HomeMy WebLinkAbout73-43 - Industrial ZoningORDINANCE NO. 73-43 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ESTABLISHING AN INDUSTRIAL ZONING ORDINANCE; DEFINING TERMS USED THEREIN; CREATING VARIOUS CLASSIFICATIONS OF USE FOR ZONING PURPOSES; ADOPTING STANDARD INDUSTRIAL CLASSIFICATION DESIGNATIONS FOR INDUSTRIAL ACTIVITIES; ESTAB- LISHING PERFORMANCE STANDARDS; PROVIDING FOR CONDITIONAL USE PERMITS; PROVIDING FOR THE ENFORCEMENT OF SAID ORDINANCE; AND REPEALING SECTIONS IN CONFLICT THEREWITH ON JULY 1, 1974. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The City Council of the City of Costa Mesa finds and declares that changes in industrial uses of property have occurred since the incorpora- tion of the City of Costa Mesa and since the adoption of the industrial zoning ordinances for the City of Costa Mesa. The City Council further finds and declares that it is essential for the reasonable application of zoning laws to the advances of the technical society of our culture. The City Council further finds and declares that advances in industrial techniques as the same are related to land uses require a modification and updating of industrial ordinances in the City of Costa Mesa. The City Council further finds and declares that a fair and equitable application of zoning laws to modern society require ordinance changes in keeping with the changing philosophies of land use. The City Council of the City of Costa Mesa further finds and declares that a major overhaul of the industrial zoning ordinances of the City of Costa Mesa is necessary for the health, safety, and welfare of the citizens of the community. Accordingly, there is herewith adopted an industrial zoning ordinance which shall be as follows: SECTION 2: DEFINITIONS 1. Central Administrative Office - A Central Administrative Office is an establishment primarily engaged in management and general administrative functions performed centrally for other establish- ments of the same company. 2. Auxiliary Unit - An auxiliary unit is an establishment primarily engaged in performing supporting services for other establishments of the same company rather than for the general public or for other business firms. 3. Permitted Uses - A permitted use is an activity or business which may operate in a designated industrial district without specific approval of said use, but which is subject to all applicable per- formance standards and other requirements of said industrial district. 4. Conditional Use - A conditional use is an activity or business which may operate in a designated industrial district only after securing approval of the City of Costa Mesa, according to proce- dures set forth in this ordinance. Only those uses specifically listed as a conditional use shall be considered for approval within a designated industrial district. The burden of proof shall rest with the applicant that said conditional use: is compatible with conforming uses within the proposed area of location, complies with all performance standards of the City of Costa Mesa, and is demonstrated not to be detrimental to the public health, safety, or general welfare. 5. Under Roof - The term "under roof" as used in the Costa Mesa Municipal Code is defined as all of the area within the walls of the building that a roof covers. Porches, roof overhangs, garage protrusions, breezeways, and other similar architectural design features are not considered herein as "under roof." SECTION 3: ZONES CREATED The City of Costa Mesa does hereby create the following industrial districts: ML - Limited Industrial MG - General Industrial MP - Industrial Park MH - Heavy Industrial SECTION 4: METHOD OF CLASSIFICATION The City of Costa Mesa does hereby adopt the Standard Industrial Classifi- cation Manual and the Standard Industrial Codes, 1972, as prepared by the - 2 - Executive Office of the President, Office of Management and Budget, as the method of classifying and defining permitted industrial uses within the ML, MG, MP, and MH districts. A copy of the Standard Industrial Codes shall be avail- able from the Planning Department. Any applicant for a use within an industrial district shall provide such information as is deemed necessary by the Director of Planning, in order to determine the Standard Industrial Classification Code. The assignment of the appropriate SIC Code shall determine the property district for the intended use. PLANNING DEPARTMENT REVIEW Any construction in an ML, MG, MP, or MH district shall be submitted to the Planning Department for review according to the following procedures and subject to the following criteria: 1. Application - Any individual proposing construction within the above listed zones shall make application to the Planning Depart- ment for site review on forms provided by the Planning Department. 2. Action - The Planning Department shall approve, approve with conditions, or deny each application. The Planning Department may require evidence or proof in a manner prescribed by the Department, to insure compliance with any performance standard as specified in this ordinance. 3. Appeals - The applicant or any interested person may appeal a decision of the Planning Department according to appeal procedures prescribed in the Costa Mesa Municipal Code. 4. Building Permits - Required permits shall not be issued until Planning Department review approval has been obtained. 5. Compliance - Final occupancy shall not be granted unless the site development conforms to the approved set of building plans. 6. Review Criteria - In case of denial, applicant shall be notified of criteria which are deemed to be deficient. Review criteria shall include, but shall not be limited to, the following: - 3 - 1. Compatible and harmonious relationship between the proposed building and site development and the buildings and site developments that exist or have been approved for the general neighborhood. 