ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA
ADOPTING THE UNIFORM FIRE CODE FOR 1971, MAKING CERTAIN
AMENDMENTS THERETO, AND REPEALING PORTIONS OF CHAPTER III,
ARTICLE 1, FIRE PROTECTION AND PREVENTION.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS
FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa hereby finds and
declares that recent revisions of the Uniform Fire Code are in keeping with
modern fire department practices. The City Council further finds and declares
that certain amendments thereto are desirable to conform with the needs of
the City of Costa Mesa. The City Council further finds and declares that
the public health, safety and welfare require the adoption of the 1971
Uniform Fire Code and the amendments thereto.
SECTION 2. Chapter III entitled Public Safety, Article 1, Fire Protection
and Prevention, Division I Uniform Fire Code and Division II Fire Department
are hereby repealed.
SECTION 3. There is hereby adopted the following Article 2, Chapter III,
which shall be as follows:

DIVISION I - UNIFORM FIRE CODE
Section 3100 Adoption of Uniform Fire Code.
There is hereby adopted by the City Council of the City of Costa Mesa,
California, for the purpose of prescribing regulations governing conditions
hazardous to life and property from fire or explosion, that certain code
known as the Uniform Fire Code, being particularly the 1971 edition and
errata sheet corrections thereof and the whole thereof, of which code not
less than three (3) copies have been and are now filed in the Office of the
Clerk of the City of Costa Mesa and the same are hereby adopted and incorporated
as fully as if set out at length herein, and from the date on which this
ordinance shall take effect, the provisions thereof shall be controlling
within the limits of the City of Costa Mesa.
Section 3101 Amendment to Article 1 of the Uniform Fire Code,
1971 Edition.
"General Provisions"
1. Amend Section 1.215 Appeals
Whenever the Chief of the Fire Department shall disapprove an
application or refuse to grant a permit applied for, or when it is claimed
that the provisions of the code do not apply or that the true intent and
meaning of the code have been misconstrued or wrongly interpreted, the
applicant may appeal from the decision of the Chief of the Fire Department to
the City Council of the City of Costa Mesa within thirty (30) days from the
decision appealed.
2. Amend Section 1.216 Compliance with Recognized Standards.
Recognized Standards. Delete, 'American Society of Mechanical
Engineers, 345 East 37th Street, New York, N.Y. 10017. ASME Codes: Code
for Power Boilers, 1968 Edition; Code for Unfired Pressure Vessels, 1968
Edition.'
3. Amend Section 1.405 Chief of the Fire Prevention Bureau to read
as follows: "Chief of the Fire Prevention Bureau shall be construed to mean
Fire Marshal."

4. Amend Section 1.405 by adding the following definition of
Corporate Council: "Corporate Council shall be construed to mean the
Attorney for the City of Costa Mesa."
5. Amend Section 1.402 Jurisdiction
Jurisdiction shall be construed to mean the City of Costa Mesa.
6. Amend Section 1.415 by adding the following definition:
"Municipality shall be construed to mean the City of Costa Mesa."
Section 3102 Amendment to Article 11 of the Uniform Fire Code, 1971
Edition.
"Explosives and Blasting Agents"
1. Amend Section 11.106 (b) by adding the following:
"The limits referred to in Section 11.106 (b) shall include all
zones in the City of Costa Mesa other than M-1, A-1, or C-2 zones."
2. Amend Division III by adding a new section to read as follows:
"Section 11.307 Exceptions. Notwithstanding the provisions of
Sections 11.104, 11.301 and 11.305 of this Article 11, said sections shall
not be applicable to transportation on public streets and highways to the
extent now or hereafter pre-empted by State Law."
Section 3103 Amendment to Article 12 "Fireworks" of the Uniform Fire
Code, 1971 Edition.
1. Amend Section 12.102 (b) to read as follows:
"Except as provided for safe and sane fireworks, it shall be
unlawful for any person to possess, store, to offer for sale, expose for sale,
sell at retail or use or explode any fireworks; provided that the Chief shall
have the power to adopt reasonable rules and regulations for the granting of
permits for supervised public display of fireworks by the municipality,
fair associations, amusement parks, other organizations or for the use of
fireworks by artisans in pursuit of their trade. Every such use of display
shall be handled by a competent operator approved by the Chief of the Costa Mesa
Fire Department, and shall be of such character and so located, discharged
or fired as in the opinion of the Chief after proper investigation, so as
not to be hazardous to property or endanger any persons."
2. Amend Article 12 by adding Section 12.107 to read as follows:

