REGULAR MEETING OF THE CITY COUNCIL
CITY OF COSTA MESA
AUGUST 21, 2000
The City Council of the City ;of Costa Mesa, California, met in
regular session August 21, 2000, at 6:30 p.m., in the Council
Chambers of City Hall, 77 Fair; Drive, Costa Mesa. The meeting
was called to order by the Mayor Pro Tem, followed by the Pledge
of Allegiance to the Flag led by Council Member Erickson, and
invocation by Pastor Shin Asami, Orange Coast Free Methodist
Church.

MINUTES On motion by Council Member Erickson, seconded by Council
August 7, 2000 Member Dixon, and carried 3-0,,Mayor Monahan absent, Mayor Pro
Tem Cowan abstaining, the minutes of. -the regular meeting of
August 7, 2000, were approved as distributed.
ORDINANCE AND A motion was made by Council Member Erickson, seconded by
RESOLUTIONS Council Member Dixon, and carried 4-0, Mayor Monahan absent, to
read all ordinances and resolutions by title only.
PRESENTATION Cheryl Jaffe announced the grand opening of the Upper Newport
Upper Newport Bay Bay Interpretive Center, located at University Drive and Irvine
Interpretive Center Avenue, on Saturday, October 14, 2000, and provided a telephone
number of (949) 640-6746 for further information. Bob Shepherd
reported that the project is managed by the County of Orange,
Parks and Recreation Division', and related the purpose of the
Center. Ms. Jaffee indicated) that she would provide Council
Member Somers with' information on a designated bus route for
schools and other attendees at the Center. Council Member Dixon
extended her thanks to Peter and Mary Muth who are dedicated to
the environment and to education.
PRESENTATION Mayor Pro Tem Cowan congratulated Brian Carey on being named
Employee of the Employee of the Month for August, 2000, in appreciation of his
Month contribution to the Public Services Department. Mr. Carey is
recognized for a remarkable job; in improving and caring for the turf
at the Costa Mesa Farm Sports Complex, and for rehabilitation of
the Costa Mesa Golf Course in his role as a Maintenance
Supervisor.

ORAL COMMUNI- Mildred Nicholson, 2063 Republic Avenue, Costa Mesa, complained
CATIONS about the number of delivery trucks in the Freedom Homes area,
Delivery Truck specifically www.homegrocer.com. She indicated that the trucks
Problem; Victoria are parked illegally, either too far from the curb or on the wrong side
Street Parkway of the street, and they sometimes block the intersection. Mrs.
Nicholson reported that she had spoken with a staff member
regarding the landscaping of Victoria Street, and he observed that
grass would be the most efficient planting along the parkway.
Mayor Pro Tem Cowan asked the Development Services Director to
investigate the Homegrocer problem, and request that their trucks
observe the City's traffic regulations.
Errant Truck Don Nicholson, 2063 Republic Avenue, Costa Mesa, reported a
telephone truck that had parked on their street on street -sweeping
day.
19th Street Bridge Robert Graham, 3260 Dakota Avenue, Costa Mesa, addressed the
delay' in completion of the Santa Ana River Crossing Study,
commenting on the cost to both the City and the contractor. He
believed that the delay is caused by the need to revise figures to
justify deletion of the 19th Street bridge. Mr. Graham addressed
traffic issues in relation to construction of the bridge, stating that an
increase in traffic on West 19th Street, which is a commercial area,
would be beneficial.
Graffiti/Seal Street Campbell Davidson, 1982 Arnold Avenue, Costa Mesa, thanked
ADA Ramps staff for the quick removal of graffiti on an electrical box at the
corner of Meyer Place and 19 Street. He asked the status of
Americans with Disabilities Act ramps on Seal Street. The
. Transportation Manager replied that a response will be forwarded
within the week.
19th Street "Auto Janice Davidson, 1982 Arnold Avenue, Costa Mesa, addressed the
Zone"; Handicap "auto zone" which is planned for 19th Street, stating that the project,
Access; Panther after checking- with the City's Planning Division, is very acceptable
Palace with the proper setbacks, trees, and a beautiful roof. She thanked
the City for the handicap considerations in her neighborhood,
including signs which indicate "Slow, Children Playing." The City
Attorney provided an update on the Panther Palace, stating that a
civil action has been filed by the City.
Property Mainte- Eleanor Egan, 1893 Parkview Circle, Costa Mesa, asked when
nance Ordinance enforcement of the property maintenance ordinance would begin.
The Development Services Director replied that it is anticipated that
enforcement of the ordinance will commence approximately 60
days from its adoption. He reported that all property owners in the
City, approximately 30,000, will be noticed around the first weekend
in September, and enforcement will ensue about two weeks
thereafter. The Mayor Pro Tem Cowan clarified the educational
process for Mrs. Egan.
Millard Comments Martin Millard, 2973 Harbor Boulevard, Costa Mesa, noted the
slum -like conditions which exist in Mesa North, including broken
sidewalks along Baker Street and Paularino Avenue between Babb
Street and Fairview Road. He reported that the area is littered with
trash, partly due to the lack of trash cans. He commented on
unsightly signs, and objected to the produce trucks in the "Fillmore
Slums". Mr. Millard noted the existence of "illegal alien drop
houses" in the "Fillmore Slums", stating that he has reported the
situation to Code Enforcement.
CONSENT The following item was removed from the Consent Calendar: Item
CALENDAR No. 10: Resolution setting the,tax rate per centum for 2000-2001
under the 1974 Open Space Bond Issue.
MOTION/Approved On motion by Council Member Erickson, seconded by Council

