new development. He submitted the following Rates documents for the record: (1) Long Range Financial Plan - Final Report dated November, 1987; (2) Proposed Development Impact Fees dated February 18, 1988; and (3) 1988 Rate Study - Proposed Increases in Basic and Commodity Charges dated March 10, 1988. PUBLIC HEARING The Mayor opened the public hearing, continued from the GP -89-02 meeting of January 23, 1990, to discuss the General Plan General Plan Review Program: Review Program General Plan Amendment GP -89-02: Proposed goals, objectives, and policies. Proposed land use building intensity standards. Proposed land use element map amendments. Amendments to the Master Plans of Highways and Bikeways. 329 In "Objectives/Anticipated Results", change the sentence to read: "Protect residential uses from intrusive, incompatible or potentially disruptive land uses and/or activities". (Addition is under- lined.) The Principal Planner reported that Council action on Planning Commission Policies 211, 211A, 231, and 231A negates the need for Steering Committee Policy 211B. Scott Williams, 3465 Santa Clara Circle, Costa Mesa, Steering Committee member, spoke.about the new State law regarding very low- and low-income housing. MOTION On motion by Vice Mayor Hornbuckle, seconded by Council Policy 211B Member Glasgow, and carried 5-0, Steering Committee Deleted Policy 211B was deleted. The Principal Planner suggested that since Council failed to take action on Steering Committee Policy 216A because the vote was split 2 to 2, it would be appro- priate to consider the policy again. Scott Williams, Steering Committee member, contended that when a density bonus is provided, specific needs should be identified, such as, handicapped, elderly, etc. Mark Korando, 582 Park Drive, Costa Mesa, Steering Committee member, stated that comments from the public at the committee's meetings indicated that specialized housing needs should be provided with or without density bonuses. Motion to Adopt A motion was made by Vice Mayor Hornbuckle, seconded by Amended Policy Council Member Genis, to adopt amended Steering Commit - 216A Failed to tee Policy 216A: "Investigate the feasibility of Carry requiring (deleted 'Require') all new rental projects over 20 units to provide 10 percent of the total units to meet specialized housing needs (deleted '[handi- capped, elderly, minorities, female -headed households and large families]'). (Addition is underlined.) The motion failed to carry 3-2, Council Members Buffa, Amburgey, and Glasgow voting no. Final recommendations on remaining General Plan topics. The Principal Planner referenced staff's memorandum of January 25, 1990, which addresses those items for which Council requested additional information at the last General Plan meeting of January 23, 1990. He summarized the recommendation from Council Member Genis for Program VIII -B, Development Review, regarding intrusion of commercial development in residential General Plan areas. : MOTION On motion by Vice Mayor Hornbuckle, seconded by Council Amended Sections Member Amburgey, and carried 5-0, the following amend - of Program ments to Program VIII -B were adopted: VIII -B Adopted In the "Program/Action Description", change the first sentence to read: "Review of development proposals within or adjacent to existing residential neighbor- hoods for potential conflicts (intrusive, disruptive or inccmpatible.land uses and/or activities). (Addi- tion is underlined.) In "Objectives/Anticipated Results", change the sentence to read: "Protect residential uses from intrusive, incompatible or potentially disruptive land uses and/or activities". (Addition is under- lined.) The Principal Planner reported that Council action on Planning Commission Policies 211, 211A, 231, and 231A negates the need for Steering Committee Policy 211B. The motion failed to carry 3-2, Council Members Buffa, Amburgey, and Glasgow voting no. 330 h 1 MOTION ;A motion was made by Council Member Glasgow, seconded by Policy 216A Council Member Amburgey, to delete Steering Committee Deleted 'Policy 216A. The motion carried 3-2, Council Members Hornbuckle and Genis voting no. The Principal Planner referenced two new policies recom- mended by Council Member Genis, to be placed under Coal SIX, Preserve Affordability: Policy 216C: "Recognizing the effect of supply and demand on prices for housing and other commodities, maximize the amount of existing vacant land to be designated for residential use". Policy 216D: "Pursue the adoption of housing linkage fees for commercial development". Motion to Adopt A motion was made by Vice Mayor Hornbuckle, seconded by Amended Policy Council Member Genis, to adopt amended Policy 216C: 216C Failed to "Consider redesignating existing vacant land to resi- Carry :dential zoning". The motion failed to carry 3-2, Council Members Buffa, Amburgey, and Glasgow voting no. MOTION A motion was made by Council Member