HomeMy WebLinkAbout08/11/1997 - City Council Special Meeting - Redevelopment AgencyROLL CALL SPECIAL JOINT MEETING OF THE CITY COUNCIL AND REDEVELOPMENT AGENCY CITY OF COSTA MESA AUGUST 11, 1997 ;' The City Council and the Redevelopment Agency of the City of Costa Mesa, California, met in special joint session on August 11, 1997, at 6:30 p.m., following the regularly scheduled Redevelopment Agency meeting, in first floor j Conference Room A, City Hall, 77 Fair Drive, Costa Mesa. Notice of the special joint meeting was given as required by law. The meeting was called to order by Mayor Pro Tem/Agency Chairperson Monahan. Council/Agency Members Present: i Council/Agency Members Absent Officials Present: Mayor Pro Tem/Agency Chair- person Gary Monahan Council Member/Vice Chairperson Libby Cowan Council/Agency Member Joe Erickson Council/Agency Member Heather Somers Mayor/Agency Member Peter Buffa City Manager/Agency Executive Director Allan Roeder City Attorney Thomas Kathe Redevelopment and Housing Manager Muriel Ullman PUBLIC HEARING ! The Redevelopment and Housing Manager announced the R-97-06 and public hearing, continued from. the special joint meeting of PA -97-28, Borders July 14, 1997, to consider Planning Action PA -97-28 and Costa Mesa, LLC Rezone Petition R-97-06, MCG Architects, 200 South Los Robles Avenue, Suite 300, .Pasadena, authorized agent for the City of Costa Mesa and Borders Costa Mesa, LLC, 410 - 17th Street, Suite 1705, Denver Colorado, to rezone property at 1884, 1898 Newport Boulevard and 145 East, 19th Street, Buildings A, B, and C, from C1, C2, and P to Planned Development Commercial (PDC); and a final development plan to construct a one-story, 25,200 -square - foot, commercial building with excess compact parking (25 percent permitted, 28 percent proposed), and outside dining in the Newport Boulevard setback. Environmental Determination: Negative Declaration. The Redevelopment and Housing Manager reported that another continuance has been requested because hydrocarbons were found in the soil after testing was completed, and a final cost estimate for the cleanup was not available until August 8, 1997. She reported that on August 12, 1997, Borders will be meeting with -staff -to discuss the magnitude of the cleanup. R 165 The City Manager/Agency Executive Director mentioned that there are provisions in the agreement which allow the City to walk away from the 'project if the cost is in excess of $ 50,000.00. MOTION On motion by Council Member/Agency Vice Chairperson Continued to Cowan, seconded by Council/Agency Member Somers, and September 8, 1997 carried 4-0, Mayor/Agency Member Buffa absent, the public hearing was continued to a special joint City Council/Redevelopment Agency meeting on September 8, 1997. CITY ATTORNEY'S The City Attorney requested a closed session pursuant to REPORT/Request Government Code Section 54956.9(a) to discuss pending for Closed Session: litigation in Wyrick's United States Bankruptcy Court Wyrick Bankruptcy Case No. SA 95-21823JB; and City of Costa Mesa . v. Cases Wyrick, United States Bankruptcy Court Adversary Case 'No. 97-1063JB. ADJOURNED .TO At 6:35 p.m., Mayor Pro Tem/Agency Chairperson Monahan CLOSED SESSION adjourned the meeting to a closed session to discuss the item announced by the City Attorney. MEETING Mayor Pro Tem/Agency Chairperson Monahan reconvened RECONVENED the meeting at 6:40 p.m., and the action taken during closed session was announced. MOTION By a vote of 3-0,' Mayor/Agency Member Buffa absent and Rejected Wyrick's Council/Agency Member Somers abstaining, the City Settlement Offer Attorney's recommendation was approved, and the Regarding . settlement offer from Wyrick was rejected, in connection Bankruptcy Cases with Wyrick's United States Bankruptcy Court Case No. SA 95-21823JB, and City of Costa Mesa v. Wyrick, United States Bankruptcy Court Adversary Case No. 97-1063JB. COUNCIL/AGENCY Council/Agency Member Somers requested that the Public COMMENTS Services Department explore ways by which to accelerate Subdivision and the process for .final approvals of subdivision and parcel Parcel Maps maps. The City Manager/Agency Executive Director stated that he would investigate this issue.
