AN ORDINANCE OF THE CITY OF COSTA MESA AMENDING CERTAIN SECTIONS
OF CHAPTER 11, ARTIC LE 7 OF THE COSTA MESA " ICIPAL CODE, PRO-
VIDING ADDITIONAL SICK LEAVE BENEFITS FOR EMPLOYEES OF THE CITY
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1. SECTION 2721 OF THE COSTA MESA MUNICIPAL CODE
SHALL BE AMENDED TO READ AS FOLLOWS:
MSEC. 2721 SICK LEAVE AND INJURY PAY. COMPUTATION.
"IN COMPUTING ANY PERIOD OF SICK LEAVE OR INJURY LEAVE HEREUNDER,
THE DAY UPON WHICH SUCH EMPLOYEE ACTUALLY COMMENCED WORK FOR THE
CITY SHALL BE TAKEN AS THE FIRST DAY OF EMPLOYMENT, AND THE
PERIOD OF TIME SERVED THEREAFTER SHALL BE COMPUTED ON A MONTHLY
BASIS, ALLOWING ONE DAY SICK LEAVE OR INJURY LEAVE FOR EACH
CALENDAR MONTH OF SERVICE WITH CREDIT GIVEN FOR FRACTIONS OF
MONTHS EXCEEDING ONE-HALF MONTH ONLY, AND DEDUCTING THEREFROM ONE
DAY FOR EACH DAY OF EARNED SICK LEAVE OR INJURY LEAVE THERETOFORE
TAKEN BY SUCH EMPLOYEE; PROVIDED, HOWEVER, THAT NO EMPLOYEE SHALL
BE ALLOWED AT ANY TIME ACCUMULATIVE SICK LEAVE OR INJURY LEAVE OF
MORE THAN NINETY (90) WORKING DAYS."
SECTION 2. THERE IS HEREBY ADDED TO THE COSTA MESA
MUNICIPAL CODE SECTION 2726, WHICH SHALL BE AS FOLLOWS:
MSEC. 2726 ADDITIONAL SICK LEAVE CREDITS.
IIF, AT THE END OF ANYCALENDARYEAR BEGINNING WITH CALENDAR YEAR
1966, A FULL-TIME EMPLOYEE'S ACCUMULATED SICK LEAVE CREDIT SHALL
TOTAL NINETY (90) WORK DAYS, THE NUMBER OF ADDITIONAL SICK LEAVE
OR INJURY LEAVE DAYS HE WOULD HAVE EARNED DURING SAID CALENDAR
YEAR HAD HIS CREDITS NOT REACHED THE MAXIMUM ACCUMULATION
SECTION 2. (CONTINUED)
FIGURE SHALL BE CALCULATED, AND HE SHALL, DURING THE SUBSEQUENT
CALENDAR YEAR, BE GRANTED THE EQUIVALENT OF ONE-THIRD (113) OF
SUCH DIFFERENTIAL CREDIT (EXCLUDING ANY FRACTIONAL DAY OF CREDIT
RESULTING WHICH IS LESS THAN ONE-HALF (1/2) OF ONE DAY) EITHER BY
PAYMENT IN A LUMP SUM AT A RATE EQUAL TO HIS CURRENT REGULAR
COMPENSATION, OR BY TIME OFF DUTY FOR A LIKE NUMBER OF WORKING
DAYS WITHOUT DEDUCTION FROM HIS SALARY OR COMPENSATION, THE METHOD
TO BE DETERMINED BY THE CITY MANAGER AFTER DUE CONSIDERATION OF
SUCH EMPLOYEE'S PREFERENCE. ANY FULL-TIME EMPLOYEE WHOSE
CLASSIFICATION IS NOT INCLUDED IN THE BASIC SALARY SCHEDULE SHALL
BE INELIGIBLE TO RECEIVE SUCH DIFFERENTIAL CREDIT."
SECTION 3. THIS ORDINANCE SHALL TAKE EFFECT AND BE IN
FULL FORCE THIRTY (30) DAYS FROM AND AFTER ITS PASSAGE, AND PRIOR
TO THE EXPIRATION OF FIFTEEN (15) DAYS FROM THE PASSAGE THEREOF
SHALL BE PUBLISHED ONCE IN THE ORANGE COAST DAILY PILOT, A NEWS-
PAPER OF GENERAL CIRCULATION, PRINTED AND PUBLISHED IN THE CITY
OF COSTA MESA, TOGETHER WITH THE NAMES OF THE MEMBERS OF THE
CITY COUNCIL VOTING FOR AND AGAINST THE SAME.