BUSINESS Notice of Intention to Appeal or Solicit for Charitable Purpose was

1974 Open Space Item No. 10 on the Consent Calendar was presented: Resolution

Robert Graham, 3260 Dakota Avenue, Costa Mesa, asked if most
of the money from the bond fund had been used to purchase
Fairview Park. The City Manager replied that the majority of the
funds were channeled to the improvement of TeWinkle Park and
the purchase of various other smaller park sites.

Previous Negative Declaration. Communications were received
from Dana Bieber, Project Manager, Standard Pacific Homes,
submitting a conceptual landscape plan showing the addition of 14
24 -inch trees; and Marilyn and Egon Reich, 2797 Bunting Circle,
Costa Mesa, opposing the present plan. The Development
Services Director summarized the Agenda Report dated August 16,
2000.
Dana Beiber, Project Manager, Standard Pacific Homes, reviewed
the history of the project, stating that the following issues are
addressed in the revised plan: density, traffic, gated community,
traffic signal, schools, perimeter landscape buffer, neighborhood
home values, project entry location, private yard area, private
sidewalks, right-hand turn lane at Mesa Verde Drive, private
recreation area, and parking within the project. She report that
meetings had been held with the Mesa Verde ad hoc committee on
March 24, 2000, the Mesa Verde Homeowners Association Board
of Directors on April 5, 2000, and the Mesa Verde Homeowners
Association general membership on June 7, 2000. On July 10,
2000, the Planning Commission unanimously recommended
approval of the revised project. Ms. Beiber indicated that the
redesigned plan, which provides a variety of housing opportunities,
fulfills the goals of the City's General Plan.
Mayor'Monahan arrived at 7:10 p.m.
The following Costa Mesa residents expressed concern regarding
the revised Standard Pacific project: Mildred Nicholson, 2063
Republic Avenue, cited traffic concerns; Tim Cromwell, 2029 Swan
Drive, stated that the location is not suitable for single-family
homes; Arlene Flanagan, 3090 Bali Circle, opposed the project
based on the density; Robin Leffler, 3025 Samoa Place, asked that
the project be refined; Martin' Millard, 2973 Harbor Boulevard,
stated that there are too many houses for the size of the site;
Gordon Pate, 2973 Ceylon Drive, Costa Mesa, opposed the number
of homes; Karen Robinson, 2722 Canary Drive, suggested reducing
densities; and Tim Sessler, 2722 Canary Drive, maintained that the
project remains high density.
The following Costa Mesa residents commended Standard Pacific
on the revisions and urged approval of the project: Tom Schworer,
1816 Kinglet Court; Sue Thoma; 1818 Tanager, suggested removal
of one home to allow room for a small "park; Alan Tuntland, 211
East 20th Street; David Keefe, 13109 Lincoln Way; Jeff Cox, 1219
Las Arenas Way; Melinda Young, 3186 Madeira Avenue; Bob Love,
2713 Starbird Drive, asked for the landscaped median; Luis Mota,
2159 Meyer Place, suggested increasing the size of the lots; and
Cindy Brenneman, 1856 Elba Circle.
Additional comments were received from Costa Mesa residents
Doug Sutton, 2739 Canary Drive, who favored the project, and
suggested that the City fund divided landscaped medians; Janice
Davidson, 1982 Arnold Avenue, suggested 6,000 square -foot lots to
conform with the Mesa Verde density; Eleanor Egan, 1893
Parkview Circle, noted serious concerns about the urbanizing trend
that this project represents; Milton Allione, 1777 Kinglet Court,
supported a tree -lined median, and suggested that the project be