"No person shall offer for sale any safe and sane fireworks
as labeled by the State Fire Marshal without a valid permit from the
Costa Mesa Fire Department. Such permits shall be issued only
to local eleemosynary groups or organizations that have been in
existance for at least one year prior to application for said permit."
3. Amend Article 12 by adding Section 12.108 "Requirements for
Fireworks Stands" to read as follows:
"All temporary stands for the display and sale of fireworks
shall be located, maintained and operated subject to the following provisions:
(A) No fireworks display or stand shall be erected within
one hundred (100) feet of any gasoline service station or any garage or
within thirty-five (35) feet of any other structure. Minimum setback from
the street curbing shall be ten (10) feet.
(B) There shall be maintained in each premises, or a stand
within which fireworks are sold or offered for sale, suitable fire extinguishers
of a type and number approved by the Chief of the Fire Department.
(C) No person shall light or cause or permit to be lighted any
fireworks or any other article or material within any such stand or within
fifty (50) feet thereof.
(D) No smoking shall be allowed in any structure used for the
sale and display of fireworks or within fifty (50) feet of said structure.
"NO SMOKING" signs shall be prominently displayed and in a number prescribed
by the Fire Chief.
(E) All such temporary stands shall be constructed in accordance
with existing City requirements and specifications.
(F) All temporary stands for the display and sale of fireworks
shall obtain an electrical permit from the City of Costa Mesa prior to
any electrical work.
(G) No arc or klieg light shall be located within seventy-five
(75) feet of any temporary stand selling fireworks.
(H) Fireworks shall be sold only between the hours of 9:00 a.m.
and midnight during the days authorized.

(I) No safe and sane fireworks shall be sold or offered for
sale at retail within the City of Costa Mesa except from 12:00 noon on the
28th day of June to 12:00 noon on the 6th day of July of each year.
(J) The permittee shall strictly comply with all of the
provisions of Section 12600 through and including 12801 of the Health and
Safety Code of the State of California.
(K) Fireworks shall be stored and kept only in the permitee's
sale booth. It shall be unlawful to store any fireworks in any building,
residence, garage, home or automobile within the City of Costa Mesa.
(L) There shall be at least one adult in attendance during
any open or sale hours of the fireworks stand.
(M) The permitee shall provide an adult night watchman to act
and serve during the hours of storage. Under no circumstances shall any
night watchman sleep within any fireworks stand.
(N) No alcoholic beverages shall be allowed on the premises.
(0) All fireworks fuses shall be taped.
(P) All permits must be posted in a conspicuous place.
4. Amend Article 12 by adding Section 12.109 to read as follows:
"All applications for permits shall be made in writing, filed
with the City Council, and shall state the name of the applicant, his address
and the location of the proposed stand. The application shall be accompanied
by a clearance from the Fire Chief as to fire regulations, by a clearance
from the Department of Building Safety as to the proposed electrical
installations, and additionally by clearance from the Traffic Engineering
Department for review of stand location in relation to possible interruption
of traffic."
Section 3104 Amendments to Article 13 "Fire Protection" of the
Uniform Fire Code, 1971 Edition.
1. Amend Section 13.301 by adding 13.301 (d) "Hydrant Installation
and Maintenance" to read as follows:
(A) "All required fire hydrants, public or private shall be
installed and operable prior to the initiation of construction of any
permanent structure using combustible materials.

