AN ORDINANCE OF THE CITY OF COSTA MESA, CALIFORNIA,
REORGANIZING AND AMENDING THE CITY MUNICIPAL CODE
SECTIONS RELATING TO SUBDIVISIONS AND SUBDIVISION
MAPS TO CONFORM WITH THE 1965 LEGISLATIVE AMENDMENTS
TO THE STATE OF CALIFORNIA CODES.
THE CITY OF COSTA MESA DOES HEREBY ORDAIN AND ENACT AS
FOLLOWS:
SECTION 1
Chapter IX, Article I of the Costa Mesa Municipal Code
shall be amended to read as follows:
CHAPTER IX
Planning and Zoning
Article 1-A
Subdivisions - Tentative Maps
Sec. 9100 - Authority
Pursuant to the "Subdivision Map Act" of the State of
California, as it now exists or may hereafter be amended the
provisions of the Article are supplemental to those of said
Act, and shall apply to all subdivisions of land hereafter
made when said land is entirely, or partially, within the
limits of the City of Costa Mesa. The Costa Mesa Planning
Commission is hereby charged with the duty of making invest-
igations and reports on the design and improvement of pro-
posed subdivisions; and is hereby authorized to approve,
conditionally approve or disapprove tentative maps of subdivisions
prepared and filed according to this Article and the said' -Sub-
division Map Act," to recommend the kind, nature and extent of
the improvements required to be installed in 'subdivisions.
Sec. 9101 - Subdivision
A subdivision, as distinguished from a parcel, is any
real property, improved or unimproved, shown on the latest ad-
opted County tax roll as a unit, wholly or partially within
the City of Costa Mesa, shown as a unit, or as contiguous units,
which is divided for the purpose of sale, Lease or financing,
whether immediate or future, by any Subdivider, into five or
more parcels.
Sec. 9102 - Subdivision - Exclusions.
The definition set out in Section 9101 does not include:
1. The subdividing or division by Lease or Sublease of
any apartment building, office building, store build-
ing, industrial building, or commercial building.

2. The subdividing or division by Lease or Sublease
in any Trailer Park.
3. The Subdivision or division of any real property by
lease or sublease in the form of mineral deeds or
oil and gas leases, or land divided into plots for
cemetery purposes.
4. Any parcel of land which is divided into four or
less parcels.
5. A division of real property where the whole parcel
to be divided contains less than five acres and the
following conditions are met:
a. Each subdivided lot or parcel abuts a public street
or highway, and;
b. No dedications or improvements are required by the
Planning Commission.
6. A division of real property, where the parcel to be
divided is divided into lots of a gross area of 20
acres or more and the following conditions are met:
a. Each lot has an access to a maintained public
street or highway; and
b. That the Planning Commission approve said access.
7. A division of real property, where the parcel to be
divided is in a zoned industrial area or park and
the following conditions are met:
a. Access to public streets or highways approved by
the Planning Commission; and
b. Approval by the Planning Commission of the street
alignments and widths within the industrial area
or park.
8. Any parcel or parcels of land divided into lots or
parcels each of a gross area of forty acres or more.
Sec. 9103 - Exclusions Subject to Parcel Map Requirements
The exclusions set forth in sub -sections four (4) through
seven (7) inclusive are hereinafter provided for in Article 1-C.
Sec. 9104 - Subdivision Standards
There is hereby adopted the following minimum subdivision
standards of development for streets, highways, alleys, walk-
ways, lots, utility easements, and setback lines:
1. Width of Streets. Streets shall have the following
minimum widths:
a. Major Highways. Minimum widths for major highways,
service roads and plating strips shall comply with
the Master Plan of Streets and Highways heretofore
adopted by the City.
b. Local Streets. Local street rights-of-way within
a subdivision or division of land, other than for
industrial use, shall be not less than sixty (60)
feet wide except where special circumstances make
it impractical to require sixty (60) feet of
right-of-way in which event said right-of-way may

be reduced to a width necessary to meet the
special circumstances but in no case shall such
right-of-way be reduced in width to less than
forty (40) feet.
c. Dead End Streets. Dead end streets shall be
terminated by a turnaround not less than one
hundred (100) feet in diameter. Cul-de-sac and
minor streets shall be subject to individual
determination by the City. Stub streets or rights-
of-way may be required to the edge of the sub-
division.
