AN ORDINANCE OF THE CITY OF COSTA MESA,
CALIFORNIA, REGULATING SIGNS.
The City Council of the City of Costa Mesa, California, does
ordain as follows:
SECTION 1. There is hereby added to Chapter VIIIof the Municipal
Code of the City of Costa Mesa, a new article numbered Article 5,
reading as follows:
"Article 5
Sec. 8500. Title.
This Article shall be known as the Costa Mesa Sign Code.
Sec. 8500.1. Purpose and Scope.
The purpose of this Article is to provide standards for the
size and location of signs in order to prevent the following:
(a) The obstruction or confusion of the view of traffic
or the view or the interpretation of any traffic sign, signal or
device.
(b) The obstruction of pedestrian traffic.
(c) The interference with off-street parking and the
ingress and egress thereto and therefrom.
(d) The obstruction of adjacent signs and structures.
(e) Uses inconsistent with zoning regulations.
This article does not cover the design, quality of materials,
construction, electrification and maintenance of signs, which are
governed by the Uniform Building Code as modified and adopted by
the City of Costa Mesa.
Sec. 8500.2. Enforcement.
The Building Official and the Planning Director of the City
of Costa Mesa are hereby authorized and directed to enforce all the
provisions of this article.

Sec. 8501. Permits Required.
No sign shall hereafter be erected, re -erected, constructed
altered or maintained except as provided by this Code and unless a
permit for the same has been issued by the Building Department of
the City of Costa Mesa.
Sec. 8501.1. Application for Permit.
Application for a sign permit shall be made in writing upon
forms furnished by the Building Department.
Sec. 8501.2. Exemptions.
The following shall not require a sign permit. These
exceptions shall not be construed as relieving the owner of the
sign from the responsibility of its erection and maintenance and
its compliance with the provisions of this Code or any other law
or ordinance regulating the same.
(a) The changing of the advertising copy or message on
a painted or printed sign only. Except for theater marquees and
similar signs specifically designed for the use of replaceable copy,
electric signs shall not be included in this section.
(b) Painting, repainting or cleaning of an advertising
structure or the changing of the advertising copy or message thereon
shall not be considered an erection or alteration which requires a
sign permit unless a structural change is made.
(c) Real estate signs.
Sec. 8501.3. Sign Permit Fee.
A fee for each sign permit shall be paid in accordance with
the provisions of the Uniform Building Code as modified and adopted
by the City of Costa Mesa.
Sec. 8501.4. Planning Department Approval.
The Building Department shall not issue any sign permit
without first receiving the approval of the Planning Director of
the City and the Department of Public Works.

Sec. 8502. Classification of Signs: Definitions.
In order to carry out the purposes of this Article as set
forth in Section 8500.1, signs are hereby classified and defined
as follows:
(a) Tract Sign. A Tract Sign shall mean any sign
located within the boundaries of an improved tract, advertising the
first sale of homes or lots within such tract.
(b) Real Estate Sign. A Real Estate Sign shall mean
a sign which contains the following copy:
(1) "FOR SALE" or "FOR LEASE OR RENT"
(2) Name and telephone number.
(c) Advertising Copy Signs.
(1) Appurtenant and Incidental Advertising Copy.
Sign shall mean a sign which relates to the goods sold or services
rendered within the building on which building site said sign is
erected and which does not fall within the definition of a Tract
Sign or Real Estate Sign as defined in sub -sections (a) and (b)
of Section 8502 of this Article.
(2) Off -Site Advertising Copy Sign shall mean a
sign containing advertising copy which does not fall within the
definition of the Tract Sign, the Real Estate Sign, or the Appurtenant
and Incidental Advertising Copy Sign as defined in sub -sections (a),
(b), and (c(1)) of Section 8502 of this Article.
Sec.
8503.
Size
of Signs.
(a)
Tract
Signs
- The maximum size
of a Tract Sign shall
be 300 square feet.
(b) Real Estate Signs - The maximum size of real
estate signs shall be six (6) square feet.
(c) Appurtenant and Incidental Advertising Copy Signs -
No maximum size.
(d) Off -Site Advertising Copy Signs - No maximum size.

Sec. 8504. Location of Signs on Premises.
(a) On or Behind Building Set -Back Lines.
Signs may be located anywhere on the premises on or
behind the established building set -back lines.
Lines.
(b) Between the Property Line and the Established Set -Back
No sign shall be erected or constructed, nor shall
any existing sign be altered or reconstructed, between the property
line and the established building set -back lines of any parcel
unless the Department of Public Works and the Planning Director
of the City of Costa Mesa find and determine that such sign:
traffic.
(1) Will not obstruct or confuse the view of
(2) Will not obstruct the view or interpretation
of any traffic sign, signal or device.
(3) Will not obstruct or endanger pedestrian
traffic.
(4) Will not unreasonably obstruct the view of adjacent
premises for a distance of 150 feet on each side of the proposed
location. The standard for determining whether the proposed sign
will unreasonably obstruct the view of adjacent premises is whether,
as viewed from the street in a motor vehicle, either present signs
and structures or permissible future signs and structures would be
obstructed from view of such motorist.
(5) Will not interfere with off-street parking
areas or with the ingress and egress thereto or therefrom.
Sec. 8505. Appeal from Findings.
Any person denied a permit for the construction of a sign
by reason of the findings of the Department of Public Works and the
Planning Director may, within twenty (20) days from receipt of notice

of the denial of the permit, file an appeal with the City Council,
and on such appeal the City Council, after giving notice to the
person so appealing, shall hear the matter and make the final
decision thereon.
Sec. 8506. Scope.
This Article shall govern as to all signs, including but not
limited to portable or moveable signs, temporary signs, permanent
signs, or otherwise.
SECTION 1. Article 3 of Chapter VIII of the Municipal Code
of the City of Costa Mesa is hereby repealed.
SECTION 3. This Ordinance shall take effect and be in full force
thirty (30) days from and after its passage and prior to the
expiration of fifteen (15) days from its passage shall be published
once in the Orange Coast Daily Pilot, a newspaper of general
circulation, printed and published in the City of Costa Mesa, together
with the names of the members Of the City Council voting for and
against the same. y�
