HomeMy WebLinkAbout64-45 Section 2736, Employee BenefitsORDINANCE No. 64-45 AN ORDINANCE OF THE CITE COUNCIL OF THE CITY OF COSTA MESA AMENDING THE MONICIPAL CODE OF THE CITY OF COSTA MESA BY THE ADDITION THM70 OF SECTION 2736, BEING A SECTION PROVIDING MENEFITS FOR ENPIOYEES INCURRING SICKNESS, INJURY, OR DEATH IN THE PERFORMANCE OF DUTY. The City Council of the City of Costa Mesa does hereby ordain as follows: SECTION 1. The Municipal Code of the City of Costa Mesa is hereby amended by the addition thereto of the following section: "Section 2736 Injury or Death in the Performance of Duty -- All Employees. on and after September 21, 1964, in all cases where sickness, injury or death is incurred in the performance of duty, full-time employees shall be entitled to the following benefits beyond the periods provided for in Sections 2730 through 2735 hereof: (a) Injury on Duty - Disability. A monthly allowance will be paid if a disability is determined by the Injury on Duty Accident Committee and the City Physician to be incurred in the performance of duty. The allowance shall be fifty per cent (50',6) of the employee's final comp- ensatiom (based an current monthly salary). This allowance shall continue daring the lifetime of the esployse, or until it has been determined by the Injury on Duty Accident Committee and the City Physician that the employee is physically able to return to duty. (b) Injury on Duty - Death. A monthly allowance will be paid to the widow, or if there is no widow, to the employee's children under the age of 18. Such am shall be paid until the youngest surviving child reaches 18 years of age. If death is determined by the Injury on Duty Accident Committee and the City Physician to have arisen out of an injury or disability incurred in the performance of duty, the allowance shall be fifty per cent (50%) of the employee's final compensation (based on his current monthly salary), and is payable to his widow until death or re- marriage. In the event of death or remarriage of the widow, the allow- ance will be paid to the surviving children." SECTION 2. This Ordinance is hereby declared to be an urgency ordinance immediately necessary for the preservation of the public welfare and shall become effective upon its adoption. The facts constituting the urgency are as follows: Norm than two hundred employees of the City are without protection in the event of injury or death in the performance of duty. SECTION 3. This ordinance shall be published once in the ORANGE COAST DAILT PILOT, A newspaper of general circulation printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
