MARCH 6, 2000
The City Council of the City of Costa Mesa, California, met in
regular session March 6, 2000, at 6:30 p.m., in the Council
Chambers of City Hall, 77 Fair Drive, Costa Mesa. The meeting
was called to order by the Mayor, followed by the Pledge of
Allegiance to the Flag led by Council Member Erickson, and
invocation by Reverend Joseph Robillard, St. Joachim Catholic
Church.

MINUTES On motion by Council Member Erickson, seconded by Council
February 22, 2000 Member Somers, and carried 5-0, the minutes of the regular
meeting of February 22, 2000, were approved as distributed.
ORDINANCES AND A motion was made by Council Member Erickson, seconded by
RESOLUTIONS Council Member Somers, and carried 5-0, to read all ordinances
and resolutions by title only.
PRESENTATION Mayor Monahan commended Bruce Covey on being named
Employee of the Employee of the Month for March, 2000, in appreciation of his
Month contributions as the Facilities/Fleet Services Supervisor for the
Public Services Department. Mr. Covey is recognized for his
outstanding record of accomplishments, and commended for his
willingriess recently to fill't `6"position of Acting Facilities and
Fleet Services Superintendent.
PRESENTATION Guy Carrozzo, Mayor of the City of Fountain Valley, member of
"Honoring Veterans of Foreign Wars Post No. 9557, announced his
Veterans" dedication to the veterans and prisoners of war of this country,
and stressed the importance of honoring the spirit of the flag for
which they fought. He encouraged citizens to purchase and
display the American flag.

