AN ORDINANCE OF THE CITY OF COSTA MESA ADOPTING
BY REFERENCE THE 1970 EDITION OF THE UNIFORM
PLUMBING CODE INCLUDING THE APPENDIXES THERETO,
AND ADOPTING MODIFICATIONS AND AMENDMENTS TO
SAID 1970 EDITION OF THE UNIFORM PLUMBING CODE.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa hereby finds and
declares that Volume and the Supplement of the Uniform Plumbing Code for the
year 1970 has been published.
Council further finds and declares that in order to conform with current
building practices, it is in the best interest of the health, safety and welfare
of the city that said Uniform Plumbing Code be adopted.
Council further finds and declares that certain amendments to said Plumb-
ing Code as compiled and published are necessary to conform special circumstances
in the City of Costa Mesa.
Accordingly, Section 8300 of the Costa Mesa Municipal Code is hereby
amended to read as follows:
SECTION 2.
Section 8300 is hereby amended to substitute the Volume and 1970
Supplement of the Uniform Plumbing Code for any reference in said section to
the 1967 Uniform Plumbing Code.
SECTION 3.
Certain portions of said Uniform Plumbing Code, 1970 Edition,
are hereby amended or deleted as follows:
"Sec. 1.1. ADMINISTRATIVE AUTHORITY.
Section 1.1 is amended to read as follows
Whenever the term "administrative authority" is used in this
Code, it shall be construed to mean the Building Safety Director
of the City of Costa Mesa or his authorized representative.
"Sec. 1.2. ASSISTANTS.
Section 1.2 is amended to read as follows:
Whenever the term "assistants" is used in this Code, it shall
be construed to mean the Senior Plumbing Inspector, Plumbing
Inspector, or other inspector of the Department of Building
Safety and Housing of the City of Costa Mesa.
"Sec. 1.3. DEPARTMENT HAVING JURISDICTION
Section 1.3 is amended to read as follows:
Unless otherwise provided for by law, the office of the Admin-
istrative Authority shall be part of the Department of Building
Safety and Housing of the City of Costa Mesa.
"Sec. 1.4. DUTIES OF ADMINISTRATIVE AUTHORITY.
Section 1.4 is amended by deleting sub -section 1.4 (10).
"Sec. 1.7. VIOLATIONS AND PENALTIES.
Section 1.7 is amended by changing the first sentence of the
first paragraph to read as follows:
Any person, firm, or corporation violating any of the provi-
sions of this Code shall be deemed to be guilty of a misdemeanor
and upon conviction thereof shall be punishable by a fine of not
to exceed five hundred dollars ($500) or by imprisonment in the
County Jail for not to exceed six (6) months, or by both such
fine and imprisonment.
"Sec. 1.15. REINSPECTION FEES.
Part One is amended by adding Section 1.15 to read as follows:
Section 1.15. Reinspection Fee.
When any reinspection is required due to the negligence of the
permit holder, his agent, or other responsible persons, or due
to the failure of said parties to comply with previous correc-
tion instructions, a fee of $5.00 may be charged by the Build-
ing Official prior to each such reinspection.
"Sec. 1.16. REFUND OF PERMIT FEE.
Part One is amended by adding Section 1.16 to read as follows:
Section 1.16. Refund of Fees.
When construction authorized by a plumbing permit is not begun
and no inspections have been made, the Administrative Authority
shall, upon written request from the permittee, make refund of
fees subject to the following limitations: The Administrative
Authority shall not make any refund of fees collected amounting
to $2.00 or less. In case a refund is made, the amount of such
refund shall not be more than 85% of the amount of the fee paid.
No refund of such fee or part thereof shall be made unless
applied for within one year from the date of the issuance of
the permit. When fees are erroneously collected by duplication
of permits or for construction outside the jurisdiction of the
City of Costa Mesa, 100% may be refunded.
Secs. 2.1 through 2.11. QUALIFICATION OF PLUMBERS.
Part Two is amended by deleting Sections 2.1 through 2.11, both
inclusive.

"Sec. 1008(c). FERROUS WATER PIPING.
Section 1008(c) is amended to read as follows:
(c) Water piping installed in or under a concrete floor slab
resting on the ground within a building shall be installed
in accordance with the following requirements:
(1) Ferrous piping shall not be used.
(2) Copper tubing shall be installed without joints
where possible. Where joints are permitted, they
shall be silver brazed or equal and fittings shall
be wrought copper.
"Sec. 1009(h). BUILDING SUPPLY PIPE AND HOSE BIBBS.
Section 1009(h) is amended by changing the second paragraph to
read as follows:
No building supply pipe shall be less than one (1) inch in size
and shall continue undiminished in size to the first fixture
branch. Hose bibb at the point where service enters the build-
ing may be considered as the first fixture branch. Not less than
three-quarter (3/4) inch hose bibb supplied by three-quarter (3/4)
inch piping shall be installed at the front and rear of all build-
ings which normally require water piping.
"Sec. 1119. ABANDONED SEWERS AND SEWAGE DISPOSAL FACILITIES.
Section 1119 is amended by adding sub -section (f) to read as
follows:
(f) No such excavation shall be left unattended at any time
unless the permittee shall have first provided a suitable
and adequate barricade to assure public safety.
SECTION 4. This ordinance shall take effect and be in full force
thirty (30) days from and after its passage and shall, prior to the expira-
tion of fifteen (15) days from its passage, be published once in the Orange
Coast Daily Pilot, a newspaper of general circulation, printed and published
in the City of Costa Mesa, together with the names of the members of the
City Council voting for and against the same.
