The meeting was called to order by the Mayor, followed by the Pledge of Allegiance to the Flag, and invocation by Warren Barnhill, The Church of Jesus Christ of Latter -Day Saints. ORDINANCES AND A motion was made by Council Member Hornbuckle, seconded by RESOLUTIONS Mayor Pro Tem Buffa, and carried 5-0, to read all ordinances and resolutions by title only. PRESENTATION Marleen Wright, 334 Tours Lane, Costa Mesa, representing the Newport -Mesa Newport -Mesa Alternative Education Center, 390 Monte Vista Alternative Avenue, Costa Mesa, reported that the Center is comprised of three Education Center schools: High Five High School, Back Bay High School, and Monte Report Vista High School. She explained that a student must demonstrate the need for independent study in order to attend, and detailed how the school operates. She reported on the following classes and activities: the school newspaper; a yearbook which is currently being compiled; community service which may be accomplished for elective credit; drama classes; and an art class which includes pottery, drawing, and painting. Ms. Wright announced a student production entitled "Stage Show '95" to be held on Saturday, April 29, 1995, at 6:00 p.m.; and the all-night graduation party will be held at Disneyland on June 14, 1995. ANNOUNCEMENT Mayor Erickson announced that Old Business Item Nos. 1 and 2, the aggressive panhandling ordinances, will be continued for two weeks. •(MPJ {`1 ... .. a'p ORAL COMMUNI- Steve Pep, 2079 State Street, Costa Mesa, representing Leaves of CATIONS Grass Property Maintenance and Landscaping, asked to be placed on Land scape/Mainte- the City's bidder's list. The City Manager suggested that Mr. Pep nance Services leave his business card with the Director of Community Services, who will respond to this request. Town Hall Meeting Dorothy Adams, 220 Amherst Road, Costa Mesa, reported that she had attended the Town Hall meeting on Wednesday, March 1, 1995, regarding the homeless, and complained that Costa Mesa was the only City in this area with a soup kitchen. Mayor Erickson explained that the Human Relations Committee, sponsor of the event, will review the significant issues, and prepare a report for Council. Council Member Genis expressed concern that the County of Orange would not be coordinating the homeless program. She indicated that the City of Santa Ana has spearheaded a program for cooperative involvement; however, felt that the problem will need to be dealt with at the City level. CONSENT On motion by Mayor Pro Tem Buffa, seconded by Council Member CALENDAR Hornbuckle, and carried 5-0, all Consent Calendar items were MOTION/Approved approved as recommended. WRITTEN COMMU- Resolution 95-16, A RESOLUTION OF THE CITY COUNCIL OF NICATIONS/Adopted THE CITY OF COSTA MESA, CALIFORNIA, AUTHORIZING Resolution 95-16 RECORDS DESTRUCTION FOR THE FIRE DEPARTMENT OF Authorizing Records THE CITY OF COSTA MESA, PURSUANT TO ORDINANCE Destruction for Fire NO. 75-60, was adopted. ADMINISTRATIVE Bids received for Bid Item No. 972, Annual Uniform Contract, are ACTIONS/Awarded on file in the City Clerk's office. The contract was awarded to Bid 972, Uniforms, Uniform Center, 1249 West Katella Avenue, Orange, for an amount to Uniform Center not to exceed $73,300.00. State Routes 55/73 Regarding the State Routes 55/73 Connector "D" Project: Connector "D" 1 2 2 i Approved Agreements Cooperative Agreement Nos. 12-230 and 12-231, with the 12-230 and 12-231 California Department of Transportation (CALTRANS) for design with CALTRANS for and construction, respectively, of northbound State Route 55 to Design and southbound State Route 73 Freeway (Connector "D"), was Construction approved; and the Mayor and Deputy City Clerk were authorized to sign on behalf of the City. Approved Freeway A Freeway Agreement for State Routes 55/73 with the California Agreement Department of Transportation, which supersedes the Freeway Agreement dated August 6, 1968, in its entirety, and that portion of the Freeway Agreement dated April 21, 1966, from Presidio Drive to Route 73, was approved; and the Mayor was authorized to sign on behalf of the City. Adopted Resolution Resolution 95-17, A RESOLUTION OF THE CITY COUNCIL OF 95-17 Amending THE CITY OF COSTA MESA, CALIFORNIA, AGREEING TO CALTRANS Freeway AMEND THE EXISTING FREEWAY AGREEMENT BETWEEN Agreement; Approved THE CITY OF _ COSTA MESA AND THE CALIFORNIA Budget Adjustment DEPARTMENT OF TRANSPORTATION (CALTRANS), was 95-39 adopted, adding the Bristol Street/I-405 Freeway Interchange Improvement Project; and Budget Adjustment No. 95-39 for $365,655.00, was approved. Adopted Resolution Resolution 95-18, A RESOLUTION OF THE CITY COUNCIL OF 95-18 Approving THE CITY OF COSTA MESA, CALIFORNIA, APPROVING THE Application for Used APPLICATION FOR GRANT FUNDS FROM THE USED OIL Oil Recycling Grant RECYCLING FUND UNDER THE USED OIL RECYCLING Funds ENHANCEMENT ACT FOR EDUCATION AND PUBLIC AWARENESS AND THE ENHANCEMENT OF THE EXISTING COLLECTION SYSTEM, was adopted. PUBLIC HEARING The Deputy City Clerk announced that this was the time and place GP-95-O1/R-95-01, set for the public hearing to consider General Plan Amendment GP- VNE Development/ 95-01, and Rezone Petition R-95-01, for VNE Development, Inc., Robertson authorized agent for Gene Robertson (120 - 23rd Street) and for the City of Costa Mesa (114 - 23rd Street), to change the land use designation of the aforementioned properties from Neighborhood Commercial to High Density Residential, and to change the zoning from C1 to R2 -HD. Environmental Determination: Negative Declaration. The Affidavit of Publication is on file in the City Clerk's office. No communications were received. Council Member Monahan stated that he would abstain from voting on this item due to the proximity of the subject property to his residence. The Deputy City Manager/Development Services reviewed the Agenda Report dated February 22, 1995, and showed transparencies of the site. He explained that although surrounding properties are zoned for medium density which is 12 units per acre, in reality many of the properties are built at a higher density, and felt that the change to residential should reflect a General Plan designation which is in accordance with the current density. Janet M. Sutton, 317 East Cabrillo Street, Costa Mesa, asked about the legality of the authorized agent using a post office box for an address on his application. The Deputy City Manager and the City Attorney assured Ms. Sutton that this is quite legal. Dorothy Adams, 220 Amherst Road, Costa Mesa, noted that construction of apartment complexes and high-rise buildings has increased. She suggested that single-family residences would be preferable. Sid Soffer, 900 Arbor Street, Costa Mesa, requested a definition of the Neighborhood Commercial zone. The Deputy City Manager responded that uses under this zoning vary from many types of retail stores to a multitude of businesses which offer services. Mr. Soffer felt that property facing Newport Boulevard should be commercial, and that the suggested change in zoning might adversely impact surrounding commercial properties. There being no other speakers, the Mayor closed the public hearing. MOTION On motion by Council Member Hornbuckle, seconded by Mayor Pro Resolution 95-19 Tem Buffa, and carried 4-0, Council Member Monahan abstaining, Adopted; Ordinance the following actions were taken based on findings stated in the 95-5 Given First Agenda Report dated February 22, 1995: Reading The Negative Declaration and the De Minimis Finding were adopted; Resolution 95-19, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADOPTING GENERAL PLAN AMENDMENT GP -95-01, AMENDING THE GENERAL PLAN OF THE CITY OF COSTA MESA, was adopted; and Ordinance 95-5, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADOPTING REZONE PETITION R-95-01, CHANGING THE ZONING OF 114 AND 120 23RD STREET FROM Cl TO R2 -HD, was given first reading and passed to second reading. Council Member Genis expressed her preference for single-family residences; however, explained that in this instance it would not be a logical choice. OLD BUSINESS The Deputy City Clerk presented from the meeting of February 21, Aggressive Pan- 1995, second reading and adoption of two ordinances: handling Ordinances _ Ordinance 95-3, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADDING SECTION 10-169 TO TITLE 10 OF THE COSTA MESA MUNICIPAL CODE PROHIBITING AGGRESSIVE PANHANDLING; and Ordinance 95-4, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADDING CHAPTER XI TO TITLE 11, OF THE COSTA MESA MUNICIPAL CODE PROHIBITING AGGRESSIVE