OF THE CITY OF COSTA MESA, CALIFORNIA, ADOPTING A UNIFORM FIRE CODE PRESCRIBING REG- ULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE OR EXPLOSION, AND ESTABLISHING A BUREAU OF FIRE PREVENTION AND PROVIDING OFFICERS THEREFOR AND DEFINING THEIR POWERS AND DUTIES. The City Council of the City of Costa Mesa, California, does hereby ordain as follows: SECTION 1. REPEAL OF SECTIONS OF THE MUNICIPAL CODE OF THE CITY OF COSTA MESA. Sections 3100 through 3106, inclusive, of Chapber III, Public Safety, Article 1 - Fire Protection and Prevention, Division I - Fire Prevention Code, and Sections 61000 through 61004, inclusive, comprising Article 10 - Private Fire Warning Systems - of Chapter VI, and Subsections (d) through (r) of Section 6505 of the Municipal Code of the City of Costa Mesa are hereby repealed. SECTION 2. ADOPTION OF UNIFORM FIRE CODE. There is hereby adopted by the City Council of the City of Costa Mesa, California, for the purpose of prescribing regulations governing conditions hazard- ous to life and property from fire or explosion, that certain code known as the Uniform Fire Code recommended by the California Fire Chief's Association, being particularly the 1966 edition thereof and the whole thereof, of which code not less than three (3) copies have been and are now filed in the Office of the Clerk of the City of Costa Mesa and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of Costa Mesa. SECTION 3• ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE PREVENTION. a. The Uniform Fire Code shall be enforced by the Bureau of Fire Prevention in the Fire Department of the City of Costa Mesa which is heeeby established and which shall be operated under the supervision of the Chief of the Fire Department. -1- b. The Fire Marshal in charge of the Bureau of Fire 2, Prevention shall be appointed by the Chief of the Fire Department. 31 c. The Chief of the Fire Department may detail such 4, members of the Fire Department as inspector as shall from time to 5 time be necessary. The Chief of the Fire Department shall 6 recommend to the City Manager the employment of technical inspec- 7, tors, who, when such authorization is made, shall be selected through an examination process to determine their fitness for the g, position. The examination shall be open to members and non - 10 members of the Fire Department. Such examination shall consist III of a written and/or oral examination as deemed necessary by the i 121 Fire Chief. 1 13i Section 4. DEFINITIONS 14, a. Wherever the word "Municipality" is used in the Uniform 15 Fire Code, it shall be held to mean the City of Costa Mesa. 16' b. Wherever the term "Corporation Counsel" is used in the 17I Uniform Fire Code, it shall be held to mean the Attorney for the 18, city of Costa Mesa. 191! C. Wherever the words "Chief of the Bureau of Fire Pre - 20 vention" are used in the Uniform Fire Code they shall be held to 21' mean the Fire Marshal. 22 Section 5. AMENDMENTS. 23. The Uniform Fire Code is hereby amended and changed in the 24��i following respects: 25'i a. Section 12.02 (B) is hereby amended to read as follows: 26�, Except as provided for safe and sane fire works, it shall 27! be unlawful for any person to possess, store, to offer for 28!I sale, expose for sale, sell at retail or use or explode any 291I fireworks; provided that the Chief shall have the power to 30 adopt reasonable rules and regulations for the granting of permits for supervised public display of fireworks by the 32I� municipality, fair associations, amusement parks, other OpZ 1 2 3 4 5 6 7 8 9 10 11 i2 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 organizations or for the use of fireworks by artisans in pursuit of their trade. Every such use or display shall be handled by a competent operator approved by the Chief of the Costa Mesa Fire Department, and shall be of such character and so located, discharged or fired as in the opinion of the Chief after proper investigation, so as not to be hazardous to property or endanger any persons. b. Section 12.07 of the Uniform Fire Code is hereby added to read as follows: No person shall offer for sale any safe and sane fireworks as labeled by the State Fire Marshal without a valid permit from the Fire Department. C• Section 12.08 is added to the Uniform Fire Code to read as follows: All temporary stands for the display and sale of fireworks shall be located,maintained and operated subject to the following provisions: 1. No fireworks display or stand shall be erected within One Hundred (100) feet of any gasoline service station or any garage or within Thirty -Five (35) feet of any other structure. Minimum setback from the street curbing shall be ten (10) feet. 2. There shall be maintained in each premises or a stand within which fireworks are sold or offered for sale, suitable fire extinguishers of a type and number approved by the Chief of the Fire Department. 3. No person shall light or cause or permit to be lighted any fireworks or any other article or material within any such stand or within fifty (50) feet thereof. 