ORDINANCE NO. /. k'-10
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA
CREATING RULES AND REGULATIONS FOR THE CONDUCT OF THE PUBLIC
AND THE USE OF PARK FACILITIES WITHIN THE CITY OF COSTA
MESA AND SETTING FORTH PENALTIES FOR THE VIOLATION THEREOF.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
ORDAIN AS FOLLOWS:
Section 1. There is hereby added to the Municipal Codes of
the City of Costa Mesa a Chapter X consisting of Article 1
through 10 which shall be as follows:

ARTICLE 1

Sec. 10.001 PARKS DEFINED.
When used in the following articles, the word "park" shall
include all grounds, roadways, avenues, parks, buildings, school
facilities when they are in use as recreational facilities when
they are under control of the Director of Parks, and areas under
the control, management or direction of the Director of Parks of
the City of Costa Mesa.
Sec. 10.002 PARKS DEPARTMENT DEFINED.
When used in these articles, the words "Parks Department"
refer to those individuals appointed by the City Manager of the
City of Costa Mesa; Director of Parks.
Sec. 10.003 DIRECTOR OF PARKS DEFINED.
When used in these articles, the words "Director of Parks"
shall refer to the department head of the Parks Department
appointed by the City of Costa Mesa.

.The word "persons" when used in these articles includes
persons, associations, partnerships, firms and corporations.

RULES AND POLICIES OF THE PARKS DEPARTMENT TO BE
OBEYED
No person
shall disobey or violate any of the rules, policie
or regulations
of the Parks Department governing the use and
enjoyment by the
public of any park, square, avenue, grounds or
recreation center
of governing the use and enjoyment of any
building, structure,
equipment, apparatus or appliance thereon,
which rules or
regulations at the time are posted in some con-
spicuous place
in the park, square, avenue, grounds or recreation
center, or in
or near the building, structure, equipment, appara-
tus or appliance
to which the rule or regulation applies.
Sec. 10.006
SIGNS AND NOTICES TO BE OBEYED.
No person
shall disobey any instruction, sign or notice
posted by the
Parks Department in any park, square, avenue, grour
or recreation
center, or in any building, structure, construction
or erection thereon
for the control, management, or direction of
such park, square,
avenue, grounds, recreation center, building,

structure, construction or erection.
Sec. 10.007 PUBLIC MAY BE EXCLUDED,
In an emergency or when the City Council of the City of
Costa Mesa shall determine that the public interest, or public
health, or public morals, or public safety demands such action,
any park, square, avenue, grounds or recreation center or any
part or portion thereof, may be closed against the public and all
persons may be excluded therefrom until such emergency or other
reason upon which such determination of the City Council is based
has ceased, and upon the cessation thereof the park, square,
avenue, grounds or recreation center or part or portion thereof
so closed shall again be reopened to the public by order of the
City Council.
Sec. 10.008 RIDING OR DRIVING OF HORSES, DRIVING, PARKING,
WASHING ETC. OF AUTOMOBILES AND OTHER VEHICLES
IN PARKS, ETC.
No person shall ride or drive any horse or other animal or
drive or propel any automobile, truck, dune buggy, motorcycle,
motor scooter or any other motor powered vehicle within any
park, square, avenue, grounds or recreation center, except upon
the roads, driveways, paths and highways provided and designated
by the Parks Department for such use, and must ride or drive
suchh�rse or other animal or propel such automobile, truck, dune
buggy, motorcycle, motor scooter or any other motor powered
vehicle in a careful manner, at lawful rate of speed, and in
accordance with the rules and regulations made by the Parks
Department. Nor shall any person park any automobile or other
vehicle on any lawn or planted section in any park, square,
avenue, grounds, or recreation center, or in any pedestrian lane
therein, or any other place where the rules and regulations of th
Parks Department prohibit vehicular parking; nor shall any person
wash, polish, grease or repair any such automobile or other
vehicle in any park, square, avenue, grounds or recreation center
except insofar as repairs may be necessary for the immediate re-