PANHANDLING. MOTION On motion by Mayor Pro Tem Buffa, seconded by Council Member Continued to Genis, and carried 5-0, the ordinances were continued to the meeting March 20, 1995 of March 20, 1995. OLD BUSINESS The Deputy City Clerk presented from the meeting of February 21, Athletic Field 1995, preparation of an amendment to Site -Specific Agreement No. Development/Costa 1 (previously referred to as Site -Specific Agreement No. 4) with the Mesa High School Newport -Mesa Unified School District for athletic field development at Costa Mesa High School. The Community Services Director summarized the Agenda Report dated February 27, 1995. R23 Joe Busi, 3133 Dublin Street, Costa Mesa, track team coach at Costa Mesa High School, voiced his support of the athletic fields. He reported that the site is currently run down, and children are injured there every year. He commented that the lighting from the field would not be a problem and might actually provide added security. Nancy Palme, 1997 Kornat Drive, Costa Mesa, stated that there has been positive feedback from the homeowners associations and the community regarding development of the fields. Mike Schaefer, 3327 California Street, Costa Mesa, applauded persons who had worked on the two new little league sites which opened the previous Saturday, March 4, 1995. Mayor Erickson congratulated Mr. Schaefer on his efforts, and that of all the other volunteers. MOTION A motion was made by Council Member Hornbuckle, seconded by Preparation of Council Member Monahan, and carried 5-0, approving preparation Amendment Approved of an amendment to Site -Specific Agreement No. 1. Mayor Erickson announced that on April 11, 1995, 7:30 p.m., at the Presbyterian of the Covenant of Costa Mesa, 2850 Fairview Road, he and the City Manager will meet with the Mesa del Mar Homeowners Association to discuss the athletic fields and other matters. OLD BUSINESS. The Deputy City Clerk presented a report on the formation of a Newport Boulevard Newport Boulevard Study Committee. The Deputy City Manager/ Study Committee Development Services reviewed the Agenda Report dated February 21, 1995. Mary Hermanski, 15592 Garland Circle, Westminster, owner of 12 units on Newport Boulevard, pointed out that there are numerous problems with the Boulevard but none that are unsolvable. She suggested improved signage and less setbacks because of special circumstances. Mrs. Hermanski complained that the single -room occupancy hotel located on Newport Boulevard is in competition with private enterprise, and she would like to see that situation eliminated. She volunteered to be a member of the committee. MOTION A motion was made by Mayor Pro Tem Buffa, seconded by Council Committee Formation Member Hornbuckle, and carried 5-0, to proceed with the Approved advertisement for and formation of the committee which will be composed of seven members: two property owners, two business owners, two residents, one member -at -large, liaison representation by Council Member Monahan, and a request that. the Planning Commission also appoint a liaison. Mayor Erickson suggested that Mrs. Hermanski apply for a position on the committee by directing an application or letter to the Deputy City Manager. NEW BUSINESS Mayor Erickson announced that Council Member Buffa's report on Corridor Agency the San Joaquin Hills Corridor Agency would be trailed until the Report Trailed arrival of the representative from the Transportation Corridor Agencies. NEW BUSINESS The Deputy City Clerk presented a request from the Professional PGA Tournament Golf Association (PGA) for street closures and waiver of police fees Street Closures during the Toshiba Senior Classic Golf Tournament: Close Capri Street, Tahiti Drive, Java Road at Maui Place, and Kornat Drive to through traffic from 10:00 a.m. to end of play on Wednesday and Thursday, March 15 and 16, 1995, and from 7:00 a.m. to end of play on Friday, Saturday, and Sunday, March 17, 18, and 19, 1995. Close Gisler Avenue and Club House Road from 7:00 a.m. through end of play March 15 through 19, 1995. The Assistant to the City Manager summarized the Agenda Report dated February 17, 1995. Don Andersen, 13402 Heritage Way, Tustin, Tournament Director, reported that a field of 78 professional golfers will compete at Mesa Verde Golf Course, with