HomeMy WebLinkAbout09/19/1994 - City CouncilROLL CALL MINUTES September 6, 1994 ORDINANCES AND RESOLUTIONS ORAL COMMUNI- CATIONS/Traffic Signal Timing Someone Cares Soup Kitchen REGULAR MEETING OF THE CITY COUNCIL CITY OF COSTA MESA SEPTEMBER 19, 1994 The City Council of the City of Costa Mesa, California, met in regular session September 19, 1994, at 6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa. The meeting was called to order by the Mayor, followed by the Pledge of Allegiance to the Flag, and invocation by the Reverend Doyle Henderson, Costa Mesa Church of the Nazarene. Council Members Present: Mayor Sandra Genis Vice --Mayor Jay Humphrey Council Member Mary Hornbuckle Council Member Peter Buffa Council =Member Joe Erickson Council Members Absent. None - Officials Present: City Manager Allan Roeder City Attorney Thomas Kathe Deputy City Manager/Development Services Donald Lamm Public Services Director William Morris Assistant to the City Manager Ann Gyben Administrative Assistant Paula Schaefer Deputy City Clerk Mary Elliott On motion by Council Member Buffa, seconded by Council Member Erickson, and carried 4-0, Mayor Genis abstaining, the minutes of the regular meeting of September 6, 1994, were approved as distributed. A motion was made by Council Member Buffa, seconded by Council Member Erickson, and carried 5-0, to read all ordinances and resolutions by title only. Sid Soffer, 900 Arbor Street, Costa Mesa, acknowledged receipt of a letter from staff which reported that three of the City's traffic signal timing devices had been defective. He commented on traffic signal problems at the intersections of Pomona Avenue and Industrial Way, and Balboa Boulevard and Pacific Coast Highway (in the City of Newport Beach) . Dorothy Adams, 220 Amherst Road, Costa Mesa, owner of property at 412 Ford Road, Costa Mesa, complained about the Someone Cares Soup Kitchen located near her rental property, indicating that 300 persons from various cities are served there each day, sleep in the neighborhood, and often commit burglaries. She suggested monitoring this operation. The City Manager responded that he met with representatives of the soup kitchen, other similar organizations, and homeless individuals, and a report would be forthcoming by the end of the week highlighting the discussions and some of the pertinent ideas. Council Member Buffa asked for guidance on the problems regarding persons sleeping in public places. 1 Proposition 187 Jean Forbath, 2880 Club House Road, Costa Mesa, addressed Proposition 187 which concerns illegal aliens and will be on the November, 1994, ballot, stating that it would affect the operation of the City by taking away a certain amount of local control. She asked Council to consider taking a stand on this issue. Council Member Hornbuckle asked the City Manager to prepare a report on how this proposition could affect the City, and to include any relevant action taken by the California League of Cities Board of Directors. PRESENTATION Harriett Wieder, Second District, Orange County Board of Super - SOY Donation visors, presented a check in the amount of $5,000.00 to Oscar Santoya, who accepted on behalf of Save Our Youth (SOY). CONSENT On motion by Council Member Hornbuckle, seconded by Vice CALENDAR Mayor Humphrey, and carried 5-0, all Consent Calendar items were MOTION/Approved approved as recommended. r READING FOLDER The following Reading Folder items were received and processed: Claims Claims received by the Deputy City Clerk: Jodi L. Heller; Peter Jensen, doing business as NIMMO Security Service; Cassandra Randall; Alfred Young, Kathleen Barnhart, and Patricia Golden; Kathleen Richey; and John Hoan Truong. Alcoholic Beverage Alcoholic Beverage Licenses for which parking has been approved Licenses by the Planning Staff: Hilario S. and Mirna A. Burciaga, doing business at 3013 Harbor Boulevard. WARRANTS Warrant Resolution 1580, funding City operating expenses in the Approved Warrant amount of $801,729.27; and Payroll 9417 for $1,260,091.23, were 1580; Payroll 9417 approved. REJECTED CLAIMS The following claims were rejected: Low Reno Low (vehicle towed). Mercury Insurance Mercury Insurance Company subrogee for Randy and Sheila Hale (vehicle damaged in collision with police unit). Daruwala-Rutledge Tehnaz Daruwala-Rutledge (vehicle damaged in collision with street sweeper). Mercury Insurance