CALIFORNIA, AMENDING CERTAIN SECTIONS OF THE LAND USE
3 ORDINANCE TO CONFORM WITH THE ZONE EXCEPTION PERMIT PROVISI
ADOPTED BY THE CITY COUNCIL OF THE CITY OF COSTA MESA AND
4 GENERALLY PROVIDING FOR UNIFORMITY IN TERMINOLOGY IN THE
LAND USE ORDINANCE.

THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 92101.9 of the Costa Mesa Municipal Code
is hereby amended to read as follows:
"Sec. 92101.9 Requirement of Zone Exception Permit on CP
Designation.
When the City Planning Commission recommends and the City
Council determines that any of the zone changes as set forth
in Section 92101.8 should have the designation CP, the uses
permitted in such zone shall be permitted subject only to
the issuance of a Zone Exception Permit."
SECTION 2. Section 92101.10 of the Costa Mesa Municipal
Code is hereby amended to read as follows:
"Sec. 92101.10 Application for Zone Exception Permit.
A. When the land included in the application for Zone
Exception Permit has sufficient square footage area to
permit five (5) or more units to be constructed thereon as
permitted in the zone in which the land is proposed to be
rezoned:
1. A boundary survey map of the property. (A tentative
subdivision may may be submitted for this requirement
if the applicant proposes to subdivide the property.)
2. Existing topography of the development area and
adjacent properties shall be shown with contours at not
more than two foot intervals.
3. The gross land area of the development, the present
zoning classification thereof, and the zoning classifica

tion and existing land use on all adjacent properties
within 300', including the location of structures and
other improvements thereon.
4. A general development plan with a least the followinc
details shown to scale and dimensioned:
(a) Location and use or uses proposed for each
existing and each proposed structure in the develop-
ment area, the number of stories, gross building
area, and approximate location of entrances.
(b) All existing and proposed storage, curb cuts,
driving lanes, parking areas, loading areas, and
trash receptacle areas.
(c) All pedestrian walks and open areas for the use
of occupants of the proposed development and the publ
(d) Types of surfacing proposed for all walks and
driveways.
(e) A detailed plan for the landscaping of the
development, including the location and height of all
proposed walls, fences and screen planting, and a
statement setting forth the method by which such
landscaping and fencing shall be preserved and
maintained.
(£) A grading plan for the entire development in
contours of not more than 2' intervals.
(g) All existing or proposed physical features such
as hydrants, utility facilities, floodlights, drainag
facilities and recreation facilities, and a statement
setting forth the method by which these features shal
be preserved and maintained.
5. Plans and elevations of one or more structures to
indicate architectural type and materials of construction

Exception Permit has a total square footage which permits les
than five (5) units to be placed thereon as permitted in the
zone in which the land is proposed to be rezoned:
1. Comply with the provisions of Section 92101.2."
SECTION 3. Section 92101.11 of the Costa Mesa Municipal Code
is hereby amended to read as follows:
"Sec. 92101.11 Time for Applying for Zone Exception Permit
on CP Designation.
An application for a rezone change and for a Zone Exception
Permit as required by Sec. 92101.9 may be made at the same
time and may be heard by the City Planning Commission and
the City Council together."
SECTION 4. Section 92101.12 of the Costa Mesa Municipal Cod
is hereby amended to read as follows:
"Sec. 92101.12 Imposition of Conditions on Granting of
Zone Exception Permit.
The City Planning Commission may impose reasonable condition
in recommending the granting of the Zone Exception Permit
including the requirement of street widening and improvement
facilities for drainage, and such other facilities as may be
found necessary to make the affected property suitable for
the uses permitted by such rezone.
1. Such facilities or matters may be required to be
completed or reasonable guarantees be provided for the
completion prior to the adoption and transmittal of the
City Planning Commission's recommendation to the City
Council for the adoption of any such rezone and the
granting of any Zone Exception Permit.
2. The City Planning Commission in recommending a deniz
of any rezone or Zone Exception Permit, may set forth
any reasonable conditions which they deem reasonable
for guidance of the City Council."

SECTION 4. Section 92101.13 of the Costa Mesa Municipal Code
is hereby amended to read as follows:
"Sec. 92101.13 Action by City Council.
The City Council, when acting on recommendation by the City
Planning Commission on rezones and Zone Exception Permits,
may either:
1. May, in addition to all the powers already vested in
them, withdraw the CP designation;
2. Eliminate or add conditions to the Zone Exception
Permit."
SECTION 5. This Ordinance shall take effect and be in full
force thirty (30) days from and after its passage, and prior to
the expiration of Fifteen (15) days from its passage shall be
published once in the Orange Coast Daily Pilot, a newspaper of
general circulation, printed and published in the City of Costa
Mesa, together with the names of the members of the Council voting
for and against the same.