moval of any damaged or disabled automobile or other vehicle from
such park, square, avenue, grounds or recreation center. No
automobile or other vehicle shall be parked in any road, place or
highway in any such park, square, avenue, grounds, or recreation
center except on the extreme right side of said road, place or
highway and immediately adjacent to the planted portion of said
park, square, avenue, grounds or recreation center; provided
however that the Parks Department shall have full power and
authority to set aside suitable space for the parking of any auto
mobile or other vehicle off any road, place or highway. The
extreme right side of said road, place or highway shall be deemed
the right hand side of any road, place or highway as measured or
applied in the direction in which any vehicle is traveling.
No person shall ride or drive a bicycle, skate board or
roller skates upon any tennis courts or shuffleboards within any
park, square, avenue, grounds or recreation center.
Sect. 10.009 PERFORMANCE OF LABOR IN PARKS.
No person shall perform any labor in or upon any park, squar
avenue, grounds, or recreation center such as taking up or re-
placing soil, turf, ground, pavement, structure, tree, shrub,
plant, grass, flower and the like, except under the supervision
and control of the Director of Parks, and by virtue of a permit
issued by the Director of Parks to some person authorizing such
labor.
Sec. 10.010 ORGANIZED GAMES., FLYING KITES. AEROPLANES OR
ROCKETS.
No person shall fly a kite, aeroplane (motor driven) or
propel a rocket or missile of any type, or participate in any
organized games such as baseball, football, hockey and the like i.
any park, square, avenue, grounds, or recreation center except
at such places designated for such use by the Parks Department.
Sec. 10.011 PEDDLING AND VENDING MERCHANDISE.
No person shall bring or cause to be brought, for the purpos

of sale or barter, or have for sale or sell or exchange, or offer
for sale or exchange any goods, wares, or merchandise, or other
things into any park, square, avenue, grounds or recreation
center, without first having obtained a permit from the City
Council of the City of Costa Mesa and appropriate business
license from the Director of Finance.
Sec. 10.012 GOLF
No.person shall play, practice, or in any way engage in the
game of golf within any public park or parkway in the City of
Costa Mesa except at the times and places designated by the
Director of Parks and under the supervision of a member of the
staff of the Parks Department.
Sec. 10.013 CAMPING,
No person shall camp, lodge or tarry over night in any park,
square, avenue, grounds, or recreation center unless there is
set aside by the Director of Parks certain places for this
purpose.
Sec. 10.014 CAMPFIRE AND BARBECUES
No person shall make any campfire or hold any barbecuein
any place in a park, square, avenue, grounds, or recreation
center other than in stoves or pits provided by the Parks Depart-
ment.
Sec. 10.015 WATER POLUTION
No person shall swim, bathe or wade in or pollute the waters
of any fountain or fish pond in any park, square, avenue, grounds
or recreation center.

Sec. 10.016 HANDBILLS AND CIRCULARS - DISTRIBUTION AND POSTING.
It shall be unlawful for any person, firm or corporation to
distribute, cause to be distributed, or suffer, allow or permit
the distribution of any handbill, dodger, circular, booklet, card,
pamphlet, sheet or written or printed notice advertising any
commodity, article, merchandise, business activity, person or
thing in or upon any park, square, avenue, grounds or recreation
center, or to post or affix, cause to be posted or affixed or
permit to be posted or affixed to any tree, shrub, plant, fence,
building, structure, monument, wall, tablet, apparatus, bridge,
post, hole, bench, gate, or other physical object within any
park, square, avenue, grounds or recreation center any handbill,
dodger, circular, booklet, card, pamphlet, sheet or written or
printed notice advertising any commodity, article,merchandise,
business, person, thing oractivity unless a permit is obtained
from the City Council of the City of Costa Mesa as provided for
in Section 6206 of the Costa Mesa Municipal Codes.
Sec. 10.017 ADVERTISING VEHICLES TO USE TRANSVERSE ROADS ONLY.
No vehicle having thereon or attached thereto any exposed
advertising matter, name of owner, name of maker of said vehicle
or sign, or advertising any commodity, article, merchandise,
business, activity, person or thing shall be allowed within any
park, square, avenue, grounds or recreation center without first
obtaining a permit as provided for in Section 6206 of the Costa
Mesa Municipal Codes. Trucks, drays, wagons, motor delivery
vehicles and other vehicles may use transverse roads extending
across such areas and designated for passage of commercial
vehicles by the Director of Parks.

