HomeMy WebLinkAbout71-37 - Control of Noise1 ORDINANCE N0. 71-37 2 AN ORDINANCE OF THE CITY OF COSTA MESA ADDING CHAPTER IX, ARTICLE 4; DIVISION I TO THE 3 COSTA MESA MUNICIPAL CODE, RELATING TO THE CONTROL OF NOISE IN RESIDENTIAL AREAS OF 4 THE CITY. 5 THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY 6 ORDAIN AS FOLLOWS: 7 SECTION 1. The City Council of the City of Costa Mesa 8 does hereby find and declare, that it is in the best interest of 9 the health,safety and welfare of this community that reasonable 10 regulations be imposed, for the control of noise in residential 11 areas of this City. The City Council further finds and declares 12 that, it is necessary in order to implement this Ordinance, that 13 reliable methods of sound measurement be adopted and approved 14 by this City Council. 15 Accordingly, the following Article is added to the Costa 16 Mesa Municipal Code, which shall read as follows: 17 SECTION 2. It is determined that certain noise levels are detrimental to the public health, welfare and safety and contrary to public interest, and therefore the City Council of the City of Costa Mesa does ordain and declare that creating or maintaining or causing or allowing to be created or maintained any noise in a manner prohibited by or not in conformity with the terms of this Ordinance is a public nuisance and shall be punishable as such. Section 92201 Definitions The following words, phrases and terms, unless the context otherwise clearly indicates, shall have the meaning as indicated below: (a) "A" WEIGHTED SOUND LEVEL "A" Weighted Sound Level shall mean the total sound level in decibels of all noise as measured with the sound level meter using the "A" Weighting network (scale). The unit of measurement shall be defined as dBA. (b) AMBIENT NOISE LEVEL Ambient Noise Level shall mean the lowest sound level in dBA as determined by employing a sound - 2 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22. 23 24 25 26 27 28 29 30 31 32 level meter and excluding transient peak sound conditions during a specified sample period using a specific procedure. (c) DECIBEL (dB) Decibel (dB) shall mean a unit of level which denotes the ratio between two (2) quantities which are proportional to power; the number of decibels corresponding to the ratio of two (2) amounts of power is ten (10) times the logarithm to the base ten (10) of this ratio. (d) EMERGENCY MACHINERY, VEHICLES OR WORK Emergency machinery, vehicles or work shall mean any machinery, vehicle or work used, employed or performed in the efforts to protect, provide prevent or restore safe conditions in the community or for the citizenry, or work by private or public utilities when restoring utility service. (e) MICROBAR Microbar shall mean a unit of pressure commonly used in acoustics and is equal to one dyne per square centimeter. (f) MOTOR VEHICLE Motor vehicle shall include but not be limited to motorcycles, motor driven cycles, mini -bikes and go-carts, but shall not include licensed vehicles while being operated upon any public highway, street or right-of-way. (g) NOISE LEVEL Noise level shall mean sound level as defined in this Ordinance. (h) PERSON Person shall mean a person, firm, associatio co -partnership, joint venture, corporation or any entity, public or private in nature. (i) RESIDENTIAL AREA Residential Area shall mean all parcels of real property within a quarter mile section map which are zoned for residential. purposes as a legal nonconforming use. (j) SOUND AMPLIFYING EQUIPMENT Sound amplifying equip- ment shall mean any machine or device, mobile or stationary, used for amplifying music, the human voice or any sound. (k) SOUND LEVEL Sound level shall mean the noise level ra �1 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 in decibels and is the weighted sound pressure level obtained by using a sound level meter whose weighting characteristics are specified in the American National Standards Institute's (ANSI) Standard 51-4-1971, for sound level meters with a reference pressure of 0.0002 microbars. (1) SOUND LEVEL METER Sound level meter shall mean an instrument including an omnidirectional microphone, an amplifier, out -put meter and meeting the ANSI Standard 51-4-1971. (m) SOUND PRESSURE LEVEL Sound pressure level shall mean the sound pressure level in decibels of a sound which is twenty (20) times the logarithm to the base ten (10) of the ratio of the pressure of this sound to a reference pressure, which reference pressure shall be explicitely stated. Section 92202 Decibel Measurement Criteria Any decibel measurement made pursuant to the provisions of this chapter shall be based on a reference sound pressure of 0.0002 microbars