W-35- ' AN ORDINANCE OF THE CITY COUNCIL OF THE.CITY OF COSTA MESA PROVIDING FOR ABATEMENT OF WEED AND RUBBISH NUISANCES AND ESTABLISHING THE RESPONSIBILITY FOR ADMINISTRATION THEREOF. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Pursuant to Division 3, Part 3, Chapter 13, Article 2, Sections 39560 through and including 39588 Government Code, the City Council does hereby enact as follows: SECTION 2. (b) "Parkway," as used in this Chapter, means the area between any property line and the edge of the pavement. (c) "Rubbish," as used in this Chapter, includes, but is not limited to, all of the following material and items exist- ing in an unusable, discarded or abandoned condition: (1) Refuse, waste, offal, garbage, filth and trash. (2) Asphalt, boards, bottles, boxes, cans, cartons, cement, concrete, crates, dirt, glass, gravel, hoses, lumber, metal paint, paper, pasteboard boxes, plaster, rubber, sand, stucco, tile, wire, wood, and other similar materials. (3) Vehicle bodies, motors, tires, parts and accessories. (4) Trimmings, clippings and cuttings from lawns, shrubs and trees, and all dead or uprooted grass, sod, shrubs, trees, vegetation and dirt. (5) Rugs, bedding, furniture, utensils, clothing, toys, appliances and household supplies. (d) "Streets," as used in this Chapter, includes but not limited to public street, drive, right of way, avenue, place, alley, land, court and way. (e) "Weeds," as used in this Chapter, includes, but is not limited to all of the following: (1) Weeds which bear seeds of a downy or wingy nature. (2) Sagebrush, chapparal, and any other brush or weeds which attain such largegrowthas to become, when dry, a fire menace to adjacent improved property. (3) Weeds which are otherwise noxious or dangerous. (4) Poison oak and poison ivy, when the conditions of growth are such as to constitute a menace to the public health. (5) Dry grass, stubble, brush, litter, or other flammable material which endanger the public safety by creating a fire hazard. 2 - I 1 2 3 4 5 6 7 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 (6) All rank growths of every kind and description. (f) "Weed Abatement Official," means the Costa Mesa Fire Chief or his designated representatives. (g) "Nuisance," all weeds and rubbish existing on or in front of any real property in the City of Costa Mesa, in such a condition as to be detrimental to the health, safety, or welfare of the inhabitants of such property, or of any adjoining property. (h) "Responsible Party," person in possession, lessee, agent or owner of property described herein. SECTION 3100.2 DECLARATION OF PUBLIC NUISANCE Whenever weeds are growing upon any street, sidewalk, or on private property within the City, or whenever rubbish is upon parkways, sidewalks or private property within the City, the City Council, by resolution, may declare the weeds and rubbish public nuisances. The resolution shall refer, by the name under which it is commonly known, to the street, highway, or road upon which the nuisance exists, upon which the sidewalks are located, or upon which the private property affected fronts or abuts or nearest to which the private property is located. Weeds and rubbish may be declared a public nuisance and may be abated as provided in this article. If the nuisance is seasonal and recurrent the City Council shall so declare. There- after, such seasonal and recurring weeds shall be abated within the same calendar year without the necessity of any further resolution. The City Council may find by said resolution that weeds on certain specified parcels of property are seasonal and re- current nuisances and that preventative abatement is necessary in such cases and .that preventative chemical and/or mechanical control of weeds, weed seeds and weed seedlings is necessary. If the City -is required to abate the. nuisance .pursuant to said resolution, it may before and during the next following germinating season of such weeds provide for preventative abatement of such nuisance 12 5 6 7 8 9 10 11 13 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 by using chemical and/or mechanical control of such weeds SECTION 3100.3 DESCRIPTION OF THE PROPERTY The resolution shall describe the property upon which, or in front of which the nuisance exists by describing the pro- perty in accordance with the map used in describing property for taxation purposes. No other description is necessary. If the private property fronts or abuts upon more than one street, highway or road, it is necessary to refer to only one of the streets, highways, or roads. Any number of. streets, highways, roads or parcels of private property may be included in one resolution. SECTION 3100.4 PERSON AUTHORIZED TO GIVE NOTICE The Fire Chief or his representative is hereby designated as the person to give notice to'destroy weeds and to remove rubbish. The Fire Chief or his representative shall have the power to make regulations consistent with this ordinance for the administration hereof and to develop such forms and procedures as are necessary to accomplish the purposes of this enactment. SECTION 3100.5 NOTICE - HEADING The notices to destroy weeds shall be headed "Notice to Destroy Weeds", and the notices to remove rubbish shall be headed "Notice to Remove Rubbish", all in words not less than one (1) inch in height. SECTION 3100.6 FORM OF NOTICE (a)- The notice to destroy weeds shall be substantially in the following form:.. NOTICE TO DESTROY WEEDS - Notice is hereby given that on the - day of 19_, the City Council of the City of Costa Mesa passed a resolution declaring that noxious or dangerous weeds were growing upon or in front of the property on