SPECIAL JOINT MEETING OF THE CITY COUNCIL
AND REDEVELOPMENT AGENCY
CITY OF COSTA MESA
December 8, 2003
The City Council and ;the Redevelopment Agency of the City of
Costa Mesa, California, met in special joint session on December
8, 2003, at 7:20 p.m.;, in Conference Room 1-A of City Hall, 77
Fair Drive, Costa Mesa. Notice of the special meeting was given
as required by law. ; The meeting was called to order by
Mayor/Agency Member Monahan, followed by the Pledge of
Allegiance.

PUBLIC COMMENT Beth Refakes, 320 Magnolia Street, Costa Mesa, advised that as
1901 Newport Plaza a Real Party in Interest that CMCRG has been working in good
Residents Project faith with the City and the developer. She informed that they had
some questions and concerns and would need time to make an
evaluation and a decision regarding the alternatives to be
proposed, stressing that it would not be prudent to rush a
decision. She expressed that CMCRG would like for a public
hearing to be conducted although: understood that it could not be
held unless a mutual agreement could be made.
Sandra Genis, - 1566 --Myrtle `'Way, Costa Mesa, made an
evaluation of the- land,.valdP=bf the. _property and homes based on
the Orange County-,&-szestor's records explaining how the
residual value of land`det;Qrnnines=the value of the land. She
asked Council to considerthe-�information in comparison to the
data previously presented by the developer in the consideration
of the financial aspects of the project. She -reiterated CMCRG's
good faith effort in the discussions and hoped the same from the
developer.
Terry Shaw, 420 Bernard Street, Costa Mesa, requested that
Council observe the golden rule, that the same rules apply to all,
and to not arbitrarily make changes for the benefit of a few, and

for compromise. While he would like the project to "go away" he
did state some suggestions that could be included in a
compromised alternative: to lower the height of the construction,
close the east exit, install a traffic -light at Harbor Boulevard and
Bernard Street, install mature landscaping where needed, ensure
mitigation of construction noise and dust and parking. He
commented that if there was compromise from the beginning, a
lot of what took place could have been avoided. He also hoped
that the special meeting was not a way to bypass the hearing
process that this project deserves.
To a question by Mayor Monahan, Mr. Shaw responded that
three stories in the height of the project facing Bernard Street
would be acceptable. He also clarified that in regards to the
parking mitigation measures he would consider "Residential
Only" permits for those on Bernard Street.
The City Manager confirmed for the City Council that Mr. Shaw's
recommendations have been received by CMCRG and by his
office and that they have sought to address each item in the
discussions that have been held.
Judy Berry, 2064 Meadowview Lane, Costa Mesa, expressed her
confusion at the ncsiiy_of conducting a joint meeting of the
City Council. and the. -_Red avelopment Agency. The City/Agency
Attorney responded. that = the _closed session will be only
conducted by the City- Council but that the necessity of joint
meeting was in the event that the Redevelopment Agency was to
give direction to staff regarding Redevelopment Agency
involvement in the project (i.e. affordable housing).
CLOSED SESSION Mayor Monahan presented the following closed session, and
1901 Newport Plaza adjourned to the closed session at 7:37 p.m.
Residents Project,
Rutter Development Pursuant to Section 54956.9(a) of the California Government
Corporation Code, a closed session has been scheduled for the City Council
to confer with legal counsel, Tom Wood, Acting City Attorney,
regarding existing litigation in the case of Rutter Development
Corporation v. the City of Costa Mesa, Orange County Superior
Court Case No. 03CC09792.
No Action Taken The Mayor reconvened the Special Joint meeting at 8:05 p.m.
and announced that no reportable action, pursuant to Section
54957.1 of the California Government Code, had been taken
during closed session.
OLD BUSINESS The Deputy City Clerk presented from the special joint meeting of
1901 Newport Plaza September 2, 2003, the subject matter involving 1901 Newport
Residences Projects Plaza Residences Project, Kennedy/Rutter Development.
MOTION/Set Date of Agency Member Cowan moved, seconded by Agency Member
Rehearing for Scheafer, and carried 5-0, to set the date of a rehearing of the
Tuesday, January 1901 Newport Plaza Residents Project for Tuesday, January 20,
20, 2004 2004, at 6:30 p.m.
MOTION/Directed Agency Member Cowan moved, seconded by Agency Member
Staff to Negotiate Scheafer, and carried 4-1, Agency Vice Chair Mansoor voting no,
Affordable Housing to direct agency staff to negotiate an affordable housing
Agreement agreement regarding 1901 Newport Plaza Residents Project to
be as complete as possible by the rehearing to be held Tuesday,
January 20, 2004.
Agency Vice Chair Mansoor expressed his opposition as he felt
that the applicant should be responsible for all of the affordable
housing associated with the project.
The City Manager assured the Council that mailings will be sent
to those that have addressed the Council, that a notice will be
placed on the City's cable television and on the City's website
and will also be published in the newspaper.
ADJOURNMENT Mayor/Agency Member Monahan declared the special joint
meeting of the City Council and the Redevelopment Agency,
adjourned at 8:11 p.m.