three days of live television coverage broadcast nationwide. He briefly reviewed the logistics, noting that the time frame for the entire process had only been four months. He stated that the host hotel is the Westin South Coast Plaza, and South Coast Plaza will host the player's wives at a tea and shopping function. Mr. Andersen declared that all net revenues would be directed to charity, and all funds from parking revenues would be allocated to Costa Mesa nonprofit organizations. Charles Robertson, 1885 Tahiti Drive, Costa Mesa, commented that this tournament was the ultimate sporting event of national interest 'that utilized existing facilities. He felt that the organization of the event had been a concerted community effort, with the common interest in the sport of golf combined with the mutual appreciation of the economic benefits to the City. He believed that the potential for significant contributions to community charities brought together individuals and groups who otherwise have diverse and often competing interests. Mr. Robertson responded to a question from Mayor Pro Tem Buffa by stating that the proposed street closures would be adequate. Tom Johnson, 330 West Bay Street, Costa Mesa, revealed that the five nonprofit organizations benefitting from the parking fees would be the Costa Mesa, Master Chorale, Rotary Club, Girls, Inc., and programs at Costa Mesa and Estancia High Schools. He explained that the parking fees would be distributed as follows: the first dollar to the Chamber of Commerce, the second dollar to the participating nonprofit organization, the third dollar to cover costs, and the balance to be distributed among the aforementioned nonprofit organizations. Nancy Palme, 1997 Kornat Drive, Costa Mesa, spoke in favor of the tournament. MOTION/Street On motion by Mayor Pro Tem Buffa, seconded by Council Member Closures Approved Genis, and carried 5-0, the requested street closures were approved. Motion to Split Fees A motion was made by Mayor Pro Tem Buffa, seconded by Council Failed to Carry Member Monahan, to split the proposed cost of security fees with the tournament; in an amount not to exceed $40,000.00. The motion failed to carry 3-2, Council Members Erickson, Hornbuckle, and Genis voting no. Mayor Erickson did not support the motion citing requests from other groups, such as the Lions Club for the Fish Fry parade, where fees are not reduced. Council Member Genis agreed that by adjusting the fee for one group, the City would be asked to do the same for others, and monies have not been budgeted to accomplish this. She noted that the nonprofit organizations mentioned, although definitely worthwhile, would not necessarily be those chosen by the City to receive this amount of money. Council Member Hornbuckle agreed with the previous reasons, stating that it would be inequitable to grant this request and deny local charities support for street closures for parades and other events. Sergeant Dave Walker, Costa Mesa Police Department, verified for Council Member Hornbuckle that the number of police officers required for Monday through Thursday, March 13 to 16, 1995, was accurate, and the use of cadets was not feasible at this time; however, the use of volunteers might be a possibility. Council Member Hornbuckle suggested working closely with the tournament sponsors to attempt to reduce the number of sworn officers needed. Council Member Monahan stressed that he supported the motion because of the benefit derived from the tournament, and suggested looking at the benefit of waiving fees for other events at a future date. NEW BUSINESS The Deputy City Clerk presented a request from "Taste of Costa Taste of Costa Mesa Mesa" to install 50 street banners throughout the City from April 24 through May 22, 1995. The Assistant to the City Manager summarized the Agenda Report dated February 27, 1995, explaining that since the attached map was unclear, clarification would be given by the applicant. Kim Kasell, 3057 Yukon Avenue, Costa Mesa, Taste of Costa Mesa Executive Director, reported that this event was successful last year due to the banners, and explained that the map was sporadic because the locations indicated are major thoroughfares. She indicated that the intent of the banners is to draw attention, and for that reason they