2. Safety and compatibility of the design of buildings, parking areas, landscaping, luminaries, and other site features which may include functional aspects of the site development such as automobile and pedestrian circulation. 3. Compliance with any performance standard as prescribed elsewhere in this ordinance. SIC CODES Permitted uses and conditional uses in the ML, MG, MP, or PMI district shall be listed according to SIC Code title and code number. The code title used may be either major group title, group title, or industry title. Code numbers used may be either major group number (two digit), group number (three digit), or industry number (four digit). If a two(2) or three(3) digit code number is listed as a permitted or conditional use, any code number beginning with the same first two (2) or three (3) digits shall be a permitted or conditional use. CONDITIONAL USES Those uses listed as conditional uses shall require special approval and shall be processed according to Zone Exception procedures as prescribed in the Costa Mesa Municipal Code. LIMITED INDUSTRIAL DISTRICT - ML Purpose - The Limited Industrial District is intended for isolated industrial areas proximate to residential districts or adjacent to other districts requiring protection. In general, it is the intent of this district to be restricted to those businesses or activities where no mechanical or chemical transformation of a product is undertaken. Permitted Uses 1. Printing, publishing, and allied industrial (27) 2. Measuring, analyzing, and controlling instruments, photographic, medical, and optical goods, watches, and clocks (38) 3. Wholesale trade - durable goods (excluding 5093) (50) 4. Wholesale trade - non -durable goods (51) 5. Computer and data processing (737) 6. Photofinishing laboratories (7395) 7. Linen supply (7213) 8. Dry cleaning plants (7216) 9. Carpet and upholstery cleaning (7217) 10. Industrial launderers (7218) 11. Blueprinting and photocopying (7332) 12. Outdoor storage (as an appurtenant or incidential use) GENERAL INDUSTRIAL DISTRICT - MG Purpose - The General Industrial District is intended for large, concentrated industrial areas. Development standards and the approval of conditional uses shall - 5 - be aimed toward eliminating possible hazards to adjoining properties, especially in those areas where residential uses are in the vicinity. A business or activity in this district may undertake the chemical or mechanical transformation of a product. Permitted Uses 1. Dairy products (202) 2. Canned specialties (2032) 3. Nonclassifiable establishments (99) INDUSTRIAL PARK DISTRICT - MP Purpose - The Industrial Park District is intended for large, concentrated industrial areas where the aim of development is to create a spacious environment in a park -like setting. A business activity in this district may undertake the chemical or mechanical transformation of a product. Permitted Uses 1. All permitted uses in the Limited Industrial Zone ML 2. Nonclassifiable establishments (99) Canned and cured fish and Seafoods HEAVY INDUSTRIAL DISTRICT - MH Purpose - The Heavy Industrial District is intended for large, concentrated industrial areas where uses must be strictly controlled in order to protect the public health, safety, and general welfare. Scrap and waste materials (5093) GENERAL No land or building in any ML, MG, MP, or MH district shall be used or occupied in any manner so as to create any dangerous, injurious, noxious, or otherwise objectionable vibration, air pollution, glare, radioactivity, or electrical dis- turbance, airborne particles, or noise in such an amount as to affect adversely the surrounding area or adjoining premises; the foregoing are hereinafter referred to as dangerous and objectionable elements. DOCUMENTATION The City Council, the Planning Commission, or Planning Director shall have the power to require proofs, letters of authorization, or other such evidence from the applicant for a use within a zone subject to performance standards, to insure compliance with said standards. The Planning Director shall also have authority to require such proofs before approving a business license within a zone subject to performance standards. REPORT BY CONSULTANTS If, in the opinion of the City Council, Planning Commission, or Director of Planning, the proposed use may cause the emission of dangerous or objectionable elements, they may refer the problem to one or more expert consultants qualified to advise as to whether a proposed use will conform to the applicable performance standards specified in this ordinance. The applicant for said use shall select the expert consultant(s) from a list of consultants approved by the City of Costa Mesa. The consultant or consultants shall submit a report, a copy of which shall - 10 - be made available to the applicant. The fee for the consultant(s) shall be assessed to the applicant. The decision to require a report by an expert consultant may be appealed in accordance with procedures prescribed elsewhere in the Costa Mesa Municipal Code. NONCONFORMANCE WITH PERFORMANCE STANDARDS Any use established before the effective date of this ordinance and non- conforming as to performance standards shall be given one (1) year in which to conform. CONTINUED ENFORCEMENT The Planning Department or Building and Safety Department shall investigate any purported violation of performance standards and shall notify the City Council of the occurrence or existence of a probable violation thereof. The Council shall investigate the alleged violation, and for such investigation may employ qualified experts. The services of any qualified experts, employed by the Council, shall be paid by the City of Costa Mesa. LOCATIONS WHERE DETERMINATIONS ARE TO BE MADE FOR ENFORCEMENT OF PERFORMANCE STANDARDS Those measurements having to do with noise, vibration, airborne particles, or glare shall be taken at the lot line of the establishment or use. PERFORMANCE STANDARDS 1. Vibration - No vibration shall be permitted which is discernible without instruments at the points of measurement specified in this ordinance. 