ORDINANCE 72-39
AN INTERIM ORDINANCE OF THE CITY OF
COSTA MESA TO PREVENT THE ERECTION OF
SIGNS WHICH MAY BE IN CONFLICT WITH THE
PUBLIC INTEREST DURING THE PERIOD OF
PREPARATION OF A COMPREHENSIVE SIGN
ORDINANCE.
SECTION 1 -- Declaration of Authority and Intent
WHEREAS, the Council of the City of Costa Mesa is charged with the
responsibility and provided the authority to regulate on -premise and off -premise signs
within the City of Costa Mesa; and
WHEREAS, proper signing is both necessary and desirable for the promotion
of commerce in the City of Costa Mesa; and
WHEREAS, sign regulations have significant economic, social and aesthetic
impacts upon the City of Costa Mesa; and
WHEREAS, considerable evidence suggests that existing ordinances and other
regulations pertaining to signing may no longer fulfill the needs of the City of Costa
Mesa; and
WHEREAS, the Council has directed the Director of Planning and his Staff
to conduct the research necessary to determine (a) the adequacy of existing sign standards
and regulatory procedures, (b) if existing standards and procedures are determined to
be inadequate, the Director of Planning shall identify feasible alternative sign
standards and regulating procedures, (c) the economic, social, aesthetic and legal
implications of alternative sign programs shall be thoroughly identified, and, (d) the
information resulting from the aforementioned research shall be submitted in report form
to the Council and Planning Commission and shall be made available to the general public.
NOW THEREFORE BE IT ORDAINED by the City Council of the City of Costa
Mesa, California:
SECTION 2 -- SIGNS PROHIBITED
The Director of Planning and his staff shall refrain from the issuance
of sign permits.
SECTION 3 -- EXEMPTIONS
1. Signs which are needed to assure public safety may be approved by
the Director of Planning.
2. Construction projects which have been issued building permits prior to
the effective date of this Ordinance and have not been authorized
signing may apply and be authorized signing in accordance with existing
city standards and procedures.
3. Tenants relocating into existing structures subsequent to the
effective date of this Ordinance may apply and be authorized
signing by the Planning Commission in accordance with existing
standards and procedures.
4. In order to alleviate unnecessary hardship, the Planning Commission
may approve additional signs which appear to be within the scope
of the regulations under development by the Planning Department.
SECTION 4- TIME PERIOD
This Ordinance shall be in full force and effect for a period of 90
days.
SECTION 5 - URGENCY MEASURE
The Council finds and declares that the promotion of the public interest
requires that this Ordinance be adopted as an urgency measure pursuant to
Section 65858 of the Government Code.
SECTION 6 - NOTIFICATIONS
This ordinance shall take effect and be in full force and effect
immediately after its passage, and before the expiration of fifteen (15)
days after its passage, shall be published once in the Orange Coast
Daily Pilot, a newspaper of general circulation printed and published
in the City of Costa Mesa, together with the names of the members of
the Council voting for and against same.