Street Grades. Street grades between six per cent
6 and ten per cent (10%) will be approved only
for such distances as topographical conditions make
a lesser rade impractical. A grade exceeding ten
per cent g10%) will be approved only when conclusive
evidence shows that a lesser grade is impractical.
Curved Streets. The center line radii of curves on
streets or highways, except where physical conditions
make compliance impractical, shall be not less than:
a. One thousand (1000) feet on highways shown on the
Master Plan of Arterial Highways.
b. Four hundred (400) feet on through streets and
c. Two hundred fifty (250) feet on local streets
which cannot be extended to a length of more than
one-fourth (a) mile.
Street Corner Radius. Street corners shall have a
minimum twenty-five (25) foot curb radius with the
property line designed so as not to reduce parkway
widths.
Street Connections. All street connections shall
be at approximate right angles.
Street Alignment. Streets which are a continuation
of streets in contiguous territory shall be so aligned
as to assure that their center lines shall coincide.
In cases where straight continuations are not physically
possible, such center line shall be continued by curves.
Streets Where No Official Plan Exists.
In areas where no official plan exists, the layout
of all improvements including roadways, curbs, park-
ways, dividing strips, sidewalks, sewer lines and
water mains within the rights-of-way of all highways,
streets, alleys and utility easements shall be in
accordance with standards established by the City
Council, and where no such standards have been adopted
the arrangement shall be subject to approval by the City.
Alleys in Rear of Business. Alleys in the rear of
business, industrial or income property shall be design-
ed and located according to the plan for the develop-
ment of the particular use involved.
walkwa s. Walkways shall have a minimum width of
four 4 feet and shall be improved according to City
specifications.

10. Corner Lots. Corner lots shall have a minimum
width of sixty (60) feet,
11. Other Lots. The minimum size of all other lots
shall be fifty (50) feet wide and contain six
thousand (6,000) square feet.
12. Cul -de -Sac Lots. Cul-de-sac lots shall be a minimum
of fifty 50 feet in width at the approved building
setback line.
13. Side Lines of Lots. Side lines of lots shall be
approximately normal to the street line.
14. Large Lots. Future Subdivisions. When large lots
are proposed, the shape, building locations and
building lines may be required to be so established
as to make it practical to resubdivide the lots into
building sites approximatel* sixty (60) feet wide by
one hundred (100) feet deep without injury to adjoin-
ing lots.
15. Utility Easements. Utility lines shall be located
at the rear of all lots, wherever practical, or as
otherwise provided by the Costa Mesa Municipal Code.
16. Walkwa in on LBlock. Pedestrian ways at least
ten 10s feet wide may be required in long blocks.
17. Master Plan Streets and Highways. Wherever any of
the standards herein are inconsistent with the Master
Plan of Streets and Highways, adopted by the City of
Costa Mesa, said Master Plan shall be controlling,
Sec. 9105 - Tentative Maps - Requirements for Subdivisions
All Subdivisions as defined in Section 9101 shall meet the
following tentative map requirements:
1. Title of subdivision and description of property.
2. Name and address of owner and subdivider.
3. Name and address of person preparing map.
4 Approximate acreage.
5. North point.
6. Scale
7. Date
8. Boundary line
9. Location of streets.
10. Width of streets
11. Name, location and width of adjacent streets.
12. Proposed street grades and proposed building site el-
evations.
