HomeMy WebLinkAbout02/10/1997 - City Council Special MeetingSPECIAL MEETING OF THE CITY COUNCIL CITY OF COSTA MESA FEBRUARY 10, 1997 The City Council of the City of Costa Mesa, California, met in special session February 10, 1997, at 6:55 p.m., in Conference Room 1-A of City Hall, 77 Fair Drive, Costa Mesa, following the regularly scheduled Redevelopment Agency meeting. Notice of the special meeting was given as required by law. The special meeting was called to order by the Mayor. ROLL CALL Council Members Present: Mayor Peter Buffa Mayor Pro Tem Gary Monahan - Council Member Joe Erickson Council Member Libby Cowan Council Member Heather Somers Council Members Absent: None Officials Present: City Manager Allan Roeder Deputy City Clerk Mary Elliott NEW BUSINESS Mayor Buffa announced that 3 of 23 applicants would be Interviews for interviewed for 3 positions on the Planning Commission. He Positions on the explained the procedure for interviewing and selection. Planning Commission The persons being interviewed introduced themselves. They were Agnes K.. Dubberly, Thomas L. Sutro, and Thomas E. Steinfeld. Applicants not being interviewed were David Ruck, Albert Simone, Bruce Garlich, Charles Robertson, Anthony Skidmore, Larry Hemming, Wyatt Lin, Mark Korando, Stuart Warrick, David Stiller, Chris Fewel, Frank Rite, James B. Netzer, Stan Brown, James Meyer, James R. Moose, Carolina Cohen, Michael Collier, Caroline Butler, and John B. Stephens. Each Council Member asked questions of, and received responses from the three applicants being interviewed. MOTION Council Member.. Erickson made a motion to reappoirt Charles Robertson and Robertson and Chris Fewel for four-year terms expiring Fewel Reappointed February 28, 2001. The motion was seconded by Council Member Somers, and carried 5-0. MOTION A motion was made by Mayor Pro Tem Monahan, seconded Appoint Sutro by Council Member Erickson, to appoint Thomas L. Sutro for a four-year term expiring February 28, 2001. Substitute Motion After discussion, a substitute motion was made by Council to Appoint Member Cowan, seconded by Council Member Somers, to Dubberly Failed to appoint Agnes Dubberly. The motion failed to carry 3-2, Carry Council Members Buffa, Monahan, and Erickson voting no. rf 3 CIAO Substitute Motion Further discussion ensued, and thereafter Council Member to Appoint Korando Somers made a motion to appoint Mark Korando. The Died motion died for lack of a second. Original Motion to The Mayor called fora vote on the original motion to appoint Appoint . S u t r o Thomas L. Sutro. The motion carried 4-1, Council Member Carried Somers voting no. NEW BUSINESS Mayor Buffa presented a request -from Council Member Moratorium on Somers to adopt a resolution requesting the Department of Alcoholic Beverage Alcoholic Beverage Control (ABC) to deny all applications for Licenses new and transfer of liquor licenses. The City Manager noted that ABC believes that the best control would be through the land use process. Council Member Somers asserted that there are too many alcoholic beverage licenses within the City; therefore, she felt that no new licenses should be issued, nor should licenses be transferred from another city to Costa Mesa. During discussion, Council Members Buffa, Monahan, Erickson, and Cowan indicated their opposition to a moratorium, preferring to require Conditional Use Permits for those businesses proposing to sell or serve alcoholic beverages. Council Member Somers stated that she would table this item for now; however, she would be bringing it back for consideration if problems continue with these type of Received and Filed businesses. At the recommendation of Mayor Buffa, this item was -received and filed. Mark Korando, 582 Park Drive, Costa Mesa, recommended that Council make it very clear to the Police Department and Planning Commission that findings must be based on definite parameters, and strong enforcement must be utilized on problem bars and convenience stores. Mr. Korando strongly supported limiting the number of liquor licenses in the City. Mayor Pro Tem Monahan maintained that it would be best to focus on the bad operators. Roy Pizarek, 1923 Whittier Avenue, Costa Mesa, contended that it is necessary to focus on those establishments with poor records, and stated that he was not concerned with the number of businesses selling alcohol, as long as they are run properly. He felt requiring Conditional Use Permits was the answer to adequate controls. Mr. Pizarek supported the formation of a committee consisting of representatives from the Police Department, residential community, and business community to gather facts for investigation,'as recommended by the consultant who assisted the City of Newport Beach in addressing problems with businesses selling liquor. Mayor Buffa stated that Mr. Pizarek's suggestion would be considered in the process. The City Manager commented that the approach used in Newport Beach is almost identical to that which was done by this City with the motel strike force, and. the Newport Boulevard Specific Plan. At the request of Council Member Somers, the City Manager stated that he would obtain any information available from the City of Newport Beach. 1 7 - ADJOURNMENT The Mayor declared the meeting adjourned at 8:30 p.m. Mayor of the City o&SO Mesa ATTEST: T.
