HomeMy WebLinkAbout68-44 Adopting Uniform Building Code1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29' 30 31 32 ORDINANCE NO._ILL4q AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA„ CALIFORNIA, ADOPTING BY REFERENCE THE 1967 EDITION OF THE UNIFORM BUILDING CODE, VOLUME I, INCLUDING THE APPENDIX THERETO, AND ADOPTING MODIFICATIONS AND AMENDMENTS TO SAID 1967 EDITION OF THE UNIFORM BUILDING CODE. THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The 1967 edition of the Uniform Building Code, Volume I, including the Appendix thereto, is hereby adopted for the City of Costa Mesa subject to the modifications and amendments as shall hereinafter appear. SECTION 2. The 1967 edition of the Uniform Building Code, Volume I, herein adopted is modified and amended as follows: Section 303 of said Uniform Building Code is hereby amended by adding the following paragraph: "No fees shall be required for fall -out shelters constructed in R-1 Zones." Section 306 (a) of said Uniform Building Code is hereby amended to read as follows: "Sec. 306 (a) Use or occupancy. No building or structure shall be used or occupied, nor shall such building or structure be connected with permanent utility services until the Building Official has determined compliance with this Code, all other applicable ordinances and laws, and the conditions of the building permit, and has authorized occupancy of such building or structure. No existing commercial or industrial building whose electrical service has been disconnected shall be reconnected with permanent electrical service until the Building Official has determined that the building does not constitute an unsafe building as defined by Section 203." Section 420 of said Uniform Building Code is amended by no 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29', 30 31 32 adding two new definitions to read as follows: "STRUCTURE, RESIDENTIAL PATIO is a one-story roofed structure open on one or more sides, attached or detached, for use with a Group I or Group J occupancy or limited to single family use in Group H occupancy. SWIMMING POOL is any body of water, created by artificial means, any portion of which exceeds eighteen inches (1811) in depth, which is used or intended to be used for swimming." Section 424 of said Uniform Building code is hereby amended by adding two definitions to read as follows: "WALL. For the purposes of the Code and excepting retaining and parapet walls, a wall is any means of upright or semi-upright support for a roof, ceiling, eave, or floor system. WADING POOL is any body of water, created by artificial means, which is designed or used for wading purposes, any portion of which does not exceed eighteen inches (18") in depth." Section 504 (a) of said Uniform Building Code is hereby amended by adding a new paragraph at the end of the section to read as follows: "Property corners upon which buildings are to be located shall be identified with survey markers in accordance with the legal description furnished with the application to build. ,111 property corners set as required herein shall be permanently marked or tagged with the registration or license number of the engineer or surveyor under whose supervision the survey was made " Section 1108 of said Uniform Building Code is hereby amended by adding the following exception to the fourth paragraph: "EXCEPTION: When such room serves an individual -2- 1 2 3 4 5 6 7 S 9 10 11 12 13 14 15 16 17 1s 19 20 21 22 23 24 25 26 27 28 29 30 31 32 occupancy within a building not more than one story in height of Group F, Division 2 Occupancy with an occupant load of less than 30." Section 1305 (a) of said Uniform Building Code is hereby amended by adding a paragraph to read as follows: "For the purpose of determining light and ventilation requirements, any room may be considered as a portion of an adjoining room, provided a single unobstructed opening not less than one-half of the area of a common wall between such rooms is provided. Such opening nee not exceed an area equal to 1/10 of the area of the interior room served, but shall be not less than forty-nine (49) square feet." Section 1305 (c) of said Uniform Building Code is hereby amended to read as follows: "Sec. 1305 (c). Kitchen Ventilation. There shall be installed in the wall or ceiling approximately over the cooking facilities, a ventilating opening with a minimum area of forty-eight (48) square inches and a minimum 6" dimension, connected by an incombustible ventilating duct free to the outside of the building. The ventilating duct for each kitchen shall have a minimum cross-sectional area of twenty-eight (28) square inches. An approved forced -draft system of ventilation may be substituted for the natural -draft ventilating system." Section 1405 (a) of said Uniform Building Code is hereby amended by adding a paragraph to read as follows: "For the purpose of determining light and ventilation requirements, any room may be considered as a portion of an adjoining room, provided a single unobstructed opening not less than one-half of the area of a -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 common wall between such rooms is provided. Such opening need not exceed an area equal to 1/10 of the area of the interior room served but shall be not less than forty-nine (49) square feet." Section 1405 (b) of said Uniform Building code is further amended by changing the EXCEPTION to read as follows: "EXCEPTION: Required windows may open into a roofed porch or residential patio where the porch or patio: 1. Abuts a street, yard or court; and, 2. Has a ceiling height of not less than seven feet(7'); and, 3. Has the longer side at least 65 percent open and unobstructed; or ,has openable windows or easily removable transparent panels with an area not less than 65 percent in the longer side and not less than one-eighth of the combined floor area of the room and the enclosed porch or patio. Section 1405 (d) of said Uniform Building Code is hereby amended to read as follows: "Sec. 1405 (d). Kitchen Ventilation. Section 1707 of said Uniform Building code is hereby amended by adding a new sub -division (c) to read as follows: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29' 30 31 32 "(c) Waterproofing and Protection. Concrete or masonry retaining walls, which form a part of the foundation of a building or structure, shall be adequately drained and made waterproof when the retaining wall abuts a usable portion of the building or structure." Section 1711 (b).of said Uniform Building Code is hereby amended to read in full as follows: "Sec. 1711 (b). Shower Areas. Shower stalls and the bathtub enclosures used as shower stalls shall be plastered with Portland Cement Plaster as required for the first two coats of exterior work. Such plaster shall be carried to a height of not less than six feet above the drain outlet and across the full width of the door jamb. In the case of tub enclosures, said plaster shall be carried at least four inches beyond the outer edge of the tub. Metal reinforcement and backing shall be as required for exterior plastering in Chapter 47. EXCEPTION: This section shall not apply to approved prefabricated shower enclosures." Section 2305 of said Uniform Building code is hereby amender by adding a new paragraph between the first and second paragraphs of Sub -section (e) therein to read as follows: "Residential patio structures, as defined in Section 420, shall be designed for a vertical live load of not less than five (5) pounds, not less than 2-1/2 times the dead load provided, however, that the live load need not exceed that shown in Table 23-B." Section 2515 (b) of said Uniform Building Code is hereby amended by deleting the fourth sentence of the third paragrapk of the Section. Section 3205 (d) of said Uniform Building Code is hereby amended to read as follows: 9610 i 2 3 4 5 6 7 8 9i 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28I 29 30 31 32 "Enclosed attics shall have clear ventilation area to the outside of not less than one square inch (1 sq.in.) per ten square feet (10 sq.ft.) of horizontal attic area. The required ventilation shall be by not less than two equal sized openings providing cross ventilation covered with one-quarter inch (1/4") non -corrosive mesh screen.'- TABLE creen."TABLE 54-D of said Uniform Building Code is hereby amended as follows: "In the first column after "Laminated", "Fully Tempered" and "Wired" add a superscript #5. Said footnote #5 shall read: "Shall be used in all H and I Occupancies where required in Section 5406." SECTION 3, This Ordinance shall take effect and be in full force thirty (30) days from and after its passage and prior to the expiration of fifteen (15) days from its passage shall be published once in the Orange Coast Daily Pilot, a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