(B) All required fire hydrants shall be capable of producing a
discharge as specified in Special Interest Bulletin 266 published by Insurance
Services Office.
(C) Access shall be provided and maintained to all required fire
hydrants by means of an all-weather road with a thirteen (13) foot minimum
width, capable of supporting fire -fighting apparatus, unless otherwise
specified by the Fire Chief.
(D) All required fire hydrants shall be of a type and located
as approved by the Fire Chief."
2. Amend Article 13 by adding Section 13.315 "Protection of Hoods,
Ducts, and Deep Fat Fryers" to read as follows:
"All hoods and ducts, and deep -fat fryer(s) with a surface area
greater than 350 square inches, where required for or used as restaurant type
cooking equipment, shall be equipped with an approved automatic fire
extinguishing system installed in the hood and duct, and over deep -fat
fryer(s). Such systems shall be installed and maintained in accordance
with the provisions of the National Fire Protection Association Standards
pertaining thereto.
3. Amend Article 13 by adding Section 13.316 "Private Fire Warning
Systems" to read as follows:
(A) The purpose of this Article is to establish strict super-
vision and control of the sale and installation of private fire warning
systems in order that public safety and welfare be protected.
(B) The provisions of this Article shall apply to all private
fire warning systems installed in the City of Costa Mesa in those occupancies
not required by law to have a fire alarm system.
(C) Definitions:
1. Alarm: An audible signal indicating a fire.
2. Approved: Shall mean approved by the Fire Department.
3. Electrical Supervision: A system so designed that
failure to any conductors, equipment or sources of energy will (a) operate
a 'trouble signals' where desired, or (b) will activate the alarm.
4. Private Fire Warning System: Shall include all
devices, controls and circuits, together with the energy necessary to sound
alarms, electrically supervise the system where required, and actuate the
alarm bells, trouble bells or trouble signals. Non -interconnected, unit -
type devices which sound an alarm only at the point of detection are not
acceptable.
5. Heat Activated Detectors: Shall mean detectors capable
of reacting to rapidly rising or elevated temperatures.
6. Smoke Activated Detectors: Shall mean detectors
capable of reacting to the presence of smoke at a visibility cut-off level
of four percent (4%).
7. Products of Combustion Detectors: Shall mean devices
capable of detecting products of combustion without being dependent upon
the presence of heat, smoke or flame, and in connection with devices or
equipment designed to sound an alarm indicating an emergency.
8. Trouble Signal: A visible or audible warning device
that will be activated upon failure or loss of primary power and will indicate
that the system is operating on secondary power, or will be activated by a
fault in a supervised circuit within the system.
(D) General Requirements:
1. Approved Equipment: All devices, combination of
devices, and other equipment installed for fire warning systems shall be
approved by the Costa Mesa Fire Department.
2. Permit Required: Systems that operate above 15 volts
and generate, transmit, transform, utilize or control more than 25 watts or
volt-amperes of electricity require a permit from the Building Safety
Department of the City of Costa Mesa.
3. Inspection: Companies or individuals installing
approved Private Fire Warning Systems shall, by the 10th day of each month,
submit to the Fire Department a list showing addresses where such systems
were installed during the previous month. The Department, at its discretion,
may inspect any or all of such installations.