as measured with a sound level meter using the "A" weighted network. Section 92203 Designated Noise Zones The following residential areas in the designated areas axe hereby assigned to the following noise zones: A All areas not included in Zone B. B All areas north of Baker Street from the eastern City limit to Labrador Drive, northwest on Labrador Drive to Gibralter Avenue, north on Gibralter Avenue to Gisler Avenue, west on Gisler Avenue to the western city limit. Section 92204 Noise Performance Standards The following noise standards, unless otherwise specifics ly indicated, shall apply to all residentially zoned property within their assigned noise zones (as specified in Section 92203 of the Ordinance) and said standards shall constitute the maximum permissible noise level within the respective zones. 1 NOISE STANDARD 2 3 NOISE ZONE NOISE LEVEL TIME 4 A 50 dBA 6:00 a.m. to 11:00 p.m. 5 45 dBA 11:00 p.m. to 6:00 a.m. 6 B 55 dBA 6:00 a.m. to 7:00 p.m. 7 50 dBA 7:00 p.m. to 11:00 p.m. 8 45 dBA 11:00 p.m, to 6:00 a.m. 9 In the event that the ambient noise level as determined 10 in Section 92205 exceeds the levels specified in this Section, the 11 maximum permissible noise level within any zone shall not be more 12 than 5 dBA above the measured ambient noise level. Noise 13 corrective factors to be applied to the noise standard during day - 14 time (6:00 a.m. to 11:00 p.m.) periods only: 15 Noise source operated less than 12 min/hour + 5 dBA * 16 Noise source operated less than 3 min/hour + 10 dBA * 17 Noise source operated less than 1 min/hour + 15 dBA * 18 Noise source of impulsive character (bang, hammer - 5 dBA 19 Noise source of periodic character (hum, screech - 5 dBA 20 * apply only one plus factor. 21 Section 92205 Monitoring Procedures 22 The following procedures shall be employed for monitoring 23 and evaluating exterior noise nuisances in the community unless 24 otherwise specified in this Ordinance. 25 1. The evaluation shall be conducted any time of the day 26 or night when the suspect noise source is being operated. 27 2. The location selected for monitoring shall be on any 28 residential property adjoining the suspect property at a point 29 approximately ten (10) feet from any building, wall or obstruction 30 (trees, bushes, etc.) or on any property line, provided there are 31 not walls, buildings, or obstructions within ten (10) feet of the 32 sampling location. 5 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 3. The sound level meter shall be equipped with an omnidirectional microphone. 4. No individual other than the operator shall be within ten (10) feet of the sound level meter during the sample period. 5. The ambient noise level shall be determined with the noise source not in operation prior to or after a measurement to determine a violation. The ambient noise level shall be determined as follows: a. Allow time for the sound level meter to warm b. Calibrate the sound level meter in accordance with the manufacturer's instructions. C. Set the sound level meter on the "A" weighted network at slow response. d. WITHOUT the noise source in operation, set th microphone in a vertical position with the microphone head approxi- mately four feet above the ground. The operator shall face the noise source and record the meter's instantaneous response (reading) observed at 15 second intervals for a period of fifteen minutes. The lowest reading is interpreted as the ambient noise level of that sampling point. If this reading is at a level above the standard set for the noise zone, the maximum permissible noise level is 5 dBA above the measured ambient level. If the reading is equal to or below the standard, continue the survey. 6. WITH the noise source in operation, the operator shall again record the instantaneousresponse at 15 second intervals for a fifteen minute period. Or, for a noise source of less than 15 minutes, the operator shall record the instantaneousresponse at 15 second intervals for the time the noise source is in operation. The lowest response level recorded while the noise source is in operation is interpreted as the intruding noise level. 7. Apply the noise corrective factors as set forth in Section 92204 to the noise standard established for the specific - 6 - 1 noise zone. 2 8. Compare the intruding noise levels with the standard. 