PRESENTATION Police Sergeant Clay Epperson addressed gang problems in the
Costa Mesa Police City of Costa Mesa, stating that a zero -tolerance policy is
Department Gang observed and a constant Police presence is maintained in gang -
Detail impacted areas. He reported that many gang members do not
reside in the City, and the number of gang incidents are in
decline. Sergeant Epperson listed the following accomplish-
ments: 40 -percent of gang members•are currently in custody; a
small percentage of citizens are actively involved in gang
activity; the gang detail has maintained a 100 percent clearance
rate on major gang crimes; and a high ratio of police officers to
gang members has been established. Mayor Monahan asked
that follow-up questions. to this presentation be directed to his
office, (714) 754-5285. .
ORAL COMMUNI- Robert Graham, 3260' Dakota Avenue, Costa Mesa, reported
CATIONS/19th that he had obtained a copy of the scope of work for the Santa
Street Bridge Ana River Crossings (SARX) Study. Mr. Graham indicated that
the SARX Study is strictly a traffic study, which includes an
environmental • analysis, and does not address commercial
opportunities.
Republic Avenue Mildred Nicholson, 2063 Republic Avenue, Costa Mesa,
Street Sweeping reported that hours for street sweeping are not designated for
the corner of Republic Avenue and Linden Place. She stated
that a petition had 'been circulated in support of correcting this
situation but the petition was not honored by the City. The
Public Services Director indicated that a petition in a residential
neighborhood requires signatures from 50 percent of the area
residents, or, a sufficient debris problem; to justify the street
sweeping designation. The City Manager explained that the
City cannot sweep the street in shifts, as Mrs. Nicholson had
indicated was requested in the petition, since manpower and
equipment would be doubled. He stated that he and the Police
Chief will review this matter with Mrs. Nicholson.
Yellowstone Diane Gomez, 158 Buoy Street, Costa Mesa, objected to the
Women's First Step on-going, open -to -the -public Alcoholics Anonymous meetings
House held every Sunday afternoon at Yellowstone Women's First
Step House, 154 East Bay Street (Planning Application PA -99-
13). She reported that the meetings create a crowded parking
situation and resemble a loud, boisterous party. She requested
that the meetings be discontinued based upon the prohibition of
non-residential accessory uses in . a residential development.
Ms. Gomez also complained about the multiple daily backyard
meetings, noting that these activities intrude upon the
neighbors. She showed photographs illustrating that the home
is -used for a warehouse for furniture donated to Yellowstone.
She asked that Yellowstone's non-profit corporation be required
by the City to apply for a business license and a home
occupation permit. At the request of Mayor Monahan, Ms.
Gomez submitted her written comments for consideration.
Jason Finney, 155 Buoy Street, Costa Mesa, neighbor of the
Yellowstone group home, suggested that they follow the
guidelines of the conditional use permit or function as a
residence. He detailed his problems with the facility. Mayor
Monahan suggested that any complaints be forwarded to the
City's Code Enforcement Division. Mr. Finney submitted his
written comments for follow-up by staff.
Alleged Gang Martin Millard, 2973 Harbor Boulevard, Costa Mesa, stated that
Confrontation on February 19, 2000, Police Department Case No. 5514 was
listed as a hit-and-run felony but Mr. Millard believed that it was
actually a gang confrontation on Mission Street. The Police
Chief responded that the aforementioned incident was a felony
hit-and-run involving a victim with a language problem. He
City Council indicated that there was no gang involvement. Mr. Millard next
Correspondence referred to a letter dated September 8, 1999, on official City
Council letterhead, signed by a person who is not a Council
Member, and asked about the propriety of this act. In
association with this letter, he complained about actions taken
by the City in support of the Latino Community Advisors.
Mayor Monahan responded that the Latino Community Advisors
is not an official City committee, and Mayor Pro Tem Cowan
generated a letter which was also signed by a citizen, hence the
West Side Specific use of City Council letterhead. Mr. Millard criticized the West
Plan Side Specific Plan as` being nonrealistic, and pointed out that the
Plan does not mention the ocean orientation of Costa Mesa.
Mayor Monahan suggested that Mr. Millard forward any
comments on the West Side Specific Plan to the City's Planning
Division.
Medical Marijuana Doug Scribner, 321 Avocado Street, No. P, Costa Mesa,
reiterated his thoughts on medical marijuana, citing a section of
the California constitution relating to implementation of the
plan. He proposed that the City develop guidelines for the
Police Department regarding medical marijuana.
Santa Ana Heights Bob Hanley, 1601 Indus Street, Santa Ana Heights, referring to
Annexation the potential annexation of the Santa Ana Heights area,
reported on a recent meeting with the Local Agency Formation
Commission (LAFCO) wherein he was advised to continue open
discussions with the City of Costa Mesa. He invited Council to
the next meeting with residents to be held on March 15, 2000,
at 6:30 p.m., at Country Club Convalescent Hospital, 20362
Santa Ana Avenue, Costa Mesa.
West Side Costa Janice Davidson, 1982 Arnold Avenue, Costa Mesa, asked for
Mesa Council assistance with the west side, stating that nothing has
changed in 20 years.
EI Toro Marine Air Russ Niewiarowski, 20102 Kline Drive, Santa Ana Heights,
Station urged Council and residents to strongly oppose the efforts of
the City of Irvine to rezone and redevelop four primary areas
surrounding the EI Toro Marine Air Station. He encouraged
attendance at a meeting on this subject on Thursday, March 9,
2000, 6:30 p.m., at the City of Irvine, One Civic Center Plaza,
Room L-102, Irvine.
Costa Mesa Gangs Ernie Feeney, 1154 Dorset Lane, Costa Mesa, referring to the
Police. Department presentation on gangs, asked how many
gangs were in the City of Costa Mesa 10 years ago; how many
gang members and their associates did we have 10 years ago;
and what would it take to rid the City of gang members. She
suggested that the Police Mobile Command Unit be utilized on
weekends to help curtail gang activity.

Fence Problems Kristen Miller, 881 West Victoria Street, Costa Mesa, reviewed
the facts relating to the rejuvenation of the fence surrounding
her home. She stated that she had been informed by the City
that the fence must be set back 10 feet, or cut down from 6
feet to 2 %Z feet, or application should be made for a variance
at a cost of $675.00. . Ms. Miller provided pictures and
documentation for Council. Responding to a question from the
Mayor, the Development Services Director reported that staff
has encouraged Ms. Miller to file for a variance; however, cost
is an issue.
Planning Process Doug Sutton, 2739 Canary Drive, Costa Mesa, asked the City
to readdress the Planning Division's process for developing
residential neighborhoods. He indicated that neighbors of
potential projects should be provided ample time to respond,
and suggested that a neighborhood meeting early in the
process could alleviate problems.
Gang Graffiti John Feeney, 1154 Dorset Lane, Costa Mesa, addressed the
"Fillmore Slum", showing photographs of gang graffiti along
Paularino .Avenue and at various other locations. He provided
a: 1999 City sponsored survey of residents who reside in the
area and their landlords, and it indicated that the No. 1 problem
listed was the elimination of gang and drug activities.
CONSENT The following item was removed from the Consent Calendar:
CALENDAR Item No. 5, Memorandum of Understanding between the Costa
Mesa Police Department and the United States Department of
Justice, Drug Enforcement Administration, authorizing partici-
pation in the Los Angeles High Intensity Drug Trafficking Area.
MOTION/Approved On motion by Council Member Erickson, seconded by Council
Except Item No. 5 Member Dixon, and carried 5-0, the remaining Consent
Calendar items were approved as recommended.
WRITTEN Resolution 00-13 was adopted: A RESOLUTION OF THE CITY

