Home My WebLink About68-15 Amending Street DedicationsORDINANCE N0. 68-15 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING ORDINANCE N0. 66-45 RELATING TO STREET DEDICATION AS A CONDITION FOR GRANTING BUILDING PERMITS. THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS; SECTION 1. Subsection 5 of Section 9298.7 of Article 2, Division XVII of Chapter IX of the Municipal Code is hereby amended to read as follows: "5. Street Dedications - Wherever the approved and up to date master plan of streets and highways for the City of Costa Mesa requires the dedication of adjoining property for street widening purposes, said dedications must be made by the owner of said property prior to the granting of any building permit for over $2,000 in improvements on any one lot, legal description, or ownership in any one 12 month period, pro- viding there shall first be a finding by the City Council of the City of Costa Mesa that the proposed construction to be made pursuant to said building permit will materially in- crease traffic on the adjacent street wherein dedication has been required. Wherever the public convenience and necessity may be served, the City shall have the power to grant encroach- ment permits to the owner for the use of that portion of the property dedicated as heretofore set out, said encroachment permits being for uses other than permanent structures or Improvements by said property owner." SECTION 2. This Ordinance shall take effect and be in full force thirty (30) days from and after its passage and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council of the City of Costa Mesa voting for and against the same.