4. No smoking shall be allowed in any structure used for the sale and display of fireworks or within fifty (50) feet of said structure. "NO SMOKING" signs shall be -3- 1 prominently displayed and in a number prescribed by 2 the Fire Chief. 3 5. All such temporary stands shall be constructed in 41 accordance with existing city requirements and 5 specifications. 6 6. All temporary stands for the display and sale of T fireworks shall obtain an electrical permit from the 8 City of Costa Mesa prior to any electrical work. 9 7. No arc or klieg light shall be located within seventy - 10 five (75) feet of any temporary stand selling fireworks. 11 8. Fireworks shall be sold only between the hours of 12 9:00 A.M. and midnight during the days authorized. 131 9, No safe and sane fireworks shall be sold or offered 14 for sale at retail within the City of Costa Mesa except 15,j from 12 noon on the 28th day of June to 12 noon on the 16i 6th day of July of each year. 3.71 10. The the permitee shall strictly comply with all of pro - 18I visions of Section 12600 through 12081 of the Health 19 and Safety Code of the State of California. 201 11. Fireworks shall be stored and kept only in the per - 21, mitee's sale booth. It shall be unlawful to store 22 any fireworks in any building, residence, garage, home 25. or automobile within the City of Costa Mesa. 24 12. There shall be at least one adult in attendance during 25 any open or sale hours of the firework stand. 261 I 13. The permitee shall provide an adult night watchman 27, to act and serve during the hours of storage. Under 28 no circumstances shall any night watchman sleep within 29 any fireworks stand. 30 14. No alcoholic beverages shall be allowed on the premises. 31 15. All firework fuses shall be taped. 32,,, 16. Section 12.09 of the Uniform Fire Code is added to read as follows: All applications for permits shall be made in writing,filed with the City Council, and shall state the name of the applicant, his address and the location of the proposed stand The application shall be accompanied by a clearance from the Fire Chief as to fire regulations. and by a clearance from the Department of Building and Safety as to the proposed electrical installations, if any. e. Article 12, Division 2, Sec. 12.20, Christmas Trees is hereby added to the Uniform Fire Code to read as follows: All temporary stands for the display and sale of Christmas trees shall be located, maintained and operated subject to the following provisions: (a) There shall be maintained in each premises or display area within which Christmas trees are sold or offered for sale suitable fire extinguishers of the type and number approved by the Chief of the Fire Department. (b) No smoking shall be allowed in any Christmas Tree display lot. "No Smoking" signs shall be prominently displayed in a number prescribed by the Fire Chief. (c) All such Christmas Tree display lots and areas shal be constructed in accordance with existing city require- ments and specifications. (d) All temporary Christmas Tree lots for the display and sale of Christmas Trees shall obtain electrical permits from the City of Costa Mesa prior to any electrical work. (e) No arc or klieg lights shall be located within seventy-five (75) feet of any temporary Christmas display area selling Christmas trees. -5- l (f) It shall be unlawful to store any Christmas trees in 2 any buildings, residences, garage, home or vehicle 31 within the City of Costa Mesa. 41', (g) There shall be at least one adult in attendance 5 during the open or sale hours of the Christmas tree stand, 6 (h) The permitee shall provide an adult night watchman 7 to act and serve during the hours of storage. 8 (i) No alcoholic beverages shall be allowed on the 9 premises. 10 (j) All permits must be posted in a conspicuous place. 11 (k) All applications for permits shall be made in 12 writing, filed with the City Council, and shall state 13 the name of the applicant, his address and the location 14 of the proposed Christmas Tree stand. The application 151' shall be accompanied by a clearance from the Fire Chief 16, as to fire regulations and by a clearance from the 17 Department of Building and Safety as to the proposed 18 electrical installation, if any. 19 f. Section 13.38 of the Uniform Fire Code is hereby added 20 to read as follows; 21', protection of hoods, ducts and deep fat fryer(s). 22All hoods and ducts, and deep fat fryer(s) with a 23 surface area greater than 350 square inches, where 24required for or used as restaurant type cooking equip - 25 ment, shall be equipped with an approved automatic fire 261, extinguishing system installed in the hood and duct, 27. and over deep fat fryer(s). Such systems shall be 28 installed and maintained in accordance with the 291 provisions of the National Board of Fire Underwriter 30 pamphlets pertaining thereto. Non -conforming equipment 311 installed prior to the effective date of this section 32I! shall be made to conform within one (1) year following I such date. 2. g. Section 13.41 is added to the Uniform Fire Code to 31read as follows: 4' The purpose of this article is to establish strict super - 5'. vision and control of the sale and installation of Private 6. Fire Warning Systems in order that public safety and i 7 welfare is protected. 