refined to add more land around the homes; Rita Simpson,1832
Kinglet Court, thought that the requirements should be 60 homes or
6,000 square foot lots, and thatthe size of the tot lot be increased;
Robert Graham, 3260 Dakota Avenue, expressed concern
regarding bicycle trails near the project; and Shirley Willard, 1840
Oriole Drive, believed the project should conform to the density
requirements of the balance of the Mesa Verde area.
Ms. Beiber, Standard Pacific ; Homes, addressed the issue of
installing a landscaped median on Mesa Verde Drive, stating that a
feasible plan has been devised.; She observed that the property is
zoned PRD medium density, and the project is designed to be
compatible with surrounding use's.

Council Member Somers commented that this is a high quality
project and meets all requirements. She felt that the project would
be an influence for higher housing prices in Costa Mesa. Council
Member Erickson observed that the property has a General Plan
designation of medium density, and he was of the opinion that the
project is a good one.
MOTION/Adopted A motion was made by Council Member Erickson, seconded by
Resolution 00-67 Council Member Somers, and carried 5-0, to adopt Resolution 00-
67: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, APPROVING PLANNING
APPLICATION PA -99-40R AND TENTATIVE TRACT MAP T-
15882, subject to all conditions, and adding the following condition:
"The developer be directed to work in accordance with the City of
Costa Mesa's plans and specifications under the oversight of the
Public Services Director to install a landscaped median adjacent to
the project on Mesa Verde Drive East."
Council Member Dixon supported the motion, stating that Standard
Pacific Homes revised the project in accordance with the wishes of
Council and a majority of the community. She believed that the
prices of the homes will provide an opportunity for those moving into
Costa Mesa to purchase a new residence.
RECESS The Mayor declared a recess at 8:10 p.m., and reconvened the
meeting at 8:25 p.m.
OLD BUSINESS The Deputy City Clerk presented from the meeting of August 7,
Request for Re- 2000, a request from Jim Cefalia, 1649 Bayside Drive, Newport
hearing, Cefalia Beach, for rehearing of the City Council's June 5, 2000, decision
denying Development Review DR -00-05 and Vesting Tentative
Tract Map VT -15991, for property at 2087 Garden Lane. A
communication was received from Roger Grable, Paone, Callahan,
McHolm, & Winton, 19100 Von Karman Avenue, Eighth Floor,
.Irvine, attorney for the applicant, stating that they believe the
revised site plan, with the exception of the lot sizes, substantially
meets the criteria of the draft, small -lot division ordinance. The
Development Services Director reviewed the Agenda Report dated
August 10, 2000.
The City Attorney recommended that Council consider the petition
for rehearing as an individual item, based upon the application for
appeal or rehearing. He added that if the rehearing is not granted,
Council can provide feedback to the applicant with respect to the
proposed amended project. He indicated that if the matter is
referred to the Planning Commission, it would be an amended
application pursuant to the moratorium ordinance, and no additional
fee would be required.
Roger Grable suggested that Council's concerns regarding the
project could be addressed at a rehearing, and agreed with the City
Attorney's opinion that an amended application could it be referred
back to the Planning Commission.
MOTION/Denied A motion was made by Council Member Erickson, seconded by