must be placed throughout the City yet be unobtrusive to the residents. She clarified for Council Member Genis that in an area such as the intersection of Fairview Road and Sunflower Avenue, banners would be placed on the commercial side of the street rather than the residential. MOTION On motion by Council Member Genis, seconded by Council Member Banners Approved Hornbuckle, and carried 5-0, the banners were approved, and the applicant was directed to work with staff on the exact location for placement. OLD BUSINESS Mayor Pro Tem Buffa presented his report on the San Joaquin Hills San Joaquin Hills Corridor Agency, stating that a letter had been received from Alan Corridor Agency Remington which had raised concerns that the toll road is a private Report project and that some public monies will be spent. He stated that for a period of over 20 years, there have been no new freeways in the state with the exception of the extension of State Route 73 and the completion of the extension of the 55 Freeway. Mayor Pro Tem Buffa explained that the revenues from the toll road would be used to secure bonds, the road will be maintained by CALTRANS, and the toll road will become a State road in 30 years with the tolls being optional at that time. He reported that the road, to be accepted by CALTRANS as part of the State system, must be built to their standards. Paul Glaab, Director of Public Affairs, Transportation Corridor Agencies, 201 East Sandpointe Avenue, Suite 200, Santa Ana, concurred with the Mayor Pro Tem's statements, noting that the toll t.r225 226 CITY ATTORNEY'S REPORTS/Request for Closed Session: Amburgey v. City; Scarcello v. City road will be funded through developer fees, which is a new method to finance transportation infrastructure. He reiterated that before the toll road can be certified as part of the State highway system, it must meet CALTRANS criteria and standards. Mayor Pro Tem Buffa stated that concerns regarding CALTRANS maintaining the road, specifically that an increase in the public cost and tax burden would be incurred, are not valid since CALTRANS has a certain maintenance burden every year and an additional road would not make a difference. Responding to the issue of why the citizens of Costa Mesa had not been informed of the traffic congestion which would occur on the I-405 Freeway and streets in the north end, he asserted that this would not happen. He explained the financing procedures, and presented a visual overview of the toll road. The Mayor Pro Tem announced that anyone interested in receiving a TCA newsletter should contact Mr. Glaab's office at 436-9800. The Public Services Director addressed improvements within the City, stating that the intention is to clean up a number of operational problems that are inherent in the existing freeway system, such as the weaving problems and poor geometrics at some of the inter- changes. Janet Remington, 1164 Boise Way, Costa Mesa, shared a story regarding the small stretch of foothill toll road, and disagreed with Mayor Pro Tem Buffa on several issues, including the percentage of people against the toll roads, and the decision to use asphalt instead of concrete. Roy Pizarek, 1923 Whittier Avenue, Costa Mesa, explained that the subject of toll roads had been brought to the attention of the homeowners associations coalition, who objected to the fact that TCA meetings had not been published. Mayor Pro Tem Buffa briefly reviewed the meetings held by the TCA, and reported that because this is a public agency the meetings are noticed and open to the public. Mr. Glaab informed Mr. Pizarek that the Environmental Impact Report (EIR) is completed, and meetings held during the EIR process had been noticed. The Mayor Pro Tem clarified that a separate EIR is being prepared for the northern confluence and will be completed shortly. The City Manager suggested that Mr. Pizarek submit a list of the dates and chronology of events in which they are interested, and staff will obtain that information from the TCA; in addition, the City will request a copy of the TCA newsletter be forwarded to the homeowners associations coalition. Nancy Palme, 1997 Kornat Drive, Costa Mesa, asked that Mr. Glaab leave his business card so she can provide the TCA with a list of homeowners who would be interested in receiving