8 Section 13.42. Scope 9 The provisions of this Article shall apply to all 10 private Fire Warning Systems installed in the City of Costa 111 Mesa in those occupancies not required by law to have a 12� Fire Alarm System. 13 Section 13.43. Definitions 14 a. Alarm: An audible signal indicating a fire. 15 b. Approved: Shall mean approved by the Fire Depart - 16'! ment. 17 C. Electrical Supervision: A system so designed that 18I failure of any conductors, equipment or sources of energy, 191 will (a) operate a "trouble signal" at the control panel 20I or on extension "trouble signals" where desired, or (b) 21' will activate the alarm. 22I d. Private Fire Warning System: Shall include all 231 devices, controls and circuits; together with the energy 24' necessary to sound alarms, electrically supervise the system 25i where required, and actuate the alarm bells, trouble bells 26, or trouble signals. Non -interconnected, unit -type devices 271I�j which sound an alarm only at the point of detection are not 281 acceptable. 29. e. Heat Activated Detectors: Shall mean detectors 3011, capable of reacting to rapidly rising or elevated temperatur 31 f. Smoke Activated Detectors: Shall mean detectors 32111 capable of reacting to the presence of smoke at a visibility cut-off level of 4%. g. Products of Combustion Detectors: Shall mean device -7- M=L capable of detecting products of combustion without being 2j dependent upon the presence of heat, smoke or flame, and 3'' in connection with devices or equipment designed to sound 4 an alarm indicating an emergency. 5. h. Trouble Signal: A visible or audible warning 6 device that will be activated upon failure or loss of 7,, primary power and will indicate that the system is 81 operating on secondary power, or will be activated by a 9 fault in a supervised circuit within the system. 10 i. General Requirements. 11! �I 1. Approved Equipment: All devices, combination i2 of devices, and other equipment installed for fire warning 13 systems shall be approved by the Costa Mesa Fire Department. 14 2. Permit Required: Systems that operate above 15.1 15 volts and generate, transmit, transform, utilize or 16� control more than 25 watts or volt-amperes of electricity 17 require a permit from the Building Department of the City 18 of Costa Mesa. 19' 3. Inspection: Companies or individuals installing 20I approved Private Fire Warning Systems shall, by the tenth 211 day of each month, submit to the Fire Department a list 22 showing addresses where such systems were installed during 23', the previous month. The Department at its discretion may 24!. inspect any or all of such installations, I 25 j. Installation and Design. 26 1. Workmanship: Private Fire Warning Systems shall 27I be installed in a workmanlike manner and in conformity with 28' the plans and specifications submitted_ 29 2. Electrical Power Supply: Every Private Fire 30„ Warning System shall be supplied with primary power from 31�1 the alternating current furnishing power to the occupancy 32'1 in which it is installed. The system shall also be provided M=L 11 with battery standby power so connected that the battery 2i will automatically operate the system in the event of loss 51 of primary power. Batteries shall be capable of (a) 41 operating the system under full load conditions for twenty 5 minutes (b) supervise the system for one week (if system 6''I has electrically supervised circuits), and (c) have a shelf i 70 life of at least one year. 8 Systems may have the control panel or power supply 9'. connected to the electrical service by a flexible cord and 10l plug, provided: 11 a. It is equipped with an approved transformer (or 12j transformer and rectifier if system operates on DC) 13I as an integral portion of the control panel; 14 b. The conductors of the cord are not less than 15, #18AWc; 16 C. The plug is connected to the receptacle in such a 17I manner as to be removed only with a suitable tool; 181 d. The cord is approved; 19I e. The control panel contains or can be co#0ected 201I to an approved battery. 21 3. Wiring: Conductors of Private Fire Warning Systems 22shall not occupy any raceway, compartment, outlet box, 23' junction box or other wiring enclosure containing conductors 24, supplying power or light. 25: Wiring of Private Fire Warning Systems that operate 26'I at 30 volts or less used for fire alarm or fire detector 27, circuits: 28 a. Shall be of solid copper wire not smaller than #19A 29 b. Shall be listed by an approved testing laboratory 30' as acceptable for the use intended. 