The Development Services Director reported that this item will be
directed to the Planning Commission meeting of September 25,
2000.
Council Member Dixon asked Mr. Grable if he could investigate the
reason that cars may not be parked in the driveways on the project.
Council Member Somers returned to the Council Chambers at 8:35
p.m.
OLD BUSINESS The Deputy City Clerk presented- from the meeting of August 7,
Fairview Park 2000, Fairview Park Master Plan Amendment request:
Master Plan
Downgrade the paved multi-purpose trail located adjacent to
the Fairview Channel to an unpaved pedestrian trail.
Request that all new trails in Fairview Park be constructed of
dirt or natural materials including decomposed granite.
Use of concrete as an acceptable substitute for trails indicated
to be constructed with asphalt pavement.
Reconfirm the master planned width of the multi-purpose trail
system in Fairview Park.
Communications were received from Duke Gallagher, 1946 Pelican
Place, Costa Mesa, opposed to paving the. natural trails; David
Goss, 2021 Kornat Drive, Costa Mesa, asking Council to limit the
size of paved bikeways to leave,the unpaved trails as they currently
exist; and Richard - J. Mehren, ; 1824 Kinglet Court, Costa Mesa,
asking Council to consider several points regarding paved trails at
Fairview Park, and supporting a minimally paved trail system. The
Transportation Services Manager summarized the Agenda Report
dated August 15, 2000.
Mayor Pro Tem Cowan applauded the master plan as devised by
the Fairview Park Committee - and described Fairview Park as
having the potential for a natural environment. She stated that she
worked with staff to reidentify ;the standards for the trails. She
explained the City's obligation to those who ride bicycles, and noted
the requirement, due to being a part of the regional commuting
lane, to provide a Class 1 bikeway connection. Mayor Pro Tem
Cowan recommended reducing the width of the proposed trails, not
reducing the number, and assuring that asphalt or natural materials
such as decomposed granite make up the vast majority of the miles
of trails.
Tim Cromwell, 2029 Swan Drive, Costa Mesa, asked why a nature
preserve would have concrete roads which cover over 3 percent of
the terrain. He suggested one asphalt road for high-speed bicycle
ingress and egress to the Santa Ana River trail, and leaving the
natural trails in tact. He reported that an ecologist with the
California State Park System, a 'specialist in trails, indicated that the
hillside trails suffered insignificant erosion. Mr. Cromwell felt that
the existing parking lot of 103; spaces is sufficient, and that the
Master Plan's proposed addition -of 60 spaces is not needed.
The following persons opposed the concrete trails and other
aspects of the Fairview Park Master Plan: resident at 1970 Swan
Drive, Costa Mesa; John Schuyler, 12221 Beach Boulevard, No. 6-
D, Garden Grove, read a letter from David Goss, 2021 Kornat Drive,
Costa Mesa; Win Lewis, 1954 Sanderling Circle, Costa Mesa,
opposed the extra 60 spaces for parking; Milton Allione, 1777
Kinglet Court, Costa Mesa, opposed an entrance to the park from
the adjacent housing tract; resident at 2110 President Place, Costa
Mesa, stated that Fairview Park is not "horse friendly"; John
Goldman, Orange Coast College Cross Country Coach, 2071
Fairview Road, Costa Mesa; Susan Weeks, 2949 Andros Street,
Costa Mesa; Nancy Corcorran, 2165 Canyon Drive, No. G-1, Costa
Mesa, urged reconsideration of paving the trails; Jan Vandersloot,
2221 East 16th Street, Newport Beach, suggested that the width of
the trails be decreased to 8 feet, the existing trail not be replaced,
the overall number of trails be reduced, concrete not be used for
paving the trails, and location of the trails be reconsidered; resident
at 2005 Swan Drive, Costa Mesa; Robin Leffler, 3025 Samoa
Place, Costa Mesa; Donna Mee, no address given; Janet
Remington, 1164 Boise Way, Costa Mesa; the Estancia High
School Cross Country Coach; Sandra Genis, 1586 Myrtlewood
Street, Costa Mesa, opposed concrete trails; Bill Fritzsche, 2044
Republic Avenue, Costa Mesa, President of the Orange County
Track Club; Kare Grams, 3237 Minnesota Avenue, Costa Mesa,
opposed fencing the vernal pools; Chris Huey, 2006 Swan Drive,
Costa Mesa; Dean Reinemann, 1877, Park View Circle, Costa
Mesa; Daniel Vargas, 1592 Caraway Drive, Costa Mesa; Jessica
Butler, 2946 Ceylon Drive, Costa Mesa; Katie Needham, 2816
Serang Place, Costa Mesa; resident at 2035 Pomona Avenue,
Costa Mesa; and resident at 631 Victoria Street, Costa Mesa.
Robert Graham, 3260 Dakota Avenue, Costa Mesa, approved of
the Fairview Park Master Plan, and commented that the park in its
present state is not a natural park.
Janice Davidson, 1982 Arnold Avenue, Costa Mesa, agreed with
the use of crushed gravel; David Kinkade, 2001 Swan Drive, Costa
Mesa, expressed concern over potential loss of the hilly exercise
area used by Estancia High School athletes, and urged approval of
recommendation No. 4 with the exception of a high-speed trail for
access across the park; Judith Gielow, 469 East 18th Street, Costa
Mesa, reported that the park is in decline ecologically, and the State
of California requires preservation of the vernal pools and native
American Indian sites; Randy Mees, 2210 Canyon Drive, No. C1,
Costa Mesa, asked that the park be retained in its present state;
Robert McKasson, 124 31St Street, Newport Beach, suggested
fencing off the vernal pools; Karen Robinson, 2272 Canary Drive,
Costa Mesa; encouraged referring this item again to the Planning
Commission; and Fred Bockmiller, 1872 Monrovia Avenue, No. B4,
Costa Mesa, suggested using the grant monies for bicycle trails on
the west side of Costa Mesa.
Richard J. Mehren, 1824 Kinglet Court, Costa Mesa, reported that
the Master Plan calls for a .total of three miles of paved trails
throughout the 210 -acre park. He agreed with downgrading the
paved multi-purpose trail adjacent to the Fairview Channel. Dr.
Mehren commented that the Master Plan is a conceptual plan which
provides a broad overview and does not contain exact dimensions.
He provided a brief history of the park, and offered his suggestion of
10 -foot wide trails with a 4 -foot wide natural surface.
Mayor Monahan suggested that staff review the comments made
this evening and return to the next Council meeting with a "minimum
paving/maximum natural" plan for the park. He asked staff to

Mayor Pro Tem Cowan proposed that the questions regarding the
trails be answered at this meeting and not delayed another two
weeks.
MOTION/Gave A motion was made by Mayor Pro Tem Cowan, seconded by
Directions to Staff Council Member Erickson, and ;carried 5-0, to redefine the Master
Plan guideline for trail systems as follows: all Pedestrian Trails
shall be no more than 3 feet wide and constructed of natural
materials as recommended by the designer; the Multi-purpose Trail,
Type A, shall be constructed ofconcrete 8 feet wide, with 2 feet of
natural materials on either side of the trail; the Multi-purpose Trail,
Type A*, shall be 8 feet wide and constructed of natural materials;
the Multi-purpose Trail, Type B, Adjacent to the Channel, shall
become a pedestrian trail; the Multi-purpose Trail, Type C, Blufftop,
shall be 4 feet wide, constructed of natural materials or
decomposed granite for accessibility; the Multi-purpose Trail, Type
D, shall be 4 feet wide, constructed of natural material or asphalt,
as needed for accessibility and bike connections; and Multi-purpose
Trail, Type E, Bicycle Trail Separated from Walk, shall remain as
shown on Page 9 of the Agenda Report; and staff was directed to
place this new information on ;the agenda for public input at the
meeting of September 5, 2000.
Council Member Erickson commended Mayor Pro Tem Cowan on
her comprehensive motion. Council Member Somers suggested
that the points regarding equestrian access be addressed. Mayor
Pro Tem Cowan proposed that the access be considered when the
design is reviewed. Council: Member Dixon stated that she
appreciated the audience participation, and suggested that those
interested apply to become members of the committee for Fairview
Park.
Council Member Somers left the; meeting at 10:25 p.m.
OLD BUSINESS The Deputy City Clerk presented from the meeting of August 7,
Rooftop Storage 2000, an ordinance amending Title 20 of the Costa Mesa Municipal
Code regarding rooftop storage. The Development Services
Director reviewed the Agenda Report dated August 14, 2000.