13. Street grades beyond tract.
14. Cross sections of proposed street improvements.
15. Width of alleys
16. Width of easements
17. Dimensions of reservations
18. Existing structures
19. Location of existing and proposed public utilities
20. Existing sewers.
21. Elevation of sewers at proposed connections.
22. Existing water mains.
23. Existing culverts and drain pipes.
24. Vater courses.
25. Land subject to overflow, inundation or flood hazard.

26. Railroads
27. Lot lines and approximate dimensions
28. Approximate radius of curves.
29. Lands and parks to be dedicated for public use.m
30. Contours at five 5) foot intervals if slope
greater than ten 10) per cent.
31. Contours at two (2) foot intervals if slope less
than ten,(10) per cent.
32. Proposed land use:
a. Single family
b. Multi -family
c. Business
d. Industrial
33• Name of adjoining subdivisions
34. Existing use of property immediately surrounding
the tract.
35• Land registered.
Sec. 9106 - Tentative Maps. Procedure
1. Preparation of Map. Filing Place. The tentative
map shall be prepared in accordance with the "Sub-
division Map Act" and the provisions of this
Article, and shall be filed with the Planning
Commission.
2. Time for Filing. Such filing should be prior to the
completion of final surveys of streets and lots and
before the start of any grading or construction work
within the proposed subdivision.
3. Number of Copies of Tentative Map. The subdivider
shall ascertain of the Planning Commission the number
of required copies of the tentative map.
Sec. 9107 - Statements with Tentative Map.
The tentative map shall be accompanied by reports and
written statements from the subdivider giving essential in-
formation regarding the following matters:
1. Subdivision development plan.
2. Source, quality and an estimate of available quantity
of domestic water supply.
3. Type of street improvements and utilities which the
subdivider proposed to install.
4. Proposed method of sewage disposal.
5. Proposed storm water sewer (grade and size)
6. Protective covenants to be recorded and filed with
the Planning Commission.
7. Proposed tree planting.
Sec. 9108 - Forwarding of Copies by Planning Commission
The Secretary of the Planning Commission shall immediately
on receiving the required copies of a tentative map, forward one
copy to each of the following:

a. City Superintendent of Streets.
b. City Engineer
c. County Health Officer
d. City Attorney
e. Unified School District
f. Costa Mesa County Water District
g. Costa Mesa Sanitary District
h. Any other Municipality entitled thereto.
i. Two copies to the District Engineer of the Division
of Highways where any portion of said subdivision
lies within or touches any freeway area of interest
shown on an ,Area of Interest" map filed with the
City by the State Department of Public Works or where
said Subdivision is within one mile of any State
highway.
Sec. 9109 - Reports by Officers or Departments.
Within twenty (20) days after each officer or department
has received a copy of the tentative map, the officer or depart-
ment shall make a report in writing to the Planning Department
as to any recommendations in connection with the tentative map
and its bearing on the particular function of that official or
department. Failure to so report shall be deemed approval.
Sec. 9110 - Tentative Map Pees.
A fee shall be paid to the City to cover costs of check-
ing each tentative map or maps in the sum of Twenty-five
($25.00) Dollars plus Two Dollars ($2.00) per lot, for each
subdivision other than a subdivision for the purpose of reversion
to acreage.
Sec. 9111 - Action by Planning Commission
Within forty (40) days after a tentative map has been
filed, the Planning -Commission shall consider said map and shall
either approve or disapprove the same.
In the event the Planning Commission shall approve said
map their action shall be final subject to the review of the
City Council as hereinafter provided for.
In the event the map is disapproved the reason for such
disapproval shall be given in a statement attached to the
tentative map outlining the changes which will be required be-
fore such map will be acceptable, and the same shall be retained
in the Planning Department records. A copy of said statement
shall forthwith be forwarded directly to the subdivider or his
agent. As soon as the Planning Commission has approved, con-
ditionally approved or disapproved the tentative map, a copy
shall be sent by the Planning Commission to the Real Estate
Commission of the State of California.