Sec. 10.018 ANIMALS AT LARGE
No.person shall let loose or permit to run at large any horse
mule, ass, cattle, goat, swine or other animal, or fowl of any
kind, in or upon any park, square, avenue, grounds, or recreation
center. Nor shall any person bring upon any park, square, avenue,
grounds, or recreation center any living thing that constitutes
a safety hazard or detriment to the enjoyment of the area by the
public without a permit from the Director of Parks.
Sec. 10.019 ANIMALS LED OR DRIVEN
No person shall lead, drive, entice, conduct or otherwise
bring any horse, mule, ass, cattle, goat, sheep, swine, or other
animal or fowl of any kind in or upon any park, square, avenue,
grounds, or recreation center without a permit from the Director
of Parks.
Sec. 10.020 DOGS
No person having in charge a dog shall permit, allow or
suffer such dog to enter upon or remain in any park, square,
avenue, grounds or recreation center,unless said dog is fastened
to and restrained by a chain or leash not more than eight (8)
feet long. Section 41.045 of the County Animal control Ordinance
shall be, insofar as applicable, enforceable in any and all parks
within the City of Costa Mesa.
Sec. 10.021 DOGS EXCLUDED FROM CHILDREN'S PLAYGROUNDS, ETC,
No person having in charge any dog shall permit, allow or
suffer such dog to enter upon or remain within any park area
reserved for children or to enter any sand box or play
apparatus area.

10.022 Rubbish to be put into receptacles.

Sec. 10.022 RUBBISH TO BE PUT INTO RECEPTACLES.
No person shall throw, place, cast, deposit, dump or cause
to be thrown, placed, cast, deposited or dumped any ashes, refuse
offal, vegetables, garbage, dross, cinders, shells, straw, shav-
ings, paper, scraps, dirt, dead animal, dead fish, dead fowl, dea
bird or dead reptile, glass, crockery, bones, tin cans or like
matter, empty box, carton, waste paper, remains of food, newspape
filth or rubbish of any kind in any park, square, avenue, grounds
or recreation center, except to place the same in cans or
receptacles provided for such matter.
Sec. 10.023 LOITERING
No adult or person may loiter on any park, square, avenue,
grounds or recreation center or any part or portion thereof, in
proximity to children organized or unorganized recreational
activity unless a reason, valid, in the judgement of the person
acting under the authority of the Director of Parks, is rendered
on request. Persons failing to offer a reason, valid in the
judgement of the Director of Parks or person acting under the
authority of the Director of Parks shall be removed or ejected
from any park, square, avenue, grounds or recreation center
where such reason has been requested of the person by the Costa
Mesa Police Department.

Sec. 10.024 BOXING AND WRESTLING CONTESTS PROHIBITED
No person shall engage in any boxing contest, prize fight,
wrestling contest or promote or participate in any such contest
in any park, square, grounds or recreation center without a
written permit from the City Council of the City of Costa Mesa.
Sec. 10.025 DISORDERLY CONDUCT
No person shall, in any park, square, avenue, grounds, or
recreation center:
a. Use profane, indecent or insulting language;
b. Do any obscene or indecent act, or be indecently clad;
C. Throw stones or other missiles;
d. Fire or carry firearms;
e. Fire or carry any firecracker, torpedo or fireworks;
f. Make any fire, except at places designated by the Direct
of Parks or his agent for such use;
g. Play any game of chance, or have, or use, or operate
any gaming table, or instrument, or apparatus or equip-
ment for such use;
h. Do any act tending to a breach of the public peace;
i. Beg or solicit contributions or subscriptions;
j. Tell fortunes, read horoscopes, practice palmistry for
compensation;
k. Climb upon any wall, fence, shelter, seat, building,
structure, construction or erection;
1. Bring, land or cause to descend or alight any aeroplane,
airship, flying machine, dirigible, dirigible balloon,
balloon, parachute or other instrumentality, or machine,
or apparatus for aviation except by permission of the
Director of Parks or his agent.
M. Or in any other manner violate any section of the Penal
Code Sections of the State of California relating to
disorderly conduct.

