ROLL CALL
ADJOURNED SPECIAL MEETING OF THE CITY COUNCIL
CITY OF COSTA MESA
DECEMBER 11, 1991
The City Council of the City of Costa Mesa, California,
met in adjourned special session December 11, 1991, at
8:15 p.m., in the Council Chambers of City Hall, 77 Fair
Drive, Costa Mesa. The meeting was duly and regularly
ordered adjourned from the adjourned special meeting of
November 20, 1991. The meeting was called to order by
the Mayor, followed by the Pledge of Allegiance to the
Flag.

MINUTES On motion by Council Member Buffa, seconded by Council
November 20, 1991 Member Humphrey, and carried 5-0, the minutes of the
adjourned special meeting of November 20, 1991, were
approved as distributed.
ORAL Alan Remington, 1164 Boise Way, Costa Mesa, thanked the
COMMUNICATIONS Council and City Manager for reserving the Neighborhood
Community Center for the two General Plan meetings on
Location of January 8 and 29, 1992. The City Manager confirmed that
General Plan both evenings have been reserved, and asked whether
Meetings Council wished to have both meetings held at the Center.
He reported that at this time, he could not confirm that
live television coverage could be provided from the
Center; however, the meetings could be cablecast on a
tape delay basis.
Meeting with Mr. Remington inquired about the Mayor's meeting with
Supervisor Wieder Supervisor Wieder. Mayor Hornbuckle responded that
the meeting has been rescheduled for mid-January, 1992.
19th Street Brief discussion ensued regarding the Newport Beach City
Bridge Council's concern over Costa Mesa's interest in removing
the.19th Street Bridge from the Master Plan of Highways.
PUBLIC HEARING The City Clerk announced that this was the time and
1990 General Plan place set for the public hearing to consider the 1990
General Plan relating to the Community Development/
Management Element which consists of Coastal Resources,
Housing, Public Facilities and Services, and Waste
Management Subelements; Transportation Subelement; and
Land Use Element. Mayor Hornbuckle announced that the
Transportation Subelement and Land Use Element will be
discussed at the meetings in January, 1992.
The Senior Planner referred to the Agenda Report dated
December 2, 1991, which includes a proposed Hydrology
Subelement Policy recommended by Vice Mayor Genis at the
last General Plan meeting relating to project -generated
storm water runoff. She read the wording suggested by
staff for such a policy: "Require new developments to
provide 100 -year flood protection within the project
site and to prevent increased peak flow runoff to down-
stream properties or drainage facilities by retaining
on site the increased storm runoff caused by the project
until the peak storm flow has passed". The Agenda
Report indicates that this language is similar to that
language found in the City's Measure "G" which was
approved by the voters but subsequently overturned in
the courts. The Senior Planner commented that a policy
requiring 100 -year flood protection would cause private
property development to have a standard in excess of the
City's Master Plan of Drainage which only requires
accommodation for a 10 -year storm.
There were no public comments on the proposed Hydrology
Subelement Policy.
New Hydrology Council Member Buffa contended that until the Santa Ana
Subelement Policy River Project is completed, 100 -year flood protection

January 8, 1992 not this issue was addressed by the court. Because the
City Attorney has been unsuccessful in obtaining all'
court documents relating to this issue, Council agreed
to continue this item to the General Plan meeting of
January 8, 1992. Vice Mayor Genis commented that it
would be unfair to owners of downstream properties to
sustain flood damage resulting from another's project.
ANNOUNCEMENT
Straw Vote Mayor Hornbuckle announced that Council's actions will

Coastal Resources The Senior Planner summarized the data on the Coastal
Subelement Resources Subelement contained in the aforementioned
Agenda Report: This subelement addresses land use
options for that portion of the City located within the
Coastal Zone; and options include a regional park, wild
life preserve, and restored wetland. She reported that
the policies for this Subelement can be found on Page
429 of the General Plan.
Responding to Vice Mayor Genis's request for clarifica-
tion of the maps on Pages 178 and 181, the Senior
Planner reported that the map on Page 178 identifies
proposed development of the County's Talbert and
Fairview Regional Parks, and the City's Canyon Park;
otherwise, it merely identifies ownership and public
land uses. In reference to the General Plan/Zoning map
on Page 181, the Senior Planner stated it reflects the
current General Plan and would be changed in accordance
with changes made during the General Plan process. Vice
Mayor Genis suggested clarifying the title of the map on
Page 178.
There were no public comments on the Coastal Resources
Subelement.
MOTION/Approved A motion was made by Vice Mayor Genis, seconded by
Objective I -F, and Council Member Humphrey, and carried 5-0, to approve
Policies 43 through Coastal Resources Objective I -F and Policies 43 through
53 53 (Page 429).
Housing Subelement The Senior Planner reported that the Housing Subelement
is designed to meet the Housing Element requirements of
State law, and as such, has more detail than some of the
other subelements in the General Plan. She explained
that in addition to Goals, Objectives, and Policies, it
also has a program section. The Senior Planner referred

