Home My WebLink About71-11 - Rezoning Portion of Block "E", Berry Tract, from R4-CP to C1-CPORDINANCE NO. %H //// AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CHANGING THE ZONING OF A PORTION OF BLOCK "E" OF BERRY TRACT FROM R4 -CP TO C1 -CP. The City Council of the City of Costa Mesa does hereby ordain as follows: SECTION 1. All that portion of the following described real property is hereby placed and included in the C1 -CP Zone, to wit: Int 3 in Block "E" of the Berry Tract, in the City of Costa Mesa, as per map thereof recorded in book 30, page 74, M. M. Records of Los Angeles County, California; EXCEPTING THEREFROM the West one acre of the South 5 acres of said land. ALSO EXCEPTING THEREFROM the West one acre of that portion of said Int 3 lying North of the South 5 acres of said lot. ALSO EXCEPTING the Southerly 40 feet of said land measured from the center line of Baker Street, as granted to the County of Orange by deed dated January 11, 1943 and recorded in book 1184, page 96 of Official Records, in the office of the County Recorder of said Orange County. ALSO EXCEPT the interest conveyed in that portion of said land deeded to the Orange County Flood Control District by deed recorded December 8, 1959 in book 5003, page 489, Official Records, that is included within a strip of land of the uniform width of 5.00 feet running North and South, the Easterly line of said 5 foot strip being the Westerly line of that certain easement granted to the Orange County Flood Control District by deed recorded in book 1309, page 399 of Official Records. ALSO EXCEPTING THEREFROM the North 162.00 feet of the West 220.00 feet of that portion of said lot 3 lying Easterly of the West 1 acre of that portion of said int lying North of the South 5 acres of said Lot. SECTION 2. Pursuant to the provisions of Section 9230.4 of the Municipal Code of the City of Costa Mesa, District Map E-7 of the City of Costa Mesa is hereby amended by the addition thereto of the C1 -CP area described in Section 1 hereof. SECTION 3. This Ordinance shall take effect and be in full force thirty (30) days from and after its passage, and prior to the expiration of fifteen (15) days from the passage thereof shall be published once in the ORANCE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City. of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