Sec. 9112 - Duration of Approval - Tentative Map
After receipt of the report of the Planning Commission
approving or conditionally approving the tentative map, the
subdivider may, within eighteen (18) months from the date of
said approval, proceed to prepare and file a final map as
herein provided. If such final map is not submitted within
eighteen (18) months from the date of approval of the tentative
map, said map shall be considered abandoned.
ARTICLE 1-B
Subdivisions - Final Maps
Sec. 9113 - Report of the City Engineer
The City Engineer shall certify to the Planning Commission
that soil tests, excavations and borings, either have been madq
or have been waived and shall report the results of such test,
or the reason for any waiver to the Planning Commission. In
the event that said tests show expansive soils or other problems
which, if not corrected, would lead to structural defects, the
City Engineer shall require a soil test on each lot of said sub-
division.
Sec. 9114 - Corrective Action
In the event soil tests are needed on each lot of said
subdivision as heretofore set out, the registered engineer
making said tests and reports, shall make recommendation for -
action to be taken to avoid structural defects. The action to
be taken must be approved by the City Engineer and such action
must be made a condition of any building permit issued for con-
struction on affected lots.
Sec. 9115 - Preparation of Final Map
After approval of tentative map by the Planning Commission
the subdivider may cause a final map to be prepared in accord-
ance with a completed survey of the subdivision and in substan-
tial compliance with the approved tentative map, and in full
compliance with the "Subdivision Map Act" and this Article.
(a) Size and Content of Map
The size and content of the final map shall comply
with the provisions of Division 4, Part 2, Chapter 2,
Article 5, Section 11567 of the Business and
Professions Code of California.
(b) Title Sheets.
Below the title shall be a subtitle consisting of a
general description of all the property being sub-
divided, by reference to deeds, subdivisions or to
sectional surveys. Reference to tracts and sub-
divisions shall be spelled out and worded identically
with original records, with complete reference to
proper book and page of the record. The title sheet
shall show in addition the basis of bearings. Maps

(c) Certificates. Certificates on the title page shall
comply with the provisions of Division 4, Part 2,
Chapter 2, Article 7, Sections 11585 through and
including Section 11594 Business and Professions
Code of California.
(d) Surveying Data for Lots. Sufficient data shall be
shown to determine readily the bearing and length of
each line. Dimensions of lots shall be the net
dimensions. No dittomarksshall be used; Lots
containing one (1) acre or more shall show net
acreage to nearest hundredth.
(e) Surveying Data. Generally.
1. The final map shall show the center lines of all
streets; length, tangents, radii and central
angles or adial bearings of all curves, the total
width of each street, the width of the portion be-
ing dedicated and the width of existing dedication
and the width of each side of the center line;
also the width of the rights-of-way of railroads,
flood control or drainage channels and any other
easements existing or being dedicated by the map.
2. Surveys in connection with the preparation of
subdivision maps as in this Article provided
shall be made in accordance with standard practices
and principles for land surveying. A traverse of
the boundaries of the subdivisions and all lots
and blocks shall close.
(f) Record of Easements. The final map shall show the
center line data, width and side lines of all ease-
ments to which the lots are subject. If the easement
is not definitely located of record, a statement as
to the easement shall appear on the title sheet.
Easements for storm drains, sewers and other purposes
shall be denoted by broken lines. Distances and bear-
ings on the side lines of the lots which are cut by
an easement shall be so shown as to indicate clearly
the actual lengths of the lot lines. The width of
the easement and the lengths and bearings of the
lines thereof and sufficient ties to locate the ease-
ment definitely with respect to the subdivision shall
be shown. The easement shall be clearly labeled and
identified and if already of record, proper reference
to the records given. Easements being dedicated
shall be so indicated in the certificate of dedication.
(g) Existing Monuments. The final map shall show
clearly what stakes, monuments or other evidence
was found on the ground to determine the
boundaries of the tract. The corners of adjoining
subdivisions or portions thereof shall be identified
and ties shown.
