ORDINANCE NO. 73--.8
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA AMENDING SECTION 3402.7 OF ARTICLE
4, DIVISION 1, PUBLIC SAFETY, VEHICLES AND
TRAFFIC; PROVIDING FOR THE REORGANIZATION OF
THE TRAFFIC COMMISSION; ESTABLISHING A STAFF
FOR THE TRAFFIC COMMISSION; AND ESTABLISHING
QUALIFICATIONS FOR MEMBERS OF THE TRAFFIC
COMMISSION.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa

hereby finds and declares that Section 3402.7 Costa Mesa
Municipal Code authorizes the formation of a Traffic Commission
whose duties shall be as set forth in Section 3402.8 and which
are generally said to be in an advisory capacity to the City
Council of the City of Costa Mesa. The City Council further
finds and declares that since April 15, 1957 members of the
city's staff as well as members of the general public have been
seated as voting members of the Traffic Commission. The City
Council further finds and declares that the interest of the
motoring public in the City of Costa Mesa requires the recom-
mendations of the general public and the technical advice of
the City staff. The City Council further finds and declares
that it is not appropriate for members of the city staff to be
seated as voting members of the Traffic Commission, and to be
in a technical advisory capacity at the same time. The City
Council further finds and declares that the health, safety and
welfare of the community requires a broader representative
citizen group from the City to recommend to the City Council
with respect to traffic needs within the City.
Accordingly, Section 3402.7 Costa Mesa Municipal Code
is amended to read as follows:
SECTION 2. "Section 3402.7 TRAFFIC COMMISSION.
There is hereby established an advisory Traffic Commission

to serve without compensation consisting of five (5) Commission
members to be appointed by the City Council, and who will meet
the following qualifications.
One member of the Commission shall be appointed from the
business community within the City of Costa Mesa, and shall be
actively engaged at the time of his or her appointment in a
commercial activity within the City. At any time that said
member ceases to be actively engaged in any commercial enterprise
within the City of Costa Mesa, his seat shall be declared
vacated by the City Council of the City of Costa Mesa and a new
member of the board meeting the same qualifications shall be
forthwith appointed.
One member shall be from the staff or elective bodies
of one of the school districts within the City of Costa Mesa,
and said member shall hold said seat so long as he or she shall
be actively affiliated either as an employee or as an elective
member of one of the school organizations within the City of
Costa Mesa. At such time as said member shall be no longer
affiliated with a school district the seat of said member shall
be declared vacated and a new member shall be appointed forthwith.
Three members shall be appointed from the community at
large.
The member appointed who is actively engaged in a
commercial enterprise within the City of Costa Mesa and the
representative from the school community within the City of
Costa Mesa shall be appointed for a period of four (4) years.
The three (3) members from the community at large upon the
adoption of this Ordinance shall be appointed for a two (2)
year term, with the provision that thereafter all terms of all
members of the Traffic Commission shall be for a period of
four (4) years from and after the date of appointment.
The Traffic Commission shall have as its staff the staff

of the City, who will prepare and make reports, recommendations;
give technical advise and prepare commission findings for
consideration by the City Council. Only those members appointed
to the Traffic Commission from the business community, the
schools and the community at large shall have voting powers,
and shall have the duties as set forth in Section 3402.8 Costa
Mesa Municipal Code."
SECTION 3. This ordinance shall take effect and be in
full force and effect thirty (30) days from and after its passage,
and before the expiration of fifteen (15) days after its passage,
shall be published once in the Orange Coast Daily Pilot, a news-
paper of general circulation printed and published in the City of
Costa Mesa, together with the names of the members of the City
Council voting for and against the same.