Sec. 10.026 LOITERING IN PARKS AFTER DARK PROHIBITED
No person shall enter upon, or engage in any activity in
any park, square, avenue, grounds or recreation center after
dark without the permission of the Director of Parks or his agent.
Sec. 10.027 INTOXICATED.PERSONS
No person who is intoxicated, noisy, disorderly, boisterous,
or publicly offensive shall be admitted into or permitted to
remain within any park, square, avenue, grounds or recreation
center; and the Director of Parks, Park Superintendent, Supervisor
or person in charge shall refuse admittance to any such person and
shall eject any such person therefrom.
Sec. 10.028 MINORS, PARENTS AND GUARDIANS OF
No parent, guardian or custodian of a minor shall permit or
allow such minor to do any act or thing, in any park, square,
avenue, grounds or recreation center prohibited by the provisions
of these articles.
Sec. 10.029 EJECT OFFENDERS
All persons doing any act or thing injurious to any park,
square, avenue, grounds or recreation center shall be removed
therefrom by the Director of Parks or his agent, Park Superin-
tendent, or by the Costa Mesa Police Department.

Any lodge, society, social organization, social club or
other organization of persons having twenty-five (25) or more
members desiring to resort to or use any park, square, avenue,

grounds or recreation center for a parade, picnic, or other
similar recreation purpose, shall notify the Director of Parks of
such intended use, and shall obtain a permit from the City Counci:
of the City of Costa Mesa not less than five (5) days prior to
such use.
Sec. 10.031 POLITICAL SPEECHES IN PARKS
No person shall discuss, expound, advocate or oppose the
principles or creed of any political party, partisan body or
organization or religious denomination or sect, or the doctrines
of any economic or social system in any public speech, lecture or
discourse made or delivered in any public park, square, avenue,
grounds, or recreation center without first obtaining a permit
from the City Council of the City of Costa Mesa which may impose
reasonable regulations upon such use.

Sec. 10.032 INJURING TREES, SHRUBS, AND PLANTS
No person shall cut, break, dig up, pull up, pluck or in any
manner injure any tree, bush, shrub, flower or plant growing in
any park, square, avenue, grounds, recreation center or in any
building or structure within any park, square, avenue, grounds
or recreation center.
Sec. 10.033 REMOVING TREES, PLANTS:', TURF, ETC.
No person shall remove or take away any tree, wood, bush,
turf, flower, plant, grass, soil, rock or anything of the like
kind from any park, square, avenue, grounds or recreation
center.

Sec. 10.034 DEFACING BUILDINGS AND STRUCTURES PROHIBITED
No person shall destroy, mutilate, deface, cut, scratch,
mark upon, write upon, print upon, paint upon or otherwise mar,
mutilate, deface or injure any building.

Sec. 10.035 ERECTING OBSTRUCTIONS
No person shall build, construct, erect, put up or maintain
any building, structure, fence, wall, monument,dome or other
thing in or upon any park, square, avenue, grounds or recreation
center without first having obtained from the Director of Parks
a permit to do so, and any such building, structure, fence, wall,
monument, dome or other such thing shall not prevent, hinder, or
impair the full and free use and enjoyment by the public of such
park, square, avenue, grounds, or recreation center for park
purposes.
Sec. 10.036 BUILDING MATERIALS
No person shall place, pile, deposit or leave any building
material or any article or thing whatsoever upon any park, square
avenue,grounds or recreation center without first having obtained
a permit from the Director of Parks.
Sec. 10.037 RED LANTERNS AT DANGER POINTS
Every person, firm or corporation by whom or under whose
direction or authority, either as principal, contractor or
employer, any part or portion of any park, square, avenue,
grounds or recreation center is made dangerous, must erect and,