(h) Established Lines. Wherever the City Engineer has
established the center line of a street or alley,
that data shall be considered in making the surveys
and in preparing the final map, and all monuments
found shall be indicated and proper reference made
to field books or maps of public record, relating to
the monuments. If the points were reset by ties,
that fact shall be stated. The final map shall show
city and county boundaries crossing or adjoining
the subdivision clearly designated and tied in.
(i) Lot Numbers. The lots shall be numbered consecutively,
commencing with the number 1, with no omissions or
duplications, provided, that where the subdivision is
a continuation of or an addition to an existing sub-
division, the lot numbers may commence with the
number immediately following the last or highest
number of such existing subdivision and in all other
respects shall conform with the preceding require-
ments. Each lot shall be shown entirely on one sheet.
(j) Traverse Sheets. And work sheets showing the closure,
within the allowable limits of error, of the exterior
boundaries and of each irregular block and lot of the
subdivision.
(k) Plans and Specifications. Of the proposed improve-
ments together with the necessary bonds or guarantees
as provided herein.
(1) A copy of the protective covenants to be recorded.
(m) A memorandum in duplicate showing:
1. The total area of the subdivision
2. The total area in streets
3. The total area in lots
4. The area in parks, school sites, or other lands
offered for dedication or reserved for dedication
or reserved for future public or quasipublic use.
(n) A preliminary soil report prepared by a Civil
Engineer who is registered by the State of California
based upon adequate tests, borings, or excavations,
provided however that if the City Engineer has
sufficient knowledge as to the soil qualities in said
subdivision either from previous testings or independent
investigation, said soil test may be waived.
Sec. 9116 - Final Map Requirements
1. If more than three (3) sheets are used, an index,
showing entire subdivision with lots numbered con-
secutively.
2, Title, name of tract, date, North Point and scale.
3. Description of land included.
4. Location and names, without abbreviations, of all:
a) Proposed streets and alleys
b) Proposed public areas and easements
c) Adjoining streets
5. Dimensions in feet and decimals of a foot
6. Dimensions of all lots
7. Center line data including bearings and distances
S. Radius, tangent, arc and central angle of curves
9. Suitable primary survey control points
10. Location of all permanent monuments
11. Ties to and names of adjacent subdivisions.
12. Ties to any city or county boundary lines involved.
13. Required certificates.
14. Net acreage of all lots of one (1) acre or more.
15. when a soil report has been prepared this fact -shall
be noted on the title sheet of the final map together
with the date of the report and the name of the
registered engineer making the report.
Sec. 9117 - Dedications and Improvements.
(a) Dedication of Streets. All streets, highways and
parcels of land shown on the final map and intended
for any public use shall be offered for dedication
for public use.
(b) Future Dedication. Streets or portions of streets
may be offered for future dedication where the
immediate opening and improvement is not required,
but where it is necessary to insure that the City
can later accept dedication when said streets are
needed for the further development of the area or
adjacent areas.
(c) Agreement to Make Improvements. The subdivider shall
improve or agree to improve, all land dedicated for
streets, highways, public ways and easements as a con-
dition precedent to acceptance and approval of the
final map. Such improvements shall include such grading,
surfacing, sidewalks, curbs, gutters, culverts, bridges,
storm drains, water mains and service connections to"
the property line with cutoff valves, sanitary sewers
and such other structures or improvements as may be re-
quired by ordinance for the general use of the lot
owners in the subdivision and local neighborhood
traffic and drainage needs.
(d) Grades. All improvements shall be installed to grades
approved by the City Engineer.
(e) Plans. Profiles and Specifications. Plans, profiles
and specifications of proposed improvements shall be
furnished to the City Engineer prior to the time of
submitting the final map to him, and be approved by
the City Engineer before the map shall be filed with
the City Council. Such plans and profiles shall show
full details of the proposed improvements which shall
be according to the standards of the City.

