HomeMy WebLinkAbout03/10/1997 - City Council Special MeetingROLL CALL SPECIAL MEETING OF THE CITY COUNCIL CITY OF COSTA MESA MARCH 10, 1997 The City Council of the City of Costa Mesa, California, met in special session March 10, 1997, at 7:00 p.m., in Conference Room 1-A of City Hall, 77 Fair Drive, Costa Mesa, following : the regularly scheduled Redevelopment Agency meeting. Notice of the special meeting was given as required by law. 'The meeting was called to order by the Mayor. Council Members Present: Council Members Absent: Officials Present: Mayor Peter Buffa . Mayor Pro Tem, Gary Monahan Council Member 'Joe Erickson Council Member Libby Cowan Council Member Heather Somers None City Manager,Allan Roeder City Attorney Thomas Kathe CITY ATTORNEY The City Attorney presented a request from Edwin J. REPORTS/Orange Richards, Attorney at Law, to waive potential conflict of County Bankruptcy interest in connection with the Comprehensive Settlement Settlement Agreement in the Orange County bankruptcy. MOTION By a vote of 5-0, the City Council waived the conflict Conflict Waived of interest. - CITY ATTORNEY The City Attorney requested a closed session pursuant to REPORTS/Request . _ Government Code Section 54956.9 to discuss the following for Closed Session: lawsuits: Elizabeth Helguero v. City of Costa Mesa, Joe Helguero/Newport Erickson, Allan Roeder, David L-. Snowden, Alan Kent, Donald Station, and D. Lamm, and Sandra M. Benson, United States District Reinglass Lawsuits. Court Case No. SACV-96-1245 AHS (Eex), concerning denial of an entertainment permit for Newport Station, 1945 - Placentia Avenue; and City of Costa Mesa v. Darwin Reinglass, et al., Harbor Municipal Court Case No. 95C2858. ADJOURNED TO.. At 7:05 p.m., the Mayor adjourned the meeting to a closed CLOSED SESSION session to discuss the items announced by the City Attorney. MEETING . At 7:10 p.m., the Mayor reconvened the special -meeting and RECONVENED the action taken during closed session was announced. MOTION/Approved In Helguero v. City of Costa Mesa, by a vote of 4-0, Defense and Waiver Council Member Erickson abstaining, the City Council of Conflict and granted the request for defense and waiver of conflict Authorized Cross- for the employees named in -the lawsuit, and authorized Complaint in the City Attorney to file . a cross-complaint for public Helguero Case nuisance. MOTION/Rejected In City v. Reinglass, et al., by a vote of 5-0, the City Council Reinglass Offer rejected the offer to settle.