the newsletter on a regular basis. Mayor Pro Tem Buffa responded to Mrs. Palme's concerns regarding the extension of the 57 Freeway. Mrs. Palme suggested that Council adopt a resolution to oppose any intrusion of that freeway southerly of the I-405 Freeway. The City Attorney requested a closed session pursuant to Government Code Section 54956.9(a) to discuss the following: Orville Amburgey v. City of Costa Mesa, et al., Orange County Superior Court Case No. 66-92-03; and Eugene Scarcello v. City of Costa Mesa, Orange County Superior Court Case No. 71-82-79. Mayor Erickson announced that closed session would be held at the completion of regular business. 1 Charles Robertson, 1885 Tahiti Drive, Costa Mesa, presented Council with badges for admittance to the golf tournament. COUNCIL Council Member Monahan reminded everyone to vote in the special COMMENTS election on Tuesday, March 14, 1995. Town Hall Meeting Council Member Genis thanked those who participated in the Town Hall meeting on March 1, 1995, and encouraged the City to work ADJOURNMENT TO At 9:00 p.m., the Mayor adjourned the meeting to a closed session CLOSED SESSION in the first floor Conference Room to discuss the items previously announced. MEETING The Mayor reconvened the meeting at 9:20 p. in., and the action RECONVENED taken during closed session was announced. MOTION/Amburgey Regarding Orville Amburgey v. City of Costa Mesa, et al., Orange v. City Referred to County Superior Court Case No. 66-92-03, by a vote of 5-0, Collection Agency Council referred recovery of costs to a collection agency. MOTION/Scarcello Regarding Eugene Scarcello v. City of Costa Mesa, Orange County v. City Settlement Superior Court Case No. 71-82-79, by a vote of 5-0, Council Authorized rejected the settlement offered by Mr. Scarcello, and authorized the City Attorney to tender an alternate proposal as outlined in the Assistant City Attorney's confidential memorandum dated February 23, 1995. with other cities regarding the homeless problem. She reported that SCAG Conference she had attended the Southern California Association of Governments (SCAG) conference where restructuring was discussed, and the City Manager will participate on a committee to investigate Athletic Fields alternate financing in terms of government structuring. Referring to Costa Mesa High School athletic fields, she pointed out that a number of Newport -Mesa School District sites may become available, such as Harper School, and the City would have first choice to acquire „ them. She suggested that the City should be prepared when thisopportunity arises. The City Manager added that this subject had been discussed- recently with the Park, Recreation Facilities, and Parkways Commission` --who have organized a small group to investigate these- options.*:_ ` Building, Housing, Council Member Hornbu l&. ; anrio�:n ;ed that she invited the Fire Code Board of Building, Housing, Fire -=Code Boaz -d . of Appeals to attend the Appeals Monday, March 13, 1995, Study Sess:6n to discuss several items. Town Hall Meeting Mayor Erickson congratulaXed.th& Human Relations Committee for hosting the March 1, 1995, meeting on the homeless, and thanked the residents and business people who attended. He announced that the original group formed to discuss this problem will continue to Man and Woman of meet once a month at the West Side Substation, 567 West 18th the Year Street. He applauded Jane Brecht and Russ Gilbert for being appointed the Costa Mesa Chamber of Commerce Woman and Man Little League Fields of the Year. He reported that the Costa Mesa American and National Little League opened Saturday, March 4, 1995, on the new, high quality fields and complimented the volunteers that made it possible. City of Costa Mesa, et al., Orange v. City Referred to County Superior Court Case No. 66-92-03, by a vote of 5-0, Collection Agency Council referred recovery of costs to a collection agency. MOTION/Scarcello Regarding Eugene Scarcello v. City of Costa Mesa, Orange County v. City Settlement Superior Court Case No. 71-82-79, by a vote of 5-0, Council Authorized rejected the settlement offered by Mr. Scarcello, and authorized the City Attorney to tender an alternate proposal as outlined in the Assistant City Attorney's confidential memorandum dated February 23, 1995.
