G,2 -y.2 AN ORDINANCE OF THE CITY OF COSTA MESA AMENDING THE COSTA MESA MUNICIPAL CODE BY THE ADDITION THERETO OF A PROVISION PROHIBITING THE INHALING, DRINKING OR BREATHING OF CERTAIN SUBSTANCES. The City Council of the City of Costa Mesa does hereby ordain as follows: SECTION 1. There is hereby added to Article 1, Chapter IV, the following sections: "Sec. 4118. Betting on Games. No person shall play or bet at or against any game not mentioned in Section 330 or 330a of the Penal Code of the State of California, which is played, conducted, dealt or carried on with cards, dice, billiard balls, pool balls, cies, or other devices, for money, checks, chips, credit or any other representative of value or for any merchandise or any other thing of value. "Sec. 4119. Keeping of Gambling Place. No person (either as principal, agent, employee or otherwise) shall keep, conduct or maintain within this City any house, room, apartment or place used in whole or in part as a place where any game not mentioned in Section 330 or 330a of the Penal Code of the State of California, is played, conducted, dealt or carried on, with cards, dice, billiard balls, pool balls, cues, or other devices, for money, checks, chips, credit or any other representative of value or for any merchandise or any other thing of value. "Sec. 4120. Inhaling or Drinking Certain Substances. No person shall inhale, breathe or drink any compound, liquid, chemical, or any substance known as glue, adhesive cement, mucilage, dope, or any other material or substance or combination thereof with the intent of becoming intoxicated, elated, dazed, paralyzed, irrational, or in any other manner changing, distorting or disturbing the eyesight, thinking -1- process, judgment, balance, or co-ordination of such person. For the purpose of this Section, any such condition so induced shall be deemed to be an intoxicated condition. "The provisions of this Section shall not pertain to any person who inhales, breathes, or drinks such material or substance pursuant to the direction or prescription of any doctor, physician, surgeon, dentist, or podiatrist authorized to so direct or prescribe. "The provisions of this Section shall not pertain to any person who inhales, breathes, drinks, or otherwise in any manner uses intoxicating liquor as defined by the Alcoholic Beverage Control Act of the State of California nor shall the provisions of this Section apply to any persons who inhale, breathe, drink or otherwise in any manner use any narcotic, dangerous drug, or other material or substance or combination thereof, which material or substance or combination thereof is defined by, and the use of which is prohibited or regulated by, any law of the State of California." SECTION 2. This Ordinance shall take effect and be in full force thirty (30) days from and after its passage, and prior to the expiration of fifteen (15) days from .the passage thereof shall be ptb lished in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same. _ PASSED AND ADOPTED this /j H day of ;Xe,,- , 1962.
