ORDINANCE NO. 69' -V:2 -
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA
MESA, CALIFORNIA, REPEALING CERTAIN PORTIONS OF CHAPTER
VIII, ARTICLE 6 OF THE COSTA MESA MUNICIPAL CODES RE-
LATING TO TRAILERS AND TRAILER PARKS.
THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. The City Council of the City of Costa Mesa
hereby finds and declares that certain sections of the Health
and Safety Code of the State of California relating to mobile
homes and mobile home parks have been enacted relating to the
same material covered in certain sections of the Costa Mesa
Municipal Codes.
The City Council of the City of Costa Mesa
hereby further finds and declares that the matters contained in
Sections 8602 through and including 8608 of the costa Mesa
Municipal Codes are now covered in Article 2, Chapter 5 of Part
2.1 of Division 13, State Housing Act, being Sections 18610
through and including 18612.
The City Council of the City of Costa Mesa
further finds and declares that the State Legislature, by act,
found that Section 18300 of the Health and Safety Code has
specifically provided that the State Act supercedes any ordinance
enacted by any city or county in relation to the matters herein
contained. Accordingly, it becomes necessary for the City Council
of the City of Costa Mesa to repeal certain sections of its
Municipal Codes in conflict with the State Act which has pre-
empted local regulations.
Section 2. Sections 8602 through and including 8608 Of
Chapter VIII, Article 6 of the Costa Mesa Municipal Codes are
hereby repealed.
Section 3. Section 8601 of the Costa Mesa Municipal codes
is hereby amended to read as follows:

1 "Sec. 8601. Enforcement.
2 The Department of Building Safety shall enforce every
3 other provision of this Article; provided, however, that the
4 Health Officer shall enforce such sections hereof as pertain
5 to maintenance, use, occupancy and sanitation. The officers
6 or agents of the Department of Building Safety or the Health
7 Officer may:
8 (a) Enter public or private property to determine
9 whether there exists any trailer park to which this Article
10 applies.
11 (b) Enter and inspect all trailer parks wherever
12 situated, and inspect all accommodations, equipment or
13 paraphernalia used in connection therewith, including the
14 right to examine any registers of occupants maintained
15 therein in order to secure the enforcement of the provisions
16 of this Article."
17 Section 4. There is hereby added to the Costa Mesa
18 Municipal Codes Section 8612 which shall read as follows:
19 "Sec. 8612. Permit Procedure, or Zone Exception Permit
20 Required for Trailer Parks.
21 Application for permission to install and maintain
22 a trailer park shall follow the procedure set forth for
23 Zone Exception Permits found in Section 9299.1 through and
24 including 9299.14 of the Costa Mesa Municipal Codes."
25 Section 5. This Ordinance shall take effect and be in full
26 force thirty (30) days from and after its passage and prior to
27 the expiration of fifteen (15) days from its passage shall be
28 published once in the Orange Coast Daily Pilot, a newspaper of
29 general circulation, printed and published in the City of Costa
30 Mesa, together with the names of the members of the City Council
31 voting for and against the same.
