HomeMy WebLinkAbout71-14 - 1970 Edition of Uniform Building Code and Amendments1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 7/ /4 AN ORDINANCE OF THE CITY OF COSTA MESA ADOPTING BY REFERENCE THE 1970 EDITION OF THE UNIFORM BUILDING CODE, VOLUMES I, II, AND III, AND THE APPENDIX THERETO, AND ADOPTING MODIFICATIONS AND AMENDMENTS TO SAID 1970 EDITION OF THE UNIFORM BUILDING CODE. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa hereby finds and declares that Volumes I, ii, and III and the Supplement of the Uniform Building Code for the year 1970 have been published. Council further finds and declares that in order to conform with current building practices, it is in the best interest of the health, safety and welfare of the city that said Uniform Building Code be adopted. Council further finds and declares that certain amendments to said Building Code as compiled and published are necessary to conform special circumstances in the City of Costa Mesa. Accordingly, Section 8100 of the Costa Mesa Municipal Code is hereby amended to read as follows: SECTION 2. Section 8100 is hereby amended to substitute the Volumes I, II, and III and the 1970 Supplement of the Uniform Building Code for any reference in said section to the 1967 Uniform Building Code. SECTION 3. Section 303 of the said Uniform Building Code is hereby amended by adding the following paragraph: "No fees shall be required for fall -out shelters constructed in R-1 Zones." Section 306(a) of said Uniform Building Code is hereby amended to read as follows: 1 2 3 4 5 6 7 8 9 10 11 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 "Sec. 306 (a). USE OR OCCUPANCY. No building or structure shall be used or occupied, nor shall such building or structure be connected with permanent utility services until the Building Official has determined compliance with this Code, all other applicable ordinances and laws, and the conditions of the building permit, and has authorized occupancy of such building or structure. No existing commerical or industrial building whose electrical service has been disconnected shall be reconnected with permanent electrical service until the Building Official has determined that the building does not constitute an unsafe building as defined by Section 203." Section 420 of said Uniform Building Code is amended by adding one new definition to read as follows: "SWIMMING POOL is any body of water, created by artificial means, any portion of which exceeds eighteen inches (1811) in depth, which is used or intended to be used for swimming." SECTION 4. This ordinance shall take effect and be in full force thirty (30) days from and after its passage and shall, prior to the expiration of fifteen (15) days from its passage, be published once in the Orange Coast Daily Pilot, a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
