HomeMy WebLinkAbout72-17 - Under-roof, Amending Section 9220.27.1ORDINANCE NO. 73-x7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, AMENDING SECTION 9220.27.1, OF THE COSTA MESA MUNICIPAL CODE, UNDER -ROOF. THE CITY COUNCIL OF THE CITY OF COSTA MESA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa hereby finds and declares, that refinement of the definition of "Under -roof" is essential to avoid misunderstanding of the general public in the considera- tion of zoning ordinances within the City. The City Council further finds and declares, that the present definition is subject to reasonable differences of interpretation by the public, and by the Planning Department, and Planning Commission of the City, resulting in unnecessary confusion in the application of City Ordinances. Accordingly, there is added to the Costa Mesa Municipal Codes, Section 9220.27.1 of Division II, of the Costa Mesa Municipal Codes, which shall read as follows: SECTION 2. "Section 9220.27.1, Under -Roof. The term "under -roof" as used in the Costa Mesa Municipal Code is defined as all of the area within the walls of the building that a roof covers. Porches, roof overhangs, garage protrusions, breezeways, and other similar architectural design features are not considered herein as under -roof". SECTION 3. The following sections of the Costa Mesa Municipal Code shall be amended each to read exactly the same as, the language hereinafter set forth, for Section 9291.5. Those sections to be amended are as follows: 9291.5, 9292.5, 9293.5, 9294.5, 9295.7, 9296.4, 9297.5, Costa Mesa Municipal Code. All of the aforementioned sections shall be amended to read as follows: "All uses permitted shall be conducted under -roof as said term is defined in Section 9220.27.1, Costa Mesa Municipal Code, with the exception that, those uses which are incidental to, appurtenant to, and an integral part of the use or uses conducted under -roof, may be conducted on the premises in the open." SECTION 4. This ordinance shall take effect and be in full force and effect thirty (30) days from and after its passage, and before the ex- piration of fifteen (15) days after its passage, shall be published once in the Orange Coast Daily Pilot, a newspaper of general circulation printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