3 If the noise level generated from the noise source exceeds the 4 standard, the noise source is generating noise levels in excess of 5 the allowable standards set for the noise zone. 6 Section 92206 Excessive Noise Prohibited 7 It shall be unlawful for any person from any location 8 within the City of Costa Mesa, including commercial, agricultural 9 and industrial zoned property, to create, maintain or cause or 10 allow to be created or maintained, any noise or sound upon any 11 residential property within the City of Costa Mesa, which exceeds 12 the noise standardsas specified in Section 92214 of this Code as 13 measured in accordance with procedures specified in Section 92215 14 of this Code, unless the noise or sound source or sound is 15 specifically exempted in this Ordinance. 16 Section 92207 Classes of Noises Prohibited 17 The provisions of this title shall apply to but shall not 18 be limited to, the control, use and operation of the following 19 noise sources whose use, operation, work, employment orother action 20 creates, maintains, permits, or causes to be created or maintained, 21 any excessive, unnecessary, unwanted or annoying noise, sound, 22 cry or behaviour which exceeds the noise standards as set forth 23 in Sections 92203 and 92204 of this Code, unless specifically 24 exempted. 25 (a) Radios, televisions, musical instruments, drums or 26 other percussion instruments, tape recorders, sound trucks or 27 vehicles whether mobile or stationary, public address systems, loud 28 speakers, bull horns, sound equipment or other devices or machines 29 used for producing, reproduction or amplification of music, instruc 30 ions, talks, speeches, addresses, lectures, attracting attention by 31 ersons selling merchandise, food or beverage or other similar 32 urooses. - 7 - 1 1. No person shall operate a loud speaker or sound 2 amplifying equipment for the purpose of transmitting sound to any 3 person or assemblage of persons in the City without first obtaining 4 approval from the City Council of the City of Costa Mesa. 5 2. Exemption: Section 92207, subsection (a) shall 6 not apply to school bands or duly licensed parades or other events 7 authorized in Section 92207 (a) 1 above. 8 (b) Animals or fowl creating, causing, generating or 9 emitting any cry or behavioral sound. 10 (c) Hawkers, peddlers, catering vehicles, pushcart vendor 11 or other similar operators who sell merchandise, food or beverages 12 by personal outcry or mechanical or electrical devises. 13 1. Exemption: The provisions of this subsection 14 shall not be construed to prohibit the selling of merchandise, 15 food, and beverage by outcry at licensed public sporting events, 16 parades, fairs, circuses or other authorized similar public enter - 17 tainment events. 18 (d) Air conditioning units, refrigeration equipment, fans 19 blowers, pumps, engines, turbines, compressors, generators, saws, 20 grinders, motors or other similar devices, equipment or apparatus. 21 1. Exemption: Any mechanical device, apparatus or 22 equipment used, related to or connected with emergency work, 23 machinery or vehicle operation defined as emergency machinery, 24 vehicle or work shall be exempted from the requirements of this 25 Ordinance. 26 (e) Construction equipment or work including but not 27 limited to the operation, use or employment of pile drivers, 28 hammers, saws, steam shovels, pneumatic hammers, drills, derricks, 29 steam or electric hoists, motorized mechanical equipment or other 30 similar construction equipment. 31 1. Exemption: Construction, repair or remodeling 32 equipment and devices and other related construction noise sources 1 shall be exempted from the provisions of this Ordinance provided 2 a building permit for such construction, repair or remodeling 3 shall have been obtained for such construction, repair or remodelin 4 from the Building Department of the City of Costa Mesa, or from 5 the Engineering Department in the case of any construction on 6 public Streets or right-of-way, and the construction, repair or 7 remodeling does not take place between the hours of 8:00 p.m. of 8 one day and 7:00 a.m. of the following day. 9 2. Exemption: Any construction, repair or remodelin 10 necessary as defined as emergency work, machinery or vehicles. 11 (£) Jet or propellor -type aircraft and other internal 12 combustion engines during repair, rebuilding, runups, testing or 13 operation. 14 1. Exemption: Engines operating in licensed motor 15 vehicles on public streets, highways, or right-of-ways and engines 16 in all aircraft during a -landing, takeoff, or while moving upon 17 the ground surface or in the air shall be exempted from the 18 provisions of this Ordinance. 