HomeMy WebLinkAbout73-34 - (Corrected) - Urgency Interim, Preventing Changes in Land Use in Civic Center AreaCORRECTED 1 ORDINANCE NO. 73-34 2 AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA ENACTED TO PRESERVE THE STATUS 3 QUO OF LAND USE IN THE CIVIC CENTER AREA; ADOPTING THE SAME AS AN URGENCY ORDINANCE AND STATING 4 REASONS THEREFOR - 5 THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY 6 ORDAIN AS FOLLOWS: 7 SECTION 1. The City Council of the City of Costa Mesa 8 finds and declares that it is necessary to adopt as an urgency 9 measure this interim ordinance prohibiting any use in the civic 10 center area which may be in conflict with a contemplated zoning 11 proposal under consideration by the City Council. 12 Accordingly, the City council of the City of Costa Mesa 13 enacts the following sections: 14 SECTION 2. (A) All uses are prohibited in an area 15 described in a plot plan attached to this ordinance marked 16 Exhibit "A" and by this specific reference made a part hereof, 17 and no building permit shall be issued for construction within 18 said area for the duration of this ordinance. 19 SECTION 3. The City Council finds and declares that 20 to protect the public's safety, health and welfare, this ordinance 21 is adopted as an urgency measure. 22 SECTION 4. The reasons in support of the urgency actions 23 of the City Council are as follows: 24 A. It is the intention of the City Council to 25 encourage development in the Civic Center area that would preserve 26 and enhance environmental quality and promote the attainment of 27 the economic and social objectives of the General Plan. 28 B. A pending sale of a portion of the vacant land 29 included in the Civic Center area has caused to occur considerable 30 speculation as to how the entire area will be developed. 31 Because no comprehensive, long term plan exists 32 for the Civic Center area, development decisions must be made on - 1 - 5 6 7 8 9 10 11 12 13 14 15 16 17 18, 19i 20 21, 22I 23 24 25 26 28 29' 30 31 32 a piecemeal basis. As a result, the opportunity to develop a strong community focal point will be lost. Additionally, the lack of a comprehensive plan increases the likelihood of land use conflicts between existing and incremental developments. Finally, the Civic Center complex constitutes a substantial public invest- ment which should be protected from the encroachment of incom- patible land uses. C. The City Council of the City of Costa Mesa does hereby direct the staff to study the subject area and indentii for public discussion development options. D. In order to protect the public safety, health and welfare, changes in land use and intensity of use are prohibited for the duration of this ordinance. SECTION 5. This Interim Ordinance shall take effect and be in full force and effect immediately after its passage, and before the expiration of fifteen (15) days after its passage, shal be published once in the Orange Coast Daily Pilot, a newspaper of general circulation printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same. �.,{� PASSED AND ADOPTED this L/ day of 1973.