(f) Agreement by Subdivider with City. If such improvement
work be not completed satisfactorily before the final
map is approved, the owner or owners of the subdivision
shall, immediately upon approval and before the
certification of the final map by the City, enter as
contractor into an agreement with the City whereby, in
consideration of the acceptance by the City of the
streets and easements offered for dedication, the con-
tractor agrees to complete the work within the time
specified in the agreement.
(g) Waiver of Access. The subdivider may be required by
the Planning Commission as a condition precedent, to
waive access to one or more, designated streets before
obtaining the City Council approval of any final map.
(h) Bonds. To assure the City that this work will be
completed, Bonds shall be provided by the subdivider
from an approved Surey Company or in cash, in the
following amounts and for the following purposes:
1. A bond equivalent to 100% of the total cost of the
improvements to guarantee payment for all labor and
materials.
2. A second bond equivalent to 100% of the total cost
of the improvements plus the cost of setting final
monuments to guarantee faithful performance of the
agreement heretofore set forth and to guarantee
completion of the work of improvement described
herein including the setting of final monuments.
Sec. 9118 - Fees. Final Maps
Fees shall be paid in the following amounts:
(a) Fee Per Lot. A business license shall be paid to the
City as provided in Sections 6222 and 6223 of this Code.
(b) Checkin Fee. The fee for examining a final map shall
be Five $$.00) Dollars, providing that where a large
amount of checking is required and/or field surveys are
necessary to check the accuracy of the data shown on
the final map, an additional fee estimated by the City
Engineer to be sufficient to cover the actual cost shall
be deposited with him. Provided further, that any
balance shall be returned to the subdivider, or in
case the fee is not sufficient, the subdivider shall
pay the difference between the estimated and actual
cost of examination.
(c)
At the time the plans, profiles and speclx'lcatlons Q1"
proposed street improvements are submitted to the City
Engineer for approval, the subdivider shall pay to the
City as fees for engineering and inspection the follow-
ing amounts:
1. 31% of that portion of the cost of improvements
which is $25,000.00 or less.
2. 3% of that portion of the cost of improvements which
is more than $25,000.00 but less than $100,000.00.
3. 2-lf% of that portion of the cost of improvements
which is $100,000.00 or more.
(d) Payment of Street Lighting Costs. All persons, firms,
and corporations shall, at the time of filing a final
map, pay, in addition to other fees provided by this
Code, an amount of the estimated cost of the installation
of light poles and electrical energy in the tract or
tracts, for the period from the date of installation of
such poles to the next November 1st. The Street Lighting
Superintendent shall determine the estimated cost of the
light poles and the electric energy charge for said
period, based upon the amounts charged by the Edison
Company to the City under the current contract. The
electrical fee to be paid, as provided for in this sub-
section shall be paid to the City Engineer at the time
that the other fees and bonds required by this Code are
to be paid and furnished to said City Engineer.
(e) Water Fee. Water acreage fees if any
(f) Sanitary Fee. Sanitary and Sanitation District fees
if any.
Sec 9119. Check and Transmittal Final Map.
(a) Engineers' Check. After issuance of a receipt for the
final map, the City Engineer shall examine it as to
sufficiency of affidavits and acknowledgements, correct-
ness of surveying data, mathematical data and computa-
tions and such other matters as require checking to
insure compliance with the provisions of the "Subdivision
Map Act" and' -of. this Article.
(b) Transmittal to the City Council. If the final map is
found to be correct in form and the matters shown
thereon are sufficient, the CityEngineershall endorse
his approval thereon and transmit it to the City Council
together with plans and specifications of proposed
improvements and such other matters as are required to
enable the City Council to consider the final map or
return the final map to the subdivider together with a
statement setting forth the grounds for its return,
provided that the City Engineer shall not forward said
map to the City Council until the requirements of
Sections 9115 to and including 9118 have been met by
the subdivider.