to the Planning Commission actions, attached to the
Agenda Report dated December 2, 1991, specifically
noting the Commission's recommended modifications for
Policies 268 and 269. She also indicated that the text
and data would be revised similar to the draft CHAS
which is undergoing Council review.
Vice Mayor Genis commented that a statement on Page 199
of the General Plan, "Likewise, EDD reports that Costa
Mesa's resident labor force still outnumbers the jobs
in the City", is in direct conflict with the jobs to
housing ratio contained in the Environmental Impact
Report (EIR). The Mayor directed staff to make sure
this data is reconciled prior to Council's final action
on the EIR and General Plan.
Council Member Humphrey proposed the following changes:
On Page 235 of the General Plan, amend Policy 254 to
read, "Protect existing stabilized residential neigh-
borhoods, including but not limited to mobile home
uses and/or activities";
On Page 238, amend the title
"Mobile Home Rehabilitation
Preservation."
of Goal VIII -E to read,
and Mobile Home Park
Amend the Program/Action Description of Goal VIII -E to
read, "Provide financial assistance to eligible owner -
occupants to rehabilitate existing dwelling units
through deferred payment low-interest homes. Amend
existing ordinances to require that a conditional use
permit be obtained as a prerequisite to the conversion
of an existing mobile home park or manufactured hous-
ing park. The conditions to the conditional use
permit shsll include a provision for reasonable
relocation assistance where the park is converted to
a commercial or industrial use."
Council Member Erickson referred to Policy 268 (Page
239) as modified by the Planning Commission: add "or
for affordable senior citizen projects" to the last
sentence of the policy. He recommended an additional
change to the last sentence: "Density bonus units may
(delete 'will') be provided ."
Responding to Council Member Erickson's inquiry on the
Comprehensive Housing Affordability Strategy (CHAS), the
Senior Planner responded that a great deal of the CHAS
had come directly from the Housing Subelement, and she
has been working with the Redevelopment Agency staff to
incorporate changes recommended by Council at their
Study Session. Council Member Erickson agreed with the
modification to Policy 269 as recommended by the Plan-
ning Commission: "Consider (delete "Provide") financial
incentives in lieu of density bonus units if the
proposed affordable, nonsenior density exceeds that
allowed ."
Vice Mayor Genis referred to Policy 261 (Page 235) and
recommended that it be modified to read, "Encourage the
replacement of existing substandard or deteriorated
dwelling -units which cannot be economically or physi-
cally rehabilitated consistent with the then existing.
Zoning Code and General Plan". She stated that she
would be agreeable to having staff reword the policy to
indicate that the replacement shall be consistent with
the zoning and General Plan in effect at the time the
work is done.
There were no public comments on the Housing Subelement.
MOTION Council Member Humphrey made a motion to approve the
Approved Housing Housing Subelement with the following modifications:
Subelement with Amend Policy 254 and Goal VIII -E as stated by Council
Modifications Member Humphrey (also contained in the City Attorney's
memorandum dated December 10, 1991); Amend Policy 261
per Vice Mayor Genis's recommendation; Amend Policy 268
as recommended by the Planning Commission and Council
Member Erickson; and Amend Policy 269 as recommended by
the Planning Commission. The motion was seconded by
Council Member Erickson, and carried 5-0.
MOTION A motion was made by Council Member Humphrey, seconded

Public Facilities The Senior Planner -summarized the Public Facilities and

She called attention to the changes recommended by the
Planning Commission for Policies 38 and 152.
There were no public comments on the Public Facilities
and Services Subelement.
MOTION A motion was made by Council Member Buffa, seconded by

FIRST AMENDMENT TO At the request of Vice Mayor Genis, Council Member Buffa
MOTION/Added a amended the motion by modifying Policy 245: "Include
Modification to an evaluation of impacts on utility systems and infra -
Policy 245 structure in EIRs for all major General Plan amendment,
rezone, and development applications". The amended
motion was seconded by Council Member Humphrey.
Council Member Erickson mentioned the possible need for
more bilingual police officers, and asked if it would be
appropriate to be more specific in the personnel poli-
cies of the General Plan to provide more Vietnamese- and
Spanish-speaking officers. After brief discussion, the
Mayor recommended that Council Member Erickson and the
City Manager discuss the bilingual issue and provide
wording for a goal or policy by the next General Plan
meeting scheduled for January 8, 1992.
SECOND AMENDMENT TO After discussion on Policy 150 (Page 275) regarding a
MOTION/Modified comprehensive needs assessment, Council Member Buffa
Policy 150 made a second amendment to the motion by modifying

Policy 150 to read, "Continue to assess needs (delete
'Conduct a comprehensive needs') to determine the type
and level of social services required by Costa Mesa
residents, to inventory existing programs and services,
and to identify service gaps, overlap, and duplication".
The amended motion was seconded by Council Member
Humphrey, and carried 5-0.
Waste Management The Senior Planner referred to Page 3 of the Agenda
Subelement Report which addresses the Waste Management Subelement.
She reported that goals, objectives, and policies for
this subelement are contained on Pages 300 and 301 of
the General Plan.
There were no public comments on the Waste Management
Subelement.
MOTION/Approved On motion by Council Member Buffa, seconded by Council
Waste Management Member Humphrey, and carried 5-0, the Waste Management
Subelement Subelement was approved.
Hearing Dates for Considerable discussion ensued on whether or not the
Transportation and Land Use Element should be heard before the Transporta-
Land Use tion Subelement as requested by Mrs. Remington, 1164
Boise Way, Costa Mesa.
Mark Korando, 582 Park Drive, Costa Mesa, suggested
receiving public input for both items at both meetings
in January, 1992, and having Council take straw votes
on both issues at the last meeting in January.
Vice Mayor Genis suggested that for the next two meet-
ings (January 8 and 29, 1992), public input should be
accepted on both the Transportation Subelement and Land
Use Element.
In response to Mayor Hornbuckle's question on whether
it would be possible to provide live cable coverage from
the Neighborhood Community Center, the City Manager
stated that he would have an answer at the next regular
Council meeting scheduled for December 16, 1991.
COUNCIL MEMBERS Council Member Buffa announced that December 15, 1991,
COMMENTS is the 200th anniversary of the Bill of Rights.
ADJOURNMENT At 9:25 p.m., the Mayor adjourned the meeting to the
regular City Council meeting of December 16, 1991, at
6:30 p.m., to decide on the location of the next two
General Plan meetings scheduled for January 8, 1992, and
January 29, 1992.