so long as the danger continues, maintain around the portion of
the park, square, avenue, grounds or retain at both ends of such
barrier, during every night from sunset until daylight, such
barricades and traffic and warning devices as shall be required
by the Traffic Engineer for the City of Costa Mesa.
Sec. 10.038 GROUNDS TO BE RESTORED TO CONDITION
Where work has been done in any park, square, avenue, ground,
or recreation center under any permit, the permittee shall repair
reconstruct, and put the ground in as good condition in all
respects when the work shall have been completed or terminated or
such permit shall have expired, as said ground was in when said
permit was granted or said work commenced; the condition of the
ground, site or place in any park, square, avenue, grounds or
recreation center where any work has been done pursuant to any
permit, shall be made satisfactory to the Parks Department and
City Engineer, and on the completion of said work, the permittee
shall forthwith remove all buildings, structures, machinery or
equipment used in connection with said work from said park.
Sec. 10.039 AMUSEMENTS, SHOWS, ETC. - PERMIT REQUIRED
No person shall set up or maintain any exhibition, place
of amusement, concert hall, moving picture, show, showstand,
performance, concert, entertainment or amusement in any park,
square, avenue, grounds or recreation center without first having
obtained a permit to do so from the City Council of the City of
Costa Mesa.

Sec. 10.040 TRUCKS, DRAYS AND DELIVERY VEHICLES PROHIBITED
No dray, trucks, auto truck, wagon, motor delivery vehicle,
or other vehicle carrying, or used in carrying goods, wares,
merchandise, manure, soil, building material or other article or
thing of commerce or trade shall enter into or upon any park,
square, avenue, grounds or recreation center without first obtain-
ing a permit from the City Council of the City of Costa Mesa.
Transportation of garbage into, upon or within any park, square,
avenue, grounds or recreation center is prohibited.
Sec. 10.041 SOLICITING PASSENGERS FOR VEHICLES PROHIBITED
No person shall solicit or arrange or contract or make any
agreement for or establish or maintain any stand or other
equipment for procuring passengers for any carriage, coach,
motor wagon, automobile, auto bus, auto stage or other vehicle,
let or used for hire, in any park, square, avenue, grounds or
recreation center without first having obtained a permit to do so
from the Director of Parks.
Sec. 10.042 UNLAWFUL TO STOP OR PARK VEHICLES BETWEEN DARK AND
5.00 A. M. - EXCEPTION.
It shall be unlawful for the driver of any vehicle to stop
or park the same at any place within the boundaries of any park,
square, avenue, grounds, or recreation center during the hours
between dark and 5:00 a.m., except when attending some special
event authorized to be conducted within the park during said hour:
by the Director of Parks, and then only when such person stops
or parks the vehicle at an area specifically designated for such
stopping or parking in connection with said special event, or wit]
a permit from the Director of Parks."

Section 2. There is hereby repealed Section 39f. of the
Costa Mesa Municipal Codes.
Section 3. Section 4201 of the Costa Mesa Municipal Codes

shall be amended by removing the word "park" and shall read as
follows:
"Sec.4201 Intoxication in Public Places
No person shall be or appear at any public place,
or at any place open to public use, or on any street,
alley, highway, court, parking lot, public square or
public property in a state of drunkenness or intoxication.--

Section 4. This Ordinance shall take effect and be in full
force thirty (30) days from and after its passage and prior to
the expiration of fifteen (15) days from its passage be published
once in the Orange Coast Daily Pilot, a newspaper of general
circulation, printed and published in the City of Costa Mesa,
together with the names of the members of the City Council
voting for and against the same. ,[.l