or.nearest to .. Street or Road, in said City, and more __ - 4 - 1 2 3 4 5 6 7 9 10 11 12 13 14 15 16 171 18 19 20 21 22 23 25 26 27 28 29 30 31 32 particularly described in the resolution, and that they constitute a public nuisance which must be abated by the removal of said noxious or dangerous weeds. Otherwise, they will be removed and the nuisance abated by the City and the cost of removal assess upon the land from or in front of which such weeds are removed and will constitute a lien upon such land until paid. Reference i hereby made to the resolution for further particulars. A copy of said resolution is on file in the office of the City Clerk. All property owners having any objections to the pro- posed removal of such weeds are hereby notified to attend a meeting of the City Council of the City of Costa Mesa to be held when their objections will be heard and given due consideration. Dated this day of , 19_ Fire Chief (b) The notice to remove rubbish shall be substantially in the form set forth above, except that the word "rubbish" shall be substituted for the word "weeds". (c) Where the City Council has found and declared in the resolution provided for in Section 3100.2 that weeds on .certain specified parcels of property are seasonal and recurrent nuisances and that preventative abatement is necessary in such cases, the notice herein may contain -this additional paragraph: "The weeds on this parcel have been found to be of a seasonal and recurrent nature requiring. prevent- ative abatement and accordinglytheowner of this parcel is required to use preventative chemical and/or mechanical control of weeds, weed seeds and weed seedlings. City mayif it is required to abate this nuisance, without further notj.ce, use. preve ntative chemical and/or mechanical control during the .next following germinating season." 5 _ i 1 SECTION 3100.7 MANNER OF POSTING 2 The notices shall be conspicuously posted on or in front 3 of the property on or in front of which the. nuisance exists, or, 4 if the property has no frontage upon any street, highway or road, 5 then upon the portion of the property nearest to a street, high - 6 way or road most likely to give actual notice to the owner. 7 The notices shall be posted: 8 (a) One notice to each separately owned parcel of 9 property of not over fifty feet (50) frontage. 10 (b) Not more than two notices to any such parcel 11 of one (1) hundred feet frontage or less. 12 (c) Not more than one (1) hundred feet apart if the 13 frontage of such a parcel is greater than one (1) 14 hundred feet. 15 The notice shall be posted at least five (5) days prior to the 16 time for hearing objections. 17 SECTION 3100.8 ALTERNATIVE PROCEDURE 18 As an alternative to posting the property as set forth 19 in this Ordinance, the Fire Chief may order postcard notices 20 mailed to the owners as set forth in the resolution. The post - 21 card notice shall be in substantially the same .form as provided 22 for in Section 3100.6 and shall be mailed to owners at least 23 seven (7) days prior to the time set for hearing protests. . 24 In any event postcard notices shall be sent to any owner 25 who has filed a written request for such postcard notice within 26 one year prior to the date of mailing, and shall be sent to the 27 address set forth in said written request. 28 SECTION 3100.9 PROTEST HEARING 29 At the time stated in the notices, the City Council 30 shall hear and consider all -objections -or protests, if any, to the 31 proposed removal of weeds and rubbish and may continue the hearinc 32 from time to time. Upon the conclusion of the hearing, the 1 2 3 4 5 6 7 9 10 11 12 13 14 15 16 17 19 20 21 22 23 24 25 26 27 28 29 30 31 ... _._.__.- 32 City Council shall allow or overrule, by resolution or motion any or all objections whereupon the Council shall acquire jurisdiction to proceed and perform the work of removal, and the decision of the Council on the mattes is final. If objections have not been made, or after the City Council has disposed of thos made, it shall order the Fire Chief to abate the nuisance by having the weeds and rubbish removed. The order shall be made by motion or resolution. The Fire Chief shall not undertake to abate said nuisances until he or his representative has made a reasonable effort to personally contact any owner protesting the Council order to abate in order to explain the purpose of the program, handle special problems if any, - and to grant the owner additional time if warranted to provide his own abatement. SECTION 3100.10 RIGHT OF ENTRY UPON PRIVATE PROPERTY The Fire Chief and his assistants, deputies, employees, or contracting agents, or other representatives may enter upon private property to abate the nuisance. SECTION 3100.11 REMOVAL BEFORE ARRIVAL OF CITY OFFICER Any property owner may have weeds and rubbish removed at his own expense if it is done prior to the. arrival of the Fire Chief or his representatives to do it. SECTION 3100.12 ABATEMENT WORK The abatement of the nuisances subject to this enactment may be done by city work forces or by independent contractor. In the event it is to be done by independent contractor, a contract shall be awarded on the basis of -competitive bids, let to the lowest responsible bidder pursuant.to rules, regulations and .laws governing public works contracts. SECTION 3100.13 KEEPING OF RECORD, RENDITION OF REPORT The Fire Chief shall keep an account of the cost of abatement in front of or on each separate lot or parcel of land and shall render an itemized written report to the City Council 7 1 2 5 6 7 8 9 10 11 13 14 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 for confirmation showing the cost of removing the weeds and rubbish, on or in front of each separate lot. or parcel of land, or both. - - - SECTION 3100.14 POSTING COPY OF REPORT AND NOTICE OF HEARING Before the report is submitted to the city Council, a copy of it shall be posted at least three.