TO PERMITS FOR THE HANDLING OF EXPLOSIVES WITHIN
4 THE CITY OF COSTA MESA AND MAKING PROVISION
THEREFOR.

ORDAIN AS FOLLOWS:

8 SECTION 1. The City Council of the City of Costa Mesa
9 does hereby find and declare that the Legislative Assembly for
10 the State of California has introduced, considered, and adopted
11 Senate Sill No. 1350, which amends certain sections of the Health
12and Safety Code relating to explosives.
13 The Council further finds and declares that Section
14112007 of the Health and Safety Code requires that a city shall
15 designate within its jurisdiction, for purposes of issuing permits
16 relating to explosives, either the Chief of Police or his designee
19 'as the issuing authority for the purchase and handling of explo-
18 sives, or the Fire Chief or his designee for the same purpose.
19 The City Council further finds and declares that the
20 Fire Chipf and the Chid of poli,rp; having considered the (matter,
21 recommend that the issuing authority be the Fire Department.
22 SECTION 2. Accordingly, there is hereby added to the
23 Costa Mesa Municipal Code, Chapter III-. Article 1, Division I, the
24 following section, which shall read as follows:
21 Sec. 3107.1 Permit Required - Possession and Handling of Explosive
26 (a) The Fire Chief, or his duly authorized agent
27 or designee, shall be the issuing authority
28 to issue any and all permits required under
29 - the law for the handling of any explosives,
30 and said permit shall be issued on forms to
31 be provided for by the Fire Department of the
32 City of Costa Mesa.

(b) For purposes of this ordinance, the term

"explosives" shall mean any substance, or
3
combination of substances, the primary or
4
common purpose of which is detonation or
5
rapid combustion and which is capable of a
6
relatively instantaneous or rapid release

of gas and heat, or any substance, the
8
primary purpose of which, when combined with
9
any other substance, is to form a substance
10
capable of a relatively instantaneous or
11
rapid release of gas and heat. The term

"explosives" shall include, but shall not
13
necessarily be limited to, any of the
14
following,
15
(1) Dynamite, nitroglycerine, picric acid,
16
lead azide, fulminate of mercury, black
17
powder, smokeless powder, propellant
18
explosives, detonating primers, blasting
19
cape, or commercial boosters.

(2) Substances determined to be class A anu
21
8 explosives as classified by the United
22
States Department of Transportation.

(3) Nitro carbo nitrate substances (blasting

i agent) as classified by the United States

Department of Transportation.

(4) Any material designated as an explosive
27
by the State Fire Marshal. Such deaigna-
28
tion shall be made pursuant to the classi-
29
fication standards established by the

United States Department of Transportation.

The State Fixe Marshal shall adopt
32
regulations in accordance with the provisions

1 of Chapter 4.5 (commencing with Section
2 11371), Part 1, Division 3, Title 2 of
3 the Government Code to establish pro -
4 cedures for the classification and
5 designation of explosive materials or
61 explosive devices that are not under
71 the jurisdiction of the United States
8 Department of Transportation.
91 (5) Certain class C explosives as designated
10 by the United States Department of
111 Transportation when listed in regulations
12 adopted by the State Fire Marshal.
13 SECTION 3. This ordinance shall take effect and be in
14 full force thirty (30) days from and after its passage and shall,
15 prior to the expiration of fifteen (15) days from its passage, be
16 published once in the Orange Coast Daily Pilot, a newspaper of
17 general circulation, printed and published in the City of Costa
18 Mesa, together with the names of the members of the City Council
19 voting for and against the same. y,