Mercury Insurance Company subrogee for Tehnaz Daruwala- Rutledge (vehicle damaged in collision with street sweeper). Bukaty Application for Leave to Present a Late Claim from Daniel P. Bukaty (billed for damage to police unit). ADMINISTRATIVE ACTIONS/Approved Budget Adjustment No. 95-03 for $216,180.00, from Community Adjustment 95-03 Facilities District 91-1 Fund to the CENTROCCS Fund, for the for Bristol/I-405 Bristol Street/I-405 interchange improvement. project, was approved. Approved Adjustment Budget Adjustment No. 95-07 for $125,000.00, to construct bus 95-07 for Bus turnouts on Harbor Boulevard at Fair Drive and Harbor Center, and Turnouts on Fair Drive at Fairview Road, was approved. Accepted Work by Carpet Replacement at City Hall, 77 Fair Drive, Project No. 94-04, Monroe Schneider was completed to the satisfaction of the Public Services Director on for Carpet Replace- August 29, 1994, by Monroe Schneider Associates, Inc., 1172 ment at City Hall, Armando Street, Anaheim. The work was accepted; the Deputy Project No. 94-04 City Clerk was authorized to file a Notice of Completion; 101 1402 Adopted Resolution 94-85, DUI Fee Urban Rail Study Approved Agreement with Boyle for Detailed Local Study Approved Agreement with Segerstrom & Sakioka to Define Terms and Funding Approved Budget Adjustment 95-11. to Appropriate Revenue ADJOURNMENT TO JOINT CITY COUNCIL/ REDEVELOPMENT AGENCY MEETING ROLL CALL PUBLIC HEARING 1994 HOME Project authorization was given to release retention funds 35 days thereafter; the Labor and Material Bond was ordered exonerated 7 months thereafter; and the Performance Bond was ordered exonerated 12 months thereafter. Resolution No. 94-85, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ESTABLISH- ING AND ADOPTING SCHEDULES OF RATES, FEES AND CHARGES FOR SERVICES PROVIDED BY THE POLICE AND FIRE DEPARTMENTS OF THE CITY OF COSTA MESA, changing the fee for Driving Under the Influence (DUI) from $1,000.00 per DUI accident to $500.00 for police DUI response and $500.00 for fire DUI response, was adopted. The following action was taken for the Central Orange County Urban Rail Local Study: A Professional Services Agreement with Boyle Engineering Corporation, 1501 Quail Street, Newport Beach, for $29,860.00, to provide a detailed local study, was approved. An agreement with C. J. Segerstrom & Sons, 3315 Fairview Road, Costa Mesa, and Sakioka Farms, 14850 Sunflower Avenue, Santa Ana, to define the terms and funding responsibilities for the Professional Services Agreement, was approved. Budget Adjustment No. 95-11 for $19,905.00, to reflect new revenue from participating developers, and to appropriate this revenue to fund the agreement, was approved. Mayor Genis adjourned the City Council meeting to a joint meeting of the City Council and Redevelopment Agency. Notice of the special meeting was given as required by law. Agency Member Present: Chairman Peter Buffa Vice Chairman Jay Humphrey Agency Member Mary Hornbuckle Agency Member Sandra Genis Agency Member Joe Erickson Agency Members Absent: None Officials Present: Executive Director Allan Roeder The Deputy City Clerk announced that this was the time and place set for the joint City Council/Redevelopment Agency public hearing to consider an Exclusive Negotiating Agreement with Civic Center Barrio Housing Corporation as developer for the 1994 HOME Project; and a list of qualified developers to be used for housing projects in 1995. The Affidavit of Publication is on file in the City Clerk's office. One communication was received from Frank De Santis, Partnership Housing Corporation of Orange County, 3337 South Bristol Street, No. 149, Santa Ana, stating that based on previous experience, this company would be the best organization to provide affordable housing. MOTION On motion by Council Member Buffa, seconded by Vice Mayor Continued to Humphrey, and carried 5-0, the public hearing was continued to the October 3, 1994 meeting of October 3, 1994. 1 OLD BUSINESS The Deputy City Clerk presented staffs recommendation to award CDBG Award $10,000.00 in Community Development Block Grant (CDBG) funds to nonprofit organizations for facilities improvements pursuant to recommendations of the Redevelopment and Residential Rehabilitation (3R) Committee. The Administrative Assistant reviewed the Agenda Report dated September 7, 1994. Council Member Hornbuckle noted that she was no longer on the Board of Directors of Girls, Inc. Council Member Hornbuckle stated that she would like to review the six proposals before voting on this issue. Mayor Genis requested information on similar types of grants given to other organizations over the past several years. MOTION/Continued On motion by Council Member Hornbuckle, seconded by Vice to October 3, 1994 Mayor Humphrey, and carried 5-0, this item was continued to the meeting of October.,3; 1994. CITY COUNCIL MEETING The Joint City Council/Redevelopment Agency meeting was RECONVENED adjourned, and Mayor Genis reconvened the City Council meeting. OLD BUSINESS The Deputy City Clerk presented a resolution adopting Cable Television administrative procedures to regulate cable television services and Regulation equipment rates (Council Policy No. 600-1). The City Attorney summarized his report No. 94-66. dated August 19, 1994, and pointed out an amendment to Section 5. 1, line 6, recommended by the Mayor: "(iii) or by means of prospective percentage reduction in the rates for the basic service tier or associated equipment for subscribers that remain in the service area." MOTION On motion by Vice Mayor Humphrey, seconded by Council Member Resolution 94-86 Hornbuckle, and carried 5-0, Resolution 94-86, A RESOLUTION Adopted OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADOPTING ADMINISTRATIVE PROCEDURES TO REGULATE CABLE TELEVISION SERVICES AND EQUIPMENT RATES, incorporating the amendment as noted by the City Attorney, was adopted. NEW BUSINESS The Deputy City Clerk presented a request from Costa. Mesa High MESA 5000 School for partial closure of South Coast Drive; Hyland, Sunflower, Run/Walk Cadillac, and Scenic Avenues; and Harbor Gateway South, for the MESA 5000 5K Run/Walk. The Assistant to the City Manager reviewed the Agenda Report dated September 1, 1994. Council Member Erickson commented that the event was successful last year, and will be held November 12, 1994 in the morning. MOTION On motion by Council Member Buffa, seconded by Vice Mayor Request Approved Humphrey, and carried 5-0, the request was approved. NEW BUSINESS The Deputy City Clerk presented- a resolution consenting to and Downtown Redeve- calling for a joint Redevelopment Agency/City Council public lopment Project hearing on proposed Amendment No. 3 to the Redevelopment Plan Hearing for the Costa Mesa Downtown Redevelopment Project. The Assistant to the City Manager summarized the Agenda Report dated September 6, 1994. MOTION On motion by Vice Mayor Humphrey, seconded by Council Member Resolution 94-87 Hornbuckle, and carried 5-0, Resolution 94-87, A RESOLUTION Adopted OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CONSENTING TO AND CALLING FOR A 'JOINT PUBLIC HEARING ON THE PROPOSED AMENDMENT NO. 3 TO THE REDEVELOPMENT PLAN FOR THE COSTA MESA DOWNTOWN REDEVELOPMENT PROJECT, was Soffer Comments Sid Soffer, 900 Arbor Street, Costa Mesa, reported -on a flyer he had received from Roy Alvarado, who is associated with Gangs for Peace, announcing a get-together to be held Saturday, October 1 1994, 12:00 p.m. to 5:00 p.m., in Lions Park, to support the fight against gang violence. COUNCIL COMMENTS Mesa Pride Awards Fairview Park - Model Engineers Police Department Voice Mail Proposition 187 Race for the Cure motels) �ouncil Member Erickson stated that he had attended the Mesa 'ride awards last week and was encouraged to see people investing ime and money to improve their homes, blocks, and residential ncome properties. He reported on the model engineers activities at yairview Park the previous weekend, stating that there were many �osta Mesa residents in attendance who were having a good time. Council Member Hornbuckle also commented favorably on the model engineers, and, announced that on the third weekend of every month train rides are provided. She expressed concern about the voice mail system at the Police Department. Mayor Genis stated for those who are interested in Proposition 187, the Libertarian Party is sponsoring a forum on September 20, 1994, and suggested calling either the Party or The Orange County Register for more detailed information. She also announced that on Sunday, September 25, 1994, the Race for the Cure will be held at Newport Center, from 7:00 a.m. to 11:00 a.m. The Mayor declared the meeting adjourned at 7:20 p.m. 0 Mayor of the City of Costa Mesa ATTEST.