31i1 C. May be exposed on ceilings and on walls if not 32 less than 7'0" from the floor. Where passed through floors or walls, shall be adequately protected against injury. e. Shall have overcurrent protection devices as follows: (1) 15 to 30 volts - not more than 3 amps. (2) 15 volts or less - not more than 5 amps. 4. Detectors: (a) Design: All detecting devices for Private Fire Warning Systems shall be automatic devices actuated by heat, smoke or products of combustion. All Private Fire Warning Systems shall be actuated either by Xa) products of combustion detectors or by (b) a combination of heat activated and smoke activated detectors. Exception: Private Fire Warning Systems installed in industrial or commercial occupancies may be actuated by heat activated detectors only. All alarm actuating devices and sounding devices sh be approved equipment. Heat activated detectors shall have a maximum temperature rating of 1400F. Exception: Attic areas and high temperature rooms; heater rooms, etc. (b) Spacing: Detector spacing shall not exceed the maximum area and line spacing for which they are approved. Combination rate -of -rise and fixed temperature detectors shall be spaced as required for fixed temperature devices. (c) Location: Detectors shall be located in all areas throughout the premises, including closets and attics. No portion of the occupancy or premises shall be exempted -10- l without written permission of the Department. 2I (d) Support: Detectors shall be supported in all 3 cases independently of their attachment to wires. 41 (e) Supervision: Detectors shall be installed on 5j a supervised circuit or on looped circuits which will 61 operate both ways from a break or fault to the control panel. 7 5. Alarm: The alarm sounding devices shall be of such 8 volume and so located that they will be heard at any locatior 9. within the dwelling when all intervening doors are closed. 10 Alarm sounding devices shall be installed on super - 11 vised circuits or on at least two non -supervised circuits 12 each entirely separate from the other. 13I 6. Trouble Signal: The system shall be provided 14 with a visual or audible trouble -indicating device that 151 will be actuated when the primary power has been interrupted. j 16 In electrically supervised systems the trouble signal will 171 be actuated upon the occurrence of a break or ground in the 1811 wiring circuits which would prevent the required operation 19' of the system, as well as indicate that the system is being 201 operated by the battery. Visual trouble indicators shall be 21in a conspicuous location to insure being detected. 22 7. Control Panel: Private Fire Warning Systems shall 23', be equipped with approved control panels containing the 241' necessary relays, connectors, switches, etc., for the proper 251��, operation of the systems. 261 h. Section 14.41 of the Uniform Fire Code is hereby amended 27'.. to read as follows: 28 (A) A space shall be maintained between goods being painted 291 or deteared and electrodes, electrostatic atomizing heads 301 or conductors of at least twice the sparking distance. A 3111 Suitable sign stating the sparking distance shall be con - 32 "i on -32I, spicuously posted near the assembly. -11- ], (B) Electrostatic apparatus shall be equipped with auto - 2i matic controls which will operate without time delay to 3 disconnect the power supply to the high voltage transformer 4and to signal the operator under any of the following 5 conditions: 6I (1) Stoppage of ventilating fans or failure of ventil- 7 ating equipment from any cause. g. (2) Stoppage of the conveyor carrying goods past the 9Ihigh voltage grid. 10 (3) Occurrence of a ground or of an imminent ground i 11' at any point on the high voltage system. 121 (4) Reduction of clearance below that specified in 13I Section 14.41 A. 14 i. Section 15.111 of the Uniform Fire Code is hereby 15 amended to read as follows: 16 The First word of said section shall read "no" instead of "n 17 j. Section 15.201 of the Uniform Fire Code is hereby 18I amended to read as follows: 19' The limits referred to in Section 15.201 of the Uniform Fire 20I Code in which storage of flammable or combustible liquids 211I in outside, above ground tanks is prohibited, are hereby 22established as follows: 23�,� Any and all property other than in a M-1, A-1 or C-2 24 zones. 251 k. Section 15.207 (f) of the Uniform Fire Code is hereby 26i amended to read as follows: 271 The existing oil storage reservoirs. The use of existing 28 oil storage reservoirs with concrete lining -and with a 29 combustible roof covering, and built prior to the adoption 30 j of this section, may be continued for the storage of 31i•, petroleum products with a flash point in excess of One 3d Hundred and Fifty degrees (150) F. Such continued use -12- 1I shall be contingent upon the maintenance of minimum fire 21 protection facilities existing as of July 1, 1962. 3�1. Section 15.401 of the Uniform Fire Code is hereby 4'', amended to read as follows: 5 The limits referred to in Section 15.401 of the Uniform Fire 6� Code, in which new bulk plants where flammable or combustible ry liquids are prohibited, are hereby established as follows: gli Any and all property other than in M-1, A-1 or C-2 Zones 9 m. Section 20.05. (a) of the Uniform Fire Code is hereby 10 amended to read as follows: 111 The limits referred to in Section 20.05 (a) of the Uniform 12 Fire Code, in which bulk storage of liquefied petroleum gas 13 is restricted, are hereby established as follows: 14 Any and all property other than in M-1, A-1 or C-2 zones. 