2. Air Pollution - Any person building, erecting, altering, or replacing any article, machine, equipment, or other contrivance, the use of which may cause the issuance of air contaminants, shall first obtain written authorization for such construction from the County of Orange Air Pollu- tion Control District in accordance with all procedures established by said District. The City Council, Planning Commission, or Director of Planning shall have the authority to require the obtaining of said written authorization. 3. Glare - No direct or sky -reflected glare, whether from floodlights or from high temperature processes such as combustion or welding or other- wise, so as to be visible at the points of measurement specified in this ordinance shall be permitted. 4. Radioactivity or Electrical Disturbance - No activities shall be per- mitted which emit dangerous radioactivity at any point, or electrical disturbance adversely affecting the operation of equipment other than the equipment of the creator of such disturbance. 5. Airborne Particle Standard - Airborne particles, including odorous gases and other odorous matter, shall be measured by the Ringleman Chart and shall not exceed #1 on said chart. 6. Noise - Noise standards shall conform to Chapter IX of the Costa Mesa Land Use Ordinance, Article 4, Division I, beginning with Section 92200. DEVELOPMENT STANDARDS FOR ML, MG, MP, AND MR ZONES UNDERGROUND UTILITIES For all new construction, all utilities shall be installed underground on the building site in accordance with the serving utility's rules, regulations, and tariffs on file with the California Public Utilities Commission. The Planning Commission may waive the required undergrounding whenever such installation is determined by the Planning Commission to be not practically feasible. Provided, however, that all required termination facilities on the structure and con- duit, at least to the outer wall, at a point designated by the serving utility, shall be furnished and installed to facilitate future connection to an underground system. USES UNDER ROOF All permitted uses shall be conducted under roof. OUTDOOR STORAGE All outdoor storage is prohibited unless approved as a conditional use according to procedures prescribed elsewhere in this ordinance. LOT SIZE Minimum lot sizes shall be as follows: District ML 10,000 square feet MG 10,000 square feet MP 30,000 square feet MH 1 acre, 43,560 square feet - 12 - Any legal lot for which a deed was on record in the office of the County Recorder of Orange County on the date of adoption of this ordinance may be used as a building site. LOT COVERAGE Maximum lot coverage by buildings shall be as follows: District ML 50 percent MG 50 percent MP 45 percent MH 40 percent SETBACKS Minimum setbacks from the property line for ML and MG districts shall be as follows: A. When property is adjacent to any residential zone: Front yard - 20 feet Side and Rear yard - 2 feet times the height of the nearest industrial structure on the site, adjacent to the residential zone. B. When property is adjacent to any zone other than a residential zone: Front yard - 10 feet Side and Rear yard - 0 feet C. When a rear property line is adjacent to a public right-of-way, a minimum setback of 10 feet shall be maintained. D. Corner Lot: Front yard - 15 feet Side yard adjacent to public right-of-way - 15 feet Minimum setbacks for MP and MH zones shall be as follows: A. When the parcel is adjacent to any residential zones: Front yard - 20 feet Side and rear yard - 2 feet times the height of the nearest industrial structure on the site, adjacent to the residential zone. �R= B. When the parcel is adjacent to any zone other than a residential zone: Front yard - 20 feet Side yard - 10 feet Rear yard - 0 feet C. When a side or rear property line is adjacent to a public right-of-way, a minimum setback of 20 feet shall be maintained. LANDSCAPING All required setbacks, abutting a public right-of-way shall be landscaped, (except for walks and driveways which bisect or encroach upon the required land- scape area). 1. A landscape plan (including planting material specifications) shall be submitted to the Planning Department. Approval of landscape plans shall be under the jurisdiction of the Planning Department. 2. All required landscaping shall be separated from paved areas by six (6) inch high cement concrete curbing and shall be provided with automatic sprinkler facilities, which shall be maintained in an operative condition. 3. One tree (15 -gallon minimum size) shall be installed per 200 square feet of landscaped area. 4. Every site on which landscaping is required, according to this ordinance, shall be landscaped according to plans approved as specified herein and maintained thereafter in a sightly and well -kept condition, irrigated periodically, trimmed, cultivated, vegetation replaced as needed, and cuttings and leaf droppings removed as often as necessary to insure a neat and orderly appearance. SECTION g: All provisions of the Costa Mesa Municipal ordinances in conflict herewith are hereby repealed on July 1, 1974. SECTION b: This ordinance shall take effect and be in full force and effect thirty (30) days from and after its passage, and before the expiration of fifteen (15) days after its passage, shall be published once in the Orange Coast Daily Pilot, a newspaper of general circulation printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same. - 14 - PASSED AND ADOPTED this -17CL day of 1973.
