AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA
MESA AMENDING THE MUNICIPAL CODE OF THE CITY OF COSTA
MESA TO PROVIDE FOR THE ADOPTION OF THE 1961 UNIFORM
BUILDING CODE AND MAKING CERTAIN CHANGES THEREIN.
The City Council of the City of Costa Mesa does hereby ordain
as follows:
SECTION 1. Section 8100 of the Municipal Code of the City of Costa
Mesa is hereby amended to read as follows:
"Sec. 8100 Adoption of Uniform Building Code.
Those certain documents, three copies of which an on file in
the office of the City Clerk, being marked and designated as
Volume I of the Uniform Building Code, 1961 Edition, as revised,
and as the same shall be hereafter amended, and Volume III,
entitled Uniform Building Code Standards, 1961 Edition, as
published by the International Conference of Building Officials,
are hereby adopted as the Building Code of the City of Costa
Mesa, including the Appendix to Volume I thereof."
SECTION 2. Section 8105 of the Municipal Code of the City of Costa
Mesa is hereby amended to read as follows:
"Sec. 8105 Toilets. :Adjacent Thereto" Defined.
Every building or subdivision thereof where persons are employed,
as set forth in Sections 1005 (E Occupancies), Section 1105 (F
Occupancies, beginning with the third paragraph of said Section),
and Section 1205 (G Occupancies, beginning with the second para-
graph of said Section), of the Uniform Building Code, shall be
provided with access to at least two toilets located within such
buildings or conveniently located in a building adjacent thereto.
The phrase "adjacent thereto" shall mean on the same lot or premises."
SECTION 3. Section 8106 of the Municipal Code of the City of Costa
Mesa is hereby amended to read as follows:
"Sec. 81o6 Minimum Building Elevation.
A new section is hereby added to the Uniform Building Code to
be designated as Section 510 and to read as follows:
For the purpose of establishing the minimum permissible elevation
of the finished floor and/or top of the foundation of any structure
not in a shopping center district, the elevation of the finished
grade of the earth or pavement at its highest point on the building
line shall be considered the am of the following four (4) items:
(1� The elevation of the control point.
(2 The dimension "A", being the local rise, if any, in
the finished grade of the earth or pavement near the
control point for contingencies.
(3) A rise in the finished grade of the earth or pavement
of not less then seventeen hendredths (0.17) per cent
of the distance from said control point to the
farthest point of the building measured along the flow
line to the drainage pattern of the site.
(4) Two (2) inches, being local rise in the finished
grade of the earth or pavement near the building line.
For a lot or portion thereof which will drain directly to a public
street, the control point shall be the intersection of the flow line of the
drainage pattern of the site with the back edge of the sidewalk,.either exist-
ing or proposed as determined by the Building Official. The dimension "A"
shall be zero (0) inches.
For a lot or portion thereof which will drain directly to a public
alley, the control point shall be the intersection of the flow line of the
drainage pattern of the site with the edge of the alley pavement, either exist-
ing or proposed, as determined by the Building Official. The dimension "A"
shall be zero (0) inches unless otherwise determined by the Building Official.
For a lot or portion thereof which will drain by way of other pro-
perty to a public street or alley, the control point shall be the intersection
of the flow line of the drainage pattern of the site with either the property
line of said site or some hydraulic control feature such as a curb, wall, drive-
way, or berm as determined by the Building Official. The dimension "A" shall
be three (3) inches unless reduced by the Building Official.
For a lot or portion thereof which will drain either directly or by
way of other property to a local inlet structure of a public atom drain, the
control point and the dimension "A" shall be determined by the Building Official.
The top of the concrete foundation of any structure with stud walls
shall be not less than six (6) inches above the highest point of said finished'
grade.
The finished floor of any dwelling unit shall be not less than six
(6) inches above the highest point of said finished grade.
The finished floor of a residential garage shall be level with or
above the highest point of said finished grade.
For structures in which the foundation and/or floor are stepped, the
highest point of the finished grade shall be determined for each level.
For special cases in which the application of the provisions of this
Section would result in undue hardship, the minimi permissible elevation of the
finished floor and/or the top of the foundation may be reduced by the Building
Official.
Actual grading of the site to the finished grade elevations calculated
in accordance with this Section shall not be required.
Nothing in this Section is intended to permit the top of a concrete
foundation to be constructed at an elevation lower than that elevation provided
by the Building Code.
SECTION 4. This Ordinance shall take effect and be in dull force
thirty (30) days from and after its passage and prior to the expiration of
fifteen (15) days from its passage shall be published once in the ORANGE COAST
DAILY PILOT, a newspaper of general circulation printed and published in the
City of Costa Mesa, together with the names of the members of the City Council
voting for and against the same.
