HomeMy WebLinkAbout68-01 Adopting OC Ordinance #21591 2 3 4 5 6 7 8 9 10 11 12 16 17 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 41=I AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADOPTING BY REFERENCE ORANGE COUNTY ORDINANCE NO. 2159, WHICH IS AN ORDINANCE RELATING TO ANIMAL CONTROL, WELFARE: LICENSE AND HEALTH REQUIRE- MENTS; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; AND REPEALING CERTAIN SECTIONS OF THE COSTA MESA MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. An Ordinance enacting Division 1 of Title 4 relating to animal control, welfare, license and health require- ments, adopted by the Orange County Board of Supervisors as Ordinance No. 2159, three copies of which are on file in the office of the City Clerk, establishing animal control, welfare, license and health requirements, is adopted by reference as if the same were set forth in full herein, with the exception of Section 1 thereof which has reference to the repeal of Division 1 of Title 4 of the Codified Ordinances of the County of Orange. Section 2. There is hereby repealed Sections 5100 up to and including Section 5140 of Divisions I, II and III of Article 1, Chapter V of the Costa Mesa Municipal Code. Section 3. Sections 5141 through and including Section 5152 of the Costa Mesa Municipal code relating to zones established for the keeping of animals are hereby retained in their entirety insofar as the same are not inconsistent or a duplication of the county ordinance heretofore adopted. Section 4. Section 5153 through and including Section 5161 relating to sanitary regulations are hereby retained insofar as the same are not inconsistent or a duplication of the county ordinance heretofore adopted. Section 5. Validity of Ordinance. If any section, subsectio sentence, clause or phrase of this Ordinance is for any reason hel to be unconstitutional or invalid, such decision shall not affect the validity or constitutionality of the remaining portions of -1- 1 2 3 4 5 6 7 8 9 10 11 12 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 this Ordinance. The City Council of the City of Costa Mesa hereby declares that it would have passed this Ordinance and each section subsection, sentence, clause or phrase thereof, irrespective of the fact that one or more of the sections, subsections, sentences, clauses or phrases thereof be declared unconstitutional or invalid. Section 6. PENALTY. Any person violating any of the provisi of this Ordinance shall be deemed guilty of a misdemeanor, and upo conviction thereof shall be punished by a fine of not more than Five Hundred Dollars ($500.00), or by imprisonment in the County Jail for a period of not more than six months, or by both such fine and imprisonment. !! Section 7. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published once in th Orange Coast Daily Pilot, a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same, prior to the expiration of fifteen (15) days from its passage. Section 8. The City Council of the City of Costa Mesa finds, determines and declares that an urgency exists, and by !! reason thereof this ordinance shall take effect immediately. The reason for the urgency is that the Orange County Health Department reports an urgent need to have administered within the City of Costa Mesa the new laws enacted by the state legislature for animal control on or before January 1, 1968 when certain provisions become effective. That in certain areas of animal control there is an urgent need for additional inspection and supervision which only the new amendments will permit the County Health Department to undertake, and this urgency ordinance is necessary to permit the lawful coordination of the various functions carried out by the Health Department. Further reason for the urgency of this -2- 1 2 3 4 5 6 7 8 9 10 11 14 15 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ordinance is because of the area of orange County being declared a rabies epidemic area by the State of California and a central control of this epidemic being desirable and being necessary for the County of orange to effectively combat this emergency.
