A RESOLUTION OF THE CITY COUNCIL OF THE CITY
-- OF COSTA MESA, CALIFORNIA, INCREASING DOG
LICENSING FEES.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AND DECLARE AS FOLLOWS:
WHEREAS, dog licensing fees were established in 1972, with a fee increase for
altered dogs from $6 to $10 occurring in 1976, a fee increase for unaltered dogs from
$10 to $20 adopted in 1989, and no fee increases adopted since then; and
WHEREAS, the current fees charged for dog licensing do not offset costs
incurred in connection with the dog licensing process, including staffing, notices,
issuance, fee collection, tags, enforcement and the costs borne in administering the
barking dog ordinance process; and
WHEREAS, pursuant to the provisions of the California Constitution and the laws
of the State of California, the City of Costa Mesa is authorized to adopt and implement
rates, fees and charges for municipal services; provided however, that such rates, fees
and/or charges do not exceed the estimated reasonable cost of providing such services;
and
WHEREAS, dog licensing fees are considered "beneficiary charges," which are
defined as payments made by consumers in direct exchange for publicly -provided
services; and
WHEREAS, the proposed increases in the dog licensing fees will allow the City
to partially recover the costs reasonably borne for providing the service, including
current average labor costs, allowable materials or overhead costs; align dog licensing
fees to close to midpoint with those similar fees charged in the municipal marketplace;
and further the message to residents to consider dog sterilization in order to reduce
overpopulation of dogs and the increasing number of dogs that are euthanized because
of it. The dog license fees are meant to cover all or a portion of the costs incurred to the
City by the user, in this case, the dog's owner; and
WHEREAS, given the history and current costs for the program, the proposed
rate increases to the dog licensing fees are a reasonable increase and do not exceed
the estimated reasonable cost of providing such services; and
WHEREAS, California Government Code Section 66016 requires notice to be
published in accordance with California Government Code Section 6062a and data
made available concerning rates, fees and charges prior to conducting a public hearing
with respect to the adoption of increases in rates, fees and charges, or the adoption of
new rates, fees and charges for which no other procedure is provided by law; and
WHEREAS, pursuant to California Government Code Section 66018, this City
Council has conducted and concluded a duly noticed public hearing with respect to the
rates, fees and charges prior to the adoption of this Resolution; and
WHEREAS, this City Council desires to adjust the fees for dog licensing services
provided by the City of Costa Mesa as set forth herein; and
WHEREAS, all legal prerequisites to the adoption of this Resolution have
occurred.
NOW, THEREFORE, BE IT RESOLVED as follows:
Section 1: This City Council hereby finds and determines that based upon the
data, information, analysis, oral and written documentation presented to this City
Council concerning the current dog licensing rates and fees, and charges described in
Exhibit "A" attached hereto, and by this reference incorporated herein, the revised dog
licensing rates, fees and charges set forth in Exhibit "A" do not exceed the established
reasonable cost of providing the services for which the rates, fees, or charges are
levied.
Section 2: The rates, fees and charges set forth in Exhibit "A" as further
described below, are hereby adopted and approved as the rates, fees and charges for
the dog licensing services and other dog services provided by the City or by the City's
contracted animal shelter.
Section 3: The rates, fees and charges set forth in Exhibit "A" shall be effective
and shall be implemented commencing July 14, 2010.
Section 4: Immediately upon the effective date of the rates, fees and charges set
forth in Exhibit 'A," any previously established rates, fees and/or charges for the City's
dog licensing program shall be, and the same are hereby superseded by the rates, fees,
and charges established in said Exhibit "A."
Section 5: The City Clerk shall certify to the adoption of the Resolution.