(3) days on the bulletin board at the City Hall with a notice of the time when the report will be submitted to the City Council for confirmation. SECTION 3100.15 MAILING OF NOTICE A postcard notice of the time and place of the sub- mission of the report for confirmation, stating generally the nature of the report, shall be mailed by the City Council to the owners of the parcels who have filed with the Council a written request for postcard notice within one year prior to the date of mailing the notice, at least seven (7) days prior to the date of submission for confirmation. SECTION 3100.16 HEARING ON REPORT At the time fixed for receiving and considering the report, the City Council shall hear it with any objections of any of the property owners liable to be assessed for the work of abatement. SECTION 3100.17 MODIFICATION AND CONFIRMATION Thereupon the City Council may make such modifications in the report as it deems necessary, after which by motion or resolution, the report shall be confirmed. SECTION 3100.16 COSTS LIEN ON PROPERTY AFFECTED .The amounts of the cost for abating the nuisance in front of or upon the various parcels of land mentioned in the report as confirmedshallconstitute special assessments against the respective parcels of land, and are a lien on the property for the amount of .the respective assessments. - 8 1 SECTION 3106.19 FILING REPORT WITH COUNTY AUDITOR 2 A certified copy.of the report shall be filed with the 3 County Auditor on or before August 10. The description of the 4 parcels reported shall be those used for the same parcels on the 5 County Assessor's map books for the current year. 6 SECTION 3100.20 MANNER OF COLLECTION 7 Thereafter, the amounts of the assessments shall be .8 collected at the same time and in the same manner as City taxes 9 are collected, and are subject to the same penalties and the '10 same procedure and sale in case of delinquency as provided for 11 ordinary City taxes. 12 SECTION 3100.21 APPLICATION OF TAX STATUTES 13 All laws applicable to the levy, collection and enforce - 14 ment of City taxes are applicable to such special assessment taxes. 15 SECTION 3100.22 ISSUANCE OF SEPARATE TAX BILLS 16 The County Tax Collector may, in his discretion, issue 17 separate bills. for such special assessment taxes and separate 18 receipts for collection on account of such assessments. 19 SECTION 3100.23 CANCELLATION OR REFUND - GROUNDS 20 All or any portion of any such special assessment, 21 penalty or costs heretofore or hereafterenteredshall, on order 22 of the City Council, be cancelled by the County Auditor if 23 uncollected, or, except in the case provided for in subdivision 24 (c) hereof, refunded by the Director of Finance if collected, if 25 it or they were entered, charged or paid: 26 (a) More than once; 27 (b) Through clerical error; 28 _ (c) Through the error or mistake of the City Council or 29 of the Fire Chief in respect to any material. fact, including the 30 case where the cost report rendered and confirmed as hereinbefore 31 provided shows that the Cityabated theweedsand rubbish but 32 such is not the actual fact; - 9 - 1 2 3 4 5 6 7 8 g 10 11 if if li lE E 2( 21 24 2-, 24 21 2f 21 2E 2S 3C 31 3, (d) Illegally; (e) On property acquired after the lien date by the State or by any County, City, School District or other political sub- division and because of this public ownership not subject to sale for delinquent taxes. _ SECTION 3100.24 SAME. CLAIM. REQUISITES. EXCEPTIONS No order for a refund under the foregoing section shall be made except on a claim: (a) Verified by the person who paid the special assess- ment, his guardian, executor, or administrator. (b) Filed with the City Clerk on or before March 1 after the tax became due and payable. The provisions of this section do not apply to cancellations. SECTION 3100.25 • ALTERNATE MANNER OF ABATEMENT - CITY EXPENSE Not withstanding any provisions of Sections, both in- clusive, to the contrary, and notwithstanding any of the proced- ural steps set up in said sections, the City, through its Fire Chief, his assistants, deputies, employees or contracting agents or other representative, may enter upon private property for the purpose of removing the weeds, vlithout following any of the procedural steps set up, provided the weed abatement work is done at the expense of the City and not charged directly to the propert, upon which said weed abatement work is done. At the time of adopting the resolution contemplating the work to be done, as set forth in the sections of this Article, the City Council shall, in said resolution, declare that said .. work shall be done at the expense Of the City and not at expense of the property :owner,. and in such event, said weed abatement work shall not be charged to the ,property owner.-" SECTION 3. The following sections -of the Costa Mesa Municipal Code' are hereby repealed: -- - 10 - 1' 2 3 4 5' 61' 7 8 g 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Sections 5300 through and including 5334, of Article 3, Chapter V Costa Mesa Municipal Code. SECTION 4. This .ordinance shall take effect and be in full force and effect thirty (30) days from and after its passage, and before the expiration of fifteen (15) days after its passage, shall be published once in the Orange Coast Daily Pilot, a news- paper of general circulation printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