Sec. 9120 - Penalty
In addition to the penalties provided by Section 1115
of the Municipal Code for violation of the provisions thereof,
each person, firm or corporation shall be deemed guilty of a
separate offense for every day during any portion of which any
violation of any provision of this Article, including any
physical condition created in violation of this Article, is
permitted, continued or committed by such person, firm or
corporation and shall be punishable therefore as provided in
this Code, and any lot, street, alley or other feature made
the subject of this Article maintained contrary to the pro-
visions thereof shall constitute a public nuisance.
ARTICLE 1-C
Parcels
Sec 9121 - Tentative Map - Required for Parcels.
A tentative map as hereinafter provided for shall be sub-
mitted in all of the following cases:
1. In the case of any parcel or parcels of land, which
is divided into four or less parcels.
2. Where the whole parcel to be divided contains less than
five acres and the following conditions are met:
(a) Each subdivided lot or parcel abuts a public
street or highway; and
(b) No dedication or improvements are required by the
Planning Commission.
3. Where the parcel to be divided is divided into lots of
a gross area of twenty (20) acres or more, and the
following conditions are met:
(a) Each lot has an access to a maintained public street
or highway; and
(b) Approval of said Access by the Planning Commission.
4. Where the parcel to be divided is in a zoned industrial
area or park, and the following conditions are met:
(a) Access to public streets or highways approved by
the Planning Commission; and
(b) Approval by the Planning Commission of the street
alignments and widths within the industrial area
or park.
Sec. 9122 - Contents - Tentative Map
Each tentative map for any parcel or parcels within this
Article shall contain the following items:

1. Designation of portion of Parcel or parcels to be
dedicated for street purposes, if any.
2. Proposed streets or alleys within the parcel being
divided, their width and alignment.
3. Abutting streets or highways proposed to serve each
parcel and the method of access proposed for each
parcel lot within the parcel being divided.
4. All of the requirements as set out in Sections 11575
to and including 11580 of the Business & Professions
Code, of the State of California, being Article 6 of
Chapter 2 of Part 2, Division 4 of the Business and
Professions Code of the State of California.
5. Existing improvements, if any.
6. Name of owner and/or subdivider.
Sec. 9123 - Time Limitation
The approval of the tentative parcel map as set forth in
this Article shall be for the period of one (1) year, provided,
however, that the applicant for approval may apply to the
Planning Commission for an extension of time not to exceed one
(1) additional year.
Sec. 9124 - Recording Final Parcel Map
At any time within the one (1) year approval period for
the tentative parcel map, or within the period of any extensioy:,
granted by the Planning Commission, a parcel map be recorded
with the County Recorder, showing each new parcel or parcels
created by the subdivision as set out herein.
Sec 9125 - Limitations - Sale, Lease or Financing.
No parcel or parcels may be sold, leased or finance prior
to the filing of the parcelmap with the County Recorder as set
out in Section 91.zy.
Sec. 9126 - Legal Description - Parcels.
Each parcel of the subdivided property may be sold, leased,
financed or otherwise dealt with by designation of lot number
and County Recorder's Book, page and document number references
as an official legal description.
Sec. 9127 - Dedications
Dedications required for street openings, widening or ease-
ments shall be provided for by legal instruments separate from
the parcel map and such dedications shall be completed prior to
the filing of the parcel map with the County Recorder.

Sec. 9128 - Street Improvements
The Planning Commission shall have the authority to re-
quire improvements of public or private streets, highways or
easements as may be necessary for local traffic, drainage and
sanitary needs in the types of parcel subdivisions set out in
Section 912'G'(1) and (4).
Sec. 9129 - Final Map
A tentative parcel map, if it complies with this article
shall also be deemed a final map insofar as this City is con-
cerned, and the Planning Commission, with the consent of the
subdivider, may act on it as a final map concurrently with its
action on the tentative map.