15 n. Section 11.06 (a) of the Uniform Fire Code is hereby 16 amended to read as follows: 171 The limits referred to in Section 11.06 (a) of the Uniform is' Fire Code, in which storage of explosives and blasting agents 19", is prohibited are hereby established as follows: 20'I Any and all property other than in M-1, A-1 or C-2 zones 21: Section 6. PERMIT RESTRICTIONS 2211 No person shall kindle or maintain any bond fire or rubbish 23 fire or authorize any such fire to be kindled or maintained on any 24, private land without first obtaining a fire permit from the Chief 25'I of the Costa Mesa Fire Department; and provided further that no 26, such permit shall be issued except on the following conditions: 271 1. That burning be allowed only between 5:00 A.M. and 28'I 10:00 A.M. 2911 2. That an adult stay in constant attendance. 30, 3. That before burning, an area shall be cleared away from I 31any building, fences and shrubbery to the extent prescribed 32 as necessary by the Chief of the Fire Department, or Fire -13- 1 Inspector designated by the Chief. 2�' 4. That no burning take place on windy days. 3 5. That burning be subject to such conditions as may be 41 deemed necessary by the Chief of the Fire Department, or 5' designated Fire Inspector for the protection of life and 6' property. 7, Section 7. MODIFICATIONS. 8 The Chief of the Fire Department shall have power to modify 9 any of the provisions of the Uniform Fire Code upon application 10' in writing by the owner or lessee, or his duly authorized agent, 11 when there are practical difficulties in the way of carrying out 12 the strict letter of the code, provided that the spirit of the 131 code shall be observed, public safety secured, and substantial 14 justice done. The particulars of such modification when granted 15 or allowed and the decision of the Chief of the Fire Department 16l thereon shall be entered upon the records of the Department and 17', a signed copy shall be furnished the applicant. 18, Section 8. APPEALS 19 Whenever the Chief of the Fire Department shall disapprove 20 an application or refuse to grant a permit applied for, or 21 when it is claimed that the provisions of the code do not apply 22 or that the true intent and meaning of the code have been mis- 23 construed or wrongly interpreted, the applicant may appeal from 24' the decision of the Chief of the Fire Department to the City 25 Council of the City of Costa Mesa within thirty (30) days from 26I the date of the decision appealed. 2711 Section 9. NEW MATERIALS, PROCESSES OR OCCUPANCIES WHICH 281 MAY REQUIRE PERMITS, 291'1 The City Manager, the Chief of the Fire Department and the 3011 Chief of the Bureau of Fire Prevention shall act as a committee 31'ii to determine and specify, after given affected persons an 32111 opportunity to be heard, any new materials, processes or DEC li 2 3 4', 5, 6 7 8 9 10 11 12 13 14 15 16 17 18', 19 20II 21 22 23 24 25 26 27 28 29 30 occupancies, which shall require permits, in addition to those now enumerated in said code. The Chief of the Bureau of Fire Prevention shall post such list in a conspicuous place in his office, and distribute copies thereof to interested parties. Section 10. PENALTIES, a. Any person who shall violate any of the provisions of this code hereby adopted or fail to comply therewith, or who shall build in violation of any detailed statement of specificati or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken or who shall fail to comply with such an order as affirmed or modified by the Chief of the Fire Department or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and non-compliance respectively, be guilty of a misdemeanor, punishable by a fine of not more than $500 or by imprisonment for not more than six months or by both such fine and imprisonment. The imposition of ,one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten days that prohibited conditions are maintained shall constitute a separate offense. b. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. Section 11. REPEAL OF CONFLICTING ORDINANCES. All former ordinances or parts thereof conflicting or inconsistent with the provisions of this ordinance or of the code hereby adopted are hereby repealed. Section 12. VALIDITY, The City Council of the City of Costa Mesa hereby declares that should any section, paragraph, sentence or word of this -15- 11 ordinance or the code hereby adopted be declared for any reason 2to be invalid, it is the intent of the City Council that it would 31 have passed all other portions of this ordinance independent of 41 the elimination herefrom of any such portion as may be declared 5 invalid. Section 13. DATE OF EFFECT ry This ordinance shall take effect and be in full force thirty (30) days from and after its passage and prior to the 9I' expiration of fifteen (15) days from its passage shall be 101 published once in the Orange Coast Daily Pilot, a newspaper of 111 general circulation, printed and published in the City of Costa 1211 Mesa, together with the names of the members of the City Council 13,ivoting for and against the same. 14' PASSED AND ADOPTED this /y qday of V �f7 1968. 151'!