(E) Installation and Design:
1. Workmanship: Private Fire Warning Systems shall be
installed in a workmanlike manner and in conformity with the plans and
specifications submitted.
2. Electrical Power Supply: Every Private Fire Warning
System shall be supplied with primary power from the alternating current
furnishing power to the occupancy in which it is installed. The system
shall also be provided with battery standby power so connected that the
battery will automatically operate the system in the event of loss of
primary power. Batteries shall be capable of (a) operating the system
under full load conditions for twenty minutes, (b) supervise the system
for one week (if system has electrically supervised circuits), and (c) have
a shelf life of at least one year.
Systems may have the control panel or power supply connected to the
electrical service by a flexible cord and plug, provided:
(a) It is equipped with an approved transformer (or
transformer and rectifier if system operates on DC) as an integral portion
of the control panel;
(b) The conductors of the cord are not less than
#18AWG;
(c) The plug is connected to the receptacle in such
a manner as to be removed only with a suitable tool;
(d) The cord is approved;
(e) The control panel contains or can be connected
to an approved battery.
3. Wiring: Conductors ofPrivateFire Warning Systems
shall not occupy any raceway, compartment, outlet box, junction box or other
wiring enclosure containing conductors supplying power or light.
Wiring of Private Fire Warning Systems that operate at 30 volts or less
used for fire alarm or fire detector circuits:
(a) Shall be of solid copper wire not smaller than
19AWG.
(b) Shall be listed by an approved testing laboratory
as acceptable for the use intended.
(c) May be exposed on ceilings and on walls if not
less than 7'0" from the floor. Conductors installed less than 7'0" from
the floor shall be enclosed in approved conduit or raceways.
(d) Where passed through floors or walls, shall be
adequately protected against injury.
(e) Shall have overcurrent protection devices as
follows:
(1) 15 to 30 volts - not more than 3 amps.
(2) 15 volts or less - not more than 5 amps.
4. Detectors:
(a) Design: All detecting devices for Private Fire
Warning Systems shall be automatic devices actuated by heat, smoke or products
of combustion. All Private Fire Warning Systems shall be actuated either by
(a) products of combustion detectors or by (b) a combination of heat -
activated and smoke -activated detectors.
Exception: Private Fire Warning Systems installed in
industrial or commercial occupancies may be actuated by heat -activated
detectors only.
All Alarm actuating devices and sounding devices shall
be approved equipment. Heat -activated detectors shall have a maximum
temperature rating of 140° F.
Exception: Attic areas and high-temperature rooms,
heater rooms, etc.
(b) Spacing: Detector spacing shall not exceed the
maximum area and line spacing for which they are approved. Combination
rate -of -rise and fixed -temperature detectors shall be spaced as required
for fixed -temperature devices.
(c) Location: Detectors shall be located in all areas
throughout the premises, including closets and attics. No portion of the
occupancy or premises shall be exempted without written permission of the
Department.
(d) Support: Detectors shall be supported in all
cases independently of their attachment to wires.

(e) Supervision: Detectors shall be installed on
a supervised circuit or on looped circuits which will operate both ways from
a break or fault to the control panel.
5. Alarm: The alarm sounding devices shall be of such
volume and so located that they will be heard at any location within the
dwelling when all intervening doors are closed. Alarm -sounding devices
shall be installed on supervised circuits or on at least two non -supervised
circuits each entirely separate from the other.
6. Trouble Signal: The system shall be provided with a
visual or audible trouble -indicating device that will be actuated when the
primary power has been interrupted. In electrically supervised systems the
trouble signal will be actuated upon the occurrence of a break or ground in
the wiring circuits which would prevent the required operation of the system,
as well as indicate that the system is being operated by the battery. Visual
trouble indicators shall be in a conspicuous location to insure being detected.
7. Control Panel: Private Fire Warning Systems shall be
equipped with approved control panels containing the necessary relays,
connectors, switches, etc., for the proper operation of the systems.
Section 3105 Amendment to Article 15 "Flammable and Combustible
Liquids" of the Uniform Fire Code, 1971 Edition.
1. Amend Section 15.201 (a) to read as follows:
"The storage of flammable and/or combustible liquids in above
ground tanks is prohibited within the City of Costa Mesa except in locations
classified as zone M-1, M-2 or C-2."
2. Amend Section 15.601 to read as follows:
"The limits referred to in Section 15.601 of the Uniform Fire
Code, in which new bulk plants where flammable or combustible liquids are pro-
hibited, are hereby established as follows: Any and all property other than
in M-1, A-1, or C-2 zones.
3. Amend Division II by adding Section 15.1107 to read as follows:
"Exceptions. Nothing contained in Sections 15.1101 to 15.1106
inclusive shall be applicable to the extent the subject thereof is pre-empted
by provisions of state law or of the California Administrative Code under and

pursuant to State law, in which event the provisions of State law shall be
applied."
Section 3106 Amendments to Article 20 "Liquified Petroleum Gases' of
the Uniform Fire Code, 1971 Edition.
1. Amend Section 20.105 (a) by adding the following:
"The limits referred to in which bulk storage of liquified
Patrols= gas as restricted is any and all property other than M-1, A-1 and
C-2 zones."
2. Amend Article by adding Section 20.105 (f) to read as follows:
"(f) This section shall not apply to any emergency standby
fuel required by any public utility when the container thereof is installed
in compliance with all laws applicable thereto."