Genis, seconded by Amended Policy Mayor Buffa, to adopt amended Policy 216C: "Recognizing 216C Adopted the effect of supply and demand on prices for housing and other commodities, encourage development of resi- dential uses on vacant parcels". The motion carried 3-2, Council Members Amburgey and Glasgow voting no. Motion to Adopt A motion was made by Council Member Genis, seconded by Alternative Vice Mayor Hornbuckle, to adopt alternative Policy 216D: Policy 216D "Investigate the feasibility of housing linkage fees for Failed to Carry commercial development". The motion failed to carry 3-2, Council Members Buffa, Amburgey, and Glasgow voting no. The Principal Planner referred to staff's memoramdum of January 25 which recommends deletion of Program IX -D, Accessory Apartments, since Council adopted Steering Committee Policy 216B, supporting legislation to delete the accessory housing provision in State law. MOTION/Program On motion by Council Member Genis, seconded by Mayor IX -D Deleted Buffa, and carried 5-0, Program IX -D was deleted. The Principal Planner reported that Policies 218 and 219 are somewhat similar to adopted Policy 176A: "Locate high intensity developments or high traffic generating uses away from low density residential in order to buffer the more sensitive land uses from the potentially adverse impacts of the more intense development of uses". He suggested that in keeping with the intent of Policy 176A, Policies 218 and 219 should be reworded/ consolidated as recommended by staff in the January 25 memorandum, and numbered 218. MOTION On motion by Vice Mayor Hornbuckle, seconded by Council Policy 218 Member Genis, and carried 5-0, staff's recommendation Adopted for Policy 218 was adopted: "Ensure that residential densities can be supported by the infrastructure and that high density residential areas are not permitted in areas which cause incompatibility with existing single- family areas". The Principal Planner recommended that Steering Commit- tee Policy 219A and Policy 220 be considered separately. He stated that the major difference is that Policy 219A limits when conversion of existing commercial and 331 industrial land will be encouraged; and Policy 220 is limited to vacant and marginal land. Motion to Adopt A motion was made by Council Member Genis to adopt Amended Policy amended Steering Committee Policy 219A: "Encourage the 219A Died for conversion of existing commercial and/or industrial land Lack of a Second to low or medium density residential, where feasible, and consistent with noise levels, air quality, open space or other environmental conditions, and infra- structure suitable for new residential development". (Addition is underlined.) The motion died for lack of a second. Motion to Adopt A motion was made by Council Member Genis, seconded by Amended Policy Vice Mayor Hornbuckle, to adopt amended Policy 220: 220 Failed to "Encourage the conversion of existing (deleted 'marginal Carry or vacant') commercial and/or industrial land to resi- dential, where feasible and -consistent with environ- mental conditions suitable for new residential develop- ment. This does not preclude the initiation of such actions by the City". The motion failed to carry 3-2, Council Members Buffa, Amburgey, and Glasgow voting no. MOTION A motion was made by Council Member Amburgey, seconded Policy 220 by Council Member Glasgow, to adopt Policy 220 as pro - Adopted posed. The motion carried 4-1, Mayor Buffa voting no. The Principal Planner reported on information contained in staff's January 25 memorandum regarding Policy 230 and Program XI -A, not considered by Council until staff could confirm the City's association with the Fair Housing Council of Orange County. He stated that the Fair Housing Council is allocated a portion of the City's CDBG budget. The Principal Planner suggested that Program XI -A be corrected to read: "Program/ Action Description: Obtain services from (deleted 'Provision of grant to') the Fair Housing Council of Orange County". During discussion, Council indicated that an alternate agency providing the same services should be added. MOTION A motion was made by Council Member Amburgey, seconded Amended Program by Council Member Genis, to adopt an amended version XI -A Adopted of staff's aforementioned "Program/Action Description" for Program XI A: "Obtain services from the Fair Hous- ing Council of Orange County or similar agencies". (Addition is underlined.) The motion carried 5-0. Vice Mayor Hornbuckle suggested that based on the motion just made, the title of Program XI A, Fair Housing Council of Orange County, should be changed, and Policy 230 amended to reflect "or similar agencies". Staff was requested to recommend a new title for Program XI A. MOTION On motion by Council Member Genis, seconded by Council Amended Policy Member Amburgey, and carried 5-0, amended Policy 230 230 Adopted was adopted: "Continue to support (deleted 'the Fair Housing Council of Orange County and') efforts to protect equal housing opportunities". Mayor Buffa invited public comment on Goal XII, Housing Opportunities, and Policies 232 through 235A. Mark Korando, speaking as a citizen and not as a member of the Steering Committee, urged Council to adopt Plan- ning Commission Policy 235A. 332 Scott Williams, Steering Committee member, referred to the Steering Committee's "Report and Recommendations" dated October 10,1989, and read Page 48, Section IV, .Steering Committee Comments and Recommendations Regard- ing Housing. Dick Sherrick felt that Steering Committee members should be allowed more time to speak. ,Frank Cole, 2482 Fairview Way, Costa Mesa, stated that ;providing adequate housing is a Countywide problem. Motion Made to ;A motion was made by Council Member Amburgey, seconded Adopt Goal XII ;by Council Member Glasgow, to adopt Goal XII as pro- posed. SUBSTITUTE MOTION Amended Coal XII Adopted MOTION Policies 232, 233, 234, and 235 Adopted A substitute motion was made by Mayor Buffa, seconded by Council Member Genis, to adopt amended Coal XII: "'It is the goal of the City of Costa Mesa to provide and 'maintain an adequate range of housing accommodations which serve all social and economic segments of the icommunity and provide a reasonable range of choice in 'terms of unit, type, design, size, price, location, and tenure, with particular emphasis and encouragement of low density owner -occupied residences". (Addition is ,On motion by Council Member Amburgey, seconded by Vice Mayor Hornbuckle, and carried 5-0, the following Poli- cies were adopted: Policy 232: "Investigate all reasonable and fiscally prudent means to provide opportunities for all seg- ments of the City's population to obtain a decent home in a suitable living environment within all areas of Costa Mesa". Policy 233: "Encourage and support construction of residential developments which will meet the needs of families and individuals with specialized housing requirements". Policy 234: "Establish a residential development monitoring program to assess the changes in Costa Mesa's housing stock over time and to evaluate the effectiveness of the City's housing program". Policy 235: "Encourage additional specialized ameni- ties in excess of minimum State requirements to improve accessibility to and within projects with handicap units". MOTION 'A motion was made by Council Member Genis, seconded by Policy 235A Mayor Buffa, to adopt Planning Commission Policy 235A: Adopted "Review existing neighborhoods which are zoned R2 but developed largely with single-family residences and redesignate these areas as Low Density Residential to encourage preservation of owner -occupied dwelling units". Council Member Amburgey suggested that this may be a policy which should be a zoning action. Council Member Glasgow stated that he could support the motion if the policy were reworded to include,. "investigate the feasibility". He mentioned that this policy would not be appropriate for those R2 -zoned, long, narrow lots on the west side, some of which have only a single-family residence. 133 Mark.Korando, Steering Committee member, suggested the possibility of designating the long, narrow lots on the west side as Planned Development Residential - Low Density (PDR -LD). The motion to adopt Policy 235A carried 3-2, Council Members Amburgey and Glasgow voting no. Mayor Buffa invited public comment on Program XII A, Bond Financing for Rental Housing. Scott Williams, Steering Committee member, contended that three large developments.which obtained bond financing do not have subsidized units available. The City Manager commented that bond -financed develop- ments are monitored by Orange County staff. Motion to Adopt Program XII -A Died A motion was made by Vice Mayor Hornbuckle to adopt for Lack of a Program XII -A. The motion died for lack of a second. Second A motion was made by Mayor Buffa, seconded by Council MOTION Member. Genis, to delete Program XII -A. `Ihe motion Program XII -A carried 3-2, Council Members Hornbuckle and Glasgow Deleted voting no. MOTION A motion was made by Council Member Genis, seconded by Program XII -B Vice Mayor Hornbuckle, to adopt Program XII -B, Condo - Adopted minium Conversions. The motion carried 3-2, Council Members Buffa and Glasgow voting no. MOTION On motion by Vice Mayor Hornbuckle, seconded by Council Program XII -D Member Genis, and carried 5-0, Program XII -D, Housing Adopted Program Evaluation,,was adopted. MOTION On motion by Council Member Genis, seconded by Council Program XII -E Member Glasgow, and carried 5-0, Program XII -E, Deleted Apartment/Condominium Agreements, was deleted. Mayor Buffa invited public comment on Goal XIII, Coor- dination and Cooperation, and Policies 236 through 238. Mark Korando, speaking as a citizen and not as a member of the Steering Committee, hoped that if a cooperative