Reading. Ordinance 00-14, AN ORDINANCE OF THE CITY COUNCIL OF

OF THE COSTA MESA MUNICIPAL CODE REGARDING
ROOFTOP STORAGE, was given first reading and passed to
second reading. Second reading and adoption are scheduled for
the meeting of September 5, 2000.
OLD BUSINESS The Deputy City Clerk presented replacement/Upgrading of the
Neighborhood fountain area at the Neighborhood Community Center:

Concept Plan "A" for the replacement/upgrade.
Allocation of $272,500.00 ; from existing excess Downtown
Recreation Center' funds for the design, construction, construction
management, and inspection/;testing/architectural oversight.
Amendment to the agreement with Martinez and Amador
Architects, Inc., 8405 Pershing Drive, Suite 201, Playa del Rey,
for $27,500.00, for architectural design.

The City Manager reviewed the Agenda Report dated August 14,
2000. Council Member Dixon suggested implementing a "bench"
program at this time for citizens who wish to contribute. The City
Manager responded that the Costa Mesa Community Foundation is
the appropriate vehicle through which to channel any donations.
MOTION/Approved A motion was made by Mayor Pro Tem Cowan, seconded by
NCC Upgrade Council Member Dixon, and carried 4-0, to approve Concept Plan
Recommendations A, to allocate $272,500.00 from the existing excess Downtown
Recreation Center funds, to approve an amendment to the
agreement with Martinez and Amador Architects, Inc., and to direct
staff to prepare a proposal for a bench naming program for Council
consideration.
NEW BUSINESS The Deputy City Clerk presented a request for youth participation at
Youth Participation the annual League of California Cities Conference, September 7
in League Meeting through 9, 2000, in Anaheim. The Assistant to the City Manager
summarized the Agenda Report dated August 11, 2000.
MOTION/Approved A motion was made by Mayor Pro Tem Cowan, seconded by
Youth Participation Council Member Dixon, and carried 4-0, to underwrite the
participation of up to five teens with the League of California Cities,
inviting the Advisory Committee of Teens, and then Costa Mesa
high school students.
COUNCIL
COMMENTS/Flood Council Member Erickson thanked staff for the recent mailing to
Zone Insurance residents and businesses regarding a potential reimbursement for
flood zone insurance. He congratulated the City Manager and
Measure "O" thanked the Costa Mesa Tourism Board for encouraging their
Executive Directive to sign the City's Ballot Measure "O" to increase
the'Transient Occupancy Tax by a maximum of 2 percent.
Victoria Street
Landscaping/ Mayor Pro Tem Cowan asked staff to provide a brief update on the
Bark Park Victoria Street landscaping. She supported plantings, as opposed
to turf, as a viable option. She also asked staff for an update on the
Bark Park construction project at the meeting of September 5,
2000.