19 Exemption: Subsection (f) (1) shall not be construed to 20 mean that licensed motor vehicles may be repaired, rebuilt, or 21 tested while on public street, highway or right-of-way. 22 Section 92208 Noise - Multiple Family Dwelling Units 23 Notwithstanding other sections of this Ordinance, it shall 24 be unlawful for any person to create, maintain or cause to be 25 created or maintained any noise within the interior of any multiple 26 family dwelling unit which exceeds 45 dBA as measured in any ad - 27 joining dwelling unit between the hours of 11:00 p.m. of one day 28 and 6:00 a.m. of the following day. 29 Section 92209 Vibrations 30 Notwithstanding other sections of this Ordinance, it shall 31 be unlawful for any person to create, maintain or cause to be 32 created or maintained an round vibrations which is y g perceptible - 9 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 without instruments at any point on any boundary line of any adjoining property to which the source is located. This prohibitio shall not apply to grading operations on private or public property Section 92210 Schools, Hospitals and Churches - Special Exemptions It shall be unlawful for any person to create, maintain or cause to be created or maintained any noise or sound upon any school, hospital or church while the same is in use, which exceeds the noise standards as specified in Section 92204 of this Code prescribed for the assigned noise zone in which the school, hospital or church is located; or which noise level unreasonably interferes with the working of such installations or which disturbs or unduly annoys patients in the hospital, provided conspicuous signs are displayed in three separate locations within 1/10th of a mile indicating the presence of a school, church or hospital. Section 92211 Prima Facie Violation Any noise exceeding the noise levels for specific noise zones as specified in Sections 92203 and 92204 and as measured as specified in Section 92205 or noise levels exceeding the standard as specified in Section 92208 or vibration exceeding the standard as specified in Section 92209 of this Ordinance shall be deemed to be prima facie evidence of a violation of the provisions of this Ordinance. Section 92212 Violations: Misdemeanors Any person violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and upon convict thereof shall be fined in an amount not exceeding $500.00 or be imprisoned in the County Jail for a period not exceeding six months or by both such fine and imprisonment. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such. - 10 - 1' 2 3 4 5 6 7 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Section 92213 Violations: Additional Remedies: Injunctions As an additional remedy, the operation or maintenance of any device, instrument, vehicle, or machinery in violation of any provision of this Ordinance, which operation or maintenance causes or creates noise levels exceeding the noise levels or vibrations as specified in this Ordinance shall be deemed, and is declared to be a public nuisance and may be subject to abatement, pursuant to Section 92102.2 or Article 2, Chapter IX, Costa Mesa Municipal Code Section 92214 Manner of Enforcement The City Manager or his duly authorized representatives are hereby empowered and it shall be their duty to enforce all provisions of this Ordinance. No person shall interfere with, oppose or resist any authorized person charged with the enforcement of this Ordinance while such person is engaged in the performance of his duty. Violation of this Ordinance shall be prosecuted in the same manner as other misdemeanor violations of the City's Code, provided, however, that in theevent of violation of Section 92207, (b), (d), and 92209 of this Title, a written notice of intention to prosecute will be given the alleged violator not less than three calendar days prior to the issuance of a misdemeanor complaint. No complaint shall be issued in the event the cause of violation is removed, the condition abated or fully corrected within such three day period. In the event the alleged violator cannot be located in order to serve the notice of intention to prosecute, the notice as required herein shall be deemed to be given upon mailing such notice by registered or certified mail to the alleged violator at his last known address or at the place where the violation occurred, in which event the three day period shall commence at the date of the day following the mailing of such notice. 1 Section 92215 Severability 2 If any provision, clause, sentence, or paragraph of this 3 Chapter, or the application thereof to any person or circumstance, 4 shall be held invalid, such invalidity shall not affect the other 5 provisions or application of the provision of this Chapter which 6 can be given effect without the invalid provisions or application 7 and, to this end, the provisions of this chapter are hereby 8 declared to be severable." 9 SECTION 3. Sections, 7114 and 7114.1, costa Mesa Municipa 10 Code are hereby repealed. 11 SECTION 4.
