AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA
ADOPTING THE 1961 EDITION OF THE UNIFORM FIRE CODE AND
AMENDING SECTIONS 3100, 3101, 3102, 3103 AND 3104 OF THE
MUNICIPAL CODE OF THE CITY OF COSTA MESA.
The City Council of the City of Costa Mesa does hereby ordain as follows:
SECTION 1. Section 3100 of the Municipal Code of the City of Costa Mesa,
entitled: "Adoption of Fire Prevention Code," is hereby amended to read as
follows:
"Sec. 3100 Adoption of Uniform Fire Code.
There is hereby adopted, for the purpose of prescribing regulations
governing conditions hazardous to life and property from fire and explosion,
that certain code known as the Uniform Fire Code recommended by the Cali-
fornia Fire Chiefs Association, being particularly the 1961 Edition thereof
and the whole thereof, save and except such portions as are hereinafter
deleted, modified or amended by Section 3102 of this Article, of which Code
not less than three (3) copies have been and are now filed in the Office of
the City Clerk, and the same are hereby adopted and incorporated as fully
as if set out at length herein and the provisions thereof shall be control-
ling within the limits of the City of Costa Mesa."
SECTION 2. Section 3101 of the Municipal Code of the City of Costa Mesa,
entitled: "Definition," is hereby amended by the deletion of the words "Fire Pre-
vention Code," and the substitution of the words, "Uniform Fire Code."
SECTION 3• Section 3102, entitled: "Amendments," is hereby amended to read
as follows:
"Sec. 3102 Amendments.
The Uniform Fire Code is hereby amended and changed in the following
respects:
(a) Section 1.02 (b) of Article 1 is hereby emended to read as follows:
The provisions of this code shall apply equally to new and existing
conditions, except that it is understood that it is the intent of the City
Council to apply and enforce the provisions of this code to new structures
hereinafter erected, but to allow existing structures to continue without
change so long as such structures do not constitute a serious fire hazard
to life or adjoining property.
(b) Section 1.13 of Article 1 is hereby amended by the deletion of the
words 'Fire Prevention Engineer,' and the substitution of the words 'Fire
Prevention Inspector,' and wherever the designation 'Fire Prevention
Engineer,' appears hereafter in this code the words 'Fire Prevention
Inspector,' shall be substituted therefor.
(c) Section 1.22 (c) of Article 1 is hereby amended to read as follows:
The Fire Prevention Inspector shall report in writing to the Chief on
June 30 following the adoption of this code and not less than twice each
fiscal year thereafter covering the work of the Fire Prevention Bureau
during the previous period. Such report shall contain all pertinent infor-
mation relating to the activities of the Bureau and in addition thereto the
Fire Prevention Inspector shall make such monthly reports to the Chief as
the Chief may require.
(d) Section 1.44 C of Article 1 is hereby amended to read as follows:
Chief of the Bureau of Fire Prevention shall mean Chief of the Fire
Department
(e) section 1.47 F of Article 1 is hereby amended by the addition thereto
of the following definition:
Fire Prevention Inspector shall mean the person designated by the Fire
Chief charged with enforcing the Uniform Fire Code within the municipality.
(f) Article 12 is hereby deleted.
(g) Section 27.01 (b) of Article 27 is hereby amended to read as follows:
Permit Restrictions.
No person shall kindle or maintain any bonfire or rubbish fire or authorize
any such fire to be kindled or maintained on any private land without first
obtaining a fire permit from the Chief of the Fire Department, and provided
further that no such fire permit shall be issued except on the following
conditions:
1. That burning be allowed only between 5:00 a.m. and 10:00 a.m.
2. That an adult stay in constant attendance.
3. That before burning, an area shall be cleared away from any
building, fencesand shrubbery to the extent prescribed as necessary
by the Chief of the Fire Department, or Fire Inspector designated
by the Fire Chief.
4. That no burning take place on windy days.
5. That burning be subject to such conditions as may be deemed necessary
by the Chief of the Fire Department, or designated Fire Inspector,
for the protection of life and property.
(h) There is hereby added to Section 27.14 of Article 27, Sub -section F,
the following: 'Any new incinerator used by any person shall be an approved
incinerator in accordance with the requirements established by the Chief of
the Fire Department. All such new incinerators sbnll be located at least three
(3) feet from the property line or fence and at least ten (10) feet from any
structure. I "
SECTION 4. Section 3103, covering the use of automatic gasoline nozzles, being
a repetition of regulations contained in the Uniform Fire Code, is hereby deleted.
SECTION 5• Section 3104, entitled: "Modifications," is hereby amended by the
substitution of the words "Uniform Fire Code," for "Fire Prevention Code" in said
section.
SECTION 6. This Ordinance shall take effect and be in full force thirty (30)
days from and after its passage, and prior to the expiration of fifteen (15) days
from the passage thereof shall be published once in the ORANGE COAST DAILY PILOT, a
newspaper of general circulation, printed and published in the City of Costa mesa,
together with the names of the members of the City Council voting for and against
the same.