Doug Scribner, 321 Avocado Street, No. P, Costa Mesa,
opposed the MOU which involves asset forfeiture funds, and
urged that it not be approved at this time. He provided Council
with an article from the University of Chicago Law Review,
entitled "Policing for Profit." Also speaking in opposition to the
MOU were Christopher Ganiere, 2822 LaSalle Avenue, Costa
Mesa; Gordon Wilson, 25192 Adelanto Drive, Laguna Niguel;
Sydney Gielow, 3018 Samoa Place;; Costa . Mesa; Paul Studier, .
24302 Ursula Circle, Lake Forest; Dennis Shor, No. 5
Ironwood, Irvine; and Don Hull, .1830 Tahiti Drive, Costa Mesa.
The City Manager clarified that he had authored a
memorandum indicating that he wished to pull this item due to
concerns regarding -the proposed agreement.
MOTION/Continued On motion by Mayor Monahan, seconded by Council Member
to March 20, 2000 Erickson, and carried 5-0, this item was continued to the
meeting of March 20, 2000.
PUBLIC HEARING The Deputy City Clerk announced that this was the time and
PA-99-40/Tentative place set for the public hearing to consider Planning Application
Tract Map T-15882, PA -99-40 and Tentative Tract, Map T-15882, for Standard
Segerstrom Pacific :,Corporation,':- 1-565 MacArthur Boulevard, Costa Mesa,
authorized agent for C. J. Segerstrom and Sons, 3315 Fairview
Road, Costa Mesa, for a Master Plan review for a 90 -unit,
small lot, single-family subdivision, with an administrative
adjustment to allow a 14 -foot setback along a portion of
Adams Avenue fora bus bay (20 -foot setback required); and a
Tentative Tract Map for a 90 -unit subdivision with five
common lots and five private streets, located at 1645 Adams
Avenue in a PDR -MD zone: i. Environmental Determination:
Negative Declaration. The Affidavit of Publication is on file in
the City Clerk's office. Communications supporting the project
were received from Costa Mesa residents Thomas L. Schworer,
1816 Kinglet Court; and Neil Horgan, 2827 Nevis Circle.
Communications opposing the project were received from
Costa Mesa residents Audrey O'Neil, 2855 Corvo Place; Karen
Barloon, 2978 Country Club Drive; John, Lori, and Kaylee

Communications were received from Mr. And Mrs. Bill Rogers,
1775 Oriole Drive; Costa Mesa, expressing concern regarding
traffic issues; and from the applicant, Standard Pacific
Corporation, advising of its intention to modify the existing
project for reconsideration by the Planning Commission. The
Development Services Director reviewed the Agenda Report
dated February 23, 2000.
Scott Stowell, Division President, Standard Pacific Corporation,
proposed the following .revisions to this application for Planning
Commission consideration: eliminating a gate at the entry to
the project; adding a second pedestrian access at the shopping
center, resulting in the loss of one lot; restricting traffic exiting
the project to right- and left-hand turns only thereby eliminating
cut -through traffic; expanding open space in the community
around the private recreation center, resulting in the loss of
one lot; and studying the feasibility of extending the length of
the right-hand turn pocket at Mesa Verde Drive East and
Adams Avenue. He suggested that the above modifications
may elicit a more favorable response from the Planning
Commission and the community, and requested that the project
be referred back to the Commission to address these issues.
He responded to questions from Council.
Council Member Dixon stated that all issues of concern had not
been addressed by Mr. Stowell, and asked that the density be
lowered, and the need for a right-hand turn lane at Mesa Verde
Drive East and Adams Avenue be reviewed. She stated that a
half -acre is not sufficient for the tot lot for the development,
and suggested that a 5 -foot setback for the 8 -foot wall along
the property line next to commercial property, properly
landscaped with trees, be considered. She requested that the
bus turnout be addressed, and asked for clarification from
staff. Council Member Erickson commented that he would like
to see a design that incorporates a larger lot size. Council
Member Somers concurred with the concerns regarding size
and density of the project.
The following Costa Mesa residents addressed their concerns,
including a request to modify the project to lower -density,
ensure a neighborhood -friendly, compatible development,
widening the exit at the golf course onto Mesa Verde Drive
East, and addressing traffic issues: Robin Leffler, 3025 Samoa
Place; Sydney Gielow, 3018 Samoa Place, asking that mature
landscaping be a high priority; Bob Knapp, 2705 Sparrow
Circle; Leroy J. Taube, 1605 Minorca Drive; Doug Sutton,
2739 Canary Drive; Christine Briee, 1771 Hummingbird Drive;
Neil Horgan; 2827 Nevis Circle; Jerry Gray, 2588 Westminster
Avenue; Karen Robinson, 2722 Canary Drive; . and Shirley
Willard, 1840 Oriole Drive. There being no other speakers, the
Mayor closed the public hearing.

