AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA CHANGING THE ZONING OF CERTAIN AREAS SOUTHWESTERLY OF THE SAN DIEGO FREEWAY AND WESTERLY OF HARBOR BOULEVARD TO R4 -CP AND C1 -CP. The City Council of the City of Costa Mesa does hereby ordain as follows: SECTION 1. All that portion of the following described real property is hereby placed and included in the R4 -CP, Multiple Residential District, Conditional Permit zone, to wit: That portion of the land allotted to James McFadden in Decree of Partition of the Rancho Santiago de Santa Ana, recorded in Book B of Judgments of the 17th Judicial District Court of California, in the City of Costa Mesa, County of Orange, State of California, described as follows: Commencing at the southeast corner of the land described in the deed to A. J. Gisler, at ux., recorded November 24, 1943, in Book 1128, page 144 of Official Records of said Orange County; thence west along the south line of said land to the southeast corner of the land described in the Final Order of Condemnation filed in connection with Case No. 88428 in the Superior Court of the State of California, a certified copy of which was recorded in Book 5782, page 843 of said Official Records; thence northerly along the boundary of said land, 15.00 feet, more or less, to the True Point of Beginning, said point being also on the north line of Gisler Avenue; thence continuing north- westerly along the boundary of said land to the northwest corner of said land; thence northerly along the northerly prolongation of the westerly boundary of said land and along the easterly boundary of Tract No. 3723, as per map recorded in Book 142, pages 46 through 48 of Miscellaneous Maps in the office of the County Recorder of Orange County, to the southerly line of the 95.00 foot strip of land described as parcel 502.1 in the deed to Orange County Flood Control District recorded October 31, 1958 in Book 4468, page 429 of Official Records; thence easterly along said southerly line to a point on the southwesterly line of the land described in a deed to the State of California, recorded in Book 6248, page 583 of Official Records; thence southeasterly along the boundary of said land to the north line of Gisler Avenue (55.00 feet wide); thence westerly along said line to the point of beginning. EXCEPTING therefrom the following described parcel of land: Commencing at the southeast corner of the land described in the deed to A. J. Gisler, at ux., recorded November 24, 1943, in Book 1128, page 144 of Official Records of said Orange County; thence west along the south line of said land to the southeast corner of the land described in the Final Order of Comdemnation filed in connection with Case No. 88428 in the Superior Court of the State of California, a certified copy of which was recorded in Book 5782, page 843 of said Official Records; thence North 0° 211 11" East 15.00 feet along the boundary of said land to the True bPoint of Beginning; thence continuing along the boundary of said land, North 0 211 11" East 251.77 feet; thence, leaving the boundary of said land North 650 27' 58" East 236.4 feet, more or less, to a point on the southwesterly boundary line of the land described in a deed to the State of California, recorded in Book 6248, Page 583 of Official Records, said point being on a nontangent curve concave northeasterly and having a radius of 400.00 feet; thenoe southeasterly along said southwesterly boundary line to the north line of Gisler Avenue (55.00 feet wide) thence westerly along said north line 634.2 feet, more or less, to the point of beginning. ALSO EXCEPTING the most westerly 210.00 feet of that portion of the above described land adjacent to said Tract No. 3723• SECTION 2. All that portion of the following described real property is hereby placed and included in the CS -CP, Local Business District, Conditional Permit zone, to wit: That portion of the land allotted to James McFadden in Decree of Partition of the Rancho Santiago de Santa Ana, recoxddd in Book B of Judgments of the 17th Judicial District Court of California, in the City of Costa Mesa, County of Orange, State of California, described as follows: Commencing at the southeast corner of the land described in the deed to A.J. SECTION 3• Pursuant to the provisions of Section 9230.4 of the Municipal Code of the City of Costa Mesa, District Map B-9 of the City of Costa Mesa is hereby amended by the addition thereto of the R4 -CP and CS -CP areas described in Sections 1 and 2 hereof. SECTION 4. This Ordinance shall take effect and be in full force thirty (30) days from and after its passage and prior to the expiration of fifteen (15) days from the passage thereof shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