follows:
A. All temporary stands for the display and sale of Christmas
trees shall be located, maintained and operated subject to the following
provisions:
(1) There shall be maintained in each premises or display
area within which Christmas trees are sold or offered for sale, suitable fire
extinguishers of the type and number approved by the Chief of the Fire
Department.
(2) No smoking shall be allowed in any Christmas tree dis-
play lot. "NO SMOKING" signs shall be prominently displayed in a number
prescribed by the Fire Chief.
(3) All such Christmas tree display lots and areas shall
be constructed in accordance with existing City requirements and specifications.
(4) All temporary Christmas tree lots for the display and
sale of Christmas trees shall obtain electrical permits from the City of
Costa Mesa prior to any electrical work.
(5) No arc or klieg lights shall be located within seventy-five
(75) feet of any temporary Christmas display area selling Christmas trees.
(6) It shall be unlawful to store any Christmas trees in any
buildings, residences, garages, homes, or vehicles within the City of Costa Mesa.
(7) There shall be at least one adult in attendance
during the open or sale hours of the Christmas tree stand.
(8) The permitee shall provide an adult night watchman to
act and serve during the hours of storage.
(9) No alcoholic beverages shall be allowed on the premises.
(10) All permits must he posted in a conspicuous place.
(11) All applications for permits shall be made in writing,
filed with the City Council, and shall state the name of the applicant, his
address and the location of the proposed Christmas tree stand. The application
shall be accompanied by a clearance from the Fire Chief as to fire regulations
and by a clearance from the Department of Building Safety as to the proposed
electrical installation, if any, and additionally by clearance from the
Traffic Engineering Department for review of stand location in relation to
possible interruption of traffic.
Section 3108 Modifications.
The Chief of the Fire Department shall have power to modify any of
the provisions of the Uniform Fire Code upon application in writing by the
owner or lessee, or his duly authorized agent, when there are practical
difficulties in the way of carrying out the strict letter of the code, pro-
vided that the spirit of the code shall be observed, public safety secured,
and substantial justice done. The particulars of such modification when
granted or allowed and the decision of the Chief of the Fire Department hereon
shall be entered upon the records of the Department and a signed copy shall
be furnished to the applicant.
Section 3109 New Materials, Processes or Occupancies Which May Require
Permits.
The City Manager, the Chief of the Fire Department and the Fire Marshal,
or their designated representatives, shall act as a committee to determine
and specify, after giving affected persons an opportunity to be heard, any
new materials, processes or occupancies, which shall require permits, in
addition to those now enumerated in said code. The Fire Marshal shall post
such list in a conspicuous place in his office, and distribute copies thereof
to interested parties.

Section 3110 Penalties.
A. Any person who shall violate any of the provisions of this code
hereby adopted or fail to comply therewith, or who shall build in violation
of any detailed statement of specification or plans submitted and approved
thereunder, or any certificate or permit issued thereunder, and from which
no appeal has been taken, or who shall fail to comply with such an order as
affirmed or modified by the Chief of the Fire Department or by a Court of
competent jurisdiction, within the time fixed herein, shall severally for each
and every such violation and non-compliance respectively, be guilty of a mis-
demeanor, punishable by a fine of not more than $500.00 or by imprisonment
for not more than six (6) months or by both such fine and imprisonment. The
imposition of one penalty for any violation shall not excuse the violation or
permit it to continue; and all such persons shall be required to correct or
remedy such violations or defects within a reasonable time; and when not
otherwise specified, each ten days that prohibited conditions are maintained
shall constitute a separate offense.
B. The application of the above penalty shall not be held to prevent
the enforced removal of prohibited conditions.
Section 3111 Validity.
The City Council of the City of Costa Mesa hereby declares that
should any section, paragraph, sentence or word of this Ordinance or the Code
hereby adopted, be declared for any reason to be invalid, it is the intent of
the City Council of the City of Costa Mesa that it would have passed all
other portions of this Ordinance, independent of the elimination herefrom of
any such portion as may be declared invalid.
SECTION 4. The City Clerk shall certify to the passage of this Ordinance
and shall cause the same to be published as required by law.
SECTION 5. This Ordinance shall take effect and be in full force and
effect thirty (30) days from and after its passage, and before the expiration
of fifteen (15) days after its passage, shall be published once in the Orange
Coast Daily Pilot, a newspaper of general circulation printed and published
in the City of Costa Mesa, together with the names of the members of the City
Council voting for and against the same.
