HomeMy WebLinkAbout09/08/1997 - City Council Special Meeting - Redevelopment AgencySPECIAL JOINT MEETING OF THE CITY COUNCIL AND REDEVELOPMENT AGENCY CITY OF COSTA MESA SEPTEMBER 8, 1997 The City Council and the Redevelopment Agency of the City 'of Costa Mesa; California, met in special joint session : on September 8, 1997, at 5:00 p.m., following the regularly ,scheduled Redevelopment Agency meeting, in first floor 'Conference Room A, City Hall, 77 Fair Drive, Costa Mesa. 'Notice of the special joint meeting was given as required by ;law. The meeting was called to order by Mayor Pro .Tem/Agency Chairperson Monahan. ROLL CALL ;Council/Agency Members Present: Mayor/Agency Member Peter Buffa Mayor Pro Tem/Agency Chair- person Gary Monahan Council Member/Vice-Chairperson Libby Cowan Council/Agency-Member yJoe Erickson = Council/Agency Member Heather Somers - ;Council/Agency Members Absent None Officials Present: City Manager/Agency Executive Director Allan Roeder City/Agency Attorney Thomas Kathe Redevelopment and Housing Manager Muriel Ullman Principal Planner Mike Robinson PUBLIC HEARING The Redevelopment and Housing Manager announced the R-97-06 and :public hearing, continued from the special joint meeting of PA -97-28, Borders August 11, 1997, to consider Planning Action PA -97-28 and Costa Mesa, LLC !Rezone Petition R-97-06, MCG Architects, 200 South Los Robles Avenue, Suite 300, Pasadena, authorized agent 'for the City of Costa Mesa and Borders Costa Mesa, LLC, 410 -17th Street, Suite 1705, Denver Colorado, to rezone property at 1884 and 1898 Newport Boulevard, and 145 East 19th Street,. Buildings A, B; and C, from C1, C2, and P to Planned Development Commercial (PDC); and a final 'development plan to construct a one-story, 25,200 -square - foot commercial building with excess compact parking (25 percent permitted, 28 percent proposed), and outside dining in the Newport Boulevard setback. Environmental Determination: Negative Declaration. The Principal Planner reviewed the Agenda Report dated Au3ust 20, 1997, and responded to questions from the Council/Agency members pertaining to trip fees, parking, and 'landscaping. 1 1 189 Richard Zapkin, representing HC Companies, developer for Borders Costa Mesa, LLC, reported that a petroleum product on the site caused a delay in developing the property, and that they are working with the Orange County Health Care Agency to finalize an environmental work plan. The City/Agency Attorney reported on a telephone conversation he had with _Tim Konold, representative for the Pope Family Trust, and was told that the County rejected the remediation plan because more data is required. He added that the Agency could take some action tonight by recommending that Council adopt the Negative Declaration of Environmental Impact and Rezone Petition R-97-06; or they can wait until the remediation issues are resolved. Brenda Godfrey, Borders Costa Mesa, LLC, stated that the main concern ofAhe Orange County Health Care Agency is that the contamination may have gone off-site and could possibly be on Newport Boulevard. She reported that a representative from the County Agency will be studying the site on Tuesday, September 9, 1997, to determine whether additional testing is required. Mr..Zapkin suggested that the public hearing be continued for 30 days in order to define the area that mulst be remedied and to determine the cost. Mayor/Agency Member Buffa agreed that a continuance would be in order. Ta Nguyen, 296 North Thora Street, Orange, owner of a _ liquor store at 145 East 19th Street, expressed his desire to continue doing business at his current location. Susie Nguyen, daughter of Ta Nguyen, felt that the bidding process had not been fair to her father and asked why the City did not sell the property to Triangle Square since their bid was the highest. Mayor Pro Tem/Agency Chairperson Monahan replied that the bid price was negotiated; it was not the actual selling price. In addition, he stated that Council issued a directive several years ago that when the City - owned property is sold, it would be with the condition that the purchaser would combine the parcel with the adjacent properties and develop it as one project. . Herb Weiser, 2049 Central Plaza East, Suite 900, Los Angeles, outside counsel for the City and Agency, commented that his analysis of the Triangle Square offer was that they did not make an offer to purchase, they merely made an offer to negotiate for a year to determine a price they would be willing to pay; therefore, Triangle Square did not make a firm commitment.. Tom Sweat, 345 University, Drive, Costa Mesa, asked if the City intended to demolish the Mesa Theater. The City/Agency Attorney replied that in April, 1997, the City published a notice in the newspapers requesting offers to purchase the corner property .with one condition: that the -- City property be combined with the adjacent properties to be developed as one project. He noted that the item on to agenda is a development proposal by Borders Costa Mesa, and is not a City project.