Sec. 9130 - Penalties
In addition to the penalties provided by Section 1115 of
the Municipal Code for violation of the provisions thereof,
each person, firm or corporation shall be deemed guilty of a
separate offense for every day during any portion of which any
violation of any provision of this Article, including any
physical condition created in violation of this Article, is per-
mitted, continued, or committed by such person, firm or corpora-
tion and shall be punishable therefore as provided in this Code,
and any lot, street, alley or other feature made the subject of
this Article, maintained contrary to the provisions thereof
shall constitute a public nuisance.
ARTICLE 1-D
Remedies
Sec. 9131 - Review
The Council may on its own motion review any action taken
by the Planning Commission in connection with its approval or
disapproval of any tentative or final tract or parcel map.
The right of review shall not be dependent upon an appeal by
any subdivider.
Sec. 9132 - Time for Review
The review as heretofore set forth may be commenced at any
time after approval or disapproval of the tentative map by the
Planning Commission but not later than fifteen (15) days after
said action.
Sec. 9133 - Hearing. Findings. Order on Review
The Council may, at its discretion, hold hearings, make
findings and an order on any review it initiates as provided
for herein. Nothing herein is to be construed as requiring said
hearings, findings or order, except that in the event the
Council shall disapprove of any tentative or final subdivision
or parcel map it shall forthwith notify the subdivider and
Planning Commission in writing of its action and the reasons
therefore.
The Council's order may sustain, modify or reject any action
taken by the Planning Commission.

Sec. 9134 - APpeal.
The subdivider may, if he be dissatisfied with the action
of the Planning Commission on tentative or final tract or
parcel maps and improvements required, appeal the Commission's
action to the City Council.
Sec. 9135 - Time for Appeal.
The appeal herein must be made within fifteen (15) days
from the date of the action taken by the Planning Commission.
The subdivider may request and be granted, if the Council de-
sires, an additional fifteen (15) days before the matter is
heard. The Council may continue the matter upon its own motion
for fifteen (15) days or its next succeeding regular meeting
with the consent of the subdivider.
Sec. 9136 - Method of Appeal
The subdivider herein shall commence an appeal by address-
ing a letter to the City Council setting forth the objectional
action taken by the Planning Commission and their grievance
with or objection to said action. Said letter may be delivered
to the City Clerk or mailed to the City. The delivery to the
Clerk or the postmark on said letter must be within the
fifteen (15) day period or granted continuance, if any, as set
forth in Section 9195.
Sec. 9137 - Fees
There shall be no fee for an appeal as provided for herein.
Sec. 9138 - Hearing on Appeal
The City Council shall fix a time for hearing on the appeal
and shall notify the Director of Planning and the subdivider
in writing, of said date and time. The City Council shall hear
evidence from any party on either side, relevant, and material
to the appeal at the time of the hearing.
Sec. 9139 - Findings and Order
The City Council shall within seven (7) days declare its
findings based upon the evidence taken at the hearing. The
Council shall make its order either sustaining, modifying or
rejecting the actions of the Planning Commission and shall
notify both the Planning Commission and the subdivider in
writing, of the Council action.
Sec. 9140 - Declaration of Policy
The Council hereby declares its policy that only evidence
touching upon character of the neighborhood, kinds, nature
and extent of improvements required, the quality and kind of
development to which the area is best adapted will be deemed
competent evidence upon appeal. This Section in no way is
intended to limit the Council's power to hear evidence on
review.
Sec. 9141 - Final Action.
Unless an appeal is taken or the Commission action re-
viewed as provided for herein, the action of the Planning
Commission shall be final.

SECTION 2. This ordinance shall take effect and be in a
full force thirty (30) days from and after its passage and
prior to the expiration of fifteen (15) days from its passage
shall be published once in the Orange Coast Daily Pilot, a
newspaper of general circulation, printed and published in the
City of Costa Mesa, together with the names of the members of
the City Council voting for and against the same.