MOTION/Continued A motion was made by Mayor Pro Tem Cowan, seconded by

application to the Planning Commission meeting of April 10,
2000, to consider the modifications proposed by Standard
Pacific Corporation, and the recommendations made by the
City Council Members, especially the need to reduce the
density.
RECESS The Mayor declared a recess at 9:00 p.m., and reconvened the
meeting at 9:10 p.m.
PUBLIC HEARING The Deputy City Clerk announced that this was the time and
Group Homes place set for the public hearing to consider an ordinance
amending Title 13 of the Costa Mesa Municipal Code regarding
regulation of group homes. Environmental Determination:
Exempt. The Affidavit of Publication is on file in the City
Clerk's office. No' communications were received. The
Development Services Director summarized the Agenda Report
dated February 28, 2000.
Rory Hughes, 2013 Republic Avenue, Costa Mesa, asked why
group homes -are allowed in residential neighborhoods. Mayor
Monahan responded that 6 or fewer residents in a group home
would be covered by the housing code, and the City is unable
to impose restrictions. There being no other speakers, the
Mayor closed the public hearing.
MOTION/Ordinance On motion by Council Member Erickson, seconded by Council

Reading first reading: AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, AMENDING TITLE 13
OF THE COSTA MESA MUNICIPAL CODE REGARDING
REGULATION OF GROUP HOMES, revising Section 13-32.2,
Referral Facility, (a) to read, "No referral facility may be located
within 500 feet of property that is as zoned as R-1 or PDR -LD,
or within 500 feet of a school, ..park, place of worship, or
licensed day care facility." Second reading and adoption is
scheduled for the meeting of March 20, 2000.
OLD BUSINESS The Deputy City Clerk presented from the meeting of February
Negotiations with 7, 2000, negotiations with Sakioka Farms, and Roy K. Sakioka
Sakioka Farms, and Sons, 14850 Sunflower Avenue, Santa Ana, regarding
Parcel No. 101370- Parcel No. 101370-2 and the temporary construction
2 easements for the Transitway Project.
MOTION/Continued On motion by Mayor Monahan, seconded by Mayor Pro Tem
to April 3, 2000 Cowan, and carried 5-0, this item was continued to the
meeting of April 3, 2000.
OLD BUSINESS The Deputy City Clerk presented from the meeting of January
Canyon Park Tree 17, 2000, Canyon Park Tree Growth Management and
Growth Manage- Maintenance Plan; and preparation of a biological evaluation of
ment Plan the Canyon Park habitat, revision of the Canyon Park planting
plan, and submission of an amendment to the Coastal
Commission for the Canyon Park Coastal Development Permit.
The Public Services Director summarized the Agenda Report
dated February 27, 2000, reporting that interested parties have
been notified of this evening's meeting.

