REGULAR AJOURNED MEETING (STUDY SESSION) OF THE
CITY COUNCIL
CITY OF COSTA MESA
September 14, 2010
The City Council of the City of Costa Mesa, California met in a Regular Adjourned
Meeting (Study Session), on Tuesday, September 14, 2010 at 4:33 p.m. in
Conference Room 1A, 77, Fair Drive, Costa Mesa. The meeting was called to order
by the Mayor.

I. PUBLIC COMMENT
1. Beth Refakes, Costa Mesa, expressed her concerns regarding the proposed Graffiti
Ordinance. (00:00:37)
2. Jim Fitzpatrick , Costa Mesa, addressed graffiti abatement, and the franchise fees for
sanitation and hauling. (00:02:13)
3. John Feeney, Costa Mesa, addressed graffiti abatement, and opposed the franchise
fees for residential waste hauling. (00:04:01)
II. ITEMS FOR DISCUSSION
1. Amendments to the Graffiti Ordinance (00:06:22)
Assistant City Manager Tom Hatch introduced the report. Officer Jason Chamness
presented the report explaining the types of graffiti that is found regularly occuring in
the community, the "tools of the trade" and statistics for each type of graffiti. Officer
Chamness reported on effective ordinances in other cities and recent success by the
City Attorney's office to negotiate restitution. Discussion ensued on language for the
ordinance and the City's limits on graffiti removal and requiring property _owners to
remove graffiti on private property. Officer Chamness and Assistant City ---Manager

2. Potential Utilization of E -Verify (00:48:43))
Mayor Mansoor presented the report.: City Manager Allan Roeder provided an
overview of the U.S. Citizenship and Immigration Services E -Verify program and the
need for approval of staff time to research the program to determine uses. The City
Council was asked to provide direction :to staff to help determine level of research
and costs. Discussion ensued on the need for E -Verify, current City contracts and
business license requirements. Mr. Roeder and City Attorney Kimberly Hall Barlow
responded to questions from Council Members.
3. Residential Waste Hauling Franchise (01:07:43)
Public Services Director Peter Naghavi ,provided an overview of the current
residential waste hauling program and those of other cities. Mike Balliet, the City's
waste management consultant presented the report. Research on trash rates for
cities in Orange County found Costa Mesa to have the third highest rate, but does
not collect a franchise fee. Council Member Monahan discussed efforts by the
Costa Mesa Sanitary District to study rates, franchise fees and combining
commercial and residential waste hauling to save money for residents. Discussion
ensued on rates, recycling and determining a possible franchise fee to help offset
direct impacts to City infrastructure. Mr. Naghavi and City Attorney Kimberly Hall
Barlow responded to questions from Council Members.
4. Employee of the Month
The City Council reviewed applications for Employee of the Month; a preference was
indicated, absent any objection. Announcement of the Employee of the Month would
be made at a subsequent City Council meeting.

There were no Council comments made.