program were developed with surrounding cities, that the housing burden would not be shifted to the South County because of the severe traffic impact it would cause. Jan Luymes, 592 Park Drive, Costa Mesa, suggested that the City attempt to convince the State to be more realistic about the housing units cities are required to provide. She also spoke about providing housing for the homeless. MOTION On motion by Vice Mayor Hornbuckle, seconded by Council Goal XIII Member Genis, and carried 5-0, Coal XIII was adopted: Adopted "It is the goal of the City of Costa Mesa to coordinate local housing efforts with appropriate federal, state, regional, and local governments and/or agencies and to cooperate in the implementation of intergoverrmlental housing programs to ensure maximum effectiveness in solving local and regional housing problems". MOTION On motion by Vice Mayor Hornbuckle, seconded by Council Policy,236 Member Amburgey, and carried 5-0, Policy 236 was adopted: Adopted "Investigate alternative intergovernmental arrangements and program. options to deal with areawide housing issues and problems". 334 MOTION On motion by Council Member Genis, seconded by Council Amended Policy Member Amburgey, and carried 5-0, amended Planning 237 Adopted Commission Policy 237 was adopted: "Develop a coopera- tive program with surrounding cities to work towards a (deleted 'to') balance of housing and employment oppor- tunities within the region". (Additions are under 'lined.) Mayor Buffa read new Policy 238 contained in staff's January 25 memorandum, which addresses a recommendation made by Council Member Genis. MOTION A motion was made by Council Member Genis, seconded by Amended Policy ;Vice Mayor Hornbuckle, to adopt amended Policy 238: 238 Adopted "Consider pooling a portion of the City's Community Development Block Grant funds with surrounding juris- dictions to produce affordable housing". (Addition is underlined.) The motion carried 3-2, Council Members Amburgey and Glasgow voting no. AMENDED MOTION After brief discussion, Mayor Buffa made a motion to Second Amended adopt second amended Policy 238: Same wording as in Policy 238 the previous paragraph, but adding to the end of the Adopted .policy, "including the single -room occupancy concept". The motion was seconded by Vice Mayor Hornbuckle, and carried 3-2, Council Members Amburgey and Glasgow voting no. MOTION On motion by Vice Mayor Hornbuckle, seconded by Council Program XIII -A Member Amburgey, and carried 5-0, Program XIII -A, Review Adopted of Housing Elements, was adopted. MOTION On motion by Vice Mayor Hornbuckle, seconded by Council Program XIII -B 'Member Amburgey, and carried 5-0, Program XIII -B, Adopted Cooperative Housing'Programs, was adopted. MOTION i On motion by Council Member Genis, seconded by Vice Program XIII -C Mayor Hornbuckle, and carried 5-0, Program XIII -C, Adopted Fairview Hospital Housing Project, was adopted. (Proposed goals, objectives, and policies have now been completed.) Frank Cole Mayor Buffa commended Frank Cole on his recent appoint- Ccmmended ment as a Director on the Costa Mesa Sanitary District board. ADJOURNMENT TO At 8:25 p.m., the Mayor adjourned the meeting to a CLOSED SESSION closed session in the first floor Conference Room, pursuant to Government Code Section 54956.9(a), to SOS discuss Orange County Municipal Court Case No. 103812, City of Costa Mesa v. Share Our Selves. MEETING RECONVENED Council Member Mayor Buffa reconvened the meeting at 9:10 p.m., and Glasgow Left Council Member Glasgow left at this time. Irvine Business The City Manager summarized his memorandum dated January Complex 25, 1990, regarding the Irvine Business Complex Urban Village proposal. He pointed out that because of the scope of the project and the potential for significant impacts on Costa Mesa, staff will continue to monitor the project and report back to Council as more informa- tion or reports are available. COUNCIL MEMBERS Council Member Genis recommended sending public hearing COMMENTS notices to occupants as well as property owners, and suggested utilizing the post office address list. She Public Hearing noted the absence of renter representation at the Notices General Plan meetings. The City Manager stated that this item will be scheduled for a future Study Session. Citizen Council Member Genis stated that in light of a recent Committees Supreme Court decision, she was concerned about appoint- ing only homeowner and business community representa- tives to the General Plan Steering Committee, and excluding the renting community. Vice Mayor Hornbuckle was concerned because the Steer- ing Committee does not include renter representation. She requested a report from the City Attorney on the recent court decision. The City Manager stated that solicitation for this City's citizen committees is done through press releases and whether an applicant owns or rents property is not an issue.