Mark Mcllroy, 2039 Republic Avenue, Costa Mesa, complained
that the Agenda Report was not mailed in sufficient time, and
asked questions regarding tree topping which were responded
to by the Park Superintendent. Mr. Mcllroy expressed
displeasure that the Canyon Park Cleanup will include the
planting of trees.
Donald Nicholson, 2063 Republic Avenue, Costa Mesa,
commented on the amount of money and staff time spent on
this issue. He indicated that the funds should have been
directed towards replacing the ground cover on Victoria Street
or repairing potholes throughout the City.
Glen Davidson, 2009 Republic Avenue, Costa Mesa,
commented that the trees behind his home block his view of
the ocean.
Mildred Nicholson, . 2063 Republic Avenue, Costa Mesa,
objected to accommodating a few people for aesthetic reasons,
and suggested investing the money for the benefit of all the
citizens.
Jim Keller, 2033 Republic Avenue, Costa Mesa, mentioned that
an ocean view would increase property values, and was of the
opinion that the area will eventually become a forest. He asked
about the trees to be planted during the Canyon Park Cleanup,
and the City Manager replied that the flyer generally used had
been updated which does not necessarily mean that a planting
will take place.
Rory Hughes, 2013 Republic Avenue, Costa Mesa, indicated
that letters from the Department of Fish and Game and the
Coastal Commission, supported removing the trees and
replacing them with shrubs. He asked that the City continue
the process of removing the trees. The Public Services
Director responded that indications are that the two above-
mentioned agencies would not approve the removal of trees,
and any wildlife habitat removed would need to be replaced.
Council Member Somers suggested the continued, adequate,
on-going pruning of the trees as a viable alternative. The Park
Superintendent proposed that the City's contractor evaluate
the trees in question. Council Member Somers stated that
although she would like residents to retain the value of their
homes, that the value of the park is also important. She
opposed replacing well-established trees with 24 -inch box or
15 -gallon "twigs".
Mayor Pro Tem Cowan indicated her interest in working with
the Coastal Commission to determine a tree -management
system that will satisfy the needs for the residents of the
community with view issues, while maintaining the integrity of
the park.
MOTION/Gave A motion was made by Mayor Pro Tem Cowan, seconded by
Directions to Staff Council Member Erickson, and carried 5-0, to authorize an
expenditure to do what is necessary with the Coastal
Commission, and to review the Coastal Park Development
Permit; directing staff to meet with the residents and work
through the proposed modifications, eliminating the use of tree

topping; to begin - the Coastal Commission permit process
addressing this issue; and to work with the contractor (West
Coast Arborists) in its evaluation of the trees and contact the
Newport Terrace Condominiums Association, offering the
contractor's evaluation of their trees at the same time, with the
intent of a joint contract in the future.
Mayor Monahan asked that staff notify Council when they will
meet with the residents.
NEW BUSINESS The Deputy City Clerk presented resolutions concerning Senate
SB402 and SB739 Bills 402 and 739: resolution opposing Senate Bill 402,
Compulsory and Binding Arbitration for Police and Fire
employees; and resolution opposing Senate Bill 739, Local
Government Collective Bargaining. The Administrative Services
Director reviewed the Agenda Report dated February 28, 2000.
MOTION/Adopted On motion by Mayor Monahan, seconded by Council Member
Resolutions 00-14 Erickson, and carried 5-0, the following resolutions were

CITY ATTORNEY'S The City Attorney requested a closed session pursuant to
REPORT/Request Government Code Sections 54956.9(a) and 54957 to discuss
for Closed Session: the following: City of Costa Mesa v. Sequel Contractors, et
City v. Sequel; and al., Orange County Superior Court Case No. 778563; and a
Resolution 00-3, request from the Administrative Services Director for City
City Manager and Council direction in consideration of applying formerly adopted
City Attorney Resolution 00-3 as it relates to personnel performance
evaluations of the City Manager and City Attorney. The City
Attorney reported that these: items could be considered in open
session.
MOTION/Accepted Regarding City of Costa Mesa v. Sequel %cntr.actors, et al.,
Settlement Orange County Superior Court Case No. 778563, a motion was

COUNCIL Council Member Dixon congratulated the Estancia High School
COMMENTS Boy's Soccer team for winnng the CIF Championship. She

EI Toro Discussions Council Member Somers announced that she will represent the
City in discussions with the Orange County Regional Airport

regarding the EI Toro Marine Corps Air Station.
Gangs Council Member Erickson recommended the soccer program at
Estancia High School as one alternative to gang membership.
He supported the use of parks, soccer fields, and school
programs towards this end.
Little League Mayor Pro Tem Cowan reported on the opening day of Little
Opening Day League on Saturday, March 4, 2000. She commented on the
community effort involved in keeping children out of gangs.
